MINUTES OF THE NOVEMBER 18, 1997 MEETING. The Englewood Water and Sewer Board Minutes from the November 18, 1997 meeting were approved as written. Southgate Sanitation District submitted Supplement #136 for approval. The supplement was submitted by Bobby G. and Delaine Stevenson for an area approximately 4.886 acres. The current zoning of the property, per Greenwood Village, is R-2.5 with the proposed use to remain the same. The property is located between E. Belleview and E. Orchard off S. Colorado Blvd. in Greenwood Village. Ms. Bradshaw moved; Mr. Guy seconded: Ayes: Nays: Members absent: Motion carried. To recommend Council approval of Southgate Supplement #136 inclusion into the Englewood sanitation area. Habenicht, Neumann, Guy, Vobejda, Bradshaw, Clark None Burns, Higday, Otis Mayor Burns entered at 5:10 p.m. 3. REIMBURSEMENT FOR WATER AND SEWER MAIN EXTENSIONS. John Bock reviewed the existing policy of water and sewer main extension, where the City incurs the initial expense of extending the main subject to recovery from the requesting party. Utilities staff has proposed that recovery shall be upon completion of said extension and shall involved the entire cost of the main extension. The Municipal Code shall read: "Recovery shall be from the requesting party or parties and shall be upon completion of said extension. Recovery shall be defined as the entire cost of the main extension. The requesting parties shall demonstrate the ability to reimburse the City for construction costs prior to construction." Ms. Bradshaw questioned what percentage of prior main extensions has been recovered. A memo from John Bock dated February 2, 1998 is attached answering Ms. Bradshaw's question. John Bock reviewed events leading to the Summons served by Lera Gesin, owner of 3605 S. Bannock St. The Gisens are petitioning to encroach into the City of Englewood's City Ditch right-of-way on the south boundary of their property. The attorneys are preparing discovery for the trial. John will apprise the Board of new developments. 5. POST OFFICE DELILVERY AND LATE FEES. John Bock noted that the Utilities Department has received numerous complaints from customers that the Post Off ice delivered water bills late. The Board recommended that if a bill is delivered late, the Utilities Department could waive the late charge one time if the customer produces the envelope with the postage mark. Late charges could be waived, at the Director's discretion, if the records show a good payment history. A notice will be posted on future bills. 6. GREASE INTERCEPTOR ORDINANCE. The Board received the existing Oil and Grease Interceptor Ordinance (Municipal Code #12-2-4F). Stu discussed allowing variances to be granted administratively and eliminating "with the approval of the Water and Sewer Board" from the existing code. The Board will discuss the variance at the next meeting. 7. CDM -PROPOSAL FOR ADDITIONAL ENGINEERING FEES. Camp Dresser & McKee will appear at the next meeting to discuss the need to increase their fees. 8. GROUNDBREAKING FOR THE ALLEN PLANT IMPROVEMENT PROJECT. There will be a groundbreaking ceremony for the Allen Filter Plant Improvement Project on Wednesday, January 28, 1998 at 9:00 a.m. at the Allen Filter Plant. All Board members are encouraged to attend. 9. VALLEY SANITATION DISTRICT. Stu will be meeting with representatives of the Valley Sanitation District to discuss a proposal to dissolve the Valley Water District. The Board noted that they were not receptive to incorporating the sanitary sewer portion of Valley Sanitation District. The Board discussed the proposal and informally adapted the following positions: 1 ) there should be no limits on differential fees, 2) future taps would only be available under current land use and zoning, 3 ) the existing Board of Directors must guarantee that all facilities are in public rights-of-way, 4) The Board of Directors would remain liable for any decisions made prior to the dissolution and 5) the contract would be patterned after and essentially the same as the current contract with Cherry Hills Village. The Board adjourned at 6:10 p.m. The next Water and Sewer Board meeting will be February 10, 1998 at 5:00 p.m. in Conference Room A. Printed on Recycled Paper.~ ATT. 2 FOURTH AMENDMENT TO AGREEMENT This FOURTH AMENDMENT made this ____ day of _______ , 1998 between the City of Englewood, Colorado ("OWNER") and Camp Dresser & McKee Inc. ("ENGINEER") modifies the AGREEMENT between the OWNER and the ENGINEER dated May 6, 1996, as subsequently modified by the FIRST, SECOND, and THIRD AMENDMENTS. The AGREEMENT is modified by this FOURTH AMENDMENT to (1) provide modifications and/or additions to the final design of improvements to the Allen WTP; (2) Bidding Phase Services Modification; and (3) Construction Phase Services Modification. Specifically, the following modifications to Exhibit A to the AGREEMENT are agreed to: 1. Add the following paragraphs to Exhibit A: "1.5 Additional Design Investigations and Final Design: 1) Investigate and redesign "Line of sight" controls for the Union Avenue Pump Station. 