PUBLIC HEARING
MINUTES
April 19, 1994
The Public Hearing for the Board of Career Service opened at 6:40
p.m.
Present: Members Fleenor, Kerzic, Farris and Turner. Ms. Davidson
was absent. Also present,:Attorney George Price representing Officer
Clark, Martin Semple representing the City, Stan Damas representing
the Career Service Board, Officer Gerri Clark, Allan F. Stanley and
Randie L. Barthlome.
The Public Hearing for Officer Gerri Clark was opened.
The Board then presented Findings concerning the timeliness and
grievability of seven grievances filed by Officer Gerri Clark of Safety
The Board voted that Grievances 1, 2, and 7 were timely and
grievable.
The grievances considered by the Board included #1 which stated
that Officer Clark's leave should be considered work-related and
therefore should have been submitted for Workers Compensation
consideration, #2 which dealt with the way Temporary Disability is
computed and #7 which asked for half of her Temporary Disability to
be restored on the first of January, 1994.
Evidence was presented to support Officer Clark's contention that her
stress was completely job related. She was examined by EAP
Psychologist Ann Samson, Dr. Anderson and Dr. Entin each of whom
concluded that medication would be required for treatment of the
stress Officer Clark was undergoing. She returned to work for about
three weeks in August or September, but was unable to continue.
She felt harassed by supervisors and fellow employees, and believed
her Temporary Disability was computed less generously than it has
been for other officers. She stated she is not required to file
Workers' Compensation papers, nor to release records. She did not
see a medical doctor in response to Dr. Entin's recommendation, but
did keep in touch with Ann Samson.

Ann Samson testified that she had met with Officer Clark 12 times
and had also talked to her on the phone. She described the stress
suffered by Officer Clark and she (Ann Samson) had filled out a FPPA
form on November 1 for a disability claim. She had not filled out
anything for Workers' Compensation. She believed the stress was
totally job related .
Mr. Price rested his case, and a continuation was set for May 5, 1994
at 6:30 p.m. The meeting adjourned at 10: 15 p.m.
