2 . SOUTHGATE SUPPLEMENT #132 & #133 .
The Board received two supplements from Southgate Sanitation District representing the
owner/developer for inclusion into the Southgate Sanitation District. Supplement #132 is
for an area approximately 2.36 acres . The zoning per Arapahoe County is Single Family·
Residence. Residential zoning is the intended use of the property. The property is located
west of Monaco St. and sout h ofE. Belleview Ave . Supplement #133 is for an area ·
approximately .785 acres . The zoning per Arapahoe County is Single Family Residence .
Residential zoning is the intended use of the property. The property is located west of
Yosemite and south ofE. Belleview Ave .

3 . PROPOSED ORDINANCE : PROHIBITED DISCHARGES
The board received a copy of a memorandum regarding an addition to the Municipal Code
concerning Stormwater. There was a question asked about how the exceptions in
paragraph ( c) were determined . Mr. Fonda explained that some of the excepts came
from the staff in the Utilities Department and some from a survey taken of surrounding
municipalities . The board wanted time to consider other possible exceptions . The Board
will discuss the proposed ordinance further at the next meeting.
Ms . Neumann noted that a correction was needed in paragraph ( a ), the word "Is" needs
to be corrected to read "It". Ms . Neumann noted that the correction needs to be made on
the Memorandum and the attached City Ordinance .
4 . POLICY FOR RELEASING HOME ADDRESS AND PHONE NUMBER TO
PUBLIC.
Mr. Fonda received a request from a developer for the addresses and home phone
numbers of the Water and Sewer Board. Mr. Fonda recommended a policy be established
for these requests .

5. CITY DITCH LICENSE AGREEMENTS
A. License Agreement submitted by Brian Greenley for a 3' wide concrete pan to cross
the City Ditch at Blakeland Industrial Park.
B . License Agreement submitted by US West Communication for installing a
telecommunications cable across the City Ditch.

6. Ms. Habenicht expressed her appreciation to Mr. Fonda and staff on an excellence
presentation to the City Council regarding the WWTP project.
7. Mr. Fonda spoke about his meeting with the Colorado Water and Power
Authority. The Colorado Water and Power Authority has a new loan program that uses
federal funds to create a revolving loan fund . The Utilities Department has applied for a
15 million dollar loan. The November ballot issue will be used as a backup measure . If
need be, the ballot issue can be pulled as late as September 1997.
The next Water and Sewer Board meeting will be July 8, 1997, at 5:00 p.m. in Conference
Room A.

RE: Dissolution of Valley Water District and
Valley Sanitation district
Dear Mayor Burns, Council Members and Mr. Clark:
We serve as the Board members of the Valley Water District
and the Valley Sanitation District, each of which has service
contract with Englewood for water and wastewater services,
respectively. We believe that it is time for the Districts
to dissolve, and we hope that you will agree.
The Districts' water distribution and wastewater collection
systems are fully paid for and in relatively good condition.
Englewood already performs all maintenance and operation on
the water system and the routine maintenance on the wastewater
collection system is now minimal.
The Sanitation District is 95% complete with its
Trunkline sliplining project. Over 90% of the mainline
identified to date for the sliplining project has been
completed. The District currently has funds to be used in
completing the line repairs and any future costs within its
boundaries. The District proposes to turn over all rem~tning
funds to Englewood in a dissolution agreement.

While it appears clear to us there is no reason for the
Districts to continue in existence. Englewood has previously
expesssed concern that the District remain in existence so
that it has some entity with which to contract to provide the
service. This is a formally expressed concern in the May 5,
1980, Total Service Contract with Valley Water District. We
are aware that similar concerns have been resolved by the Town
of Breckenridge with the dissolution of the Blue River Water
District and the Woodmoor at Breckenridge Water District, each
of which lie outside the boundaries of the Town. Other
situations at the Town of Gypsum and Eagle, through an Agreement
and Plan for dissolution, allow the District Court to approve
a continuing service agreement but allow the dissolution of
unnecessary districts. We would be pleased to supply a draft
of such an Agreement and Plan for Dissolution which would fit
our situation. We offer this simply as a way of moving this
-forward and explaining our propos~l for dissolutio~.
It is estimated that a maximum of $210,000 of additional
lining is appropriate to improve Sanitation District lines.
We propose the remaining funds be reserved for future maintenance
on District lines or other contingencies that may arise.
The Valley Water District '..as virtually no cash balances
nor should it need any, since Englewood Currently bills all
customers directly under a total service arrangement. We
essentially propose to continue that arrangement, with the
District Court's approval.
We appreciate your consideration of this matter. We look
forward to discussing it further at your convenience and
preparing a draft Agreement for your review. Please contact

