A RESOLUTION DECLARING THE INTENT OF THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD , COLORADO, TO APPROVE THE WHOLE COST
OF THE IMPROVEMENTS MADE IN AND FOR SIDEWALK IMPROVEMENT
DISTRICT NO. 69 IN THE CITY OF ENGLEWOOD, COLORADO; TO APPROVE
AND CONFIRM THE APPORTIONMENT OF SAID COST TO EACH LOT OR TRACT
OF LAND IN SAID DISTRICT; TO ASSESS A SHARE OF SAID COST
AGAINST EACH LOT IN THE DISTRICT; ESTABLISHING A DATE AND
PLACE FOR A PUBLIC HEARING UPON THE ASSESSMENT OF SAID COSTS
AND ORDERING PUBLICATION AND MAILING OF NOTICE THEREOF TO
THE OWNERS OF PROPERTY TO BE ASSESSED WITHIN THE DISTRICT;
AND TO APPROVE THE COMPLETION OF SAID DISTRICT.
WHEREAS, th e City Council o f th e City of Engl e wood,
Colorado, pursuant to the Charter and Ordinanc e No. 14, Series
of 1965, of said City and the Laws of the State of Colorado,
enacted Ordinance No. 28, S e ries of 1969 creating Sidewalk
Improvement District No. 69, and providing for the construction
therein of sidewalk improvements; and
WHEREAS, the construction of such improvements has
been completed and the total costs of such improvements have
been reliably ascertained.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD , COLORADO, as follows:
1. That, subject to the provisions and conditions
contained within the Charter of the City of Englewood, Ordi-
nance No. 14, Series of 1965 , and any applicable statute,
City council hereby declares that it is its intent to approve
the whole cost of the improvements made in and for Sidewalk
Improvement District No. 6~ to approve and confirm the appor-
tionment of said cost to each lot or tract of land in said
District and to assess a sh a r e of said cost against each lot
or tract of land in t h e District , and to approve the complet i on
of said district.
2. That a publ ic he ar i ng upon said assessments will
be held before City Council at City Hall, 3400 South Elati,
Englewood, Colorado, to c omm e nc e at 8:00 o'clock p.m. on
Monday, February 16, 19 70 , and t h a t notice of the proposed
assessments be given b y t he City Cle rk and published in the
Englewood Herald and En te r prise, a n e wspaper published and
of general circulat i on i n said City , in three consecutive
weekly editions, the r e in g i ving Notic e to the owners of th e
property to be asse ss ed of t he matters and things required by
law. At or about t h e time o f t he f irst publication, Notic e
shall also b e give n b y prepa i d mail to all known owners of
property to be ass essed with th e cost of said improvement s.
3 . The Notice to be p ublished shall b e i n s ub -
stan tially the fol lowi n g form :

All owners of real estate and property located in
Sidewalk Improvement District No . 69 created by Ordinance No.
28, Series of 1969, City of Englewood, Colorado, and all persons
generally, are hereby notified that the construction of the
improvements for Sidewalk District No. 69 has been completed
and the costs thereof have been ascertained, and that the City
council is of the intent to approve and confirm the apportion-
ment of said costs to each lot or tract of land in said
District; to assess a share of said costs against each lot or
tract in said District; and to prescribe the manner of collection
and payment of said assessments; and that the City Council
at its regular meeting on January 19, 1970 adopt ed a resolution
setting forth its intent to approve said costs and assessments.
Said persons are further notified as follows:
(a) The whole cost of said improvements is the sum
of $14,063.31.
(b) Of said sum of $14,063 .31, the City of Englewood
will pay $4,169.91, leaving a balance of $9,893.40 to be
assessed against the real property in said District.
(c) The sum of $9,893.40 will be apportioned to
the real property in said District and assessed as follows:

(d) Any person desiring to make any complaints or
objections to said costs or assessments may make said objections
or complaints in writing and submit said objections or complaints
to the City Clerk within twenty days from the first publication
of this Notice and a public hearing thereon will be held before
the City Council on Monday, February 16, 1970 at 8:00 P.M. at
Englewood City Hall, 3400 South Elati.

JANUARY 19, 1970
REGULAR MEETING:
The City Council of the City of Englewood, Arapahoe
County, Colorado, met in regular session on January 19, 1970 at
8:00 P M
Mayor Schwab, presiding, called the meeting to order .
The invocation was given by Reverend Francis Kappes of
the All Souls Catholic Church. Pledge of Allegiance was led by
Boy Scout Troop No. 154.
The Mayor asked for roll call . Upon the call of the
roll, the following were present :
Councilmen Brown, Dhority, Kreiling, Lay, Senti, Schwab.
Absent: Councilman Lone.
The Mayor declared a quorum prese nt.
Also present we re: City Manager Dial,
City Clerk Lyon.

