1. MINUTES OF THE SEPTEMBER 15, 1998 MEETING.
The Englewood Water and Sewer Board Minutes from the
September 15, 1998 meeting were approved as written.

2. MCLELLAN RESERVOIR PROPERTY.
The Board received a memorandum dated October 9, 1998 from
Chuck Esterly, Englewood's Director of Public Works. Mr.
Esterly reviewed the proposal for the PA84 Detention
Facility, involving City owned property near McLellan
Reservoir, and believes it is "a reasonable solution that
should have minimal impact on the City-owned property in the
vicinity." THK, the City's consulting engineers, recommends
that the adjacent road be raised 5'. The Board directed Mr.
Fonda to proceed to negotiate an agreement.

3. DEVELOPMENT OF HIGHLANDS RANCH BUSINESS PARK.
The Board received a copy of the letter sent to Mr. Chester
Latcharn of Shea Properties stating, "the City is "ready and
willing to immediately join Shea homes and Lucent
Technologies in developing standards for the Highlands Ranch
Business Park which exceed the zoning requirements and would
apply to the entire business park." Limited participation
in rnonurnentation was discussed.
Torn Burns entered at 5:25 p.rn.
4. VALLEY WATER DISTRICT DISSOLUTION.
The Board received a letter from James Collins of Collins
and Cockrel representing Valley Water District, asking that
Englewood reconsider their request to incorporate the Valley
Water District into Englewood upon dissolution. Stu
discussed reasons for not dealing directly with a district
located within another City's jurisdiction.

5. FIRE HYDRANT USAGE POLICY.
Stu discussed a recent case of a construction company taking
water from a fire hydrant without a permit or permission.
The Board noted that this was an unacceptable practice and
recommended a substantial fine. The Board directed Stu to
draft an ordinance imposing a f in~e for taking water from an
Englewood fire hydrant without a permit.
6. MATT GUY'S RESIGNATION.
The Board regretfully received Mr. Guy's resignation from
the Englewood Water and Sewer Board. The Board wishes him
well in his future endeavors.
The next Water and Sewer Board meeting will be November 10,
1998 at 5:00 p.m. in Conference Room A.

Our preliminary analysis of the proposed drainage improvement referenced above allows me to
make tb.e following observations:
1) Utilizing the regional detention facility in its proposed location is of significant benefit
to the city by allowing more devclopable acreage in the 40 acre parcel to the south (more
developable acres occurs because detention for the 40 acres will be achieved at this
proposed regional facility and not on the 40 acre parcel). Additionally, the 40 acre
parcel's land value is higher than the land value of Parcel 84.
2) Although final design has not been completed, we are working closely with Lhe Highlands
Ranch Metropolitan District and Shea Homes to maximize the development opportunities
for Parcel 84. We would recommend moving forward with preliminary city approvals
with the condition that final approval wil~ be given with final design plans.

SUPPLEMENT NO. 1.3...1_ TO CONNECTOR'S AGREEMENT
THIS AGREEMENT, made and entered into by and between the CITY
OF ENGLEWOOD, acting by and through its duly authorized Mayor and City Clerk ,
hereinafter called the "City," and SOUTHGATE SANITATION DISTRICT, Arapahoe
and Douglas Counties , Colorado , hereinafter called the "District,"
WITNESSETH:
WHEREAS, on the 2oth day of June, 1961, the City and the District
entered into an Agreement in which the City agreed to treat sewage originating from
the District's sanitary sewer system within the area served by the District, which
Agreement was most recently renewed by Connector's Agreement dated November
16 , 1988 ; and
WHEREAS, said Connector's Agreement provides that the district may
not enlarge its service area without the written consent of the City ;
NOW, THEREFORE, in consideration of the mutual covenants and
undertakings herein set forth , the parties agree as follows :
1. The City hereby consents to the inclusion of certain additional
area located in Douglas County , Colorado, owned by Manchester Homes and more
fully described on Exhibit A attached hereto and incorporated herein by reference ,
into Southgate Sanitation District. The City agrees that said additional area may be
served with the sewer facilities of the District, and that the City will treat the sewage
discharged into the City's trunk line from said additional area , all in accordance with
the Connector's Agreement dated November 16 , 1988 . Accordingly , Ex hibit A
referred to in Paragraph 1 of the Connector's Agreement dated November 16 , 1988 ,
is hereby amended to include such additional area .
2 . Each and every other provision of the said Connector's
Agreement dated November 16 , 1988, shall remain unchanged .

For and on behalf of Raymond Anilionis, Miller Engineering & Sw-veying, Inc . is submitting the
enclosed package for the inclusion into the District of a 5.41 acre parcel ofland located in the city of
Greenwood Village. (See enclosed vicinity map.) The parcel ofland will be broken into two (2) lots .
A 2 .5 acre lot will be broken out with the residual to be retained as lot #1. Both lots now have a city
zoning ofR-2.5 (residential) and will remain so. The lots will have 9,000-11,000 ±sq. ft. single
family homes built on them. Lot #2 will then be sold and lot #1 will be retained by the owner/developer
for his residence. The development schedule should begin with construction starting at or near January
1, 1999 and continue into summer of 1999. Service requirements should be those normal for this size of
residential home.

ATT. 'f
S & H Concrete Company wishes to connect several buildings to sewer and water with one water
service and one sewer service for all of the builidngs . These buildings are all separate and
located on the same parcel of subdividable land. The Municipal Code requires separate water and
sewer taps for each building where separate buildings on subdividable parcels are connected . S &
H Concrete has agreed to not subdivide the land unless the water and sewer arrangement is
brought to City Code .
The agreements is before the Board for its approval.
