SUBJECT: STATUS OF MUNICIPAL FINANCES

As requ i r e d by the Engl ew ood City Charter , one of the responsibilitie~f the
City Manager is to keep the City Council informed of general municipal finan-
ces. Therefore, I have taken the liberty to generally outline our municipal
financial picture as it appears at this time.
GENERAL FUND :
196 8 Finances :
Revenue s for tbe year 1968 fell below our 1968 estimates pro-
jected at the time we prepared the 1969 budget. Of particular
significance was the apparently optimistic 1968 estimates to be
derived from the City's sales and use tax.
An approximate ten per cent underage of projected sales taxes
in 1968 was balanced by unanticipated increases in revenues
from other revenues so that the City derived approximately
ninety-nine per cent of revenues anticipated for the year 1968
in the General Fund. The General Fund's balance at the end
of 1968, in fact, exceeded our 1968 estimates by $53,264 , pri-
marily due to the closing of several special funds and a reduc-
tion of general operating expenses.
1969 Finances:
In 1969, the General Fund started the year with an unappropriated
surplus of $206,590 ---$53,264 above the 1969 budget's projected
unappropriated surplus. However , during the month of January ,
1969, the City received approximately $222 ,000, or 5. 7% below
the anticipated sales tax projected for the month. January, 1969's
collected sales tax represents local retail sales taking place during
December , 1968 . If 1969 sales taxes continue at a 5. 7 % deficit
throughout the e ntire year , the General Fund would not receive
$8 6, 403 of anticipated revenue.
The reduction in the 1969 General Fund mill levy will result in a
reduction of the City's shares of the specific ownership tax wh ich
was overlooked at the time the mill levy reduction was set. The
City r e venues from the specific ownership tax will be $36 , 000
under the total $56, 000 anticipated in the budget .
Projected expenditures in the General Fund have increased slightly
($3, 804) as a result of a supplemental appropriation on February
3rd, primarily for the purposes of replacing a broken accounting
machine in the Finance Department.

If the City Council e lects to discontinue municipal garbage
collection service for the last six months of 1969, the City
would save $2 ,000 per month, or a total of $12 ,000, which
could be earmarked for the 1969 year-ending balance. The
Fund requires an approximate $20,000 year-ending balance
in order to finance municipal operations during the first
thirty days of January, 1970, prior to the City's receipt of
initial 1970 revenues.
If the City Council should extend the municipal sales tax to
liquor and lodging, approximately $21,100 in additional
revenues would be derived during the last stx months of 1969.
Administratively, we have devised a program to control
General Fund expenditures, particularly capital outlay. Pro-
posed expenditures are and will continue to receive critical
review.
The following breakdown on the General Fund indicates that
we would end 1969 with a $103,879 balance if revenues and
expenditures occur as projected in the 1969 budget. If
revenues, particularly the sales tax, do not materialize as
budgeted, and other factors occur as itemized, we shall end
the year with an $11,328 balance, a sum under the $20,000
believed necessary to finance the beginning of 1970.

PUBLIC IMPROVEM ENT FUND:
1968 Fi nances:
The fact that 1968 sales tax revenues did not meet our antici-
pated revenue was also felt in the Public Improve ment Fund.
Revenues were about $19,000 less than expected in this Fund.
January 1, 1969, unappropriated surplus was $1,064 ---
$5, 788 less than we had anticipated to start the year with.
1969 Finances:
If 1969 sales tax reve nu es continue at a 5. 7% rate below our
projected sales tax figures, we could end the year with
$24,885 less than we budgeted.
The 1969 budget for the Public Improvement Fund relies upon
re-financing of the City Hall building for $50,000 to assist in
the relocation and construction of a new central fire station .
It is essential that a structure be completed in 1969 due to
housing requirements for the new fire aerial apparatus which
will arrive late this summer. Municipal interest rates es-
tablished a new 1968-1969 high again on February 10, 1969,
as interest rates continue to go higher. If we refinance the
City Hall structure at this time , we could anticipate an inter-
est rate ranging from 5.6 % to 5. 9%. When compared with
the present mortgage rates on the City Hall of 5-5 /8 %, it is
quite doubtful that the City will find it attractive to refinance
the City Hall during 1969.
The 1969 Public Improvement Fund contains an appropriation
of $34, 297 for the relocation of the police station. It was not
the Council's intention to appropriate these funds in the 1969
budget. Therefore, this sum is available for future uRe as
the City Council desires , and will help offset any deficit
which may arise from the possibility that retail sales tax may
not come in as projected in the budget or a delay in refinancing
City Hall.
The attached charts show that we can now expect to end 1969
with a $14,064 balance in the Public Improvement Fund if reve-
nues and expenditures occur as budgeted. If the sales tax fails
to materialize and we cannot refinance City Hall, we would have
a $60,821 ending deficit. The transfer of $34,297 from the
Police Relocation Account would reduce this deficit to $26,524.

