At the time set in the resolutions, you appeared on behalf of both of these applicants and gave assurances that plans for the building of the structures involved would be submitted shortly thereafter to the Building De- partment and that work would be commenced. Council's present information is that, while there may have been preliminary plans submitted by one of these parties, no progress has been made. Mr. Dial also reminded Council that the City of Englewood's Annual Service Awards Banquet would be held on May 13, 1969, at Wolhurst Country Club. * * * * * * City Manager Dial stated that as the 1969 Session of the Colorado Legislature was rapidly drawing to a close that unless indicated otherwise no breakfast with the area legislators would be held on Thursday, May 8, 1969. * * * * * * City Manager Dial discussed the problems of the paving of South Santa Fe Lane between Quincy and Tufts. Mr. Dial stated that it had been the intent of the City to pave South Santa Fe Lane from Quincy to Tufts in 1968 out of the one-half mill County Road and Bridge work credit given to the City of Englewood by Arapahoe County. The City had attempted to acquire a full 60 foot right of way for this street; there being an existing 30 foot dedication for all that portion within the City of Englewood and a 40 foot dedication for that portion outside the City of Englewood. Mr. Dial stated that all property owners lying within the City of Englewood had agreed to dedicate the additional 30 feet, but two property owners lying within Arapahoe County would not dedicate the additional 20 feet necessary to make the road a full 60 feet in width. APRIL 8, 1969 The Englewood Public Library Board met at dinner with the City Council and Mr . Dial following a quick tour of the library facilities. Immediately following dinner Mrs. Simon and Mrs. Wiebe presented statistics and future plans for the library to Mr. Dial and the City Council. There followed a question and answer period. The Council members and Mr. Dial left at 9:20 P.M., at which time the regular Board meeting was called to order. Present: Beverly Simon, Muriel Smith, Harold Miller , John Maxwel l, Ray Walsh, Dallas Dhority and Phyllis Wiebe. Absent: None. The minutes of March 11, 1969, were discussed and after the correction of a typographical error were approved. Mrs. Wiebe presented the monthly statistics. The book circulation for March of this year was the highest for any March. Mrs. Wiebe stated that the bookmobile still circulates about one-third of the total circulation. There are thirteen bookmobile stops, ten of which are at schools. John Maxwell wondered how to get library books and other materials to head start groups, etc. Mrs. Wiebe indicated that head start groups now visit the library with the opportunity of checking out books. Mrs. Wiebe reported on the Central Colorado Public Library System. She stated that the system has r.eached what she interprets to be a plateau in progress, with some dissension among the members. Systems funds have been appropriated for a systems study. CCPLS has received a communique from the State Library informing them that Douglas County now belongs to CCPLS. Beverly Simon reported on CCPLC, principally reciprocal borrowing, under which books are available to anyone having a library card in a Central Colorado Library System library. She stated that re- ciprocal borrowing is working well. Mrs. Wiebe announced that Judy Houck, Librarian of the Central Colorado Public Library System, and J. K. Smith , of the Denver Regional Council of Governments, will attend our May Board meeting. Other interested Board and Commission members will be invited to attend. Mrs. Wiebe reported on reciprocal borrowing for the first quarter of 1969, Englewood loaned a total of 7,079 books to ~58 non- resident patrons. Mr. Dhority suggested that discussion concerning the possibility of a speed reading program, sponsored by the library, be placed May 5, 1969 y(j?) I • • · . .• I ! ' . , f '!' • on the next agenda. John Maxwell stated that he felt it was a proper responsibility of the library to conduct such a program . Mrs. Wiebe stated that she felt it was an appropriate program to be sponsored by CCPLS . Carroll brought to the attention of the Board the fact that the Connector's Agreeme nt, f or Engle wood sewage treatment service, between the City of En glewood and Bow Mar Water and Sanitation District, executed May 16, 1967, provides for the renegotiation of head tap and connection fees two years from the date of execution, or May 16, 1969. Mr , Carroll presented a draft agreement titled EXTENSION OF CONNECTOR'S AGREEMENT and proposed that same be recommended to City Council for execu tion to provide for continued service to Bow Mar Water and Sanitation District. Mr . Carroll pointed out that there were four proposed amendments or additions to the original contract provided for in the extension agreement, as follows: 1 . Paragraph 3 be amended to provide that the district be subject to the head tap or connection fees in effect, for sewer taps outside the City, as established by City Council and as may be adjusted from time to time by the City. 2 , Paragraph 5 be amended to change the word "waste• to "gasoline" in the first sentence and to add the following sentence at the end of the paragraph: "At any time when the City is reasonably sure of the presence in the system of any detrimental discharge incl1•ding storm or ground water, the City may call for television or other type inspection of the mains, the cost for such service to be borne by the Connector. • 3. Paragraph 8 be amended to add the following to the fifth sentence: "or , at the option of the City to hold the Connector responsible for such charges, and the Connector agrees to pay the same when charged." 