The City Council of the City of Englewood, Arapahoe
County , State of Colorado, met in special session Monday,
January 26, 1970 at 8:00 P.M.

MONDAY , JANUARY 26, 1970 -8:00 P.M.
The City council of the City of Englewood, Arapahoe county,
Co lorado, is hereby called to a special meeting in the City
Hall, 3400 South Elati Street, to consider passage of an
ordinance amending the Retail Sales and Use Tax to clarify
that said tax is applicable to purchases by national banks.

Colorado, do hereby acknowledge receipt of Notice of the above

Mayor Schwab, presiding, called the meeting to order
and asked for roll call. Upon the call of the roll, the following
were present:
Councilmen Brown, Dhorit y, Kreiling, Lay, Senti, Schwab.
Absent: Councilman Lone.
The Mayor declared a quorum present.
Mayor Schwab stated that recent Federal legislation
had removed the sales tax exemption from national banks and that
an emergency bill for an ordinance had been prepared to change
the City of Englewood's Retail Sales and Use Tax to make national
banks taxabl e .

AN ORDINANCE AMENDING SECTIONS l6.5-5(a) AND 16.5-18
(5) OF THE MUNICIPAL CODE OF THE CITY OF ENGLEWOOD, COLORADO,
BY REMOVING ANY EXEMPTION FROM THE CITY RETAIL SALES AND USE TAX
PREVIOUSLY GRA NTED TO NATIONALLY CHARTERED BANKS WITHIN THE CITY
OF ENGLEWOOD, COLORADO UNDER THE AUTHORITY OF ORDINANCE NO. 8
SERIES OF 1968 AND DECLARING AN EMERGENCY.
COUNCILMAN DHORITY MOVED, COUNCILMAN LAY SECONDED,
THAT THE EMERGENCY BILL FOR AN ORDINANCE BE PASSED ON FIRST
READING. Upon the call of the roll, the vote resulted as
follows:
Ayes: councilmen Brown, Dhority, Kreiling, Lay,
Senti, Schwab.
Nays: None.
Absent: councilman Lone.
The Mayor declared the motion carried .
COUNCILMAN LAY MOVED , COUNCILMAN DHORITY SECONDED,
THAT THE MEETING BE ADJOURNED. Upon the call of the roll, the
vote resulted as follows:
Ayes: councilmen Brown, Dhority, Kreiling, Lay,
Senti, Schwab.
Nays: None.
Absent: councilman Lone.
The Mayor declared the motion carried and the meeting adjourned

capacity only; in all sales to the City; providing, however,

organized or chartered BY THE UNITED STATES GOVERNMENT, ANY
AGENCY OR DEPARTMENT THEREOF, or by the State of Colorado, shall
be considered a governmental institution for the purpose of this
exemption.
Section 2. That Section 16.5-18(5) entitled "Items Exempt
From Use Taxes" is hereby amended to read as follows:
Section 16.5-18(5). The storage, use, or c onsumption of

Presently, the amount o f this bond depends upon the size
of the house be ing moved . The houses are divided into five
c la ssifications, from s mall to la r ge , and the a mount of deposit
require d depends upon the class into '"hich the house fall s .
