HomeMy WebLinkAbout1997-02-14 EC MEMOMEMORANDUM TO: Election Commission Members FROM: Lou Ellis , City Clerk DATE: February 14, 1997 SUBJECT: TELEPHONE POLL BY WEDNESDAY, FEBRUARY 19TH I have attached a draft of the council communication I have prepared requesting Council approval of an ordinance which would require write-in candidates to file an affidavit of intent and allow Council , by resolution to cancel an election 19 days prior to an election if there are not more candidates than offices to be filled at such election . Even though I don't anticipate that either situation will be an issue in the upcoming vacancy election, I wou ld like to have the enabling ordinance in place for future elections . City Hall is closed Monday and I will be out of the office Tuesday and Wednesday . Please give Brenda a call at 762-2405 by February 19th, regarding approval of the council communication draft. I hope the Election Commission will be in attendance that night acting as the Resolution Board . Ellis, City Clerk/Election Commission Member To my knowledge Council has never adopted a policy regarding write-in candidates or cancellation of an election. RECOMMENDED ACTION Per Colorado Revised Statutes§ 31-10-507, Council may adopt an ordinance requiring write-in candidates to file an affidavit of intent with the City Clerk . This provides clear direction for potential candidates , as well as the City Clerk 's office. Additionally , that same cite states that Council may, by ordinance, establish that if the only matter before the voters is the election of persons to office and if, at the close of business on the 19th day before the election, there not more candidates than offices to be filled at such election, including candidates filing affidavits of intent the clerk, if instructed by resolution of the governing body either before or after such date , shall cancel the election and by resolution declare the candidates elected. FINANCIAL IMPACT Some election costs will have been incurred by the 19th day prior to the election . But in a mail ballot election, specifically, we would save the cost of postage.
