I • • • • City Attorney C=iswell sta t ed that t h e pr0posed bill for an ordinance renaming South Pecos Street to South Windermere Street be held for further consideration as the Planning Commission was presently considering the renam~ng of South Santa Fe Lane to South Windermere Street to be e ffectlve with the renaming of South Pecos Street. City Attorney Criswel l stated that on July 1, 1969, right turns on steady red lights would be a l lowed on all inter- sections except those posted. A bill for an ordinance amending the Model Trafflc Code of the Clty of Englewood to conform with the State law change had been prepared. City Manager Dial stated that other than the intersection of South Bannock and U.S. 285 which presently prohibits right turns on red after stop, no other intersection wou ld be posted to c all for this prohibition as of this date. Introduced as a Bill by Councilman Dhori ty and read in full, A BILL FOR AN ORDINANCE AMENDING CHAPTER 25 OF THE MUNICIPAL CODE OF THE CITY OF ENGLEWOOD, BY AMENDING SECTION 25.1 THEREOF AND BY ADDING A NEW SECTION TO BE KNOWN AS SECTION 25.2-7 , TO AUTHORIZE VEHICLES TO MAKE RIGHT HAND TURNS ON STEADY RED LIGHTS, AFTER COMING TO A COMPLETE STOP, EXCEPT AT INTERSECTIONS WHERE SUCH TURNS MAY BE SPECIFICALLY PROHIBITED . The Mayor decla r ed the motion carried. * * * * k City Attorney Criswell presen ed a bill for an ordi- nanc e amend i ng the Retail Sales and Use Tax Ordinance whereby fifty per cent of the cost of contract construction will be utilized i n computing use tax on materials used in construction ra ther th an the present forty per cent. City Council discussed the use tax on automobiles as well as construction and retail sales made in the City of Englewood by firms not residi n g in said city. Councilman Brown atatad that he waa in oppoaition to the axtanaion of Hampden •• one way, waat bound from Downing to Logan. Mayor Schwab diacuaaad traffic pattern• at the intar- aaction of Floyd and South Broadway and atatad that in hie opinion Hampden ahould be two way, Girard remain one way, and that Floyd ahould be placed aa a one-way atraat to replace Hampden. City Manager Dial atatad that he had bean informed that the 1969 and 1970 Highway Department budget contained aufficiant fundi for the conatruction of the u.s. 285 -South Broadway inter- change and that it waa hie undaratanding that the Highway Depart- ment wa1 praaantly negotiating to acquire property for the inter- change. * * • • * • -3- I . • • • City Manager D .~al stated that the City of Engl ew o od had ma de app lication to the Depa rtment of Highwa y s for partici- p a tion i n ~he Federal TOPICS program for road saf ety betterment in the Denver metropol1tan a re a. Mr . Dia l stated th at t he City had requested that funds be prov~ded to tie in ~he traffic sign als on South Broadway from Yale to Man sfield to the mon it rol s ystem and to construct a traffic divi der in the 3400 block of South Broadway . Mr. Dial stated that th i s progr am c alls for n o matching funds and that he wa s opt 'mistic bf its succe ss. City Ma nager Dial requested authorization for the Mayor and City Clerk to execute a license agreement with the Denver Board of Water Commissioners for cr ossings bene a th the City Ditch wh ich were made during 1968 in the Water Pr e ssure Improvement Program. Mr . Di al stated th a t the cros s ing s were loc a ted i n the vicinity of Hampden a~d Pennsylvani a , Kenyon and Log a n, an d Corn ell and Logan . COUNCILMAN DHORIT Y MOVED , COUNCILMAN KREILING SECONDED, THAT TH E CITY DITCH CROSSINGS BE APPROVED AND THAT THE MAYOR AND CITY CLERK BE AUTHORIZED TO EXECUTE THE LICENS E AGREEMENT WITH THE DENVER BOARD OF WATER COMMISSIONERS . Ci ty Council discussed t h e affect of the agreement upo n the storm drainage proble ms connected with the City Di tch. COUNCILMAN DHORITY STATED THAT HE WOULD WITHDRAW HI S MOTION FOR APPROVAL OF THE AGREEMENT IN ORDER TP.AT 'I"HE MATTER MIGHT BE REFERRED TO THE CITY AT TORN EY. COUNCILMA N KREILING WITHDREW HIS SECOND ON THE SAME BASIS. City Manager Dial reported on t he reservati on of shelter houses at the var1ous parks w1th in the City . Mr . Di al s t a ted that shelters would be reserved f or g roups of over si x ty people on a first-come, first-serve basis . The Parks a n d Recreation Depa rtment does indicate over the telephone whethe r o r not the shelter has been reserved and if requested b y tel ephone will tempor arily hold a shelter for a few hours. However, this temporary reserva tion is not b inding and i s on l y when an indi- vidual will personally come to the Parks and Recreat i on Depar t- ment and specific a lly sign for the reservation . Mr . Dial stated that no signs are posted in the park shelters s t ating that t hey are reserved. Mayor Schwab suggested that the party reserving the shelter should b e made responsible for posting his reservation prior o the arrival of his group. I • • ' • • • • amount of $500. This would mean a loss of only $250. However, it might also mean th at c ost of i mprovements on the Arapahoe County property would be ineligible for HUD participation which would result in a reduction of several thousand dollars from the HUD grant. * * * * ~ * City Manager Di al called City Council's attention to the June issue of the Colorado Municipal League's Colorado Municipalities in which Mr. J.R. Mack, As s ist ant City Manager, h ad an art icle on a ir rights. * * * * * * Ci ty Man ager Dial discu ssed the storm drainage problem in the 3300 block of South Wa s hington. Mr. Dial stated that prior to the June 8 , 1969, rain storm he and Mr. Waggoner, Director o f Public Works , h ad discussed the flood with Dr. and Mrs. Walgren, 3341 South Washington. Mr. Dial stated that the temporary