RESOLUTION NO. 14-A, SERIES OF
A RESOLUTION AUTHORIZING REPLACEMENT OF INADEQUATE
WATER LINES.
WHEREAS, Section 8.7-1 (b) of the Municipal Code of
the City of Engl e wood provides that City Council may construct
a water main of sufficient size to serve an area served by an
inadequate line when, in council's opinion, the present line
is causing an undue hardship upon the users thereof, or the
City; and,
WHEREAS, City Council has, and does hereby, determine
that the lines presently existing in the street hereinbelow
enumerated are inadequate and are causing undue hardships thereby
upon the users thereof and upon the City.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD, COLORADO, that all service connections
to the present lines in the following locations be changed over
to adequate City mains at once, that charges therefor be made
in accordance with the schedules established by City council
by resolution dated July 16, 1956, and that the same be collected
by the Utilities Department of the City:
3000 & 4400 Block on South Elati Street
4000 & 4100 Block on South Grant Street
4000 & 4100 Block on South Pennsylvania Street
4000 Block on South Pearl Street

The attached petitions, asking exclusion from storm
sewer fees and bonds, are quite c o nclusive in expressing the
needs a nd desires of the prope rty owners in the area c ove r ed
by t h petitions.
None of the property ow ne rs contacted by the can-
vasse r s r e fu sed to sign for exc lusi on because of storm water
problems, and tenants contacted c o ncurred, since they, too ,
had n o flo od water problems.
No c o ncerted e Uo rt wa mad e to cover South B road-
way, but those co ntacted were glad to sign up for exclusio n.
The shaded area o n th e attached copy of map, except for Broad-
way as indicated above, reflects the area canvassed.
Wh ere the signers s how as Mr. a nd Mrs., the non-
s igning spouse concurred. If nec essa ry , their respective signa-
tures cou ld be obtained, th ough we believe t he ir inte nt is clearly
expressed .
The canvass was completed in o nly a few days a nd
its purpose was to c learly indicate t o Coun ci l that the areas,
as indicated by the addresses on the a ttached p titions, having
previ u ly acquired a n adequate system without the u se of tax
money or s p ec i a l assessment from areas outs id e of our sto rm
sewer district, now r equ es t exc lusion from all further cost for
the purpose of providing sto rm sewer facilities primarily in
other ar as of Englewood where they may b e badly needed.

It is important to note that the storm sewer outfall
line from this area discharges directly into the Platte River.
We sincerely hope Council will grant the relief re-
quested in these attached petitions so that Council may proceed,
without further delay, toward the development of additional and
adequate facilities elsewhere in Englewood as may be needed
and desired by the people in such areas.
Assuming that each address on Lincoln and Acoma
occupies 37-l/2 foot of frontage, then each block would contain
36 addresses; with the remaining residential area at 50 foot
frontage per address, each block would contain 24 addresses.
On this assumption approximately three-fourths of the property
owners requested exclusion in this residentially zoned area
covered by these petitions.

construction of the improvements in said District has been duly
publ i shed and the contract for such construction has been award e d

Section l. By virtue of and pursuant to the Laws of the

The principal of and interest on said bonds shall

Said bonds shall be signed with a facsimile sig -
nature of the Mayor, sealed with a facsimile of the seal of said

Sec tion 8 . If it shall b e necessary to advance money to
maintain current paymen ts of interest and equal annual payments of
t he principal amount of the bonds is su ed for said Di strict, the
City Council shall levy annual taxes on the taxable p roperty with-
in the City not exceeding two mills i n any one year and sha ll apply
the proce e ds of such t axes for said purpose. In lieu of such tax
levies, the Council may annually transfer to such special fund any
availa ble money of the Ci ty, but in no event shall the amount
transferred in any one year exceed t~e amoun t which would resu lt
from a tax levied in such year as herein limited. Such tax levies
o r transfers of funds shall be mad e in accordance with and pursuant
t o Section 109 of the Charter of said City.
Section 9. Should any p art or provision of the Ch arter
of the City of Englewood, Colorado, or this Ordinan ce , or any par t
or p r ovision of an ordinanc e or the charter of any other City in

