Manager 1) MINUTES OF THE MARCH 10, 1998 MEETING. The Englewood Water and Sewer Board Minutes from the March 10, 1998 were approved as written. Mr. Vobejda moved; Mr. Otis seconded: Ayes: Nays: Members absent: Motion carried. To approve the March 10, 1998 Englewood Water and Sewer Board Minutes as written. Habenicht, Burns, Otis, Guy, Vobejda, Bradshaw None Clark, Higday 2) GUEST: MICHAEL ROSEN -ATLAS METAL & IRON. Mr. Michael Rosen appeared representing Atlas Metal & Iron requesting their current minimum charge on the water and sewer billing be reduced on their 6 '' water tap at the I General Iron site at 600 W. Bates Ave. Mr. Fonda noted that the 6'' tap represented the potential demand that the City is obligated to meet and the minimum charge covers the City's expenses for maintaining that capacity demand in reserve. Mr. Fonda noted that an alternative would be for Atlas to surrender their tap credits and reduce the water tap to a smaller size. Mr. Rosen did not consider that a viable alternative. The Board denied Mr. Rosen's request. Ms. Bradshaw raised the issue of proposed development of the General Iron site, specifically the Pick and Pull, a car crushing operation. Discussion ensued. 3. SOUTHERN PACIFIC RAILROAD RIGHT-OF-WAY CROSSING. As part of the Southwest Corridor Light Rail Project, two locations of the heavy rail railroad tracks have been modified requiring additional encasement of the existing sanitary sewer pipes. The railroad crossing licenses must be modified to reflect these changes. The easements are located at Yale & Bates and Kenyon & Santa Fe. Ms. Habenicht moved; Mr. Burns seconded: Ayes: Nays: Members absent: Motion carried. To recommend Council approval of the Southern Pacific Railroad Right-of-Way Crossing Modifications License Agreements. Habenicht, Burns, Otis, Guy, Vobejda, Bradshaw None Clark, Higday 3. CITY DITCH SMALL LAND ACQUISITION. The City of Englewood's Water Department inquired about the possibility of placing a gate on the parcel located at S. Bannock and W. Jefferson Ave., which adjoins City Ditch. The parcel is owned by Arapahoe County and was acquired due to delinquent taxes. The City Ditch was recently piped at this location and a gate is necessary to control access. The County has no use for th i s piece of land and would be willing to transfer ownership to the City of Englewood for the unpaid tax amount. Mr. Otis moved; Ms. Habenicht seconded: Ayes: Nays: Members absent: Motion carried. 4. LETTER FROM SHEA HOMES. To recommend Council approval of the small land acquisition at W. Jefferson and S. Bannock St. for a City Ditch gate from Arapahoe County. Habenicht, Burns, Otis, Guy, Vobejda, Bradshaw None Clark, Higday The Board received a copy of a letter dated March 2, 1998 from Shea Homes recognizing the advantage to sharing information regarding planning and infrastructure efforts with the City's McLellan property at areas 81 and 85 at Highlands Ranch. Mr. Fonda told Shea Homes that, per the Board's direction, he cannot discuss selling the property. 5. DISSOLUTION OF VALLEY WATER DISTRICT. James Collins,· Counsel to Valley Water District, submitted an Agreement and Plan for Dissolution for the Valley Water District. It is proposed that Englewood acquire this district to serve the residents in that area. The Board directed Stu to continue negotiations and submit the final agreement to the Board for discussion at a future meeting. Stu noted that since part of the Valley Water District is in Littleton, the municipality would be involved as a third party. 6. GEORGE & KATHY HOERNIG -3086 S. OGDEN ST. The Board received correspondence from Joseph Davies, attorney for the Hoernig's, Colleen Caudill, Englewood's Risk Manager and CIRSA about the Hoernig's claim regarding their sewer line back-up that caused a sink hole in their alley. Ms. Hoernig will appear at the next Water Board meeting to discuss. 7. NEW CHAIRPERSON. Matt Guy expressed his interest in filling the vacant Water and Sewer Board Chairperson position. Ms. Habenicht moved; Ms. Bradshaw seconded: Ayes: Nays: Members absent: Motion carried. To appoint Matt Guy as the next Water and Sewer Board Chairman for Mary Neumann's vacated position. This plan has been developed by local governments and water providers working with environmentalists, the Farm Bureau, ranchers, residents of the area and others. The entire final plan is enclosed. As you know, the Forest Service issued an EIS in spring of 1997 considering recommending that Congress designate the South Platte River between Elevenmile Reservoir and Strontia Springs and the North Fork as a Wild and Scenic River. The Forest Service chose two preferred alternatives -(1) designating the mainstem or (2) selecting a local government alternative which we were charged with developing in concert with other interested parties. That was referred to as Alternative A2 in the Forest Service EIS; we now refer to it as the South Platte Protection Plan. Our hard work is now paying off. We expect to submit this local alternative before the end of May. I will be signing the transmittal as Chairman of the Wild and Scenic Task Force and will attach any letters of support which you send to me. We are asking that you: 1. Send a letter or resolution of support of the South Platte Protection Plan by Tuesday May 19 to the above address. If you adopted a resolution on this local effort last spring, you may want to reference that resolution . Address it to Rick Cables, Forest Supervisor, U.S. Forest Service, 1920 Valley Drive, Pueblo, CO., 81008. We will collect all the letters, and submit them with a single transmittal jointly with Denver Water. 