The Englewood Water and Sewer Board Minutes from the
February 10, 1998 meeting were approved as written.

2. GUEST: TIM DILLAVOU OF SOUTHWEST CONCRETE PUMPING
Mr. Dellavou of Southwest Concrete Pumping at 2323 W. Oxford
Ave. appeared to request a %" tap extension of their
existing water service to another building on the same
property. The Board was asked to approve the request since
the new building is outside Englewood's existing water
service area. The Board required as a condition of service,
that the owners sign an agreement that would be recorded
against the property stating that water service to the new
building is contingent upon the property never subdividing
into separate ownerships. The agreement would allow the
City to disconnect the service immediately if the property
is subdivided or sold separately.

3. LETTER FROM MARTIN & WOOD DATED JAN. 12, 1998.
The Board received a letter for information purposes from
Martin and Wood dated January 12, 1998 regarding Job No.
159.6, "Plan for Augmentation of Conifer Corners."
4. 3605 S. BANNOCK -GISEN SUIT.
John updated the Board on deve l opments in the Gisen suit
regarding the City Ditch at 3605 S. Bannock St. John met
with the City Attorney on February 3, 1998 to discuss.
Englewood has filed a counter claim against the Gisens. The
suit is now in the discovery phase, and per the judge's
recommendation, mediation will be attempted by both parties.
5 . CLOSING LAYTON.
The Board received two letters, one from Camp Dresser &
McKee dated February 5, 1998 and one from Centric/Jones
dated February 5, 1998. Both letters recommend closing West
Layton Avenue during the Allen Plant Improvements
construction for the benefit of both the plant and
contractor. Adjacent properties will be notified. The
Board concurred that Layton should be closed during
construction.
6. GUEST: CARL HOUCK -CAMP, DRESSER & McKEE.
RE: FOURTH AMENDMENT TO AGREEMENT.
Camp Dresser & McKee, Inc. submitted the Fourth Amendment to
Agreement modifications and additions to the final design of
the Allen Plant Improvements for the amount of $371,138 .00.
The Fourth Amendment would include line of sight controls at
the Union Avenue Pump Station for controlling chemical feed
equipment, conformed documents to incorporate all addenda
items and original design information into one set of
documents, a flood wall redesign to improve accessibility to
the Southgate Sanitation District sewer and accommodate the
newly constructed bridge over Big Dry Creek, investigations
and negotiations with a second potential carbon supplier -
ACMS, preliminary design report for chemical storage and
feed facilities for continuous feed of phosphate solution
for the water distribution lines, a stand-alone emergency
generator to power the ventilation equipment in the high
hazard areas, final design of the sodium hypochlorite feed
and storage facilities and extending the bid opening date by
one month, and providing construction management for an
additional 190 calendar days.

7. BILLING LATE CHARGES.
The Board discussed customer complaints because of late fees
resulting from the Post Office delivering water bills late.
The Board recommended that if a bill is delivered late, the
Utilities Department could waive the large charges per the
staff's discretion.
The meeting adjourned at 5:40 p.m.
The next Water and Sewer Board meeting will be March 10,
1998 at 5:00 p.m. in the Conference Room A.

The following list briefly describes some of the major issues that are facing the
Littleton/Englewood WWTP. Each of these issues will be discussed at future Water and
Sewer Board meetings as meeting time and schedule allow . The tentative schedule can
be adjusted as the length of the board agenda dictates .
1. Facility Odors -This is a continuing, high priority concern at the facility.
Operation in December and January resulted in odor production and odor reports
from the public, city council and staff and plant staff. The causes and corrections
will be discussed at the March meeting. In addition, several components of the
Phase lb construction project are for odor control and will also be reviewed.
Remaining sources and issues will be identified.
2. Whole Effluent Toxicity -The biomonitoring test determines if toxic materials in
toxic amounts are being discharged to the river. Over the past few years, the test
has 'failed' and much work has been performed to determine the cause . Test
failures are permit violations that require specific actions and may result in
penalties for failure to comply with permit conditions. Tentatively scheduled for
the April meeting.
3. Total Maximum Daily Loads -The Clean Water act requires that the EPA
determine total maximum daily loads (TMDLs) for rivers and lakes that are
adversely impacted by pollutant discharges. The EPA is currently being sued for
failure to determine TMDLs in many states , including Colorado. Plant staff are
currently involved in TMDL work on the South Platte River and in organizing a
coalition of point source dischargers on the South Platte to effectively perform
this work. Tentatively scheduled for the May meeting.
4. Nitrate -The TMDL work performed to date indicates that nitrate concentrations
in the river may be impacting the drinking water use of the river, particularly at
the Burlington Ditch downstream of the plant. Future river studies and possible
treatment requirements will be presented. Tentatively scheduled for the June
meeting.
5. Industrial Pretreatment -The program controls industrial and commercial
wastewater discharges to the plant and is responsible for non-technical activities
(like public education) when water quality issues have no acceptable technical
solution (like public education for mercury.)
6. Biosolids -The development of the city farms as permanent biosolids use sites
will be reviewed, as well as regulatory developments affecting biosolids use.
Each of the issues will be presented in a concise briefing format, with handouts as
appropriate. Each presentation will last 10 to 15 minutes , not including questions. If
additional information is needed by any board member, a follow up memo with the
information is suggested to keep the board meetings as time effective as possible.