director from the direct control of the Career service Board and
place him beneath the control of the City Manaoer.

REGULAR MEE'riNG:
The City Council of the City of Englewood, Arapahoe
County, Colorado, met in regular session on February 17, 1969,
at 8:00 P.M.
Ma yor Pro Tern Dh ority , presiding, called the meeting
to order.
The invocation was given by Reverend Richard Westwick
of the Bethany Lutheran Church. Pledge of Allegiance was led
by Boy Scout Troop No. 333.
The Mayor Pro Tern asked for roll call. Upon the call
of the roll, the following were present:
Councilmen Parkinson, Lone, Lay, Kreiling, Brown,
Dhority.
Absent: Mayor Schwab.
The Mayor Pro Tern declared a quorum present.
Also present were: City Manager Dial,
City Attorney Criswell,
City Clerk Lyon.

COUNCILMAN PARKINSON MOVED, COUNCILMAN LAY SECONDED, THAT
THE CITY COUNCIL AUTHORIZE THE CITY MANAGER TO GIVE NOTICE TO MR.
HANSEN OF THE CITY'S INTENT TO CANCEL THE GARBAGE COLLECTION CON-
TRACT WITH MR. HANSEN. It was noted by members of City Council
that no citizen had appeared either in opposition or favor to the
cancellation of the garbage service.
MI '. Dial stated that the Englewood Herald and Denver Post
had published stories of the City's intent to cancel the garbage
service and that the City of Englewood had received only two
telephone calls related to cancellation. The first call had been
from a citizen who had been concerned that she had never be advised
that the City provided "free" garbage collection. The second call
had been from a citizen who had no special remarks about the con-
tract but stated that the City of Englewood should provide both
garbage and trash collection service.
COUNCILMAN PARKINSON STATED THAT HIS MOTION SHOULD BE
AMENDED TO AUTHORIZE THE CITY MANAGER TO CANCEL THE GARBAGE COL-
LECTION CONTRACT AFTER ONE MONTH OR AS SOON AS POSSIBLE.
COUNCILMAN LAY STATED THAT HE WOULD ACCEPT THE AMENDMENT.

City Attorney Criswell presented a report dated
February 14 , 1969, c oncerning the development of the liquor
outlets of the Peanut Barrel and Zuider Zee.
Mr. William K. Malone , attorney, 3 311 South Broadway ,
appeared before City Council on behalf of Mr. Thomas J. Nomina ,
Peanut Barrel , 3535 South Huron. Mr. Malone reviewed negotiations
between Mr. Nomina and the property owner and stated that action
to develop the outlet would be taken within thirty days. Mr .
Malone stated that the applicant had kept the lease current from
the time the City Council granted the application and had pur-
chased kitchen equipment for the outlet.
Mr . Jerry Sturm , 3184 West Edgemore Dr i ve, appeared
before City Council and discussed Mr. Nomina's plans for developing
the Peanut Barrel liquor outlet. It was the consensus of City
Council that a ction i n regard to the Peanut Barrel liquor license
be deferred until March 3 , 1969.
T * * * * Mr. Malone reappeared before City Council in regard to
the Zu i der Zee liquor license. Mr. Malone stated that it had been
stated in the public hearing that c onstruc tion would start in
early spring , 1969 , and in sofar as he was aware this schedule
would be adhered to. Mr. Malone stated that it was the intent of
the developers of the Zuider Zee to construct the liquor outlet
as indicated to C1ty Council.

