COUNCILMAN DHORITY MOVED, COUNCILMAN LAY SECONDED,
THAT THE RECOMMENDATION OF THE BOARD OF ADJUSTMENT AND APPEALS
FOR AN ENCROACHMENT OF CITY PROPERTY LOCATED AT 5050 SOUTH
LINDEN DRIVE BE ACCEPTED AND THAT THE MA YOR AND CITY CLERK BE
AUTHORIZED TO EXECUTE THE NECESSARY DOCUMENTS . Upon the call
of the roll, the vote resulted as follows:

Parkinson , Schwab.

Mrs. Phyllis Miller, 4089 South Acoma Street, appeared
before City Council and discussed the litigation concerning the
clean up of her property . Mrs. Miller requested that Council
1) dismiss the litigation and allow her to clean up her property
to the best of her ability and at her own expense, 2) extend
the time stated in the Notice to Clean Up to December 15, 1969
or January 1, 1970, and 3) allow her to build an 8-foot extension
to the shed that is already on the property according to the
Building Inspectors' instructions.
City Attorney Criswell gave a brief summarization of
the events leading to the litigation and Notice to Clean Up of
the Miller property. Mr. Criswell stated that Mrs. Miller had
until October 26, 1969 to clean up her property.
City Manager Dial suggested that the City Council con-
sider the court as a po ssible agent in determining what is equit-
abl e in regard to a time extension in the clean up of the Miller property.
Mr. Bill Hamilton, Acting Chief Building Inspector,
appe ared b efore City Council and gave a brief report on the
condition of the Miller property. Mr. Hamilton stated that an
addition to the existing shed as suggested by Mrs. Miller would
e nable it to hold only 10 per cent of the items on her property.
The shed could then b e classified as a garden-tool shed build-
ing . However , it would have to meet the requireme nts of the
Building Code.
Discussion ensued .

to the construction of the City Servicenter. Mr . Nichol reviewed
the bids received , the problems with said bids and the negoti-
ations with Mr . Rob Ro y , low bidder on the project, to r educe
the cost of the facility.

Mr. Rob Roy, Rob Ro y Construction Company, 3232 South
Platte River Drive, appeared before City Coun c il and presented
a letter dated October 20, 1969 setting forth the latest n egoti-
ated figures for the constructi on of the Servicenter. Mr . Ro y
stated that the lowest figure possib l e based upon construction
of a Butler ste el building had been $180 ,094 . However, late
this afternoon quotations had been received from Meta llic Build-
ings of Houston, Texas which gave a low bid of $178 ,395 .00. Mr.
Roy stated that he had not reviewed the specifications and other

mat erials on the Metallic steel buildings and did not know if
they would me e t the City's requirements.
Mr . Kells Waggoner, Director of Public Works and City
Manager Dial discussed the bids received and the items to be
deleted in the negotiated bids with the City Council .

City Manager Dial stated that in the agreement with
American Metal Climax , Inc., approved at a previous City Council
meeting , it had been found that one line concerning cost distri-
bution had been omitted from the original contract . The amend-
ment would place that line back into the contr act document.

City Attorney Criswell stated that the Atchison Ranch
appeal had b een tried before the Colorado Supreme Court, and a
decision should b e rendered within the next 60 to 90 days .

City Attorney Criswell stated that he would appear
Octob er 24, 1969 at a meeting concerning the condemn a tion of a
six acre tract of land f or the Chatfield Reservo ir site near
the Atchison Ranch prope rty.

City Attorn ey Criswell reported that in the case of
the National T e a Company, Inc. against the City of Englewood
fo r the City's failure to issu e a 3 .2 beer license to National
T e a Comp any's De l Farm Store at 4160 South Broadway, that a
Stay of Execution of the order of the District Court to issue
the 3 .2 beer license had b een denied by the District Court and
by the Colorado Supreme Court . Mr. Criswell stated that the
City must issue a 3 .2 beer license to National Tea Company, Inc.
I f the City's position should prevail in the Colorado Supreme
Court , the license of National T e a would be revoked.

City Attorney Criswell stated that some months ago an
agreement between the City of Englewood and the De nver Water
Board for cross age of Wa ter Depar t ment pipe lines beneath the
City Ditch h ad been referred to his office to check the wording
of the "save and hold h armless" c laus e . Mr . Criswell stated that

the question which h a d been stated in the referral was whether
or not the City of Englewood would be liable for damage caused
by the backup of storm drai nage water if the backup of water
was c aus ed by the construction of these lines. Mr. Criswell
stated that the "save and hold harmless" clause did impose
this liability upon the City of Englewood. However , should the
City refuse t o execute an agreement wi t h the "save and hold
h arml ess " provision, the City would still be held liable if
damage was caused b y this construction. Mr. Criswell recom-
mended the executi on of the a g reement.