equipment as defined herein, to stop, stand, or park such
vehicle or to caus~h vehicle to be stopped, stood, or
parked in any resid ntially zoned area of the city and on
any street adjacen to said residentially zoned area of said
city at any time except When such vehicle is being ex-
peditiously loaded or unloaded, or .obile equipment is
being used to perform the special operation for which it
was designed, on any street or highway, alley, or other
public way within the City of Englewood.
(b) The term or phrase •spec ial Mobile Equipment•
shall f or the purpose of this ordinance have the following
meaning :

otherwise, designed primarily for operation or use

City Manag e r Dial presented a plat of the area . Mr.
Dial state d that the developers indicated that they would diminish
th e problem and that Mr. Kells Waggoner , Director of Public Works,
indicated that he was not sure whether they would or would not
alle viate the problem . Mr. Dial discussed possible alleviations
to the drainage situation.
City Attorney Berardini discussed potential legal
remedies and legal a c t ions which might serve to improve the problem.
Mr. Jame s Slewitzke , 4565 South Julian, appeared before
City Coun cil and stated that the deve loper has changed the grade
above the ar e a and is c ausing problems with the ditch that was co nstruct ed .
It was the c onsensus of City Council that the citizens
in atte ndan ce , the City Manager, and the Director of Public Works
meet with the developer in regard to protecting those properties
with i n the City of Englewood from storm drainage runoff.

Report on Attendance at KU Ci ty Management School,
Lawrence, Kansas
Despite he burning o f the Kansas University Union , the imposition
of a strict curfew and the presence of l a rge numbers of National
Gu a rd , the three day school in munici pal management was held a fter
a rapid r eloc a tion to a loc al motel. The school employed many
small group sessions; and although v a luable information about
l ocal government was i nterchanged, I am limiting this report to
some of the more relevant comments of the speakers.
Mr. Gerald Fox , City Manager , Wi chi ta Falls
Th e City of Wi chita Falls , the University of Kansas, and Booz,
Allen & Hamilton, Inc . are the successful c ontractors with the
Federal Go v e rnment for the development of a computer driven
munici pal i n form a tion system. Mr . Fox discus sed the performance
requirements placed upon the City by the con tract and the various
sta ge s whi ch mak e up the three ye ar p roject . Mr. Fox expressed
his view that the most severe problems which he a nticipates are
those connected with people --the acceptance of the system and
the analysts involved in the initial system des1.gn .

men is involving hose who hav never been con erned before .
These people come from bo h poll. ical ex remes but are primarily

element with only limited success .

also noted that in the United States people c a st their votes
in inverse relation to the votes potential ef fe ct . In a
municipa l election o nly a small percent age of the eligible
voters cast ballots , but the people elected to city government
h a ve the most direct effect upon an individual 's environment.

Wichi t a Falls Project
The other purpose of the KU trip was to study the Wichita Falls
co ntract for a municipal information system . Approximat ely three
days of research and interviews were devoted to this analysis
(and over 20 pages of notes). The information obtained is of
co nsiderabl e value to Englewood 's efforts .