City Attorney Criswell stated that he had been discussing
issuance of bonds by the Englewood Building Authority for the
purchase of Cl y Hall from the City of Englewood with Mr. Bill
Lamm , bond couns 1 Mr . Criswell stated that once a decision
was reached to i ssue the bonds , approximately thirty days would
have to elapse to the date of sale.

appeal by Mr. Buchler from the decision of the Board of Adjustment
and Appeals in regard to Mr. Buchler's proposed development of
property at Jefferson and Acoma would be held on Friday, February

Englewood had been sued by National Tea Company for the City's
failure to issue a 3.2 beer license to Del Farm, 4160 South
Broadway. Mr. Cri E'w2l l requested City Council's direction as
to the action to be taken in regard to the litigation.

RECOMMENDATION:
The Planning Commiss i on rec ommend to the Ci ty Council t hat the
following cov e nants as recited in People's Ordinance No . 3 , S e ries
of 1964 , 823 (a) (i), (ii), (iii), which "coveriants also appear in
other r e lated docum e nts , be releas e d:
(i) Landlord shall not use or permit the use o f t h e burd e n e d land
for any purpos e other than that of office purpos e s su c h as o ff ices
for prof e ssional persons, financial institutions , admini stration
and the like.
(ii) Landlord shall maintain on the burdened land at all t imes at
least one automobile space for each 300 square feet of f loor space

SUBJECT: Summarizat i on of Taxes and Fees o n L iquor Establishmen t s
The attached table summ ari zes taxes and fees levied upon liquor
stores within the metropolitan area. It shou ld be noted th at the
State liquor license fee, pay able annually, is appl ic abl e to all
liquor outlets throughout the State of Colorado. If the liquor
outlet is located within a municipality, the license fee is divided
between the city and the s tate as set forth on the a tt a ch ed table.
All cities surveyed on the attached table levy a municipal sales
tax including the City of Arvada. All of these cities make sale
of alcoholic beverages and lodging taxable except the City o f
Englewood.
I am working with Mr. John Criswell, City Attorney, to extend
the retail sales tax to alcoholic beverages and lodging. It is
my und er standing that the effective date of this ordinance will
be July l, 1969. This will result in the following estimated
additional revenues in sales tax:

Heights , had requested that their property b e included in the
rezoning, and Mr. Wrigh t had agreed t o amend h is app li ca t ion to
include their property . The request is for a change of zone from
R-1-C (Single-family Residential) to R-3 -B (Multi-family Resid e ntial).

6088 South Lakeview -s t ated tha t he has Lots 11 thru 19, Block
15 , Jackson's Broadway Heights, under option
for pur chas e . Mr . Wright s t ated he was proposing an apartment
complex of 42 units, three and one-half stories high, with 30 two
bedroom units , and 12 o ne bedroom units . He stated the land has
been filled at some po i nt in the past with a poor quality of fill
dirt--there is lots of t rash in the fill. He stated that because
he would have to e x c avate to get this trash out anyway, he is
proposing to provide underground parking space to accommodate 36
cars. There would also be 22 surface parking spaces. Mr. Wright
stated the subjec t p r operty is in poor condition , and that there
have been three fires on this property in the last ten years, at
least. There have also been court cases against the occupant to
get the property c leaned up, but outside of the work the Jaycees
did on the property seve ral y nars ago, nothing else has been done.
Mr. Wright stated that he had c irculated a petition in the area,
and there were only thr e e persons who did not sign it. One
person he could not c o n ta c t ; a second felt such a development
might block his v iew ; and a third stated he did not want any
rental competiti o n in t h e area.
Mr. Parkinson asked Mr . Wr i ght what he felt the market for apart-
ments in the Englewoo d ar e a was in light of the comment by the
one gentleman who wanted "no rental competition"? Mr. Wright
replied that the Englewood market is very good; apartments are
hard to find, and few are available under $150. Mr. Woods asked
what would happen to the two ownerships to the south of the
property Mr. Wright has under option? Mr. Wright stated he felt
it would develop as R-3. There is 100 ft. frontage, and he feels
that it would be f e asible to purchase the land and remove the
structures to make it available for redevelopment.
Mr. Woods asked if t here were others in the audience who wished
to speak in favor of the rezoning?
Mr. Robert Card
4079 South Acoma -stated he was in favor of the request . He has
lived across the alley from the property for seven years or so,
and two of the fires Mr. Wright mentioned have occurred in that
time. Re stated there is considerable vandalism on the property
inasmuch as the house is vacant, and it is used to store "junk".
He fears the vandalism will spread throughout the ar~a, and feels
that the new development will be an asset to the neighborhood and
improve the a~pearance of the area.
Mr. Horn
4075 South Acoma -stated he lives directly across the alley
from this property also, and while he is not
opposed to the request, he would like some questions answered.
He asked i f it would be necessary to have the building 3i stories
high? He feels this will cut off the evening sunlight from the
back yards across the alley. He also questioned the drainage
problem. He stated that there has been fill put on the property ,
and as a r e sult this property drains back to the alley and there
is a "wat e r hole" in back of his house. He asked if the alley
would be raised or lowered, and if it was raised, wha t would
the other property owners on Acoma do then , as the drainage would
be right i n their back yards.
Mrs. Romans pointe d out that the drainage would have to be approved
by the Public Works Director, Mr. Waggoner, pr i or to the issuance
of a building permit.