SUPPLEMENT NO . .L3...L_ TO CONNECTOR'S AGREEMENT
THIS AGREEMENT, made and entered into by and between the CITY
OF ENGLEWOOD, acting by and through its duly authorized Mayor and City Clerk ,
hereinafter called the "City," and SOUTHGATE SANITATION DISTRICT, Arapahoe
and Douglas Counties , Colorado , hereinafter called the "District,"
WITNESSETH:
WHEREAS, on the 2oth day of June , 1961 , the City and t he District
entered into an Agreement in which the City agreed to treat sewage originating from
the District's san itary sewer system within the area served by the District , which
Agreement was most recently renewed by Connector's Agreement dated November
16 , 1988 ; and
WHEREAS, said Connector's Agreement provides that the district may
not enlarge its service area without the written consent of the City ;
NOW, THEREFORE , in consideration of the mutual covenants and
undertakings herein set forth , the parties agree as follows :
1. The City hereby consents to the inclusion of certain additional
area located in Douglas County , Colorado, owned by Janet L. Holman and more fully
described on Exh ibit A attached hereto and incorporated herein by reference , into
Southgate Sanitation District. The C ity agrees that said additional area may be
served with the sewer facilities of the District , and that the City will treat the sewage
discharged into the City's trunk line from said additional area , all in accordance with
the Connector's Agreement dated November 16 , 1988 . Accordingly , Exhibit A
referred to in Paragraph 1 of the Connector's Agreement dated November 16 , 1988,
is hereby amended to include such additional area .
2. Each and every other provision of the said Connector's
Agreement dated November 16 , 1988 , shall remain unchanged .
IN WITNESS WHEREOF, the parties have set their hands and seals

The one acre property at 5670 South Newport Street -Lot 2 Block 5 Harbold Acres -
is currently vacant land . My husband and I plan to build a single family dwelling on
this site in 1998, and I request inclusion of t his property in the Southgate Sanitation
District.
The existing zoning on the one acre is R-1 , and will remain R-1 .
We plan to begin construction in mid-April , with an estimated completion date of
December, 1998.
Service requirements will be 3/4" water and 4" sewer, each of which is already
stubbed into the property .

RE : Bike Path Along City Ditch
Per your request to investigate installing a bike path along Englewood's City Ditch , the
following are items to consider regarding this proposal :
• The open sections of the City Ditch have always been an attractive nuisance . Sections
of the ditch are fenced off to prevent children from having access to dangerous
hazards .
• Many sections of the City Ditch are fenced as part of owner's private yards and are
not continuously accessible . In many cases , agreements have been signed between the
City and owners allowing citizens to maintai n and use the City Ditch easements as part
of their yard . Many owners along the ditch would adamantly oppose such a proposal
in that" it would greatly decrease, and in some cases completely take away, their yards .
• Because of natural formations and grading necessary for water flow, some sections of
the ditch are impassable .
• In sections where the City Ditch is in an easement , the City can only use the area for
City Ditch use. By the terms of the easement , the City cannot use the area for any
other use.
• The City Ditch is constantly being maintained and repaired . On a continual basis , the
City Ditch is piped , areas reinforced , branches removed and brush burned to facilitate
flow . There would always be sections that would not be passable for these reasons .
• Resident's security would also be a primary concern. A bike path would provide
access and opportunity for various crimes . Severe opposition would be encountered
from residents adjacent to the City Ditch right-of-way if a bike path allowed direct
access to their yards .

• Due to the nature of an open water ditch, liability would also be a major factor to
consider.
• The City Ditch is a primary raw drinking water source for the City of Englewood .
Public access to this valuable resource could create pollution and water quality
problems .
• This proposal has been reviewed in the past because, if it were feasible, this would be a
great amenity for the City . However, it has always been concluded that this proposal
would encounter too many insurmountable obstacles to be implementable on any
practical basis . This memo will be presented to the Water and sewer board at their
next meeting. Please call me if you have any further questions .