2) Prepare conformed documents incorporating all of the addenda items and the original design information into one set of documents. 3) Redesign the fl9od wall along Big Dry Creek to accommodate the desires of Southgate Sanitation District and the COOT re-alignment of the Bridge on Windemere A venue. Prepare evaluation of alternatives for the redesign for the COOT Bridge re-alignment to include the estimated construction costs, pro's and con's. 4) Investigate and assist in negotiations with a second supplier of activated carbon. 5) Prepare a preliminary design report for a phosphate feed system at the Allen WTP . 6) Prepare a preliminary design report and final design for an emergency generator to meet code requirements outlined by the City's Building Department. 7) Prepare an evaluation and provide justification for the final design of the sodium hypochlorite feed and storage system. 8) Assist in investigations of feasibility of purchasing and using a new belt filter press for sludge dewatering operations. 1.6 Bidding Phase Services described in paragraph 2.3 of the AGREEMENT were authorized under the TIIlRD AMENDMENT. With the extension of the bid date, additional Bidding Phase services are required of the ENGINEER. O:IOYEIAMEND.-4 The net cost for printing of the contract documents issued during the Bidding Phase was to be paid for by the OWNER. Net cost is defined as the actual co .st of printing as arranged for by the ENGINEER less the net value of the document deposits received and held by the 1 ENGINEER from prospective bidders after all refunds have been issued. The net cost was a credit to the City of Englewood for $858. 1. 7 The Construction Phase Services described in paragraph 2.4 of the AGREEMENT were authorized through August 31 , 1999 by the THIRD AMENDMENT. During the Bidding Phase, the construction period was extended through December 31, 1999. Extended construction phase services through that date are hereby authorized. 2. The controls are for controlling chemical feed equipment placed in the Old Pump Station. The hard-wire system entails burying a conduit in the soil between the Old Pump Station and the Union A venue Pump Station. A change to "line of sight" control system has been requested by the City due to concerns regarding the poor soils conditions potentially causing construction, operations and maintenance problems. A "line-of-sight" system does not have buried conduits and will therefore eliminate the potential problems related to the soils. 2) Conformed Documents -Conformed documents will be prepared to incorporate all of the addenda items and the original design information into one set of documents. The addenda items include Addendum No. 1, 2, 3 and 4. Addendum No. 1 is the drawings and specifications for the electrical, instrumentation and control designs for the project. Addendum No.s 2 and 3 primarily contain responses to questions from the bidders and designs of some miscellaneous items. Addendum No. 4 primarily contains responses to questions and comments from the City's Building Department. Addendum No.s 1 and 4 are a direct result of the time constraints imposed on the project by the deadline for the SRF Loan Application. Had there been more time, most of the contents of Addendum No.s 1 and 4, and portions ofNo.s 2 and 3, could have been incorporated into the original design information. The conformed documents will facilitate the construction of the project by clearly presenting the requirements to the Contractor. O:IOYEIAMEN0.4 3 O:IOYE\AMEN0.4 The agreement with Centric/Jones states that the City of Englewood will provide ten sets of design documents to them for their use. In addition, the City of Englewood and Camp Dresser & McKee Inc. will need copies for their use. 3) Flood Wall Redesign -The flood wall has had to be redesigned to: (a) improve the accessibility to the underlying sanitary sewer for the Southgate Sanitation District, and (b) accommodate the re-alignment of the newly constructed bridge over Big Dry Creek. In response to requests from the Southgate Sanitation District, the transition of the flood wall where it crosses over the 60-inch sanitary sewer was redesigned. The redesign involves opening up the width of the transition to improve the access to the sanitary sewer. 