Cle r k : The foll owing "Notice of Call" was read by the City NOTICE OF CALL BY THE MAYOR F OR SPECIAL SESSION OF THE CITY COUNCIL MONDAY, SEPTEMBER 29, 1969 --8:00 P.M. The City Council of the City of Englewood, Arapahoe county, Colorado, is hereby called to a special meeting in the City Hall, 34 00 South Elati Street, for the purpose of considering and taking a ction as deemed necessary for matters relating to: (1) Sale of street shop property to the Colorado Department of Highways; (2) Construction of a Central Garage (Servicenter): and (3) Petition calling for the modification of traffic patte rns. Mr. Howard E. Abbott, 3681 South Albion, appeared before City Council and requested that the wording of the petitions be read . City Clerk Lyon read th e following petition : AN ORDINANCE REMOVING THE LEFT TURN TRAFFIC RESTRICTION AT THE INTERSECTION OF SOUTH BANNOCK ST. AND STATE HIGHWAY 285 , CITY OF ENGLEWOOD, COL ORADO AND DESIG- NATING HAMPDEN AVE., BOTH EAST AND WEST, AS A TWO WAY OR TWO DIRECTIONAL AVENUE PER- MITTING MOTOR VEHICLE TRAFFIC TO MOVE OR TRAVEL BOTH EAST AND WEST. BE IT ORDAINED BY THE PEOPLE OF THE CITY OF ENGLEWOOD, COLORADO: The left turn traffic restriction at the intersection at So. Bannock St. and State Highway 285 in the City of Englewood, Colorado is hereby removed. Motor vehicle traffic approaching this intersection from the west shall be permitted to turn left and proceed north on So. Bannock St. with- out restriction. If any restriction pre- vails it shall be removed. Hampden Ave . in the City of Englewood, Colorado both east and west, is hereby desig- nated as a two way or two directional avenue with motor vehicle traffic to be permitted to move both east and west except for that portion of West Hampden between South Bannock Street and Highway 285 . This ordinance re- peals all ordinances, resolutions, motions and traffic directives in c onflict therewith. Mr. Chalmerse A. Parker, 3996 South Grant, appeared before City Council. Mr. Parker stated that in his opinion the intent of the petition was self-explanatory , but he also stated that it was the intent of the petitioners to allow traffic move- ment in such a way as not to conflict with other existing traffic situations. Mr. M. M. Summers , 3140 South Delaware, appeared be- fore City Council. Mr. Summers stated that on the petition the word "restriction" meant the left hand turn restriction only, no other restrictions of traffic patterns are intended. Mr. Howard E. Abbott, 3681 South Albion, (business property located at 3524 South Lincoln) re appeared before City council. Mr. Abbott btated that the State Highway Department -2- ) \ ! Councilman Kreiling asked Mr . Chalmerse Parker if he witnessed the signatures on hi s petition. Mr. Chalmer s e Parker , 3996 South Grant Street, stated that h e had witnessed al l sign ature s on the petition he had cir - cul at ed . Mr. Ear l S. Hill , 3553 South Bannock , stated that he h a d witnessed all signatures on the petition he had ci rculated. Mr . M. M. Summers, 3140 Sou th Del aware, stated that he had witness ed all signatures on the petition he had circulated . Mr. Leo L e n tsch , 1 550 East Dartmou th , stated that he had witnessed all signature s on the petition he had circulated. Counc ilman Lone stated that in order for the downtown section of the City of Englewood to thrive that the merchants would have to give the shoppers a reason to stop . Mr. Lone stated that past business practices had not been conducive in obtaining custome rs to th e downtown Englewood stores and that it was the tend e nc y of the merchants to blame the lack of custo- mers upon the traffic pattern . AND STATE HIGHWAY 285, C ITY OF ENGLE WOOD , COLORADO AND DESIGNATING HAMPDEN AVE., BOTH EAST AND WEST, AS A TWO WAY OR TWO DIRECTIONAL AVENUE, PERMITTING MOTOR VEH ICLE TRAFFIC TO MOVE OR TRAVEL BOTH EAST AND WEST. COUNCILMAN LAY MOVED, COUNCILMAN BROWN SECONDED, THAT THE BILL F OR AN ORDINANCE BE PASSED ON FIRST READING AND ORDERED PUBLISHE D IN FU LL IN THE ENGLEWOOD HERALD AND ENTERPRISE. Councilman Kreili ng stated that he would vote against the ordinance and wished to explain the reasons for his vote. Mr . Kreili n g s t a ted that in 1968 a similar measure had been r efe rred to the e lectorate and had be en defeated. Mr . Kreiling stat e d that th e people should be given the opportunity to vote on the matter aga in . Councilman Dhority st at ed that on e of his re asons for voting for the ordinance would be that it could be changed at the direction of City Council. If the ordinance was submitted to a vote and passed by the people, then the City Council 's hands would b e tied . Counci lman Lon e stated th at his no vote was based upon the fact that the peo p l e h a d already to ld the Englewood City Cou n cil in the 1968 e lection what the tra ffic pattern should be. -3- • I ! ~ • ' • • Mr. Lone st ated th at the passage of this ordinance would be the first step towa r ds o v erturning the present traffic pattern . Mr. Virgil T . We lls, 3380 South Marion, appeared be- fore city Coun cil . Mr. We lls inquired of councilman Lone if he owned a bu si n ess on a traffic artery. Councilman Lone stated no. Mr . We lls st ated that a mined by the traffic going by the the streets on a one-wa y pattern , business's volume is deter- business door; and