COUNCILMAN LAY MOVED, COUNCI LMAN BROWN SECONDED , THAT
THE MINUTES OF THE REGULAR MEETING OF JANUARY 5, 1970 BE APPROVED .
Upon the call of the roll, the vote resulted as follows:
Schwab.
Ayes: Councilmen Brown, Dhority, Kreiling , Lay, Senti,
Nays: None .
Absent: Councilman Lone.

Note: Mr. M. M. Summers, 3140 South Delaware, was
scheduled to discuss pornographic films being shown in the City
of Englewood but was not present.

the Snorkel Fire Truck be dedic a ted as a memorial to Douglas c.

Lions Club wished to place plaques on the Snorkel setting forth
this dedication .

WHEREAS, the City Council of the City of Englewood,

Improvement District No. 69, and providing for the construction
therein of sidewalk improvements; and
WHEREAS, the construction of such improvements has
been completed and the total costs of such improvements have
been reliably ascertained.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD, COLORADO, as follows:
1. That, subject to the provisions and conditions
contained within the Charter of the City of Englewood, Ordi-
nance No. 14 , Series of 1965, and any applicable statute,
City Council hereby declares that it is its intent to approve
the whole cost of the improvements made in and for Sidewalk
Improvement District No. 6~ to approve and cohfirm the appor-
tionment of said cost to eac h lot or tract of land in said
District and to asses s a share of said cost against each lot
or tract of land in t he District, and to approve the completion
of said district .
2. That a publi c hearing upon said assessments will
be held before City Council at City Hall, 3400 South Elati,
Englewood, Colorado, to comm e nce at 8:00 o'clock p.m. on
Monday, February 16, 1970, and that notice of the proposed
assessment s be gi ve n by the City Clerk and published in the
Englewood He r a l d and Enterprise, a newspaper published and
of g ene ral ci r cu latio n in said City, in three consecutive
weekly edi tion s, ther e in giving Notice to the owners of the
prope r ty to be a ssessed of the matters and things required by

Counc il a n d reviewed the increase in gas f r anchise rat es with
City Counc1l. Mr . Rust stated that the electric f ran chise rat e
would r ema1n the s ame wh ile the gas franchise rat e would be
increased from two per cent to thr ee pe r cent . This would result
in the City r ecei v i ng approximately $37,000 more a ye ar. Mr.
Rust stated that this was the s a me rate as the De nver f ranchise
and that the franch1se checks would be delive r ed fou r times a
year .

City Attor n ey Berardini indic ated that a numb er of
legal decisions affect i ng the City of E ngl e wood had been received
and that he wished to review these with City Council at an i n fo rmal
session.
A study sessi on for January 26, 1970 was established .

City Manager Dial presented the estimates for Paving
District No . 19 and a list of proposed streets . Mr. Dial
indicated that in all ye ars prior to 1969, fisc al agent ser-
vices had been obtained from a Colorado bond house. However,
in 1969 due to the high bids received and the lack of competi-
tion in the bids, fiscal agent services had been accomplished
by the Department of Finance. Mr. Dial indicated that the
Department of Finance would again perform this function for
Pav~ng D~s rict No . 19.
I was the consensus of City Council that a review
and decis~on of the streets to be included in Paving District
No. 19 be reached at he January 26, 1970 study session.

City Manager Dial indicated that right of way acquisi-
tion would be necessary upon two streets proposed for Paving
District No. 19. Mr. Dial briefly reviewed the right of way
required.

City Manager Dial indicated that a public hearing by
the Colorado Department of Highways would be held on January
7, 1970 concerning the proposed alignment of Interstate 470.
Mr. Dial discussed the various alternate routes which would go
by the McLellan Reservoir property. Mr. Dial stated that it
was his recommendation to Council that the City Council recom-
mend the I470 alignment which would parallel the south shoreli ne ·
of McLellan Reservoir.
It was the consensus of Co uncil that this recommendation
be accepted .