4) 5) The flood wall will tie into the newly constructed Windermere Street bridge over Big Dry Creek. For the original design of the flood wall, the ENGINEER was provided with CDOT documents for the design of the bridge. Discrepancies in the bridge design information were discovered during design. To correct the discrepancies, it was necessary to resurvey the area around the bridge to obtain an as-constructed topography. Due to site constraints presented in the as-constructed topography, the flood wall will have to be redesigned where it attaches to the bridge. The redesign will involve another crossing of the sanitary sewer owned and maintained by the Southgate Sanitation District. There are a number of alternatives for crossing the sanitary sewer. The alternatives either impair the accessibility to the sewer or have a high construction cost and possibly impair the use of some of the facilities at the Allen Water Treatment Plant. A study of the alternatives is necessary for discussions and negotiations with the Southgate Sanitation District. Once an alternative is agreed upon, the redesign can then proceed. Carbon Supplier Options and Agreements -Operating conditions at the Allen Water Treatment Plant have rendered a situation where the warranty originally proposed by the Calgon Corporation for the service contract for the granular activated carbon was unacceptable to the City of Englewood. The Calgon Corporation was initially unwilling to rela"X the warranty conditions. In response to this situation, investigations and negotiations were pursued with a second potential carbon supplier, ACMS. Calgon Corporation has since changed its warranty to meet the needs of the Allen Water Treatment Plant. As a result of its negotiations, the City of Englewood now has two potential carbon service companies to chose from for the project. Phosphate System -Treated potable water from the City of Englewood's (City) Allen Water Treatment Plant (WTP) is delivered to customers via a network of water main piping referred to as the "distribution system." The majority of the distribution system is comprised of small-diameter (e.g., 4 inch) unlined cast iron pipe, which has been in service for several decades. Over time, the effective diameter of the pipes in the distribution system has slowly been reduced by tuberculation buildup on the internal pipe walls. This has been observed throughout virtually all reaches of the distribution system . The tuberculation limits the ability of the City to deliver the required flowrates and/or pressure required by its water customers. Furthermore, periods of high demand increase the flow velocity in the distribution system , resulting in shearing of the deposited tuberculation materials. These materials are then resuspended in the water traveling through the distribution system and are observed 4 6) 7) 8) O:IOYEIAMEND.4 at customers' taps, which results in numerous "red water" or high-turbidity complaints from customers. A two-part program has been proposed by the ENGINEER to mitigate these distribution system issues. It is recommended that the City continue to mechanically clean affected sections of the distribution system piping followed immediately by application of a liquid phosphate solution to prevent corrosion of the resulting bare metal. The second part of the proposed plan includes continuous feed at the Allen WTP of a different liquid phosphate solution to further control corrosion and prevent deposition of particulate matter in the distribution system. Details of the distribution system issues and the recommended corrosion control plan are included in the report titled City of Englewood, Colorado: Corrosion Control Study (CDM 1998). That report also includes a recommended set of tests to be performed by the City to determine the optimum chemicals and doses to be used. It is important to note that this program is expected to reduce the occurrence of "red water" at customers' taps, but such occurrences will not be completely eliminated. Mechanical cleaning of segments of pipe in the distribution system will continue to release deposited materials back into the water system for a period of a month or more following the cleaning. However, the "one-time" application of chemical following the cleaning is intended to reduce the severity of this effect. Upon commencement of the preventive program, it is anticipated that over time, the frequency of mechanical cleaning of the system will be reduced, and subsequent "red water" occurrences will likewise decrease. ENGINEER will prepare a preliminary design letter report for the proposed chemical storage and feed facilities to be installed for continuous feed of phosphate solution at the Allen WTP. Final design will be authorized, if necessary, after the testing program. Emergency Generator -The Allen Water Treatment Plant is provided with electrical power through two feeders from the Public Service Company. The initial design considered using one of these two feeders as an emergency power source to the treatment plant. During the review of the design by the City's Building Department, it was determined that a stand-alone emergency generator is required, instead of one of the feeders, to power the ventilation equipment in the high hazard areas. Sodium Hypochlorite Investigations and Report -The operations staff at the Bi-Cities Wastewater Treatment Facility reviewed and commented on the final design of the sodium hypochlorite feed and storage facilities. Their review comments called for facilities significantly different than what was designed. The as-designed system was reviewed, documented, and justified. Assistance with Belt Filter Press Investigations -The existing belt filter press is 10 years old. It has been recently discovered that a slightly-used newer press is available for purchase through a nearby sanitation district. Preliminary negotiations indicate that the press can be purchased for $80,000 to $90,000, approximately half the cost of a new press. Further investigations are necessary to determine the feasibility of using the press in the new facility. An allowance of $10,000 is authorized to assist the CITY with the investigations. 