4. Paragraph 13 be added, as foll ows: "The term of t his contract is f or a period of twelve (12) years from May 16, 1969 , during which time the Connector agrees that all effluent produced from taps within the District shall be treated by the City and the City agrees, during the term hereof, to maintain adequate facilities for treating said sewage. Annexation of a part or all of the District to any community shall not terminate this agreement as to the Distri ct or the portion thereof annexed," Mr. Carroll pointed out that these amendments and additions would serve to bring this particular Connector's Agreement more in line with other existing Connector's Agreements. I • • • • • -2 - Mayor John Kinghorn and City Manager Larry Borger, of the City of Littleton, appeared to discuss, with the Water and Sewer Board, the proposed annexation of McLellan Reservoir lands, owned by the City of Englewood, to the City of Littleton, (Al so see Minutes of Water and Sewer Board Meeting held February 25 , 1969 .) ayor K i n ~horn stated that it was his understanding that the offi cials of the City of En lewoo d were not favorable to t he annexation and it was his desire to clar ify any matters wh ich mi h be ~onsid ered adverse to the City of En glewood. Mayo r Kinghorn explained that co ntrary to Littleton's earlier planning, they are not now co nsider ing annexation of lands south of the Arapahoe-Dou glas Cou nt y Line, though it was his personal feeling that should a go lf course be developed on the Englewood land s outh of sa i d Co unty Line , the City of Littleton should participate financially in the project . Mayor Kinghorn advised that Littleton is planning for annexation to the west of their present boundary, possibly as far as Platte Canyon Road and that their main reasons for wanting the McLellan Reservoir lands included, north of th e Arapahoe-Douglas County Line is to strai ghten out their proposed south Cit y boundary and to provide more land area required for further an- nexation wes twa~d. The Mayor further advised t hat it was his opinion that the City of Littleton could not legally restri c t the use of McLellan reservoir, should it become annexed, nor could the City of Littleton impo se any use upon the reservoir or land not desired by the City of Englewood, He state d that it is the policy of the City of Li ttleton to waive issuance of licenses, bui ldi ng permits, etc, for public structure~ and public endeavors and that written verifica- tion of thi s could be obtained if deemed necessary, Mayor Kingho rn advised that sufficient owners of land adjacent to the McLellan Reservoir and north thereof had indicated their favorable participation in the annexation movement, that the McLellan Reservoir Jands could, no doubt, be ~~nexed unilaterally; however, he and others of the Littleton City Council would prefer that, in the spirit of cooperation, the City of En glewnod approve of and sign the annexation petition, He also pointed out that Littleton does no t wish to i nvolve the possible legal question as to dividing the City-owned property, in the annexa tion, without City of Englewood authorization. After considerable discussion, by all present, it wa s determined that Mr. Carroll, Utili ties Director , would contact Mr. M. 0, Shivers, Jr., Le gal Consultant, f or his further opinion on this matter , in light of the informa tion provided by Mayor Kinghorn, with the hope that, after receipt of same, the Board will be in posi tion to make recommendations to the Englewood City Co uncil. Mr. Richard L, Banta, Attorney f or South Arapahoe Sanitation District, was in attendance on be half of that district , Mr. Banta brought to the attenti on of the Board that the Vista Verde Subdivision and the north portion of Southwind Subdivision, all of which is in South Arapahoe Sanitation District, are served by the En l evoo d sewage treatment plant, through a lift stati on. The a rea involved is in the l oop of the Highline Can al ju st east of South Broadway and encompasses approximately 250 taps. Mr , Banta advised that the City of Littleton proposed to construct a sever mai n in the vicinity to be so situated that this area could be connected thereto and be served, by the Littleton sewa ge treatment plant, without t he use of a lift stati on, and has offered such service to t he district. Mr . Banta stated that the di str i ct is interested in the Littleton offer to serve them and is curren tly making a study of same to determine whether or not the change would be econom- ically feasible, considering the following factors: • 1. The original cost of the lift station (approximately $28,000)1 mainte nance and po wer costs . 