SUBJECT: Mail Ballot Election
Attached is an election calendar reflecting deadlines relative to a mail ballot
election , per your request. The calendar is based on the mail ballot statute and
the Uniform Election Code.
If Council elects to hold a Mail Ballot Election, the Election Commission should
be advised of their decision prior to Council receiving a resolution for action . At
a work session May 12, 1993, the Election Commission unanimously agreed that
it is in the best interest of the electors of Englewood to conduct its future
elections jointly with the other political entities within the County. However,
conducting a separate mail ballot election is an option .
Sequoia Pacific, of Exete r, California, provided the mail ballots for the 1993
coordinated election . However, as we would be working within a tight time
frame , I would suggest we contract with Hoeckel's of Denver. Hoeckel's has
advised that they must have a commitment from us to use their services by
September 2, 1994. They provide full service for vote by mail at a cost of $.80
to $1.05 per ballot plus mailing @$.25 each. There were 17,347 registered
voters for the November 2, 1993 election. Additionally, the cost of scanning the
ballots and the mailing of the Tabor notice must be considered. The cost of
scanning may be substant ial.
As mail ballot statute sets forth specific dates by which various actions must be
taken, and these dates must be integrated into election calendars based on the
uniform or municipal election codes, Council would have to adopt either the
Uniform Election Code or the Municipal Election Code, by resolution. (The
Election Commission would make a recommendation.)
I spoke to the Secretary of State's office and Geoff Wilson of CML and was
informed that a notice (regarding the EPBA question), separate from the Tabor
notice, can be mailed out as long as the notice is fair and balanced and complies
with the constraints of 1-45-116.

MAIL BALLOT ELECTION CALENDAR

ON THE MAIL BALLOT ST.A TUTES AND THE UNIFORM ELECTION CODE
DATE DEADLINES
The Election Commission should be advised of Council's preference
(coordinated vs mail ballot election) prior to Council receiving a
resolution.
Council would need to schedule a special meeting prior to
September 2, 1994 (in order to meet Hoeckels deadline) to establish
that the election will be conducted as a Mail Ballot election and
approve either the Uniform Election Code or the Municipal Election
Code.

September Last day to notify the Secretary of State that an election is to be

Statements specifying the reason for requesting any replacement ballots
shall be submitted to the designated election official by no later that 7:00
p.m. on election day. (1-7.5-107(3)(d)(i))
Replacement ballots shall be cast by no later than 7 :00 p.m . (1-7 .5-107
(3)(d)(ii))
Ballots returned by mail must be received by no later than 7 :00 p .m . on
election day.