Thank you for talcing the time and effort to meet with City staff to express your concerns
regarding the piping of City Ditch adjacent to your home . To summarize the City's position ,
because of water quality issues, erosion of the banks and because of the increased flows that must
be sent through the Ditch, Englewood has no economical choice other than to pipe the Ditch .
From our discussion, the City is willing to assure the following : after the Ditch has been piped
the City will slope and grade the Ditch right-of-way so as to direct stormwater run-off either
west towards Bannock St. or to the east towards Broadway. The City will work with your
engineer on this issue . This grading will carry the water from most storm events . It may or may
not be able to handle the runoff from extremely heavy storms. In the event storm water does
get into your basement, the City will assist with the cleanup . The City will extend the cedar
privacy fence on your east property line south across the ditch right-of-way. A gate will be
installed in the fence for maintenance access . The City is willing to enter into a right-of-way use
agreement (enclosed) whereby you can use the ditch land as part of your yard for non-permanent
landscape features .
The mature spruce tree in your yard doubtless depends upon water from the Ditch. The City
cannot assume any liability for the tree. We suggest that you water the tree thoroughly for the
first year or so until the roots can reestablish themselves.

1. In granting this License , the City reserves the right to make full use of the
property involved as may be necessary or convenient in the operation of the
City and the City retains all right to operate, maintain, install, repair, remove
or relocate any of its facilities located within the City's property at any time
and in such a manner as it deems necessary or convenient. In the event
Licensee's installations should interfere with the City's use or operation of its
property, at any time hereafter, Licensee shall, upon request by the City and
at Licensee's sole expense, immediately relocate, rearrange or remove its
installation so as not to interfere with any such City use and to remove the
installation of Licensee when necessary or convenient for the City , its
successors or assigns .
2. The City shall have the right to maintain , install, repair, remove or relocate
the City Ditch or any other of its facilities or installations within the City's
rights-of-way, at any time and in such manner as the City deems necessary
or convenient. The City reserves the exclusive right to control all easements
and installations.
3 . The rights and privileges granted in this Li cense shall be subject to prior
agreements, licenses and/or grants, recorded or unrecorded, and is shall be
the Licensee's sole responsibility to determine the existence of said
documents or cor:iflicting uses or installations.
4. The Licensee shall have the right to maintain the above described parcel
including but not limited to planting and trimming grass and/or bushes,
fertilization and irrigation and removal of trash and brush.
5. Access to the parcel by City personnel must be maintained by Licensee for
inspection and maintenance .
6. No construction shall be allowed on this parcel without express written
permission from the City.
7 . Upon abandonment of any right or privilege herein granted, the right of
Licensee to that extent shall terminate, bu t its obligation to indemnify and
save harmless the City, its officers and employees, shall not terminate in any
event.
a. The rights granted Licensee hereunder may not be assigned without the
written consent of the City.
9 . Licensee shall comply with all applicable laws and ordinances and all rules,
regulations and requirements of any environmental standards and conditions
of the premises. If, as a result of the Licensee's occupancy of the premises
and its operation hereunder, any such law, ordinance, rule or regulation is
violated, Licensee shall protect, save harmless, defend and indemnify City
from and against any penalties, fines , costs and expenses including legal
fees and court costs incurred by City, caused by, resulting from or connected
with such violation or violations .
In granting the above authorization, the City reserves the right to make full use
of the property involved as may be necessary or convenient in the operation of
the water works plant and system under the control of the City .

service on SWCP ,LLC property is hereby declared to be null and void . An extension of
Englewood water to a new, unattached building on this site is denied . This denial shall remain in
effect until such time as SWCP ,LLC can furnish the City of Englewood with verifiable
documentation that no replatting or subdivision or transfer into separate ownership of your
property will occur, as was stipulated in the Agreement to extend water service.

Littleton/Englewood WWTP. Each of these issues will be discussed at future Water and
Sewer Board meetings as meeting time and schedule allow. The tentative schedule can
be adjusted as the length of the board agenda dictates.
1. Facility Odors -This is a continuing, high priority concern at the facility.
Operation in December and January resulted in odor production and odor reports
from the public, city council and staff and plant staff. The causes and corrections
will be discussed at the March meeting . In addition, several components of the
Phase Ib construction project are for odor control and will also be reviewed.

3. Watershed Management -The regulatory agencies are encouraging the
formation of watershed management groups to make water quality decisions .
Several groups already exist in Colorado (e .g ., Cherry Creek, Clear Creek ,
Chatfield Basin) and we are now trying to organize a group on the South Platte
River through Denver. The group would be responsible for segments 6, 14 and
15 , from the Chatfield/Bear Creek/Cherry Creek Dams to Fort Lupton.
Tentatively scheduled for the May meeting.

ammonia standard that may affect plant operations . The new standard would be
close to the existing summer standard (approximately 3 mg/l) and would be
applied year round. There would be no seasonal variation in the standard as
currently exists in Colorado.