IV. OFF-STREET PARKING

Mr. Ray Ludwig introduced Mr . Robert Anderson, principal property
owner for the proposed apartment complex at that address. Mr.
Ludwig stated they are pres e nting t he off-street parking plan for
approval by the Commission.
Mrs. Romans stated that the matter is before the Board of Adjust-
ment and Appeals for a variance in the front setback, and for
permission to park in the "front yard " on the north and south
sides of the complex, per the Chief Building Inspector's finding.
Mr. Ludwig stated that the matter had been scheduled for Public
Hearing before the Board of Adjustment on the matter of the front
setbac k on January 8 , 1969 , but they were informed just before
the Hearing by memb ers of the Building Departmen t that they would
need additional var iances for the parking or the north and south
ends of the bl oc k. He stated that he did not understand why the
varianc es were n eed e d, but if they would be in violation of the
ord i nanc e by parking o ff of Kenyon and Jefferson Avenues, they
would r e v i s e t h e plans if a variance wer e not granted .

VII. SUBDIVISION WAIVER
Glenn H. Koo1
CASE #8-69
Mr. Mellema stated he represented Mr. Kooi who owns property in
Northwest Englewood on the northeast corner of South Zuni and
West Floyd Av e nue extended. Mr. Kooi's property extends over to
the railroad right-of-way to the east, and encompasses approximately
3! acres. This property is zoned I-2 (Heavy Industrial), and
Mr. Kooi is desirous of building a warehouse on the eastern
part of his land. This will serve as the warehouse for Carey
Salt Company, and he will be the distributor for Colorado. He
stated that they wer e unaware of the fact that the property mus
be subdivided or a waiver obtained from the City prior to the
issuance of a build1ng permit.
Mrs. Romans stated that a subdivision plat must be filed or a
waiver obtained on any piece of unplatted land before any act
of dividing the property can be approved. She pointed out that
there is a house and several sheds on this property now, and by
putting the warehouse on this same property, one would be "dividing "
the property. She stated that she had talked to the Director of
Public Works about the situation , and he is conce r ned about ob-
taining right-of-way for West Floyd Avenue in this area. There
is a 20f t . utility easement on the south of Mr. Kooi's property
now , and Mr. Kooi has indicated he will be willing to set back
from the 20 f t . easement to allow for fu t ure roadway for West
Floyd. Discussion of the dedication of land for the right-of-way

built to the approval of the Director of Public Works and open
for traffic prior to the occupancy of the proposed warehouse;
and further, a subdivision plat for this tract must be filed
prior to a permit being issued for the construction of any other
buildings or structures or any other act which causes a division
of this property.