THAT THE AG REEMENT BETWEEN THE DENVE R WATER BOARD AND THE CITY
OF ENGLE WOOD FOR CROSSINGS BENEATH THE CITY DITCH BE APPROVED

City Manager Dial s t a ted that tree branch removal
within the City of Englewood was continuing and that it might
extend as long as a month. Mr . Dial stated th a t private equip-
ment and men h ad been hired to assist the City in this emergency program.

Colorado Municipal Le a gue conce rning League participation was
received for the record.
City Manager Dial stated that as a result of a number
of municipalities indicating that they would support the Colorado
Municipal Le agu e appearing on behalf of municipalities in the
matter of the Pub lic Servic e Company's requ e st for rate increases,
that Mr. L e onard M. Campbell had b een r e~ain ed by the Mu nicipal League .

City Manager Di al stated that Fire Chief Severn was
at tendi n g the October 19 to 23, 1969 meeting of the Internationa l
Association of Fire Chiefs convention in Chicago, Ill inois . Mr .
Dial stated th at normally this would have been requested of Council
earlier but since Chief Severn had been i n the hospital it was
doubtful wh ether he would be abl e to attend. Mr . Dial stated that
the expense of Fire Chief Sovern's trip was being paid by the
Volunteer Firemen and th a t he would assume that this trip was ap-
proved by Council unless indicated otherwise by members of City Council.

J . Finer, Western Trading Company, was recei v ed for the record.

City Manager Dial stated that Mr. Finer of the Western
Trading Company, 3550 South Broadway, was proposing to enclose
a portion of Little Dry Creek for the purpose of providing
parking at his Army Surplus Store. Mr. Dial stated that it was
estimated that the cost of the project would be $75,000 of which
$40 ,000 would represent the enclosure and approximately $35,000
would involve paving. Mr. Dial stated that Mr. Finer was also
requesting that the City participate in this project as a portion
of Little Dry Creek is owned by the City and that parking would
be eliminated by the construction on the interchange at Broadway
and U.S. 28 5 .
Councilman Lay requested that the City Manager review
any possible elimination of parking by the co nstruction of the
Broadway and U .S. 285 interchange and report back to Council .
After discussion it was the consensus of City Council
that Mr. Finer be discouraged in his hope that the City would
provide assistance in the parking construction and encl osure of
Little Dry Creek .

Note : A letter dated October 7 , 1969 from Mr. Victor
Heyliger of the De nver Bench Advert ising Company was received
for the record.
City Manager Dial stated that Mr . Heyliger was pro-
posing the placement of bus benches at various bus stops through-
out Englewood and was willing to pay the City fifty cents per month
per bench. Mr. Dial indicated that the operation of the Denver
Bench Advertising Company in other communities had been very good,
and b enches had been maintai ned.
It was the consensus of City Council that the City
Attorney prepare a bill for an ordinance effecting a contract
between the Denver Bench Advertising Company and the City of
Englewood allowing for the placement of benches on City property.

City Manager Dial presented a memorandum from Mr.
Kel ls Waggoner, Director of Public Works, dated October 17 , 1969
con cerning proposed streets to be included in Paving District
No . 19. Mr. Dial requested that members of City Council review
the suggested list and provide c omments on the District at a
future City Council meeting.

Mayor Schwab stated that in his opinion the Englewood
citizens should know prior to the election what their mill levy
would be; and, therefore , asked that a bill for an ordinance
establishing the t ax levy for 1970 be presented at this meeting.

Councilman Kreiling called City Council's attention
to the fact that City Attorney Criswell's letter of resignation
of July 17, 1969 was to be effective no later than November 1,
1969.
After discussion it was the consensus of City Council
that Mr. Criswell be asked to continue as City Attorney through
December 31, 1969.
City Attorney Criswell consented to the extension and
stated that in his opinion the Englewood City Council should con-
sider the possibility of a full time City Attorney.

Ma yo r Schwab recognized Mr. and Mrs. Dean Karr, 3190
South High Street , from the list of "Speci al Citizen Program
Invitees."
Mr. Karr stated th a t Police Officer Larry Leyden should
be commended for the recognition he g ave a Lowry airman who
assisted Mr. Leyden in the investigation of an accident. Mr.
Karr stated that this act of appreciation should be particularly
cited as i involved a city employee and a citizen.

Mr. John Murphy, Personnel Director , appeared before
City Council and introduced Mr. Robert Byerly , Byerly-McClurg
Insurance Consultants. Mr. Byerly indic ated that specifications
had been prepared for the bidding of the City's health insur ance
and life insurance fringe benefit package . He indicated that the

maximum ben efit on the life i nsuranc e would be r a ised from
$8 ,000 benefit to $11,000 benefit and that t he he alth insurance
would be bid in a package c om p arabl e to the current coverage of
Blue Cros s -Blu e Shield. The tentative date f or receipt of
bids was set for Novemb er 1, 1969. Mr. Byerly estimated that
the total cost to the City for the health and life insurance
would be $42 ,000 and $15 ,0 00 respectively.