5 1.6 Additional Bidding Phase Services 1) Extended Bid Period -In an effort to attract the top local contractors, encourage competitive bidding, and obtain the best possible bids, the City of Englewood extended the bid opening date for the project by one month. During the extended bid period, the ENGINEER interviewed contractors, prepared additional addenda items responding to questions from the bidders, consulted with the City, attended meetings, and provided management and administration of the extended bidding period. The City of Englewood's efforts to extend the bid period has paid off: bids were received from five top local contractors, the range of bids was very narrow, and the low bidder's price was considerably below the Engineer's Opinion of Probable Construction Cost. 2) Final Document Printing -Reproduction and distribution of the design documents to the bidding contractors, plan rooms , and vendors is essential to attracting interested parties to the project. The design documents were sold to these parties to cover the associated costs resulting in a nominal credit to the City of Englewood. 1. 7 Additional Construction Phase Services 1) Extended Services During Construction -In response to requests from several of the bidding contractors , the City of Englewood extended the contract time for completing the project. The extended contract time will provide for more time during the low flow season, the time when most of the critical construction activities will take place . Giving the bidding ~ontractors more time during the low flow season has undoubtedly reduced bid prices and will likely reduce the potential for construction claims. The contract time has been extended to 689 calendars from 499 calendar days (an increase of 190 calendar days). For the time extension, the ENGINEER will attend additional coordination and progress meetings ; provide additional resident project representative services; respond to additional questions, and requests for clarifications and interpretations; and provide additional management and administration of the construction phase. All other terms and conditions of the AGREEMENT of May 6, 1996 , as amended , remain in full force and effect. The proposed subdivision will lie near the headwaters of North Turkey Creek west of U.S. Highway 285 near Conifer. The plan in all likelihood will use Ron Blatchley' s Mountain Mutual Reservoir Company water for augmentation which is derived from changed rights in the Warrior Ditch and in Soda Lakes. Approximately one to three acre-feet of consumptive use water will be involved in the plan for augmentation. Consistent with Martin and Wood's opinions on similar plans located in the Bear Creek Turkey Creek water sheds and that such plans have not warranted objection by the City of Englewood, it is our opinion that this plan near Conifer would also not affect Englewood's McBroom Ditch water rights. This is an opinion which you and the City of Englewood, of course, should retain the right to determine on your own terms, perhaps with the help of an outside engineer. In this letter Centric/Jones Constructors requests permission to dose Layton Avenue adjacent to the Allen Water Tzeatment Plant for the duration of the improvements construction. We request that you review this request with Stewart Fonda and pass on your recommendations to the appropriate parties. COM has reviewed the Contractor's request and we agree that the closure of Layton Avenue will be of benefit to the plant as well as to the Contractor. Ii the Contractor is allowed to use only the areas designated for staging and construction in the contract documents, the staging area will be quite congested and will have an impact on the City's access to the plant. If Layton A venue can be used as a staging area, better access to the plant and a less congested work area will be the result Another point to consider that is not mentioned. in Centric/Jones' request is that Layton will need to be closed several different times during the construction for extended periods of time anyway in order to install pipelines. Centric/Jones is preparing a drawing that would show their proposed work and staging areas, which we will forward to you as soon as we receive it We recommend that this request to dose Layton Avenue be granted.
