The Mayor declared the motion c arried.
City Manager Dial noted that the protest letters were
in possession of members of City Council and discussed the pro-
cedures involved in the formation, construction, and assessme nt
of Paving District No. 17. Mr. Dial also discussed the history
of Paving District No. 17.
(Councilman Lone entered the Community Room at 8:15
P .M. and took his seat with Council.)
Director of Public Works Waggon er appeared before City
Council and reviewed the basic unit costs which were used in c al-
culating assessments, the manner in whi ch side street assessment s
were calculated, and the two year guarantee on workmanship for
materials and concrete, and the five year guarantee for street
paving.

At the time of the public hearing on the assessments for Paving
District No. 1~. some persons raised a question as to the
applicability of certain charter and ordinance provisions relating
thereto insofar as the same mi~ht affect realty annexed subsequent
to the adoption of the charter. At that time, I agreed to render
a written opinion concerninq the same.
First, it would be well, however, to establish the chronological
order of certain events.

The Englewood charter was originally adopted by a vote of
the people on July 8, 1958. Section 107 thereof provides, in
essence, that City Council may install special improvements and that
residents may protest the same, but that Council "shall have the
final decision" thereupon.
During the 1ears 1959 through 1962, Enqlewood, by a series of
ordinances, annexed that territory generally referred to as the
"Centennial" area.
By Ordinance No. 14, Series of 1965, Council adopted a procedure
for assessino the costs of such districts (Chapter 14, Enqlewood
Municipal Code), 1~hich, for the most part, adopted the procedure
set forth in the state statutes which apply to ~tatutory cities.
The ques tion, t herefore, is whether the provisions of the charter
and ordinance are applicable to realty in the Centennial area.
The answer to this que stion is clearly "Yes" for two reasons:
1. The statute un de r which the r ea1tv wa annexed (1 39 -10,
C.R.S., 1963) provided t hat an annexation would be co mplete "for ~ purposes" upon the effective date of the annexation. Court

decisions are myriad to the effect that, when a parcel becomes a
part of a city, all ordinances then in existence beco me immediately
applicable to that parcel. Indeed, to say that a newly annexed
parcel of ground is not bound by the City's charter would be as
illogical as to say that the State of Colorado is not bound by the
United States Constitution because the land comprisin ~ this state
was not acquired, or made part of this nation, until after the
Constitution was adopted.
2. In any event, the ordinance pursuant to whic h City
Council assesses property for paving district purposes was, as
noted above, enacted ~~quent to these parcels' annexation.
For these reasons. it is this office's firm opinion that the
provisions of the City's charter and ordinances are as fully
applicable to this territory as they are to any other territory