The Election Commission approved the tally of votes
cast in the special elect1on of May 5 , 1970.
Mr . Lyon reported that in three precincts the polls
were opened late due to the individuals who were to open the
buildings not being available. In future elections the ch ance
of this type of problem occurring wil l be reduced by providing
e l ection judges telephone numbers of two people who can open up
the building if it is found that the building is not opened prior
to 6 :30 A .M.
Mr. Lyon reported that the voting machines did not have
the non-property taxpaying elector lockout properly s et upon their
delivery to the polls . This wa s corrected by 1 0 :30 A .M. with
eight non-prope r ty taxpaying elector s b eing allowed to vote on
their honor. Occurrences of this nature will be prevented in
the future by a physical inspection of one or more voting machines
prior to their delivery to the polls .
Mr. Lyon reported that in accordance with an Attorney
General 's opinion of 1967 stating that all liquor outlets must
b closed during a municipal election whether or not candid ates
were involved , all au lets were closed . This caused considerable
dissa isfaction amon g these outlets due to the fact that the
State Liquor Control Division was not disclosing the Attorney
General's opinion and was instead stating that it was purely a
rna t r of lo al option . Mr. Lyon presented a copy of a letter
wr1t n to h Sta e Liquor Control Division expressing his con-
cern abou h failure of that office to reveal the Attorney
General's opinion .

Dear Sir:
April 30, 1970
The purpose of my attending armorer school was twofold -
(1) to train me to be able to maintain the handguns of the
department to a high degree and in a professiQDal manner
that is not available to us except if we rettirn the fire-
arms to the manufacturer, and (2) to give me sufficient
knowledge to be able to recommenq the safest, most durable,
and most economical weapons for our department should the
day arrive that they will be city-furnished equipment.
This training will soon pay for itself in savings on
express charges, and if properly set up the cost of repairs
and parts will be negligible.
At Colt Firearm Industries my training course was con-
ducted by Mr. Don Tedford, Supervisor of Customer Repair.
Mr. Tedford began the course by acquainting me with the
function of the internal parts of the revolver and how each
one depends on the other, what would happen if one was worn
out or out of adjustment and if it needed to be replaced or
could be repaired. He then pointed .out what other functions

The purpose of my attending armorer school was twofold -
(l) to train me to be able to maintain the handguns of the
department to a high degree and in a professiQnal manner
that is not available to us except if we ret~rn the fire-
arms to the manufacturer, and (2) to give me sufficient
knowledge to be able to recommenq the safest, most durable,
and most economical weapons for our department should the
day arrive that they will be city-furnished equipment.
This training will soon pay for itself in savings on
express charges, and if properly set up the cost of repairs
and parts will be negligible.
At Colt Firearm Industries my training course was con-
ducted by Mr. Don Tedford, Supervisor of Customer Repair.
Mr. Tedford began the course by acquainting me with the
function of the internal parts of the revolver and how each
one depend s on the other, what would happen if one was worn
out or out of adjustment and if it needed to be replaced or
could be repaired. He then pointed out what other functions
s hould be checked when parts were checked or added, and also,
what the safety features were of the revolver.

e tc. The la s t phase is what is called "box guns" -these are
g un s that, for one reason or another, had to be repaired and
reblued. Our assignment was to refit them and send them on.
Mr. Grondalsk i was at all times available to us for any
questions or h e lp that was needed.
Mr. Grondalks i and his supervisor, Mr. Dub i a, and Mr. Davis
have worke d out a v ery f ormal program along wi th written
material that is re t ained by the student to be used as future
refer e nc e . Th is ma t erial is so written that it can only be
util ized by th ose wh o hav e attended the school. When you
h a v e sa t isfactorily comp l eted these courses you also receive
a n a r morers certificat e .
Em phasis is placed on the revolver over automatics because
of t h e safety factor a nd simplicity.
These cours e s a r e g iven only to police officers and not to
civil i an g unsmiths . Many gunsmiths profess to be able to
work on these handguns and are not -qualified 'to do so with all
safe ty f unction s in mind.
Th ere are only two other men in the area who have attended
these sch oo l s and th e y are with the Denver Police Department
and t h e De nver Sh erif f's Office.
At t h is time I would like to say that I am i ndeed g rat e ful

AN ORDINANCE ANNEXING A CERTAIN PARCEL OF LAND OWNED SOLELY
BY THE CITY OF ENGLEWOOD, COLORADo.

