ORD INANCE NO. 27 , SER-ES OF 1969
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND THE
CITY CLERK OF THE CITY OF ENGLEWOOD 'TO EXECUTE A DEED TO A CERTAIN
PARCEL OF LAND PRESENTLY OWNED BY 'THE CITY OF ENGLEWOOD CONVEYING
SAID LAND TO THE GA'IES RUBBER COMPANY , A COLORADO CORPORATION,
AND DECLARING AN EMERGENCY.

COUNCILMAN LAY MOVED, COUNCILMAN DHORITY SECONDED, THAT
ORDINANCE NO. 27 , SERIES OF 1969 BE PASSED ON FINAL READING
AND PUBLISHED IN FULL IN THE ENGLEWOOD HERALD AND ENTERPRISE.
Upon the call of the roll, the vote resulted as follows :
Ayes: Councilmen Lay, Kreiling, Dhority, Brown, Schwab.
Nays: None.
Absent: Councilmen Parkinson, Lone.
The Mayor declared the motion carried.
Mayor Schwab stated that at a n earlier informal meeting
between the Englewood Water Board and the C~ty Council, the
Englewood Water Board had recommended that a contract with the
Denver Water Board be executed whereby Englewood would obtain all
rights to the City Ditch from its headgate in Douglas County to
the interception of the City Ditch at Harvard Gulch near Yale and
Downing. Englewood would agree to deliver up to November 1, 1973,
12 cubic feet of water per second at the Harvard Gulch blowoff.
Englewood and the Denver Water Board would jointl y attempt to
obtain all other water rights on the City Ditch. However, Englewood
would be allowed to retain water rights equal to no more than
2.5 cubic feet per second.
(Councilman Parkinson entered the Council Chambers at
7:40 P.M. and took his seat with Counc i l.)
City Manager Dial stated that over a ten ye ar period
it was estimated that approximately $30,000 net savings would be
obtained by using the City Ditch to provide water to the Allen
Filter Plant rather than pumping up from the Platte River at the
Union Avenue station.
Mayor Schwab stated that the take over of the City Ditch
by the City of Englewood had been tied into the negotiat ions
between the Denver Water Board and Englewood for the West Slope
Water Development Project .
Discussion ensued.
COUNCILMAN DHOR ITY MOVED , COUNCILMAN LAY SECONDED, 'THAT
THE MAYOR AND CITY CL ERK BE AUTHORIZED TO EXECUTE THE PROPOSED
AGREEMENT WHEREBY THE CITY OF ENGLEWOOD WOULD ASSUME ALL RIGHTS
TO THE CITY DITCH UP TO THE INTERCEPTION OF 'THE CITY DITCH WITH
HARVARD GULCH.
Councilman Parkinson stated that he believed the City
should agree only in principle at this time instead of specifically
authorizing the Ma yor and City Clerk to execute the agreement.

City Attorney Criswell stated that it probably would be
best to have an ordinance passed at the time of finalization of
the agreement which would incorporate all aspects of the agreement
therein.
Upon the c all of the roll, the vote resulted as follows:
Ayes: Councilmen Parkinson, Lay, Kreiling, Dhority,
Brown, Schwab.
Nays: None.
Absent: Councilman Lone.
The Mayor declared the motion carried.

THAT THE MEETING BE ADJOURNED. Upon the call of the roll, the

WHEREAS, the Major of The City of Englewood and the City
Clerk of the City of Englewood on March 27, 1969, entered into
a Purchase and Sale Agreement with The Gates Rubber Company, a
Co l orado corporation , for the above-described parcels of real
prope r t y pursuant to a motion p assed by the City Council of the
City o f En g lewood on January 6, 1969; and
WHEREAS, said parcels of real property are no longer necessary
f or t he use of the public ; and
WHEREAS, The Gates Rubber Company, a Colorado corporation,
desires to purchase said parcels of real propert y pursuant to
the term s of the Agreement entered into on March 27 , 1 969 ; and
\VHEREAS, the City of Englewood desires to c onve y said par -
ce l s of real property pursuant to the terms o f said Ag reement;
and
WHEREAS, pursuant to the terms of said Agreement it i s n eces-
sary f or the City of Englewood to issue a deed for said parce l s
of said real property to The Gates Rubber Company, a Colorado
corporation,
NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUN CIL OF THE
CITY OF ENGLEWOOD as follows:
Section 1. The Mayor and the City Cl erk of the City of
Englewood are hereby authorized and directed to execute a deed
conveying said parcels of real property to The Gates Rubber
Company, a Colorado corporation.
Section 2. For the reasons hereinabove set forth the City
Council of the City of Englewood hereby finds and declares that
the immediate passage of this Ordinance is necessary for the
preservation of the public health, peace and safety in order to
allow for the immediate conveyance of said parce ls of real pro-
perty by reason of which this Ordinance shall become effective
immediately upon its passage , in accordance with the provisions
of Section 4 1 of the Charter of the City of Englewood, Colorado.

conveying said parcels of real property to The Gates Rubber
Company, a Colorado corporation.
Section 2. For the reasons hereinabove set forth the City
Council of the City of Englewood hereby finds and declares that
the immediate passage of this Ordinance is necessary for the
preservation of the public health, peace and safety in order to
allow for the immediate conveyance of said parcels of real pro-
perty by reason of which this Ordinance shal l become effective
immediately upon its passage, in accordance with the pr ovisions
of Section 41 of the Charter of the City of En gl ew ood, Colorado.