Thank you for your letter you delivered yesterday, June 26, 1997_ I appreciate you
voicing your concerns and outlining your special concerns _ Your phone number was not
included so I was not able to call.
Considering your special medical problem, it would be possible to provide distilled water
to you . Distilled water is available at the Allen Filter Plant at W . Layton and Windermere
or at the Bi-City Wastewater Plant at S. Platte River Drive and Dartmouth. You could
come to either plant to fill your containers. Please call me or Cathy if you wish to explore
this option.
This topic will be discussed at our next Water and Sewer Board meeting on July 8, 1997
and you are welcome to appear at this meeting. Please call Cathy Burrage at 762-2636 if
you wish to appear on the Water Board agenda.
Bill McCormick has discussed the current Allen Water Plant Expansion Project with you
and we are striving to solve current problems in the system. Once again, we appreciate

MEMORANDUM

Subject: Addition to Municipal Code, Stormwater Section
There is no language in the Englewood Municipal Code that prohibits the dumping of harmful
substances to the City's stormwater system. Following is a proposed addition to the Storm Water
ordinances :
Section 12-5-9: (New Paragraph) PROHIBITED DISCHARGES .
(a) It shall be unlawful for any person to discharge or cause to be discharged to the storm
drainage system any polluting material or any other material which is not composed entirely of
stormwater .
(b) It shall be a complete defense to the application of this section that such discharge was
made pursuant to an NPDES stormwater discharge permit or resulting from firefighting activities .
( c) Except insofar as such may be identified by the City as sources of polluting materials,
this section shall not apply to the following categories of non-stormwater discharges:
( 1) Water line and fire hydrant flushing;
(2) Landscape irrigation ;
(3) Diverted stream flows ;
(4) Rising ground waters;
(5) Uncontaminated ground water infiltration into the storm drainage system;
( 6) Uncontaminated pumped ground water;
(7 ) Discharges from potable water sources;
(8) Foundation drains ;
(9) Air conditioning condensation ;
(10) Irrigation water;
(11) Springs ;
(12) Water from crawl space pumps ;
( 13) Footing drains ;
(14) Lawn watering;
( 15) Individual residential car washing;
( 16) Flows from riparian habitats and wetlands;
( 17) Dechlorinated swimming pool discharges; and
(18) Street washwater .
( d) Any person who violates any provision of this section shall be subject to a civil penalty
of not more than $999 .00 per day during which such violation occurs or continues, or, upon
conviction, a criminal penalty punishable by a fine of not more than $999 . 00 per day during which
such violation occurs or continues or by imprisonment for not more than three months or by both.

officer or employee of the City as a hearing officer with authority to hold such hearings.

to the Water and Sewer Board and then t o the District Court. (Ord . Series 1993)
12-5-8: FLOOD INSURAN CE: Floods from storm water run-off may occasionally occur
· whiCh exceed the capacity of sto rm water facilities constructed and maintained by funds
made available under this Chapter. This Chapter does not imply that property liable for the
fe es and charges establis hed in this Chapter will always be free from flooding or flood
damage. This Chapte r does not purport to reduce the need or the necessity for the owner
obtaining flood insura nce. (Ord . 20Series 1993)

This letter is in response to the Wild and Scenic River Study Report and
Draft Legislative Environmental Impact Statement for the North Fork of
the South Platte and the South Platte Rivers. The City of Englewood
wholeheartedly supports Alternative A2, as outlined in the Draft LEIS.
Adoption of alternatives other than Alternative A2 present the following
concerns for the City of Englewood:
Federalization of the river would at its least, impart an additional and
unnecessary extracted level of non-local management. Consequently,
concerns include inhibiting or altogether nullifying further water
resource development plans along said stretches of river and
tributaries, including those plans currently under consideratron.
At its worse, current procedures and practices related to storage,
conveyance, and delivery may be impacted to a degree resulting in
diminished necessary flexibilities currently enjoyed by front range
water providers resulting in maximized water resource development and
management.
It is the concern of the City that the greater regulation potential for
river stretches utilized as conveyances for these resources may
negatively impact delivery/ex change mechanisms currently in place.

Additional inhibitive consequences include potential inability to
utilize excess surface water resources in reclamation activities such as
aquifer recharge, currently under investigation. Furthermore, and more
importantly, is the increased potential to impede the ability of local
governments and water providers to develop ongoing and long term water
resource development strategies necessitated by current and inevitable
continued development and growth of front range communities.
We look forward to working with you and other USFS representatives in
preserving the "outstanding remarkable values" of the river, and
implementing Alternative A2. If you have any questions or c omments