WHEREAS, the city of Englewood, colorado has purchased and
is now the sole owner of a certain parcel of land hereinafter
described, and
WHEREAS, the City of Englewood now desires to annex said
parcel of land, and
WHEREAS, said property to be annexed is not a public street
or right-of-way, and
WHEREAS, said land is eligible for annexation under the
provisions of Subsection (2) of Section 3 and Section 4, all
of Article 21, chapter 139, c.R.S.'63 as amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CrrY OF ENGLEWOOD, COLORADO, as follows:
Section 1. That the following described parcel of land
being eligible for annexation and being owned entirely and solely
by the city of Englewood, located in and being a part of Arapahoe
county, State of colorado is hereby annexed and made a part of
the city of Englewood, colorado:
Beginning at a point 1413.0 feet east of the
southwest corner of the southeast one-quarter
(SE~) of Section 9, Township 5 south, Range 68
West of the 6th P.M.: thence north 250.26 feet:

AND IN THE SOUl'H HALF OF THE NORTHEAST QUARTER OF SECTION 8,

WHEREAS, there presently exists a public street lying
east of South Decatur Street within centenn i al Park known as
west Tufts Avenue; and
WHEREAS, the Planning and zoning c ommiss i on of the City
of Englewood has heretofore recommended that the said street
hereafter described be vacated; and
WHEREAS, all of the land adjo i n i ng said street is con-
ta i ned within centennial Park and owned and maintained by the
c i ty o f Englewood; and
WHEREAS, the afore-described street no longer serves any
useful purpose and the vacation of said street will not leave
any realty adjoining said street without an established public
road connecting the said realty with another established public

SUBJECT: CA PITAL IMPROVEMENTS
Attached please find th e li s ting of Capital Improvements requests as pre-
p a red a year ago and as r e vi ewed by the Planning Commission. Please
note the left h a nd column sets forth lhe total cost per item with a total of
those totals of approximately $6, 800, 000. A cursory glance s h ows me
that the amounts are in definite need o f being updated, and that some
possible capital improvements are not listed .
Th e City Ch arter provides th at the Pl anning Commission is to recommend
to the City Manager its evaluation of capital needs for the next five years
a nd that these needs a re to be enumerated in a sequence of priority in
their judgment. These are to be provided to the Manager not less than
ninety (90) days prior to his submission of the Budget to Council, although
this time has never been precisely adhe red to in the p a st.
In order to faci litate th e Planning Commission's review of the capital
needs, this office will shortly b e updating the list of capital needs, and
City staff will be reviewing these items in detail with the Planning Com-
m ission to con s id er this at their meetings on June 2nd a nd June 16th.
As y ou can s e, curre nt Public Improvement Fund expenditure levels
(1970 appropriation of $53 , 000) a r e not enough to accomplish these im-
provements except over a period of year s , and then In competition with
t h e Inc r easing cost s of the City's operational needs.

WOOd Pile or Plants -The city Por .. ter aay enter upon
a ny preals e a without warrant to inspect all wood piles
or trees, logs, shrubs, and other plants within the
limi te o f the City whether s uch trees, logs, shrubs,
or plants are f or sale or not. Upon discovering any
i nfectio us i ns e cts or diseases h~rbo r ed with i n such
wood pile or accuaulation of plant aatter or th e
existence of Ela wood, the city FOrester shall at
once notify the own e r or an agent o f the premises
whereupon the same is located o f the condition found
and shall d i rect such owner or agent by not i ce to
rem dy s uch conditions i mmediately or a t ime ~s deter-
mined by the city POrester.
(3) Issue Pepait -The City Forester sha ll have the
uthor ity to aff i x reasonabl e conditi on s and re ulations
to t h q rant o f a perait hereunder.