Odor Report Summary to Ann Nabholtz
January 8, 1998
Odor report on Sunday, January 4, 1998:
A chemical odor removal system controls odors from two major processes at the plant. On
January 3, there were no chemicals available for odor removal and the system was operated at
reduced efficiency.
• Sodium hypochlorite (bleach) was ordered the previous week for a January 5 delivery based
on routine chemical usage and volume remaining in tank.
• · System chemical demands increased, resulting in higher than expected chemical usage .
• Chemical supply ran out at approximately 3:00 PM on Saturday (January 3).
• Odor treatment continued through the use of odor controlling chemic al samples on hand.
However, these chemicals are not specifically effective on hydrogen sulfide.
• Sodium hypochlorite was received early January 5, as ordered and the system resumed
normal operation.
• Process area chemical monitoring procedures have been reviewed and revised to prevent
reoccurrence.
• The cause of increased usage has been identified and will be repaired (high priority.)
Odor report on Sunday December 21. 1997:
An odor report for Sunday, December 21 from the 3200 block of South Clay (four blocks east of
Federal Blvd.) was made on January 4. The specific odor source was not determined in this
report and weather conditions at the time of report were calm. The following summary includes
conditions that may have caused the report.
P rocess co ntro COil a10ilS relatin~ to potential odor production :
Odor control system -The odor control system is specifically designed to remove hydrogen
sulfide (rotten egg odor) from process air passing through the trickling filter . Recent mechanical
and control failures in the odor control system have been corrected and the system is adjusted to
match hydrogen sulfide production from the filter.
Inverted siphon -These structures allow wastewater from the south eastern portion of the LIE
WWTP service area and the Littleton service area to pass beneath Little Dry Creek at the comer
of West Dartmouth and South Platte River Drive. The siphons gradually collect wastewater
solids and gen erate odors. The odors frequently vent to atmosphere due to physical blockage of
air flows at the siphons. Both siphons were cleaned in early December and will be placed on a
regular schedule for cleaning by respective entities. Collection and treatment of odors from the
siphons is part of the construction project.
Anaerobic digester foaming -Anaerobic digesters stabilize collected wastewater solids prior to
beneficial use in a land application program. The digester system is foaming and occasionally
has spilled over the wall and onto the ground. Exposed in quantity , this foam can generate an

"earthy" to "ammonia" odor. While contained to the immediate area, spilled foam is returned to
the process and cleanup focuses on immediate removal of spilled foam to minimize odor.
Process operating parameters are being adjusted to reduce and/or eliminate foaming conditions.
Normal system operation is anticipated by Monday, January 12 .
Biosolids storage -Wastewater solids, following anaerobic digestion, are dewatered and
transported to beneficial use land applic ati on sites. Occasionally weather conditions or
equipment repairs require temporary storage of these biosolids on-site . As specific conditions
dictate, priority is to remove these stored biosolids as soon as possible . Recently, one truck has
been out of service for three weeks for repairs. While removal of stored biosolids has been
constant, plant operation has kept the stored inventory at a constant level for the duration of the
repair period. The last of the stored inventory was removed January 8. Any time biosolids
require on-site storage, an odor suppression chemical is applied frequently (every 2-4 hours).
This is a minor source and is being corrected in the construction proj ect.
Construction activities impactin2 odor 2eneration/control:
Influent sewer work -Phase 1 b construction requires the installation of influent channel and grit
basin coverings to help control interceptor and headworks generated odors. Three fourths of the
covers are in place; however, planned ventilation equipment will not be operational for
approximately three months. Recent investigation indicates high concentrations of hydrogen
sulfide are accumulating and venting from under the covers. The increase in reports appears to
correlate with the installation of these covers and investigation will continue in this area.
Immediate correction for this condition is to remove some of the cover panels and allow more
normal ventilation to minimize hydrogen sulfide accumulation .. A longer term solution will be
investigated to provide odor control until construction in the area is compete.
Anaerobic digester piping work -Construction activity related to the rehabilitation and
improvement of the process has restricted the ability to effectively remove foam from digesters.
Temporary process piping is currently being installed to facilitate foam removal and maintain
process operation while construction continues. Temporary installation should be completed by
the end of this week.
Anaerobic digester construction sequencing -Construction activity on the improvement of the
process requires that anaerobic digesters be removed from service and cleaned. This cleaning
process exposes digester sludge to the atmosphere for short periods -usually less than a week .

Three more digester transfers are anticipated in 1998 and is estimated to be complete by the fall.
These occurrences are ve ry short in duration.