City Manage r Dial stated that the City of Englewood
now participates in group life insurance at roughly one-half
the total c os t to the employee and that the City Council had
discussed the possibi li ty of absorbing the full c ost. Mr.
Dial stated that Mr. Bye rly had recommended that the City
Cou ncil should decide prior to the issuance of specifications
whether it wished to carry the fu ll c ost of the life insurance
prog ram . This would probably result in a lower cost.
It was the consensus of City Council that the City
be given an alternate in the spec ifications of a) paying all
g roup and life insur ance p r emiums; b) paying under its present
s chedu l e ; c ) th at the specifications b e d e signed to give the
bidder the option of bidding a health and life insurance combi-
nation , a health insur ance onl y , and a life insurance only;
d) that no bidder be disqual ified if he c annot bid on all
three above combi nat i ons.

Mr . M. M. Summers, 3 140 South Delaware, appeared
before City Council and requested tha t the City of Englewood
ban the sale of 3.2 be e r on Sundays. Mr. Summers stated
th a t on weekdays and Saturday s children between the ages of
18 and 21 were b u s y and working. However , on Sundays they had
no job and would b e drinking beer. Mr. Summ e rs stated that
the City of Greeley presently does this and that this ban has
been tested in the Supreme Court. Mr. Summers concluded his
remarks by a ddressi ng himself to the question of whether 3.2
beer is intoxicatin g .

Mr. Ed Cartwright , 3517 South Elati, appeared before
City Co un cil . Mr . Cartwright ask ed the Englewood City Council
t o reconsid er the busin ess and occupational t ax placed upon
liquor establishments . Mr. Cartwright submitted the foll owing

GENTLEMEN :
The undersigned , licensed liquor outlets in your City,
respectfully request that you RESCIND the existing Business
and Occupat i onal Tax, and as grounds therefor , would show:

1. That said Business and Occupational Tax is now
applied solely to b eer and liquor outlets in this City.
2. That beer and liquor outlets are now also required
to co llect City sales t axes on these sales, which are producing
revenues far in exce ss of those being obtained from imposition
of the Business and Occupational Tax.
3. That beer and liquor outlets are thus required
to supply a disproportionate share of the revenues of the City,
above and beyond services supplied, resulting in gross discrimi-
nation against legitimate busine ss enterprise, existing and
operating because of the desires of the majority of the inhabi -
tants .
4. That liquor outlets within y our City are placed
at a competitive disadvant age with similar establishments in
a djacent communities under the present circumstances."
(Note: The petition was signed b y 31 people, all owners or
operators of 3 .2 or liquor outlets. The petition is not certi-
fied as to circulation .) '
Mr. cartwright stated that the occupational tax is
unfair and discriminatory and that the cost involved in policing
liquor outlets is in proportion to that c ost in policing retail
businesses.
Mayor Schwab asked Mr. Cartwright if his business
has suffered since the levying of the sales and use tax.
Mr. Cartwright stated that he could not definitely
say either way.
Councilman Brown called Mr. Cartwright's attention
to the fact that 61 police calls have been made to liquor
est ablish:ne nts since March, 1969.
Mr. Lee Corder, Casual Lounge , 65 West Floyd,
appeared before City Council and stated that only two police
calls have been made to his establishmen t in the last two
years .
Mr. Willard Ball, GEM Liquors, 5450 South Broadway,
appeared before City Council and stated that the sales tax
would yield from his establishment between $8,000 and $10,000
annually in addition to the occupational tax.

A memorandum from Police Ch ief Jack Clasby regarding
police calls to the Lucky Lady Club was received for the record.
City Manager Dial stated that since March 1, 1969,
thirty-nine police calls had been received concerning disturbances
at the Lucky Lady Club. Mr. Dial stated that these disturbances
were primarily due to the condition of the customers of the Club
and rec ommended that a resolution be adopted establishing a
show c ause hearing on the revocation or suspension of the Lucky
Lady Club's liquor license.
Mr. Jack Clasby, Police Chief, appeared before City
Council and reviewed the police calls which had been received
from the Lucky Lady Club. Mr. Clasby stated that officers of
th e Police Department had met with the Lucky Lady Club's manage-
ment on July 24, 1969 and discussed the high number of police
c alls that had been received. Mr . Clasby stated that this meet-
ing had r e sulted in no apparent reduction of the number of police
calls.

District undertakes an intensive effort to solve its sanitary

in principle to a connector's agreement.

Mr. J. Robert Mack, Assistant City Manager, appeared
before City Coun ci l in regard to the r e commendation of the Water
and Sewer Board conce rning the approval of Supplement No. 16 with
th e Va lley Sanitation District. Mr. Mack described the property
to b e included within Supplement No. 1 6 and indicated that accord-

A memorandum recommending authorization for the exe-
cution of a quit cl aim deed for a portion of State Highway No.
31 in favor of the State Highway Department was considered by City Council.
City Manager Dial stated that the City of Englewood had
secured a deed for a portion of State Highway No. 31 in favor of
the State Highway Department which had been attested and signed
in 1964 but had not been delivered to the Highway Department.
Mr. Dial stated that the document would be delivered upon the
recording of vacation of the original roadway by the appropriate authorities.