2. We at the Englewood Utilities Department are very interested in the feedback we receive from our customers . In response to your letter, Mr. Fonda, Director of Utilities, has waived the $1 . 77 late charge on your account. In response to your other requests : Number 1. The Utilities Department does not keep copies of the bills and notices it sends to its customers . All billing and payment activity is posted to the account. Number 2. The account will be credited . Number 3 . Because of the nature of our billing cycles and other related collection activities we unable to limit the mailing of final notices to specific days of the week. Number 4. You are far from being the only person we have heard from to whom this has happened . We take every measure to insure the accuracy and reliability of our billing operation. However, once the bill leaves our hands we have no control over what may happen to it. Please also bear in mind that not all of our customers are as conscientious with their payments as are you. It is towards that other segment of our customer population the final notices are directed . It is an unfortunate fact oflife that occasionally, for various reasons, our dependable customers receive these notices . When they do we are willing to work with them, as we have with you . • Number 5. We are going to change the final notice to read "five business days". We just took delivery of 150,000 final notices, so rather than waste our customer's money, we will use those up first , then change the wording. At that time I took your word that all efforts were being made to improve both the quality of water and the customer service. I know that improving the quality in a long-term process, currently underway. However, improving customer service should be a less difficult proposition . I arrived home after 6 :00 p.m. today to find the enclosed in my mail. Please examine the attached carefully and you will understand why I am so angry. This is marked FINAL NOTICE. I never received an initial invoice. I never received any interim notice. I have no way of determining whether the sums on this notice are accurate and true . This FINAL NOTICE was mailed on 04-16-98 . That means it would not be received until the Utility Office was closed for three full days, and only five days are provided for response. This FINAL NOTICE also threatens action by the County Treasurer and imposes penalties unclear1y and unfairly. This account has been paid ON TIME and IN FULL for almost 42 years. The Utility Department records should reflect th is at every instance , indicating that something was amiss. To send only a final notice, with such unpleasant and threatening wording is wrong and counterproductive . Without exception, each time I have called the Utility Department in the last 42 years I have received, at best , misinformation. Sometimes I have been lied to . But this is a prime example of bureaucratic misuse of power and I strongly recommend that procedures be changed . I am separately sending my payment, with penalty, in my own envelope , to the Billing Agency. However, I request that you consult with the Utility Director and arrange for the following: 1. for me to receive a copy of my original invoice and copies [if any] of notices of past due status prior to this final notice; 2. for me to receive a credit of $1 .77 on my next bill if that $1.77 marked other on this notice is indeed an undeserved and unexplained penalty; 3. an assurance , in writing, that such notices be mailed ONLY Monday through Wednesday so that recipients have an opportunity to contact the Utility Department before any time limit comes into play; 4 . an apology from the Utility Department for its carelessness and insensitivity; 5. a review of Department mailing procedures. If there recently have been an unusual number of delinquencies I can assure you that it is NOT the U.S. Postal Service . I personally have outstanding and reliable mail delivery, as has been my universal observation. Ogden Dear Mr. Easterly, I represent George and Kathy Hoernig who have asked me to assist them in obtaining payment for damage to the sewer line from the city main to their home. It is my understanding that the line was broken by the weight of a trash truck which drove into