City Manager Dial stated that Mr. Lyon, Director of
Finance, had requested that Mr. Hugo T. Ruggiero, Purchasing
Agent, be allowed to attend a Purchasing Management Seminar in
Tempe, Arizona from February 15 to 20, 1970. Mr. Dial indicated
that the cost of the Seminar would not exceed $500 .
COUNCILMAN KREILING MOVED, COUNCILMAN LONE SECONDED,
THAT THE OUT-OF-STATE TRIP OF MR . HUGO T, RUGGIERO, PURCHASING
AGENT, TO ATTEND THE PURCHASING MANAGEMENT SEMINAR IN TEMPE,
ARIZONA FROM FEBRUARY 15 TO 20, 1970 BE APPROVED AND THAT THE
COST OF SAID TRIP NOT EXCEED $500 . Upon the call of the roll,
the vote result ed as follows :
Ayes : Councilmen Brown, Dhority, Kreiling, Lone,
Senti, Schwab.
Nays: Councilman Lay.
Absent: None.

City Counci l discussed the enlargement of the Bus
Commi ttee by one member . After discussion, Councilman Senti was
appointed a s a third City Council member of the Bus Committee.

City Manager Dial indic at ed that a dinner honoring fo rmer
City Attorney John A. Criswell would be held on January 7, 1970
at Columbine Country Club at 6:30 P .M.

City Manager Dial indicated that the projected year
ending balance in the General Fund had been $77,000 and that the
actual balance was in excess of $101,000.

Mayor Schwab indicated that the City Council resolution
concerning the construction of the Mount Carbon and Chatfield Dams
had been received by Colorado Senators and Representatives.

councilman Dhority wondered why the automatic renewal of
liquor licenses could not be accomplished without the involvement
of City Council if there were no police problems with the outlets
during the year.

Councilman Brown discussed his negative vote on the
appointment of the Englewood Herald as the official City news-
paper and inquired of City Attorney Berardini whether the City
of Englewood could have two official newspapers.

Mayor Schwab inquired as to what would be required to
change the term of office of the Mayor from two years to one year.

Mrs. Romans stated that Mr. Pettitt and Mr. Machol, counsel for the
owner of the present Payton Park, have indicated that their plans for
Mr . Pettitt's proposed mobile home park are not yet ready, and they
will plan to attend the Commission meeting in January.
IV. PLANNING COMMISSION-CITY COUNCIL MEETING.
The matter of a joint C1ty Council-Planning Commission meeting was
discussed. Mrs. Romans asked Councilman Lone if the matter was discussed
at the Council meeting December 15 , 1969? Mr. Lone stated that it had
be e n, and that it was felt that it might be better to wait until Council
appointments to the Commission had been made. Further discussion
followed.
Mr. Parkinson entered the meeting .
V . NEW BUSINESS.
Mrs~mans rev1ewed items that will be considered at the meeting on
January 6 , 1970, and reported on the progress of the Land-use Report.
VI. CITY COUNCIL ACTION.
Mr . Lone reported that the City Council had agreed to participate in
the cost of the remod ling of the Denver Regional Council of Governments
headquarters, but only if sufficient numbers of other jurisdictions
participated, thus assuring that the remodeling would be completed.

Mr . Murp hy advised the Board o f the mo vements of the
employee groups in Auro ra and Denver and suggested that there
be close communication between the City Council , the Career
Service Boa rd, the City Manager and the Personnel Director .

In the latter part of 1969 Arapahoe County collected money
on three defaulted special districts: Sanitation District
No. 1, Water Main District No. 1, and South Broadway Paving
District No. 1. These three districts were formed during
the 1920's and went into default on their bonded debt.
When these districts went into default, tax certificates were
issued to the City of Englewood. These certificates have
since been lost. In order for Arapahoe County to pay the City
of Englewood the $1,390.41 due on these certificates, the
County is requiring that an affidavit be executed by the Mayor
and attested by me. The affidavit states that the tax certifi-
cates were lost and that should the tax certificates be found
and rightfully possessed by a party other than' the City ot
Englewood, said city will save and hold Arapahoe County harmless .
It is recommended that the Mayor be authorized to execute the
affidavit. The $1,390.41 is probably the most money we have
collected on the defaulted districts since the early 1950's.
Unfortunately, we will probably collect nothing elae.

Novembe r 17 through 21, 1969
The Introductory Course in Systems Analy s is )Has sponsor ed b y
the U.S. Civi l S ervice Commission, San F ranci sco Region.
Approximately thirty individuals participated. The course
itself was taugh t by a systems engineering firm based in Palo
Alto , California. Each morning was devoted to lecture, and the
a fternoon was devoted to application of the items covered in
the lecture to te am problems. The following points were covered
in the lecture .