A memorandum from Mr. J. Robert Mack, Assistant City
Manager, regarding Dutch elm disease was received for the record.
Mr. J. Robert Mack, Assistant City Manager, appeared
before City Council and discussed Dutch elm disease. Mr. Mack
indicated that Arapahoe County had been willing to provide labora-
tory and testing facilities for Dutch elm disease.
After discussion, it was the consensus of City Council
that the administration draw up a model Dutch elm disease ordi-
nance and e ncourage Arapahoe County Commissioners to continue
in their role of supplying testing facilities during this emer-
gency affecting the arbor population of the City of Englewood.

A memorandum dated September 24, 1969 regarding liti-
g ation with Oliver S., Agnes and Charles F. Kingsley was received for the record.
City Attorney Criswell reviewed the memorandum with
members of City Council. Mr. Criswell indicated that in regard
to the suit filed against the City Manager, Director of Public
Works and the former Building Inspector for alleged violation
of Kingsley's civil rights which had been dismissed on September
17, 1969, that a new suit had been filed against the City of
Englewood in th e Federal District Court on the same grounds.
Mr. Criswell indicated that the judge had ruled that the Federal
District Court had no jurisdiction and as yet no further action h ad been taken b y Mr. Kingsley.

City Attorney Criswell reported that on October 14,
1969 a t 8 :30 A.M. the Supreme Court would hear the Atchison Ranch case appeal.

City At orney Criswell stated that litigation had been
institu e d agai nst Mrs. Miller, 4089 South Acoma, and the welding
and metal f a brication shop, 4690 South Grant as discussed at
the September 15, 1969 City Council meeting.

City Attorney Criswe ll stated that a 30 foot right
of way in the 4300 block of South Santa Fe Lane had been deeded
to the City b y Mr. Edwin F. Deline under an agreement which
allows the City of Englewood to use the 30-foot dedication for
public street, utility and related purposes. The agreement is
contingent upon:
1. The City of Englewood blacktopping the 30-foot
strip of groun d a butting the property being c onveyed without
cost to Mr. Deline.
2 . Any further street improvements of a special
improvement district nature shall be borne by Mr. Deline and
any successors.
3. The City of Englewood will exerci s e its best
efforts to prevent extens ion of an y street within the City
in such a manner that would cause the taking of further
property owned by Mr. Deline.

City Manager Dial stated that the passage on first
reading of the eme rgency ordinance providing f o r two-way traffic
on Hampden Avenue and left turns on Bannock and U.S. 285 had
caused the City administration to prepare a possible implementa-
tion method. Mr . Dial presented this method to members of City
Council on a drawing dated October 6, 1969. Mr. Dial stated
that the proposed system depicted on the drawing was designed
to allow for the maximum number of turns possible off of Hampden.
City Council discussed the pro posed traffic system.
City Manager Dial stated that in his opinion the
Colorado Department of Highways would not allow left turns off
U.S. 285 through separate traffic signal time cycles . Mr. Dial
stated that in his opinion the Colorado Department of Highways
might allow left turns within the present traffic signal time
cycles but would b e reluctant to take time off U.S. 285 for a
separate left turn phase.
It was the consensus of City Council that the City
Manag er cont act the State Highway Department to determine said
department's position on the signalization for left turns off
U.S . 285 on South Bannock Street.
City Manager Dial indicated that after the initiative
ordinance is passed on final reading and no problems arise

would probably proceed to implement the traffic changes prior

pocke ts insta l l e d o n S e ptember 4 and 5 at the Broadway inter-
s e ctions o f Oxfo rd ,M ~~sfiel d , Ke n y on and Dartmouth. Mr. Dial
s tate d t ha t a cc i dent s a t similar locations had been reviewed

t ion s were not n eede d at th e s e inters e ctions. Mr. Dial stated
that t he alte r nati ve s as he saw t hem we r e t h e following:
1. To r e turn to t he state wh ich previously existed
to S e ptember 4, 1969; i.e., with no stacking lanes but left
t urns allowed. Mr. Dial stated that this was the situation
in which ~he high number of accidents had occurred.
2. To allow through traffic at these intersections
but prohibit left turns. Mr. Dial stated that the high volume
of left turn movements at these intersections indicated that
a number of neighborhood residents were using them as access
to their homes.
3. Re duce the size of the pocket and, therefore,
restore parking space. Mr. Dial stated that presently the
size of the pockets were such that a sharp turn into them was
necessary and that this would probably aggravate the sharp
turn situation.
4. To lopside the lanes through the area and prohi-
bit parking only on one side of the street. Mr. Dial stated
that this would shift the no parking restriction to one side
from the other .
5. To widen streets from U.S. 285 to Quincy, which
would cost $106,000 and to widen the downtown area north to
Yale which would cost $100,000.
City Council discussed the problem.
Mr. Ed Draper, 4900 South Lipan, whose business is
located at 3673 South Broadway, appeared before City Council.
Mr. Draper requested additional information on the widening
of South Broadway in the vicinity of his business and reiterated
h is suggestion made at the September 15, 1969 meeting that a
spec ial zone be created for businesses without parking, there-
f or e , reducing property taxes.
Di s cuss ion continued. At the conclusion of discus-
sion i t was d e t e rmined that a meeting between the owners,
tenan ts , an d o ther pe rsons involved be established to discuss
t he l ef t h and turn-no p ark ing problem.