VIII, MEDICAL CLINIC
S601 S. Clarkson
CASE #20-68E
Mr. Henry Baume stated that he is the architect for this proposed
medical clinic, and stated that the information and changes which
the Planning Commission had desired had "suffered in the trans-
lation". He stated that he has not had time to complete a new
drawing, but does have a revised site plan for their consideration.
He stated that the drainage will be taken care of with a 22 ft.
easement along the west line of the property , and will go into
Dry Creek. He stated the parking spaces have been widened to the
minimum 9 ft. and they now have 112 spaces ; they are required by
the Ordinance to have 103 spaces. The entrances and exits to the
parking lots were discussed. Mr. Parkinson pointed out that the
north cut on South Clarkson is too close to the yield lane. He
asked if it could possibly be moved further south? Mr. Baume
replied that he did not think the property owner would approve of
this suggestion. Further discussion followed. Mr. Baume commented
that the building was designed to face South Clarkson Street be-
cause it was felt South Clarkson was the "most prominent " entrance
street. He stated he had been under the impression that the Com-
mission was concerned with the entrance from U.S. 285 rather than
either of the entrances on South Clarkson. Mr. Lone stated he
felt the north curb cut on South Clarkson would be better situated
were it to be located further south, or eliminated completely.
It was suggested that perhaps the entrance-exit from U.S. 285
should be widened to permit easy flow of two-way traffic, and the
north curb cut on South Clarkson Street should be closed completely.
Further discussion followed. Mr. Baume stated he would present
this plan to the property owners, and if it is approved, will
incorporate it into a revised plot plan for presentation to the
Commission . It was suggested that perhaps a letter could be
written incorporating the thoughts of the Commission for presentation
to the owners , and for reference for Mr. Baume.
IX. ARKE LL'S SUBD IV ISION CASE #4-69A
January 4, 1969
Mrs. Romans stat e d this matter was tabled at the last meeting
for f urther information . She stated that she had reviewed the
Minutes of the Planning Commission for 1953, and has found no
definite reference to the 8 ft. dedication that was obtained off
of the east side of Lots 1 thru 12 and the west side of Lots 37
to 48 , other than th a ~ t here was a plan discussed for the develop-
ment of this entire area on Logan in the 2900 block, and that the
School Board purchased this land shortly thereafter. She stated
that she had discussed the matter with Mr. John Kramer, of the

Englewood School Distr1ct, and 1t is their r ecollect1on that
inasmuch as a school was planned for tha t loca t ion, the 16 ft.
which was obtained in addition to the alley , was required to pro-
vide access to the school si t e with an eas ~-west access way pro-
jected to Logan from tha t por t ion of the Logan-Pennsylvania alley
which was dedicated in Arkell 's Subdivision. Now, however, the
City of Englewood owns the land that had been intended for the
school and this additional dedication is not needed. Discussion

X. COUNCIL OF GOVERNMENTS,
Councilman Lone, representative of t he Ci t y of Englewood to the
Council of Governments, reported on the meet ing of January 21, 1969 .
He gave members copies of three proposals concerning Councils of
Governments. One has been written by the Denver Regional Council
of Governments, one proposed by the Colorado Municipal League,
and a third is a Statement of Policy on Councils of Government
prepared by the Denver Regional Council of Governments. These
are being considered for presentation to the State Legislature.
Mr. Lone discussed these proposals at length, and noted that more
information would be available following the next meeting in
February.
Mr. Lone also noted that there were three grant-in-aid applications
which were approved by the Council of Governments: one from
Adams County, one from Littleton , and one from Englewood for aid
on the park-golf course complex at McLellan Dam.
It was moved and seconded to adjourn the meeting. The motion
carried unanimously , and the meeting adjourned at 10:50 P. M.

4070 South Ba nnoc k S reet from R-1-C (Single-family Residential)
to R-3-B (Multi -family Residen ti al ). He was la ter joined in t he
applica t ion by Mr . and Mrs . Thomas A. Kermmoade, 4080 Sou th Bannock
Street , and Ms . Barbara Bush , 4090 South Bannock Street .
The property in which Mr . Wright is specifically interested is
that which is commonly referred to as "t he Miller property", and
which has been of som e concern to various City agencies and the
adjacent residents and property owners for some time. He also had
option to purchase property immediately to the north upon which a
condemned residence is situa ted. By including t he Ke r mmoade and
Bush properties , his requested R-3 -B zoning would be contiguous
to the R-3-B Zone Dis r ict on the former Hawthorne School site, which
was approved by the City Council on February 3, 1969.
A Public Hearing was held on this ma tter by the Planning Commission
on January 22 , 1969 . No persons appeared at the meeting in opposition
to the rezoning , and five persons appeared who favored the rezoning .
Although the applicant 's plans were not related to the approval
given by the Commission , as a point of interest , Mr . Wright has
indicated that he plans to construct a 42 unit apartment house on
the site after removing the existing buildings with underground
parking for 36 cars, and to provide surfaceparking for 22 additional
cars. It was the concensus of those at the meeting that it would
be to the best Interest and welfare of the people to remove the
existing d eteriora ted struc t ures, and to redevelop the land .
This development would fit in with the general plan for that area .