solution to the problem would cost $10,000 and that the problem could be solved with the installation of a storm sewer servi ng the northeast Englewood area. City Counc il discussed the effect of the Craig Rehabili- tation Center 's parking lot upon storm drainage within the area. City Manager Dial reported that a more detailed review of the Hoskins' storm drainage study had been made, and it appeared that the figures in the Hoskins' study might be close to being accurate in 1969. Mayor Schwab discussed the reversal of the flow of the City Ditch to solve storm drainage problems within the City. * * * * * * Mayor Schwab reported that a water fountain would be dedicated i n honor of Mr. Dick Huff , deceased, by the Old Timers' Association at Denny Mi ller Field, Tuesday, June 24 , 1969, at 10:00 A.M. * * * * * * Mayor Schwab stated that a quest i on had been raised on the Police Pension Board concerning the interpretation of the Polic e Pension Statutes as to whether the statutes allowed a police officer to be retired on d i sability if the disability was not service connected. City Attorney Criswell stated that the present statutes made it clear that a temporary disab i lity reti rement at half pay for one ye ar could only be granted by the Polic e Pension Board if the retirement was service connected. Mr. Criswell stated that for an individual perma nently disabled it was his opinion that only those officers injured in the line of duty could be retired. However, the statutes governing this provision are at best unclear and certainly have been interpreted by others to mean that the disability does not have to be service incurred. Mayor Schwab stated that the Police Pension Board had considered such a case of disability in the last three months whereas there appeared to be no relat ionship of the indiv idual 's service to his disab~lity. In this case the Pension Board had concluded that the officer should be retired. Mayor Schwab -5- • I • • . , , - • • stated that he believed that this matter should be clarified in the court and that a suit should be filed attempting to do this. Mayor Schwab requested that City Attorney Criswell have additional information about this matter at the next regular City Council meeting. * * * * * * Councilman Kreiling reminded members of City Council that it was time to appoint an auditor for 1969. After discussion Mayor Schwab appointed Councilmen Kreiling and Dhority to a committee to select an auditor for 1969. * * * * * * COUNCILMAN DHORITY MOVED, COUNCILMAN KREILING SECONDED, THAT THE MEETING BE ADJOURNED. SUBJECT: FUTURE TRAFFIC PATTERNS This m e morandum is provi de d as a result of y our inquiry w ith regard to the City administration 's intentions for future traffic patterns w ithin the community . Before the e nd of 1969 we intend to complete a four-step p r ogram to promote a better general traffic pattern. Within the very near f uture the existing one-way couplet of Girard and Hampden will be e xtended east to South Downing Street. Shortly there- after we intend to extend the north-south couplet of Bannock and Sherman north to Yale Avenue. Som etime in September , after completion of Paving District No. 18, we e xp ect to extend the Bannock-Sherman couplet south as far as Chenango. This will complete the one-way street program in Englewood and no other one-way streets are contemplated. After construction is completed in Paving District No. 18 on South Dela- ware Street, we a nticipate the use of Delaware from We s t Belleview Ave- nue to West Kenyon A venue as a two-way street favoring north and s outh tra ffic. The Planning Commission is now reviewing a comprehensive pla n and may favor South Fox Street as a two-way traffic artery between West Belleview A ve nue a nd U, S. 285 . Although South Fox Street is much narrow er , it m ay be d esirable to utilize it in addition to South Delaware Street to serve th e s outhwest portion of the City. Th e four s te p s a bove are probably the most economical approach toward s improving traffic w ithin the community at this time. Expenditures for signs, poles a nd labor are minor a nd no supplemental appropriations will be require d . Signals at s uch intersections as South Bannock Street and West Oxford A ve nue , South Bannock Street a nd West Quincy A venue, South Sherman Street a nd East Quincy Avenue , a nd South Sherman Street a nd East ThJ rtmouth A ven ue m ay be necessary in the future if traffic vol um es on these stree t s continue to increase. A special City Council meeting will be held this coming Monday, June 23rd, at 8:00p.m. in the City Council Chambers to consider those matters which were not considered at our June 16th regular City Council meeting. Specifi- cally, items which were not considered were: a) Monthly financial report; (b) Bill for an Ordinance amending the Model Traffic Code to provide for right turns on red signals; (c) Bill for an Ordinance regarding construction use taxes; (d) Bill for an Ordinance renaming South Pecos Street to South Windermere Street; (e) Report on 1969 traffic program; (f) Report on reserving park shelter houses; .(g) Request for authorization for the Mayor and Director of Finance to enter into an agreement allowing the City to place water mains across the Denver City Ditch; (h) Attorney's choice; (i) Manager's choice; (j) Mayor's choice; and, (k) Councilman's choice. Most, if not all of the materials, regarding the above items and subjects were provided in the June 16th City Council agenda packet. Please bring these materials with you. Upon completion of the special City Council meeting, we can adjourn to Conference Room A to have a short study session to discuss progress which has taken place with regard to employee discussions, and other items.