Mr. Dial stated that the cost of this construction would be
approximately $8,000 and that Mr. VonFrellick had indicated
his willingness to bear a port ion of the cost on a number of
previous occasions although a formal agreement had not been
drawn . Mr. Dial stated that now, however, Mr. VonFrellick
stated that he did not intend to participate in the cost of
the project . Mr. Dial reviewed various correspondence between
the City of Englewood and Mr. VonFrellick concerning the
Cherokee extension and indic a ted that he would write a letter
to Mr. VonFrellick calling his attention to these items .

Councilmen Dhority and Kreiling reported on the
Englewood-Littleton-Fort Logan Bus Line Commit tee meeting with
the Cities of Sheridan and Littleton and Mr. Herbertson on
October 6 , 1969 . Mr. Kreiling stated that it was Mr. Herbertson's
desire to sell the bus line to the City of Englewood or for the
cities to establish a subsidy whereby Mr. Herbe rtson would not
suffer additional loss. Mr. Herbertson stated that if the latter
approach were taken a new bus should be purch as ed for the opera -
tion.

discussion and pointed out that the City had until Janua ry 1,
1970, the expir ation of the current contr a ct with Mr . Herbertson,
to make a decision and take action.

Dear Mr. Ha ase:
This will acknowledge receipt of your letter dated October 15, 1969,
in which yo u denied our request to approve the restoration of left turns
for eastbound State Highway 285 traffic Into West Hampden Avenue at
South Bannock Street. Receipt of your letter was timely in that I was
able to present copies of it to the City Council at their regular meeting
on Monday , October 20, 1969 , prior to their consideration of the
initiative ordinance regarding left turns at this Intersection and two-
way traffic on Hampden Avenue.
After considerable discussion, the City Council passed the ordinance
on final reading. We expect this ordinance to be published on Oc tober
23, 19G9, and to become effective thirty days thereafter.
Mr. John Criswell , Ci t y Attorney, has indicated to me that It s the
respons ibility of the City Manager to carry out and implement the
policies of the City Council, including ordinance enactments . unless
otherwise directed by the City Council or the Courts . I mu t , there-
fore, take steps to changE' the signs at this Intersection in s cb a
manner a s to allow turns pursuant to the ordinance unless t he courts
or C ity Council direct me to do otherwise .

SUBJECT: ADDITIONAL COST INFORMATION OF SERV1CENTER
Since our last meeting regarding the Servicenter bids, the low
bidder, Rob Roy Construction Company, has developed additional
coat information baaed upon the use of a metal roof system, and
other modifications. These have been reviewed by the architect,
Kells Waggoner and myseU, and we have reached certain con-
clusions.
The attached information was developed by Mr. Roy. U you will
note, the second page of Information he has provided us iDdicates
that the savings by using a metal roof system will be almost
$19,000. The first page lists a number of posstble.cost adjustments
from the baste bid price. U all of them were to be accepted, the
total construction cost would be $183,151. Mr. wagooer and I are
in accordance with all of the listed price and work cba.nges with the
following exceptions:
1. Item No. 7 should be changed so that an epoxy material
would be used on the walls with a correspolldeot cost
tDcrease to us of $130. (This would cause the deduct
figure to be $1,383.)
2. Item No. 11, which Involves the deletion of ntDe wiDdows
should not be accepted. We feel that the retention of the
windows is important from a lighting point of view and
particularly from a c omfort point of view with the elimi-
nation of air conditioning. (This deduction of $459 would,
therefore, not be taken.)
3. Item No. 24 regarding the deletion of gasoline storage
may or may not be feasible. We are investigating this,
and feel this deletion should be taken ooly U we a re cer-
tain that it will in. no way jeopardize our ablllty to seek
valid, periodic, competitive bids on gasoltDe purchases.
U the abov e changes in Mr. Roy's list are made , the probable con-
tract price would become 1 6 , 730. This cost is ten per cent (10 %)
gr eate r than th 170,000 estimate we have been using . In addition
to this, app roximately 20,000 additional expeod!tures will be re-
qui r ed In connection with oth r work to be done at the site and pro-
fess ional s rvi es , bringing the total c onstruction cost to $206,7 30 .
This is in ex ess of th appropriation of 190,000.