a sink-hole in the alley behind the Hoernig home. Mr. and Mrs. Hoemig have made demand on their insurance company for reimbursement, but the company has denied coverage for the loss . Inasmuch as the damage was caused by a dangerous condition of a city right-of-way, and the activity of a city contractor it would appear that the City is responsible for the damage and should reimburse the Hoemigs the cost of the repairs . I am enclosing copies of documents which reflect the city's investigation of the incident and the cost of the repairs. The cost to the Hoemigs of repairing the line totaled $2 ,629 .50. Please give this matter your immediate attention. If you require further information, you or your representative may contact me at any time. Ogden Dear Mr. Easterly, I represent George and Kathy Hoernig who have asked me to assist them in obtaining payment for damage to the sewer line from the city main to their home. It is my understanding that the line was broken by the weight of a trash truck which drove into a sink-hole in the alley behind the Hoernig home. Mr. and Mrs. Hoemig have made demand on their insurance company for reimbursement, but the company has denied coverage for the loss. Inasmuch as the damage was caused by a dangerous condition of a city right-of-way, and the activity of a city contractor it would appear that the City is responsible for the damage and should reimburse the Hoernigs the cost of the repairs. I am enclosing copies of documents which reflect the city's investigation of the incident and the cost of the repairs . The cost to the Hoemigs of repairing the line totaled $2 ,629 .50 . There is also no risk in improving the real estate (participating in improvements) then having the market take a downturn. CONS The market is good toady , there are many potential buyers. The market could take a downturn and take many years to recover , in wh ich time Englewood could need the money. Estimated land value today is in the $2.00 to $2 .25 per square foot range , or $8 , 102, 160 to $9, 114 ,930 range. THK Associates. Inc OPTION TWO PARTICIPATE IN THE IMPROVEMENT DISTRICT DEVELOP ASIDE FROM SHEA HOMES PROS The total cost to Englewood would be approximately $1, 700,000 for their portion of the improvements, and we estimate that the value of the land would increase to $2.75 to $3 .00 per square foot, or $11,140 ,470 to $12,153,240, prior to present value considerations. CONS The improvements could be made with Englewood responsible for their fair share, which is yet to be negotiated. The market could stall, leaving Englewood with cash outflows when inflows are needed. Development without Shea Homes would result in a less efficient land use plan , inhibit access to the northwestern 53 acres, and cause competing developments. THK Associates. In c. OPTION THREE JOINT VENTURE WITH SHEA HOMES Basic Terms Shea Homes would front all costs and receive a preJerred return on negative cash flows of 9 3 . After all costs are recovered, Shea Homes and the City of Englewood would participate in revenues on a proportional basis of acreage contributed. PROS Eliminates risk of negative cash flows to Englewood from developing property. Places a qualified developer in charge of the project. CONS If the market takes a downturn, the preferred return to Shea Homes on costs could erode future payments to Englewood. The present value of Englewood's cash flow, depending on the chosen discount rate could be less than an outright sales or trade. At a safe rate of 6.5 3, annual returns would be in the $526,500 to $$591 ,500 range. CONS The property is sold at less than true market value. The City of Englewood is unable to reinvested the property in areas that provide adequate returns. The City of Englewood does not reinvested the capital and receives no future income. T HK Associates . Inc. OPTION FIVE TRADE THE PROPERTY FOR AN INCOME PRODUCING ASSET The possibility of trading the land for an offic~ building, industrial building, etc. also exists. In this case the value of the land would be determined, then traded for an asset of equal value. The City of Englewood would receive income from that asset. PROS The trading for another asset would protect Englewood from future inflation or erosion of capital. The return generated from an income property would most likely be greater than a safe rate from alternative investments . We would estimate that a 93 to 103 return is likely, or $729,000 to $910,000, annually . CONS Future market values decline and principal is lost. The asset traded for is overvalued/land being traded is undervalued and capital is lost. The tenant(s) of the property become insolvent, the income stream is at risk . Management of the asset can be time consuming. THK Associates . Inc. SUMMARY Based on the preliminary evaluation to date , THK believes that the best options for the City of Englewood related to the subject property are aq. outright sale or trade for an income producing asset.