2 . Littleton is asking for distric t participation in the cost of installation of the new sever main. 3. The Littleton rate for sewage treatment would be higher than that of the currently effective Englewood rate, I • • ·' ' r ' 'r • - 3 - Mr. Banta said that no decision had been made by the district's Board of Directors on the matter, but de!!lires to know the feeling of the City of Englewood a!!l to the pouible release of this area from the Connector's Agreement should a decision be made that same could be connected to the Littleton system at a !!Savings to the district. After considerable discussion, it was the con!!lensu!!l of the Water and Sewer Board members present, and Mr. Banta W&!!l so advised, that, if the Board of Directors of South Arapahoe Sanitation District determines that the change from Engle'IIOod sewage treatlnent to Littleton sewage treatlnent, for the area discussed, will, in fact, save money for the district and the user!!! involved, the Englewood Water and Sewer Board would entertain favorable recom- mendations for the necessary action to release the area from the South Arapahoe Sanitation District Connector • s Agreement. Mr. Carroll referred to the minutes of the regular meeting of the Englewood Water and Sewer Board, held March 18, 1969, at which time he was requested to prepare wording for changes in certain sections of the 1962 Municipal Code and the proposed revised Municipal Code, as pertains to water and sewer regulations, and presented his suggestions for such changes. (See copy of these recommended changes attached as a part of these minutes.) After consideration by the Board, Schwab moved, Lay, seconded, That the Water and Sewer Board recommend to City Council that the changes in the 1962 Municipal Code and the proposed revised Municipal Code pertaining to water and sewer regulations, as presented by Mr. Carroll, be effected by proper action of City Council. Ayes: Nays: Brownewell, Frantz, Oliner, Kreiling, Lay, Schwab None Absent: Robohm Mr. Carroll referred to the offer by Mr. Marvin w. Cooper, 3650 South Clay Street, to sell his total ownership of McBroom Ditch Water rights, consisting of eight shares (inches), to the City of Englewood, as discussed at the regular meeting of the Board held March 18, 1969, at which time the Board had authorized Mr. Carroll to negotiate for the purchase of same. Mr. Carroll stated that, since the City had not previously paid more than $500.00 per inch for McBroom Ditch water, he did not offer more and that Mr. Cooper had advised that he did not desire to sell for less than $750.00 per share (inch). Negotiations were therefore dis- continued at this time. For information of the Board, Mr. Carroll advised that a declining balance trend in the Water Fund which had developed during the past two years had stopped and has been reversed for at least thi!!l year. Mr. Carroll stated that he would keep the Board apprised, from time to time, on the financial situation. Mr. Carroll advised the Board that the HUD application for Federal grant in aid for West Slope Water Development had been filed with the Denver Regional Council of Governments and has been in the hands of a COG sub-committee for study. Mr. Carroll stated that a meeting of this sub-committee with the City Manager, Wheeler and Wheeler, Consulting Engineers, Mr. M. 0. Shivers, Jr., Legal Consultant, and himself, is scheduled for Monday, April 21st for the purpose of examining all pertinent information available which could bear on the recommendations of the sub-committee. Mr. Carroll further advised that the recommendations of the sub-committee will be aired at the next meeting of the COG Water Advisory Committee on April 28, 1969. Refunds shall date from receipt of notice. Refunds shall also be allowed in cases where services are turned off by the water department and proper charge for such turn off shall have been paid. No credit or refund shall be given for excessive consump t ion or use of water due to broken service lines or leaking fixtures beyond the meter when a meter is required. DATE : May 2, 1969 SUBJECT: FIRST YEAR'S EVALUATION OF PUBLIC WORKS REORGANIZATION On February 4, 1968 , the City Council adopted on final reading Ordinance No. 11, Series of 1968, which placed the Traffic and Building Inspection Divisions under the Public Works Department and designated the Director of Public Works as responsible for the operations of those two Divisions . Just one year has passed since the reorganization took place . My im- pressions of the progress that has taken place during the past year as a result of this reorganization are submitted herewith . Attached to this report are copies of two memoranda submitted to you last year . BUILDING INSPECTION: It was my desire that departmental administrative policies would be assumed by the Public Works Director after the Building Inspection De- partment was integrated in the Public