W e have committed to the Department of Highways to give possession
of our present street shop on March 1, 1970. Mr. Roy indicates that
construction of this building as now being considered would require
four months. If Council acts favorably on a contract with Roy Con-
struction Company as early as October 20th, this will barely allow the
minimum required time for construction by March lat. Proceeding
with the present physical arrangement of the building has the advantage
of growth flexibility and enlargement for the future. The additional
fuDds would need to be transferred from other expenditures or covered
by additional revenues. Tbe Colorado Department of Highways will be
paying the City nearly $20, 000 more for the present street shop than
the amount anticipated in the Manager's Recommended Budget for
1970.
Therefore, it t.Jiae recommendation of the City Manager and Director
of Publtc Works that the llammittee fav ·orably consider recommending
to tbe City COUDCll a contract essentially along the lines and at the
c011ta outlined above, and request the administration to work out fiJal
detaUs on the cmtract with a report to be presented to Council oo Mon-
day evemiDg, October 20th.

At a Special Meeting of the City Planning and Zoning Com-
mission on October 11, 1969, the Planning Commission con-
sidered the requests which, in their opinion, should be
referred to the Arapahoe County Commissioners to be included
in the official Arapahoe County request to the Highway Com-
mission for the 1970-71 Work Program.
The Commission considered the pertinent information before
them which included the projects which have been studied
and recommended in previous years, and in addition, the
pattern of growth and development in the southern metro-
politan area and the effect of this growth and development
upon the City of Englewood. It was upon the basis of
this study that the Commission has reaffirmed their recom-
mendation on certain projects such as the Sout'h Broadway-
U.S. 285 interchange, the designation of South Clarkson
Street as a State Highw~y · south of U.S. 285, and the extension
of West Quincy Avenue west of South Santa Fe Drive, etc.
However, even though not wanting to detract from the im~
portance of any of these projects, but rather wanting to
place emphasis upon what they feel is the most urgent under-
taking, the Commission designated the improvement of South
Santa Fe Drive as the number one priority in their recom-
mendation.
With these very brief general comments, the attached recom-
mendation is submitted for the Council's consideration .

OF THE CITY PLANNING AND ZONING COMMISSION.

S BJECT: Colorado Highway Department 1970-71 Work Program
RECOMME DATION:
After onsiderable discussion, it was the opinion of the Commission
that the f ollowing projects should b e referred to the Arapaho e Count y
Commissioners to b e included in t heir request to the Colorado Highway
Commi ssio n for the 1970-71 Work Program:
I. Upgrade South Santa Fe Drive to the standards of a major arterial ,
acquiring whatever additional right -o f-way is necessary to accom-
modat e at least six lanes for through traffic, a turning and
stora ge lan e, and acceleration and deceleration lanes at locations
n ecessary to s e rve major traffic generating facilities such as the
Cinderella City shopping complex in the vicinity of West Floyd
Avenu . Th e intersections at West Dartmouth Avenue, West Oxford
Av e nu , West Quincy Av en u e, West Tufts Avenue and West Belleview
should be improved immediately, with any necessary modifications at
th e intersectiou with U.S. 285.
II . Th e f undin g for d etailed engineering studies for the Columbine
Fr eeway, for the acquisitio n of right-of-way and for the construc-
tion of the Freeway.
(Both projects identified in No. I and No. II are necessary to serve the
r apidl y increasing growth and d eve lopment within this southwest quadrant
of th De nv er Metropolitan Area).
lii. Funding for the completio n of the interchange at South Broadway
and U.S. 285.
IV. Th d sig nation of South Clarkson Street as a State Highway from
U.S . 285 to Littleton Boulevard , and thence west on Littleton
Boul vard from its intersection with Soutb Clarkson Street to
1ts int rsection with State Highway #87 (South Broadwa y).
(This str t involves four jur isdictions: Englewood, Littl eton, Cherry
Hills and Gre e nwood Village. It is needed to provide necessary addition-
al nor th-so uth access between South Broadway and South University
Boulev ard) .

not only for the motorist, but for the pedestrians who must ross
th highway.

List of expenditures for September 1n t he amount of $1, 237. 73 was presented for
approval. Lay moved, Allen seconded, that these expenditures be approved as presented

In reportln.,. the progress of Centennial Park, Mr. Romans informed the Commission
that St-.trgeon Electric failed to complete tbe lighting tnstalbtioo by time scheduled which
held U!> other construction and the seeding. This will make it necessary to release Keeson
from his &Uarnnt~e because the seeding will be at least one week later than specified 1n tbe
contract. The lighting instnllation is now 98% completed.
The Director r e commended that appltcatlon be made to the Land & Water Conaervation
Fw.ld fot· federal aid to compte 3 tbe development of Belleview Park. He presented tbe follow-

which he attended September 15 -19 in Chicago. He stated there were se eral good work-
ahopa and s peakers which he felt were very helpful.

Foundatio Gold Medal Award. Mr. Ro mans is now completing the appU c atl on which will
b e forwiU•ded 800:1.