by placing business was cut in half. I Councilman Lone stated that the traffic counts had indicated that the volume of traffic on one-wa y streets had increased rather than being cut in half. Mrs. Rachael Gordon of the Englewood Flower Shop, 700 East Hampden Avenue, appeared before City Council. Mrs. Gordon st at ed tha t further extension of the one-way traffic pattern would close down her business. Mr. Sam Hill, 3456 South Broadway , appeared before City Co uncil. Mr. Hill stated that City Council had indicated one and one-half years ago that it would review the traffic p attern. Mr. Hill stated that City Council had not reviewed the traffic patte rn as of yet. Mr. Hill also referred to a meeting of downtown merchants with the Public Works Director at which time the Director of Public Works had stated that the traffic pattern was specifically designed for a certain group. Mr. Hill stated that in 1968 when the traffic propositions had been submitted to the voters, the people had misunderstood them; but this time they would pass. Mayor Schwab stated that passage of the ordinance changing the traffic pattern would combine Englewood back into a unified community. Upon the call of the roll on the passage of the bill for an ordinance, the vote resulted as follows: Ayes: Councilmen Lay, Dhority, Brown, Schwab. Nay s: Councilmen Lone, Kreiling. Absent: councilman Parkinson. The Mayor declared the motion carried. * * * * * * (Councilman Dhority left the Council Chambers at 9:00P .M.) * * * * * * City Manager Dial indicated th a t the De partment of Highways had offered to pay the City of Englewood $57 ,080, the full appraised value of the stree shops. An a greement between the City of Englewood and the Colorado Department of Highways had been submitted to the City of Englewood for approval. City A torney Criswe ll s ated that he h ad reviewed the agreement and with one exception fou nd no reason for the . ' ·' \ ! ~ I • • ' • • • City Council not to sign . Mr. Criswell stated that the excep- tion was the provision stating that the possession of the property would be yielded to the Colorado Department of High- wa ys upon tendering of the $57 ,08 0 . Mr. Criswell stated that he had prepared a resolution amending the agreement allowing for a date to be established whereby the City of Englewood would turn possession of the street shop property over to the Color a do Department of Highways. City Manager Dial recommended acceptance of the Department of Highways offer of $57,080. City Manager Dial prese nted bid tabul ations on the construction of the new street shops. Mr . Dial stated that the low bidder's base bid had exceeded the architect's estimate by $66,833. Mr. Dial stated that low bidder was Rob Roy Construction Company . Mr. Dial stated that the Central Garage Committee had met with Mr. David Nichols, architect for Ken R. White Company. Mr . Nichols had not offered an expl anation as to why the bids had exceeded the estimat e other than these bids were indicative of the times and the fact that the pre-stressed concrete firms had more than adequate amounts of business. City Manager Dial stated that the City of Englewood met with Mr. Roy and he had indicated that he would review the bids submitted with his subcontractors to see if the base con- struction cost could be placed under $200,000. Mr. Roy had stated that he would submit a report to the City prior to October 6, 1969. Councilman Lone reported on behalf of the Central Garage Committee. Mr. Lone stated that if Rob Roy Construction Company is unable to bring down the construction costs , then the City of Englewood should consider another type of construction such as an all steel building. COUNCILMAN LONE MOVED, COUNCILMAN LAY SECONDED, THAT THE CONSIDERATION OF THE AWARD OF THE SERVICE CENTER BE DEFERRED UNTIL OCTOBER 6, 1969 AND THAT THE BID BONDS ON THE THREE LOW BIDDERS BE HELD BY THE CITY OF ENGLEWOOD AND ALL OTHERS RELEASED. Englewood City Manager, Stanley H. Dial, announced the acceptance of the resignation of Assistant City Manager, Robert Mack. Mack, 30, who has served as Assistant City Manager with the City of Englewood since July, 1967, has been appointed City Manager of the City of Grants Pass, Oregon. Mack and his wife, Margaret, and their two sons, Christopher and Jeffrey, who reside at 3361 West Monmouth Avenue in Englewood, will be leaving for Grants Pass on the first of November. Mack will assume his new duties in Grants Pass on November 10, 1969. In his letter of resignation to City Manager Dial, Mack indicated that his decision to accept the Grants Pass position was difficult due to the hospitalltr which had been extended to him by employees of the City and by the community. He also indicated that his decision was based to a large extent upon the opportunity in Grants Pass to more directly con- t r i bute to municipa l government in a cit y manager's position. Di a l stated that It was with c onsiderable reluctance that Mack's r~sig- n ation was accepted a nd that Mack had made much contribution to the many asp ects of the City's affairs over the past two years. m addition, he indicated, "Bob is one of the more outstanding young men I have seen ente r the field of city management in the past several years and we all extend to him our very best wis he s for a s uccessful career."