Works Department. Hopefully, the Chief Building Inspector would then have more time for the coordination of his personnel in the field and technically for involved inspections. It was also my expectation that greater emphasis could be placed on code enforcement within the community . I believe these expectations have been met for a large part. As an example of the progress attained during the last year in the code enforcement program, you may recall that several dilapidated motel units on South Santa Fe Drive no longer exist or now meet the Minimum Housing requirements of the City . The project re- quired a great deal of concentration, detail and coordination with the Englewood Fire Department , and the Tri-County Health District. The Division has changed its policy so that it actively follows through on each code violation to assure compliance rather than issuing a greater number of code violation tickets without being able to assure enforcement in each case . Enforcement is being made more effective by virtue of the efforts of the Assistant City Attorney . In several recent cases, the Municipal Judge has lev ied fairly substantial fines , which will have a positive effect in securing compliance in future cases. AI though the amendments to the Englewood Building Code , which are presently being considered by the City Council , are a product of a com- mittee , the end product is , to a large extent , the direct result of the efforts which have been made by the Chief Building Inspector during this past year . Weed violations were pursued with earnest in this past year and the result will likely be that continuing offenders will r~alize Engle- wood is sincere in its efforts to remove weeds . The Building Inspection Division 's effort in code enforcement did not diminish the quality nor the quantity of new construction inspections . I • • All Members of the Englewood City Council May 2, 1969 Page 2 • - increased over all preceding years. Furthermore , no additional per- sonnel were added to the Division staff . We have not yet reached the point at which I would recommend that one Inspector be designated a full time Code Enforcement Officer . How- ever, I do believe that as the affairs of the Division develop with time, such an appointment will likely be made . An appraisal of the organi- zation of the Division will be one of the first activities of Mr . Wallace 's successor. The placement of the Building Inspection Department into the Public Works Department has not resulted in any material differences in cost to the taxpayers of our community . Salary increases have been received by all personnel in the Building Inspection Division and by the Public Works Director and the Assistant City Engineer , but such salary increases were tied into the oJ\1\:!rall City salary review procedure rather than tied to the reorganization. The incumbent Chief Building Inspector has retired . We have had some difficulty in locating qualiffed applicants for the position, but such diffi- culties are not related to the organization of the department as the Building Inspection function of most suburban communities in the Denver area is a part of the Public Works Department. The difficulty arises from the existing salary -grade level of the Chief Building Inspector's position, Grade 26. Other communities , such as Fort Collins and Vail , are also having difficulty filling their Inspector positions. The problem is likely tied into the general construction activity and availability of high paying positions in the private construction field at this time . The Building Inspectors are now at Grade 22 . One Inspector is at the F step ($727 per month) and another will be eligible for the F step in Octo- ber. The normal beginning level for a new employee is the A step of his established grade. (On rare occasions , when special conditions warrant and upon recommendation of the City Manager , the Board of Career Ser- vice Commissioners has approved the B step for a new employee.) If a new Chief Building Inspector is started at Grade 26, A step, the begin- ning pay level will be $693 per month , less than the salary of several subordinates. This is highly undesirable , as the supervisor should be paid at a higher level than his subordinates. As indicated in my memorandum of last year to you , the Assistant Chief Building Inspector's position has been place d on a grade level with all Inspectors in the Division . This action results in a five per cent savings in personnel costs for that position . Since early 1968, the "spread" between the Chief Building Inspector and the Building Inspector positions has been reduced from a seven-grade separation to a four-grade separation . Increasing the Chief Building Inspector by one grade at this time would still leave us with a net re- duction of two grades (10 %). " A review of my memorandum of February 19 , 1968 , indicate s that this position would be refilled. In my opinion , it is just as essential to have a superv isory position over- seeing the ten employees of this Division as it is to have supervisory positions overseeing the employees and operation