THE CITY OF ENGLEWOOD, COLORADO, FOR THE YEAR 1970.
WHEREAS, it is the duty of the City Council of the City of Englewood,
Colorado, under the Charter of said City and Statutes of the State of Colo-
rado, to make the annual levy for City purposes for the year 1969 due and
p ayab le in 1970; and,
WHEREAS, it is necessary for an additional special levy to maintain the
Firemens' Pension Fund at a reasonable level; and,
WHEREAS, the City Council has duly considered the estimated valuation
of a ll of the taxable property within the City and the needs of the City for
each of said levies, and has determined that the levies as hereinafter set
forth are proper and wise:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ENGLEWOOD, COLORADO:
Section 1. That there be and there is hereby levied for the year 1969,
due and payable as required by the Statutes in the year 1970, a tax o~
mills on the dollar for the General Fund of the City of Englewood, Colol'ado.
Section 2. That there be and there is hereby levied for the year 1969,
due and payable as required by the Statutes in the year 1970, a tax of~
of a mill on the dollar for the Firemens' Pension Fund of the City of
Englewood, Colorado.
Section 3. That there be and there is hereby levied for the year 1969,

for the Public Improvement Fund.

1-1. Ci t y Property. All trees, s hrubs ,
e ve r y descri ption or portions the reof locat ed , standing or growing
within or upon the a reas of any s treet, alley, avenue , public place or
right-of-way belonging to the City are by v irtue of such location
property of the City.
1-2. City Forester To Supervise Planting, Pruning, Etc . The City
Manager shall designate an employee of the City to be known as City
Fores ter, whose powers and duties are hereaft e r specified . The
City Forester shall h ave the power to promulgate rules, regulations
a nd specifications for trimming, spraying, remova l, planting, pruning
and protection of trees, shrubs, vines, hedges and other pla nts upon
the public right-of-way of any street, alley, sidewalk or other public
place in the City.
1-3. Property Owners Responsibility For Public Right-of-way. It
s ha ll be the res ponsi bility of the owner and agent of any property ad-
jacent to any public sidewalk, street, avenue , highway or a lley to
maintain, trim, spray, remove, plant, prune and protect all trees,
s hrubs , vines, hedge s and other plants located upon such public right-
of-way, and, hereafter, all rules a nd regulations specified in this
ordinance pertaining to the responsibility of owners and agents for
care, trimming, spraying, removing, planting, protecti ng, etc . and
the c o s t, therefore, s hall extend to and include any public sidewalk,
street, avenue, highway or alley a djoining or adjacent to s uch
property .
1-4. Authori zation Required For Planting In Or Removal From Public
Are as . No shade or ornamental tree, plant or s hrub shall be planted
in or removed from any public place, street, alley, avenue, park or
right-of-way until all matters pertaining to the planting or removal,
a s the case may be of such tree, plant or shrub, shall first have been

approved by the City Forester or until the place where it is to be
planted or the manner of its removal shall have been designated by the
City Forester and written authorization has been granted, therefore,
by the City Forester .
1-5. The City Forester Regulates Spacing of Plantings. It shall be
unl awful to space trees, shrubs or other plants upon the public right-
of-way or any other public place within the City other than as prescribed
in the rules and regulations promulgated by the City Forester.
1-6. Unlawful To Injure, Destroy Plants, Etc. It shall be unlawful
for any person to injure , ruin or destroy any tree, shrub, plant, flower
bed or grass plot on any parkway, street or public property and no per-
son shall pluck, pull away or take away any flow er , tree or shrub from
any park, street or other property of the City.
1-7. Unlawfu l To Plant Certain Trees, Shrubs, Etc. It shall be unlaw-
ful to plant or set out upon any property within the City female cotton-
wood trees (populus deltoides -female), female silver leaf popl a r trees
(populus alba) or box elder and the planting or setting out of the same is
hereby declared to be a menace to public health, safety and welfare and
a public nuisance.
1-• Inspection: Notice In Case Of Disease. The City Forester may
enter upon any premises without warrant or to inspect all trees, shrubs
and plants within the limits of the City. Upon discovering any infected
trees, s hrubs or plants, the City Forester shall at once notify the owner
or agent of the premises whereon the same is located of the condition
found and shall direct such owner or agent by notice to remedy such
c ondition within ten (10) days.
1-9 . Inspection: Notice In Case Of Dead Or Dangerous Plant. The
City Forester may enter upon any premises without warrant to inspect
all trees , s hrubs and plants within the limits of the City. Upon dis-
covering any dead trees, shrubs or plants or overhanging or broken
boughs dangerous to life, limb, property or roots causing damage

