Members present: Members absent; Also present: Habenicht, Higday, Neumann, Guy, Vobejda, Wiggins Clark, Burns, Otis Stewart Fonda, Director of Utilities l} MINUTES OF THE MARCH 11, 1997 MEETING. The Englewood Water and Sewer Board Minutes from the March 11, 1997 meeting were approved as corrected. Mr. Vobejda moved; Ms. Neumann seconded: Ayes: Nays: Members absent; Motion carried. To approve the March 11, 1997 Englewood Water and Sewer Board Minutes as corrected. Habenicht, Higday, Neumann, Guy, Vobejda, Wiggins None Clark, Burns, Otis Mr. Clark and Mayor Burns entered at 5:10 p.m. .. 2. THE "PIPELINE" PUBLICATION. The Board discussed the drafted "Pipeline" articles and recommended minor changes. Mr. Wiggins suggested a sample comparison bill to show an average bill with and without using General Obligations Bonds. 3. SOUTH ENGLEWOOD MAINTENANCE AGREEMENT. Stu updated the Board on the status of the South Englewood Maintenance Agreement. An addendum was added stating that the City would not be responsible for damages in the case of a sewer backup. Mr. Marturano, attorney for South Englewood, concurred with the addendum. 4. BI-CITY MEDIA FILTER COLLAPSE. Stu reviewed the media filter collapse at the Bi-City Treatment Plant. Stu noted that the media has been ordered and odors may be noticed until the repair. An independent consultant has been retained to determine cause of the collapse. The meeting adjourned at 5:55 p.m. The next Water and Sewer Board meeting will be May 13, 1997 at 5:00 p.m. in Conference Room A. Respectfully submitted, Cathy Burrage Recording Secretary A TT. 2 SUPPLEMENT NO. / 3 I TO CONNECTOR'S AGREEMENT THIS AGREEMENT, made and entered into by and between the · CITY OF ENGLEWOOD, acting by and through its duly authorized Mayor and City Clerk, hereinafter called the "City," and SOUTHGATE SANITATION DISTRICT, Arapahoe and Douglas Counties, Colorado, hereinafter called the "District," WITNESSETH: WHEREAS , on the 20th day of June, 1961, the City and the District entered into an Agreement in which the City agreed to treat sewage originating from the District's sanitary sewer system within the area served by the District, which Agreement was most recently renewed by Connector's Agreement dated November 16, 1988; and WHEREAS, said Connector's Agreement provides that the district may not enlarge its service area without the written consent of the City; NOW, THEREFORE, in consideration of the mutual covenants and undertakings herein set forth, the parties agree as follows: 1. The City hereby consents to the inclusion of certain additional area located in Arapahoe County, Colorado, owned by THE PRESERVE AT GREENWOOD VILLAGE, and more fully described on Exhibit ?:. attached hereto and incorporated herein by reference, into Southgate Sanitation District. The City agrees that said addi- tional area may be served with the sewer facilities of the District, and that the City will treat the sewage discharged into the city's trunk line from said additional area, all in accordance with the Connector's Agreement dated November 16, 1988. According- ly, Exhibit A ref erred to in Paragraph 1 of the Connector's Agreement dated November 16 , 1988, is hereby amended to include such additional area. 2. Each and every other provision of the said Connec- tor's Agreement dated November 16, 1988, shall remain unchanged. IN WITNESS WHEREOF, the parties have set their hands and seals this day of , 1996. '-----------------------__ .. _ The real threat to metro water Vi nce nt Carroll Will someone please inform the U.S. Forest Service that there is a city called Denver, that it's been around for nearly 140 years, and that its citizens are not eager to see their water supply jeopar- dized just to satisfy a federal agency's appetite for power? Apparently the Forest Service · doesn't have enough to do manag- ing its vast land holdings. It now. hankers to control the flow of water upon which 1 million metro · residents -roughly half of them outside Denver itself -depend. The agency proposes to do this by the simple step of designating a 48-mile stretch of the South Platte River as "wild and scenic." Now, the section of river the agency has in mind, southwest of Denver, is certainly scenic and superficially wild, but the South Platte is also one of the most thoroughly managed rivers in the country in terms of water flow. That's been the case since 1905, when Cheesman Reservoir was completed. That structure was followed by oth- ers , including Antero Reservoir (1909) and Elevenmile Reservoir (1932). The Denver Water Board, and to a meager extent other utilities, now manages the river year-round, pulling water from storage during dry months to deliver to treatment plants and then to a host of users. The Forest Service would like to second-guess these decisions, as it freely admits in its Draft Environmental Impact Statement. The agency not only pines for authority to evaluate routine work undertaken by Denver to stabilize banks or modify the channel, but it also yearns to regulate the water flow itself, in cluding the "timing and quanti- ty of flow operations for water delivery and stor- ag ~". . .. ~-- A IT,, 3 This 1s alarming language. It suggests tnat ueu- ver's almost unmatched experience in safe- guarding water quality and delivery is somehow deficient and needs a federal overhaul. The news gets worse. The Forest Service also promises to "file for a water right on unappropriat-.. ' ed flows to protect river values," and, if necessary, to "condemn and purchase existing water rights." Here the agency is both confused and cavalier. It is confused because there are no "unappropriated flows" on the South Platte River. What river does 1 the agency have in mind? As for being cavalier, how else should we explain the threat to condemn existing water rights? Those rights are legally held property pledged to farmers, homeowners and businesses. Whose water does the Forest Service intend to seize first? Unfortunately, environmentalists are likely to support a wild-and-scenic listing in the hope of quashing any resurrection of a Two Forks-like dam project on the South .Platte. Their goal is under- standable, yet the reality is that a big new dam has Jost virtually all heavyweight institutional and political support. The alliance of water providers that sought it has dispersed, off to new adven- tures. Denver never needed it anyway, and big dam supporters in city politics are now as popular as muggers. So while supporters of a wild-and-scenic clas- sification whisper "big dam" to whip up their troops, that's a sideshow. The real issue is the secure delivery of water to 1 miJlion Coloradans. Reply Separator Subject: Colorado Water Resources Power Development Authority JNOLAN at Englewood Author: Date: 4/24/97 4:10 PM Hi All, FYI, I spoke with Mike Brod of CWR & PDA today and during the conversation he informed me that yesterday they loaned $20million @ 4.55 %. If compared to a Bond issue of the same amount yesterday@ 5.8 %, the savings they provided over the bond market was 1.3 %. He is very excited about the loan to Englewood for the Water Plant Improvements. He also mentioned that Fort Collins will be borrowing from them and that Boulder decided not to go through them for a loan. Thought you'd be interested in hearing this, Jenny