SUBJECT: MUNICIPAL GARBAGE COLLECTION Q~
The City of Englewood presently contracts for the collection of garbage from
residences and a few business establishments with Mr. Adolph J . Hansen of
Adams County. The existing argeement with Mr. Hansen provides that the
City of Englewood guarantees Mr. Hansen the exclusive right to collect all
garbage accumulated at all residences and places of business within the City
limits of Englewood, and permits him to use such garbage as he desires in
conformity with all sanitary regulations. Mr. Hansen is paid by the City a
sum of $2,000 per month for his services. Mr. Hansen 's firm collects
garbage weekly from approximately 4, 000 residential units between October
1st and May 1st. During the remainder of the year collections from resi-
dences is twice a week . Fourteen business establishments presently have
daily service. Fifteen or sixteen apartment houses, motels or schools re-
ceive twice-weekly service throughout the year. The City may , at any time ,
give Mr. Hansen ninety days' notice of termination of a contract.
Of the approximate 10,000 water users in the City of Englewood, 4,000 of
these units have garbage disposal units and the bulk of accumulated garbage
from these homes is primarily disposed through the disposal unit which
costs that homeowner seventy-five cents per quarter for sanitary sewage
processing by the Util ities Department. Four thousand units take advantage
of the City garbage collection service and disposes the bulk of their garbage
through this service according to Mr. Hansen's count. The remaining two
thousand units presumably dispose of their garbage through one of two means .
They either place the garbage in their trash and rubbish collection receptacle
which is removed by a private rubbish collector or the unit owner takes the
garbage with his trash and rubbish to a local disposal area.

only the 4 ,000 units taking advantage of this service. All 10,000 units in
the City bear their share for providing service to 4, 000. The average cost
per month for each of the 10,000 units is twenty cents , arrived at by dividing
the 10,000 units into the $2,000 cost per month.
Since all units share the expense of the Hansen contract through general tax-
ation, 6 ,000 units are helping subsidize the service for the other 4 ,000 units .

*It is presumed that most people hauling their garbage to a fill also haul
rubbish and trash resulting in no additional fill fee for garbage included
with the trash and rubbish.
**Private trash and rubbish haulers do not charge extra for the inclusion of
garbage.
The separation of trash and rubbish from garbage was at one time required as
a sanitation measure. However, modern landfill methods and improved admini-
stration of health regulations no longer necessitate in Englewood the separation
of garbage from rubbish and trash. Both local sanitary landfills are permitted
and will accept garbage intermingled with trash and rubbish. Private trash and
rubbish removal companies who operate In Englewood permit the inclusion of
garbage if it is wrapped. Mr. Arend Lenderink, Jr., representing the Engle-
wood -Littleton-Arapahoe Rubbish Removal and Freddie's Rubbish Removal who
collectively collect ninety per cent of the trash and rubbish from private resi-

dences in the City of Englewood, publicly stated at the February 3, 1969,
City Council meeting that there will be no increase in the cost of private
rubbish and trash removal services in Englewood if the City abandons
municipal garbage collection and such garbage is included in trash and
rubbish receptacles. It may be noted that the cost of private trash and
rubbish removal will increase on April 1st, but such notice was provided
by Mr. Lenderink prior to any discussion of the abandonment of municipal
garbage collection.
The decision as to whether the City of Englewood shall continue municipal
garbage collection is a decision which must rest with the City Council.
However, I recommend that such municipally-financed service be discon-
tinued effective June 1, 1969.