to a ny public sidewalk, curb, gutter , str eet or public improvement,
the City Forester s hall at once notify the owner or agent of the
premises wh ereupon the same is lo cat ed of the condition found and
s hall direct such owner or agent by notice to remedy s uch condit ion
w ithin ten (10) days .
1-10. Inspection: otice Tn Case Of Infected Wood Pile. The City
Forester may enter upon any premises without warrant to inspect
all wood piles or accumulations of trees, logs, s hrubs a nd other
plants with i n t he limits of the City whether such trees, logs, shrubs
or plants a re for sale or not. Upon discovering any infection insects
or diseases ha rbored wi thin such wood pil e or a ccumulation of plant
matter, the City Forester shall at once notify the owner or an agent
of th e premises whereupon the same is located of the conditi:on found
a nd shall direct such owner or agent by notice to remedy such con-
dition wi thin ten (10) days.
1-11. City Forester's Power To Trim, Remove, Etc , Th e City
Forester shall have the po wer to have caused , at the owner or
agent's expense , plus fifteen per cent (15 %) for administration fee s ,
the trimming, spraying, removal, planting or whatever measures
are necessary to correct such condition for which notice was pro-
vided , if s uch condition is not corrected within s uch time as pro-
vided within such notice, Tn event such owner or agent fails to pay
s uch e xpense plus fifteen per cent (15 %) for administrative fees,
s uch e xpense, plus twenty -five per cent (25 %) of such expense, shall
be recovered by the City from the owner of such property through
special assessment on that property .
1-12. Emergency Notice To Correct Condition . Tn the event the
City Forester finds a condition involving a tree, shrub or other
plant which constitutes Immediate threat to life, limb or property,
the City Forester shall have authority to Immediately have caused
correction or remedy to such condition at the owners or agent s' ex-
pense without administrative fee. Tn event such owner or agent

fails to p ay fo r s u ch expense, such expense plus fifteen per cent (15 %)
of such expense shall be recovered by the City from the owner of such
property through special assessment on that property.
1-13. Removal Of Trees, Shrubs Or Plants Due To City's Special
Improvement District. In the event the removal of any tree, shrub,
vine , hedge or plant is necessitated by a City paving or sidewalk dis-
trict, the expense of such removal will be borne by the City, not sub-
ject to recovery from the owner or agent of the property unless such
tree, shrub, vine, hedge or plant was planted or placed without written
permit from the City Forester after the effective date of thi s ordinance .
1-14. License Required For Care And Remova l Of Trees , Etc. It
shall be unlawful for any person, firm or corporation to engage in the
bus ines s of planting, cutting, trimming, pruning, removing or spraying
trees, shrubs, vines or hedges within the City without further procuring
a license, therefore, from the Director of Finance. No such license
shall be issued without the written a pproval of the City F orester who
shall first be satisfied of the competency of the applicant to engage in
such business as indicated by an examination conducted by the City
Forester, either oral or written. Prior to issuance of such license,
the a pplicant shall post bond in the sum of Five Hundred Dollars ($500)
with s urety to be approved by the Director of Finan ce for the payment
of a ll fines, penalties and costs that may be adjudged against such
licensee for violations of the City Code and for the purpose of indemni-
fyi n g the Ci t y of Englewood or other person from loss or damage re-
sulting to any person or property by the negligence of such licensee.
Such license s hall be issued for a period of one (1 ) year a nd expire on
the thirty-first day of December following its issuance . The licensee
fee shall be Seventy-Five Dollars ( 75) per year, or fraction t hereof,
payable in advance . Any such license may be revoked by the City
Council after hearing upon a showing that such licensee has violated
the rules and regulations of the Ci t y Manager, City Forester or any
provision of any City ordinance •

1-15. City Forester Provides standards Of Worlrmansbip To Licensees .
The City Forester shall develop and provide to all licensees copies of
standa rds of worlrmansbip required by the City for tree trimming, tree
removal, spray applications, safety requirements and other such rules
and regulations governing the business of planting, cutting, trimming,
pruning, remova l or spraying trees, shrubs, vines or hedges within the
City. Violation of any provisions of these standards of worlrmanship
provided by the City Forester shall provide sufficient cause for a bearing
b y the City Council.
1-16 . Protection Of Trees From Wires. No person shall attach any
electric insulator or any device for the holding of electric wires to any
live or dead tree or plant. Every person having any wire charged with
electricity running through a public place shall securely fasten such wire
to a post or other structure so that it will not come in contact with any
tree or plant therein and every person shall, when, and if, the City For-
ester deems it necessary in order to prune or cut down any trees growing
on or in any public property, temporarily remove such wire or cut off
electricity within twenty-four (24) hours after service upon the owner
of the wire or his agent of a written notice signed by the City Forester
to remove such wire or cut off the electricity.
1-17. Protection Of Trees From Gas Leaks. In the event that a leak
exists or occurs in a gas pipe or main within a radius of forty feet (40')
from any tree, it shall be the duty of the person owning or operating such
defective pipe or main to repair the same immediately and stop such
leak.
1-1 • Interference With City Forester. No person shall in any way
interfere or cause any person to interfere with the City F orester or
hi s repre ntatlve in or about the performance of his duties as defined
within the City Code .
