MINUTES
July 13, 1995
The Career Service Board's Public Hearing on the proposed Charter amendments
opened at 6:55 in the City Council Chambers at City Hall.
Present: Members Yaklich, Fleenor, Kerzic, Perry-Smith and Turner
The Chairman opened the meeting for comments by City representatives. Doug
Clark, City Manager, spoke on the reasons the City supported the amendments.
Attached is a copy of his statement.
Also supporting the proposed amendments were Tom Daugherty, a representative
of AFSCME, which covers non-emergency employees, and Mike Grunninger,
President of the Englewood Firefighters Association. They both emphasized that
binding arbitration was something they wholeheartedly wanted, and agreed that the
proposal would provide expertise and cost cutting.
The Board questioned the likelihood that costs would really be reduced, noted that
the associations in the past campaigned for modifications rather than "either I or"
choices and noted that in Stan Damas it had access to a specialist in labor relations.
After questions and discussions, the Board agreed that, if the associations and the
City were agreed on the amendments, it would send the following to City Council:
The Career Service Board considered Council Bill 38 proposing amendments to the
Charter Section concerning the Career Service System at a hearing last evening.
They adopted the following recommendations to the City Council to aid in
consideration of the proposed Charter amendments.
1. The Board generally supports the concept of binding arbitration and the
Charter amendments recommended by the City and the employee groups .
2. The Board recommends re-wording Section 138:5 of the Charter amendment
to require that hearing officer decisions be final and binding.
3. The Board recommends the elimination of the Career Service Board, and that
the four remaining duties reserved to the Board in the current version be taken over
by an as-needed ad hoc citizen board.

4. Due to testimony at this meeting of July 13, and due to the fact all the
remaining duties of the Career Service Board might occur once a decade, the Board
recommends that the Council carefully examine the actual relative costs of the
current and proposed systems, as no substantial testimony was provided at the
hearing.
5. The Board strongly believes that the Charter changes will cause a loss of
citizen participation in government.
6. The Board recommends the following points be covered in the Ballot
Question, and suggests the following wording for it:
"Shall the Horne Rule Charter of the City of Englewood be amended to modify the
process for negotiations with employee groups to provide for binding arbitration of
negotiation impasses and to refer the powers currently exercised by the Career
Service Board to Hearing Officers selected as provided by Ordinance for the purpose
of reducing costs, introducing additional expertise in employment matters and thus
eliminating the current Career Service Board by repealing Sections 137:5 -Subjects
for Collective Bargaining, 137:6 -Impasse Resolution, 138:1 -Career Service System,
138:4 -Duties And Powers Of The Career Service Board and 138:5 -Effective Date -
Vested Rights of Article XV and reenacting Sections 137:5 -Subjects for Collective
Bargaining, 137:6 -Impasse Resolution, 138 :1 -Career Service System, 138:4 -Duties
And Powers Of The Career Service Board and 138:5 -Hearings Under Career Service
System."