Mr. Allen reported that the Englewood Golf Committee had met with tbe Littleton Golf
Committee and Littleton City officials to discuss the possibility of a Joillt ventnre in the
development of a. golf course at McLellan Reservoir. The Littleton group suggested that it
mtght be possible to lease land near 1he Chatfield Dam from the Corp of Engineers for a golf
course. It we.e agreed that t.h1B possibility should be explored and a committee was appointed
to do so. Kennedy Golf course was developed em this type of arrangement and t he Director
was instructed to look into this to see how it was handled.
Mr. Romans reported on the meeting held wlth Mr. Phipps ooncern1D g the usfuw.ty of
exchanging some land near McLellan Reuervolr ownod by him !or 110m City owned land in
the s ame area in order to make a more desirable golf oourse layout. Mr. Phipps waa not
receptive to the idea of trading 40 or 80 a cres of his property located west of the City owned

property since it would leave him without access to the County road. He said he 'WOUld rather
discuss a trade of the isolnted 40 acres owned by the City for an equal area of h1s land adjacent
to the south border of the City land. He was told this information would be relayed to the Golf
Comm1Uee for their oona1deratlon.
Mr. Romans reported thr.t the Director of Finance is checking out various ways of
financing a golf course development.
Mr. Menger and Mr. Robinson were introduced to the Commission. Mr. Menger a:.ted
their purpose for attending the meeting was to request that consideration be given to providing
a lighted ball field in En glewood where older boys in t he Old Timers program and adults tn
the sam! -pro league could play night baseball. At this time there 1a no facility where this age
boy can play ball in the evening when parents, sponsors, etc. can attend. Mr. Printz presented
an analysis of the Englewood softball end baseball p1·ograms which pointed out the fact that the
majority of pm·ttciponts are involved in programs that can utilize a standard softball field --
adalt softball ond the panther lengue of the Old Timers program. Mr. Menger sugpeted that
the Commiscion consider lighting the high school baseball field. Mr. Romans stated this waa
included in the future park improvement program but could not say how eoonft would be done .
He alco pointed out that if the lighted ball field ill located 1n Centennial Park ft will take care
oft he boys in the 11 and 12 yea.r old league. Mr. Robinson pointed out thai many people would

nECOMMENDATION:
Attachment
That the Englewood City Council approve the development
of Centennial Park including all improvements and
facillties as l!sted on the attached memorandum dated
Febr..tary 12, 1969, from the Director of Finance. The
revised cost estimate for this development, which in-
cludes additional costs to develop lighted ball field,
is $195,937. 00.
Also, that the amount of $20,000. unspent appropria-
tions from Dartmouth Parlt be transferred to the
Centetmial Park budget; that the transfer of the $13.500.
light app1·opriat1on in the Miller Field budget to the
Centennial Park budget, as previously recommended
by the Commission, be completed; and that the balance
of approximately $2!}, 000. needed to complete the
development of Centennial Park be transferred from

Pur suant to y our directions , which I was qi ven at Council's
infor mal sess i on, I have s po ken with Mr. Rich ard Si mon, the
attorney f or Thomas J . Nomina (Peanut Ba rre l ) and t he attorney
for Zuider -Zee .
Insofar as the Peanut Darrel is concerned , Mr. Simon informed
me that e f te r having t he application app roved, t he applicant
was advised by his archi t ect that it would be ;~practicable
to re model the stru c ture pre se ntly existin~ upon t he pre mises
and that a new str ucture should be erected . Apparen tly the
land owne r would not agree to this, unle ss the lease upon
the p re mi ses was rene go t iat e d . Appa r ently th ose r enegotiat ions
have be en continuing fo r some month s and ha ve been po stponed
for t ne reason that Mr. r omina is a profes si ona l football
player and has been out o f t he ci ty . Mr. Sim on does not know
the exact status of f1 r. Nom ina's intent a t t hi s point, although
he did ooint out t ha t he ha s been making lease payment s
co nsistently and ha s had money invested for le gal fe es and
other ma tters.
I did indicate to 1r. Si mon that Council had instructed me
to prepa re a r e solution for Mon day evening, which I have done ,
bu t that I felt Council would not be offended if either he
or r r. Nomina wanted to appear Monday evenin g on an informal
basis.
Insofar as Zui der-Zee is concerned, Mr. Simon in f or ned me
that an application was mad e with Glendale si multaneously
with the application made wit h Enalewood . The resolution on
Zuider-Zee was not ado pted until December 2, 1968, a pe riod of
approxi mate ly 75 days a g o . He informs me that the appli cation
is presently in he process of havin~ detailed plans and
specifications ma de, making final finan c ial co mmitments , etc.,
and th at we should anticipate an application for a building