Overall, I was pleased with the course and have b een abl e to

On Wednesday, January 7 , 1970, Mayor Elmer Schwab and I me t with Cordell Smith
in Governor John Love's Adminis t rati ve Office regarding a proposed, new program
under the Highway Safety Ac t dealing with special alcohol safety enforcement.
At this mee ting i~ was described to us that a nev program vas under vay with a
date of July 1, 197 0, being the target date for commencement concerning the
participation of the various law enforcement agencies in the Denver metropolitan
area dealing wi th t he special alcohol safety enforcement problems.
We were requested at t hi s meeting to review the various aspects of the program
and to indicate by letter this city's intention to particip&te if, indeed, it
vas our decision to do so. Also to prepare and submit along with our letter
of intention to participate a proposed budget outlining the cost to the community
to initiate this program which would be funded 100 percent by the federal
governmen t . The program is to be a full three-year program and all costs incurred
by the community in participat ing would be financed 100 percent by the federal
governiTien t.
We would propose to have t his p rogram in effect seven days week ly, throughout
t he i ntended three-year p eriod. The tentative hours of coverage would be -
one officer on duty between the hours of 7:00P.M. and ):00 A.M., Sundays, Mondays,
and Tuesdays and Wednesdays, with two officers on Thursdays, Fridays, and Saturdays,
with the hours ext ended on the latter three days, which covers t he weekends with
more traffic problems. These officers shall be special alcohol safety enforcement
and accident inves tigation officers, and shall give emphasis and priorty to
special alcohol safe ty enforcement over the other aspects of t r affic safety
enforcemen t system . This capability shall include -
1 • Assignment of personnel and operating equipmen t and procedures to
ins ure the apprehen sion of drivers suspected of alcohol related
offenses. The procedures will i nclude as a minimum-
a. Use of breath screaning test
b. Special enforcement e fforts at times and places where the
great es number of accidents and alcohol rela ed of fens es
occur , and a t frequent intervals in areas surrounding alcohol
beverage e s a blishments.

2 . Operating procedures to insure app rehension and surveilance of
persons whose driving privileges have been revoked or restricted
as a result of an alcohol related offense, or as a result of an
alcohol re'lated disability or unfitness to drive.

testing equipment and in other alcohol safety enforcement measures.
u. These efforts will be directed to insure that to the ext~nt practicable
there are quantitative tests for alcohol.

a. On all drivers involved in accidents or arrested for vehicle code
violations for whom there are reasonable grounds to suspect that
they ~ave been driving while intoxicated.
b. On the bcidies of all drivers and adult pedestrians who die within
four hours of a traffic accident.
c. On all surviving drivers in accidents fatal to others.
To conduct a public information and education program concerning
the alcohol related accidents and a preventive program.

On several oecaelons over the past year some confusion has arisen In
regard to the applicability of the provisions of the City Charter (Sectlou
111-118) covering purchasing.
REQUJIITIONS:

placing a requlaltlon for the Items desired with the Pur-
cbastng Agent In the Department of Finance . In tum, he
wtll make the necessary contact& with the vendor and place
the purchase order. Upon plaolnl the requisition with the
Purcbaalng Acent, the department head Is Invited to aub-
mlt Information regarding particular auaested vendors
and particular product linea, lncludlnc particula r standards
or speclftcat~a. and the desired delivery dale .

The undersigned, being the Mayor and Clerk of
the City of Englewood, State of Colorado deposes and aayaa
1. The City of Englewood is the record holder of
Tax Sale Certificates issued by the Tr~asurer of Arapahoe
County, State of Colorado, which Certificates are
numbered 31982, 31983 and 31984.
2. The City of Englewood received from Paul W.
Wolf, Treasurer of said Arapahoe County, a notice that
said Tax Sale Certificates have been redeemed in the
total amount of ~1390.41.
3. The City of Englewood after thorough and
diligent search cannot locate said Tax Sale Certificates.
4. The City of Englewood affiant has not sold or
otherwise transferre~ said Certificates.
5. The City of Englewood has searched all of ita
own recorda and files very thoroughly and cannot locate
said Certificates.
6. The City of Englewood will save and hold the
Treasurer of Arapahoe County harmless from any claims
which may be made by any other person claiming ownership
of said Tax Sale Certificates, and shall refund in
accordance with C.R.S., 1963, 137-12-12, as amende~, the
above mentioned money to the Arapahoe City Tr~asurer
with 25~ per annum interest thereon, if any person shall
thereafter show his right to the above mentioned Tax
Certificates.