Agreement, made this J;}l. •
1933, between the City and County of and
through its Board of Water Commissioners, first party, and
Littleton Ce me tery Association, a non-profit corporation, of
Littleton, Colorado, second party,
Witnesseth that whereas the first party owns and
operates a certain ditch takind wa ter from the South Platte
River and known as the Ci ty Ditch; and,
Vfuereas, the second party h~~ acquired the water
rights evidenced by one share of the capital stock of The
Nevada Ditch HoldinG Co mpa ny and desires to have the point ot
diversion of the water rights evidenced by said Nevada stock
changed to the intake of said City Ditch and desires fur.ther to
have the water evidenced by said Nevada stock carried in said
City Ditch; and,
Whereas, it ia satisfactory to the first party to
carry said water in the City Ditch upon the terms and condi-
tiona hereinafter· stated;
Now, therefore, in consideration of their mutual
agreements the parties hereto have agreed with each other as
follows a
1. The second par ty at its own expense will secure
such change of poi nt of diversion of the water rights repre-
sented by its share of nevada stoc k to the intake of the City
Ditch and the first pa rty wil l car ry such water in said City
Ditch to a point in the Littleton cemetery.
2. The second party at its own expense will install
a headgate in the east bank of t he canal of t he City Ditch and
a short flume leadine fr om said headgate to a three inch Venturi
weir and a shor t flume leading from said weir to a pipe line

3. The cost or installine said headgate, weir,
sump, pump and their app li-ance s a nd maintaining the se.me

carrying said v1ater in the City Ditch than the usual charge
:for carryinG a like amount of City Ditch water therein.
5. The first party shal l have the right to discon-
tinue carrying said Nevada water in said City Ditch at any
time v;hen the carriage thereof shall interfere, in the opin-
ion or the engineers of the first party, with the carriage of
City Ditch vrater in said ditch and shall also have the r _ight
to stop such carriage in case the City Ditch is ever abandoned
as a carrier of City Ditch water.

Englewood. Mark feels timing on this is rather critical and it appears
to me that we're being asked by Denver to take on a sizable c ommitment.

SUMMARY OF PROPOSED CITY OF ENGLEWOOD
PENSION PLAN
The pension plan is designed to provide at age 65 approxi-
mately fifty per cent of an individual's average monthly salary
when combined with Social Security.
Benefit Formula
Individual benefits are determined on the basis of years of
current service, past service, and average career salary.
A. current Service Benefits (all benefits earned from the
date of establishment of the pension plan to the date of retire-
ment):
1% of average career monthly salary plus
1/2% of the average career monthly salary
in excess of $550 times total years of
current service equals monthly current
service retirement benefit.
B. Prior Service Benefits (those benefits earnad while
in the employment of the City of Englewood prior to the estab-
lishment of the pension plan) :
1/2% of the average career monthly salary
plus 1/4% of the average career monthly
salary in excess of $550 times number of
years of prior service equals the monthly
prior service retirement benefit.
Effective Date of Plan
January 1, 1970.
Coverage and Eligibility
All full time, permanent employees who are presently with
the City of Englewood shall have the option of joining the plan.

All full time, permanent employees hired by the City of Englewood
after establishment of the plan are automatically covered.
Normal Retirement
Age 65.
Pension Guarantee
A retired employee (or his estate) shall be guaranteed ten
years' pension benefits or pension benefits for the length of
his life, whichever is longer.
Disability Benefits
If an employee is disabled with ten or more years of
service, he shall receive the actuarial equivalent of the normal
retirement benefits earned up to the date of disability. If
less than ten years, the employee's contributions with interest
shall be refunded.
Death Prior to Retirement
The employee's estate shall receive his contribution with

interest.
Vesting
Vesting applies to an employee who leaves the City prior to
retirement age with more than ten years of c redited service .
If the employee leaves his contribution to t~e pension with the
City, he may receive a percentage of his normal pension benefit
earned to the date of his retirement at age 65. The vesting
schedule is set forth below:

If an employee has less than ten years service upon
resignation or ~ischarge, he shall receive a refund of his
contributions with interest.
If an employee resigns or is discharged with ten or more
years of service, the employee may either receive a refund of his
contributions with interest or may elect for a deferred retire-

ment allowance in which case the above vesting provision shall
take effect.
Unfunded Liability
The unfunded liability is created by the fact that employees
shall receive reduced benefits from the pension plan for the years
of service when the pension plan was not in effect and no con-
tributions were made either by the employe~ or employer. It is
estimated that the liability will equal $146,840 and will coat
1.14 per cent of annual payroll over the next 25 years to amortize. I • •

The employee's contribution sh 11 be 3 per cent for the
first $550 per month of ea1nings and 4.5 per cent for all
earnings in excess of $550.
The City's contribution shall be 5.76 per cent of payroll.
Pension Committee
The pension committee shall consist of seven members; two
employees who shall be members of the plan, two members of city
Council, and three taxpaying electors. Terms of the pension
committee membership shall be for four years, overlapping.
Investment of Assets
The pension committee shall d~termine whether the assets
of the fund shall be invested through:
A. A non-insured trust.
B. A group annuity contract from a life insurance company.
c. A board administered investment program with restrictions
similar to those placed on PERA .