of othe r municipal f unctions of the City . TRAFFIC REGULATION DIVISION : As I indicated to you in a memorandum date d February 2, 196 8, the principle reason for my request to t ransfer the Traffic Regulation functions of the City from th e Planning Department to the Public Works Department was twofold . One , the City of Englewood had reached such a point in its devel opme nt that greater concentration to the long-range pla n s for the commun ity was neede d . Day-to-day technical d iffic ulties and probl e m s s uch as those prese nted by the Traffic Re gulation function have a tendency to d ivert resources to the short t erm problem at hand . Secondly , the transfer of Traffic to the Public Work s Department was to prov id e closer technical-engineering coordination in traffic facility physi cal de s ign a nd that greater manpower and equipment flexibility be- tween Traffic a nd Street Divisions would result. After on e year of having the Traffic Regulation Di vis ion within the De- partment of Public Works , I believe that we are achiev ing these results. One departme nt head now establishes the prio r ity of street-related pro- jects and is free to interchange personnel and equipment as required w ithout coordination and consent of other departme nt heads . Coordina tion a nd exchange of m anpower and equipment are now easier to achieve with a ll of our resources within one department. Street Division personnel s uppl ement the regular Traffic Regulation per- sonnel during p eak project loa d s. There have been no significant prob- lems in coordinating major traffic plans with the Planning Director. Sine th e na ture of planning functions doe not readily lend it elf to short term evaluation, it is a little more difficult to itemize progress in that department ~i nc e the transfer . Pr gress has been hampered som ewhat by our inability to obtain qualified Planning Aides at our ex- isting a lary and wage scal e . Howe ver, this di fficul ty is not related in any way to the transfer of Traffic Regulation fun ction . These c hall e nges for the City to pro vi de n ew and expanded services, pubh c improvements on a n unpreced e nted scal e a nd efficie nt dt s patch of publi c m a tte rs, require the City to re-analyze methods of rendering municipal services. The City of Englewood has reached that point in wh iC h it mu st dedi cate at least one full-time agency to the preparation of planning for this community's future. Presently, the Ci ty Planning a nd Traffic Director must share her efforts, talents , and sta ff between tw o key City functions -- planning as well as traffic regulation. A tra n s fe r of the Ci ty traffic regulation function from the Planning a nd Traffic Regulation Department to the Public Works Department would, in my opinion, reli eve a sub- stantial portion of the work load of the Planning Director and would per- mit concentration on the direction of this community 's future d evelop- ment. Several phases of municipal planning demand increasing attention : 1. Wi th the opening of the Englewood shopping complex, it is reasonable to expect that the p e ripheral areas should receive furthe r s tudy for poss tbl e future de- velopment of land us es. 2. The number of zon ing a nd re zon ing cases of a rather technical and complicated nature will, no doubt, increase. 3. A number of i mprovements in the Ci t y's current zoning ordinance need to be developed. 4. In the light of the c hanges both in E ngl ewood a nd in our neighbor ing areas , m aj or r eview needs to be given to the C ity 's Master Plan, i ncluding th e d evelopment of a five or six-yea r Capital Improve- m e nts Plan. 5. Further, many other d evelopment s need atten t io n , s uch as working toward a program of betterment in ce:·tain neighborhoods. (Co ntinue d) • ·' .. I ! '! I • ' - • • - All Members of the Engl ew ood City Co uncil February 2, 1968 Page 2 In addition to strengthening the plann ing aspects of the City, this transfer should provide for close coordination of the technical- engineering aspects of phyE~ical design in traffic facilities. Our pre- sent Assistant Planning and Traffic Director has more than six years' experience with state and municipal traffic departments in Alaska and Colorado, and is well-suited for the position of Traffic Engineer. The transfer of the Signal Technician and his crews and equipment will also allow for better integration and exchange of men and equip- ment within the Public Works Department . Such projects as the new traffic signal Installation program will require more resources than the four-man traffic regulation crew can provide without assistance from other divisions of the Public Works Department. Plans for centralized services such as garage facilities and, perhaps , radio repairs, will be facilitated and difficulties reduced with the centrali- zation of similar services and equipment within one department. It is certainly expected that the Director of Planning would continue to insure proper coordination of major planning aspects of traffic with the Planning and Zoning Commission as bas been the case in the past.