o f an application f or a perait to plant or eat out an

Section 9.10 -6 -PROCEDURE UPOII ORDER TO PRESERVE OR RBMOVE
When the City FOrester shall fi nd i t necessary to order
the tr~i ng , preservation, or removal o f tr .. s or plants upon
p l 1c o r pr i v te property as authori zed in this ordinanee,
he s hall serve a written order to correct the dangerous con-
dition upon the owner, operator, occupant, or other person
responsible for its existence.
(1) Method o f Serv i ce -The order re uired herein
shall b served In one of the fol lowin g wa ys:
( ) By making personal delivery of the order
to t he person responsib le.
(b) By leaving the order wi th s ome person o f
suit a ble a g e and discretion upon the p remis es.
(e) By affixin

known address o f the owner of the premises by regis-
t ered or certified aail.

or prope rty , the City FOrester shall have authority to

condition at the owners' or agents' expense without
a dmin istrat i ve fee .
Section 9.10-7 -ABUSE OJ\ M!1fiLATIOII OF TMES
&o person shall (a ) daaage, c ut , carve, transplant, or
remove a ny tree or shrub or injure the bark thereof, {b) pick
the f lower s or seeds o f any tree or plant, (c) attach any
rope, wire, or other contrivance to any tree or plant, or
(d) di~ in or otherwise disturb g ras s areas, or in any other
way injure or impair the natural beauty or usefulness o f any
area .

In the vent the removal of any plant is necessitated
by a Ci t y pavi ng or s i dewalk d istr ict, the expense of such
remova l will be borne by the City, not subject to recovery
f rom the owner or agent o f the property un l ess such p lant
w s planted or pl ced with written permit from t he City
FOrester after t he effect i v e date of th is ord in ance.
Sect i on 9.10-9 -LICP.IISE REQUIRED P'OR BUSINES S
It s hall b e unlawful for any person, firm, or c orporation
to engag e in the bus ines s o f planting, cutting, trimming,
p runing , remov i n g , or spraying tree, shrubs, vines, or hedges
within the city without further procuring a l i cense, therefore,
f rom the Director o f Finance. No such license shall be issued
wi thout the written approval of th city FOrester who shall
first be satisfied ot the competency of the applicant to en-
g age in such business as i ndicated by an e xam inat i on conducted
by the City FOrester, both oral and written. App l icants who
hold current val i d trimming and spraying licenses fro. the
city o f Denver .. y be ex-pted froa the oral and written ex-
am i nat i on at the discretion o f th e city Poreeter. Prior to
issuance of such license, the applicant shall have a cer-
t ific t o f Insur nee with a min imum of lD-2D-25-50 Thou-
• nd Dollars, copy of s id c rt ificate to b pl ced on fi le
wlth Director o f F i nance. Said insur nee ah 11 be f or the
p ur pose o f i ndemni fyi n g th e City of Englewood or other person
from lo s or d m e resu lt ing to ny person or property by
the n g lig nee o f such lic e nsee. Such l icense shall be
iaau d f or a period o f one (l) year and expire on the thirty-
fi rst d y o f Dece.Oer f ollowing ita issuance. 'l'he license

fee shall be Twenty-Five Dollars ($25.00) per year, or
f r a ct i on thereof, payable in advanc e . Any s uch license may
be suspended or revoked b y the City FOrester u pon written
notice f rom the city Forester stating i n what manner such
licensee ha s violated the rules a nd r e g u l ations of the city
Fores ter or any pro visi on of any City ordinance. An appeal
from such suspension or revocation may be made to the city
c ounc il by re ~uest i n g such hearing within twenty-four hours
o f issu nee o f notice of suspensio n or revocation. Said
licensee may continue to perform serv ice unti l th city
counci l renders a fina l decision. Licenses a r not trans-
ferable. Licensee shall supervise and be responsible for
all work done under his license.

No per son shall in a ny way inter f ere or cause any person
to interfere with the City Forester or his representative in
or about the performance o f his duties as de fi ned in this
ordinance.
Section 9.10-11 -SEPARABILrrY
If any section, sub-section, sentence, clause, phrase,
or portion o f this ord inance is for any reason held inva lid
or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and in-
dependent provision and such holding shall not affect the
val idity o f the remaining port i ons hereof.
