MINUTES OF THE MAY 13, 2001 MEETING. The Englewood Water and Sewer Board Minutes from the May 13, 2001 meeting were approved . Mr. Kasson moved; Mr. Otis seconded: Ayes : Nays: Members absent: Motion carried. Mr. Higday entered at 5:04. 2. HYDRANT BOUNTY POLICY. To approve the May 13, 2001 Englewood Water and Sewer Board Minutes. Wolosyn, Burns, Higday, Otis , Kasson , Habenicht None Clark, Cassidy, Bradshaw The original hydrant bounty policy stated that if a person reports an unauthorized contractor taking water from a hydrant and there is a conviction, a $100 bounty will be paid. Staff recommends the policy be changed so the bounty is paid upon the offender receiving a ticket. Ms. Wolosyn moved: Mr. Kasson seconded: Ayes: Nays: Members absent: Motion carried. To approve the change in the fire hydrant bounty policy so the bounty is paid upon a ticket being issued to the offender. A request was made by the Southgate Sanitation District representing the owner, the Richard Lee Simon Trust, for inclusion into the Southgate Sanitation District. Supplement #150 is for Lot 2 that is 2.5 acres. The lot is zoned Residential and contains a single-family residence. The legal is attached as Exhibit A. The property is located west of Colorado Blvd. and south of Belleview in Greenwood Village. The address is 3749 Garden Ave . Mr. Otis moved; Ms . Wolosyn seconded: Ayes: Nays: Members absent: Motion carried. To Recommend Council approval of Southgate Supplement #150 to the Richard Lee Simon Trust. The Board received a copy of a Notice of Hearing on Petition for Dissolution for the Cherrymoor South Water and Sanitation District. The District will become part of the Cherry Hills Sanitation District. Englewood will maintain the lines. 5 . DARTMOUTH STORM SEWER INTERCEPTOR REPLACEMENT. Stu briefed the Board on the upcoming Dartmouth Storm Sewer Project. The project is expected to be bonded for $1 .2 million with a resulting rate increase. The issue will be reviewed with Council at their July 9 study session. The meeting adjourned at 5 :35 p.m. The next meeting will be held July 10 , 2001 at 5:00 p.m . in the Public Works Conference Room. The proposed project is the development of four single family residences on the vacant parcel of land just north of the existing Korean Church at the northwest comer of University Boulevard and East Dartmouth Avenue . The owner proposes to connect the new residences via a new 8". sSewer main to the 15 " Denver Metro main in University Boulevard . The nearest City of Englewood main is approximately 450 ' to the west of the project property in East Dartmouth Avenue . WHER~AS. the Bo~rd operates a municipal water supply system that provides water to customers in the Board's Combined Serv ice Area; and WHEREAS, Englewood operates a mun icipal water supply system that provides water for its residents and others, as determined by Englewood's City Council; and WHEREAS, a portion of Englewood's service area Hes within the Board's Combined Service Area , so that the two service areas share common boundary lines; and WHEREAS , in certain areas near those common boundary lines , customers located within Englewood's or the Board 's serv ice area, respectively, could be served more efficiently by facilities owned by the other entity ; and WHEREAS , the transfer of water service for certain customers from one entity to the other would eliminate the need for expensive and duplicative distribution facilities and would also provide better service to those customers; and WHEREAS , cocpen~tion among local governments to provide services is encouraged by Article XJV , Section 18(2)( a) of the Colorado Constitution; and WHEREAS, Englewood and the Board wish to provide a mechanism to · accomplish the transfer Of water service of customers between the two entities whenever such a transfer would be mutually beneficial. NOW THEREFORE, Englewood and the Board agree as follows: 1. Iransfer of water servir;e, The transfer of taps from water service provided by Englewood or the Board to water service provided by the other entity is hereby authorized. The transfer must be approved by Englewood's City Council or their qesignated representative and the Manciger of the Denver Water Board, using a form to be developed by the two parties . Transferring Entjty , The transferring entity will be responsible for providing notice to the customer whose tap is being transferred ~nd for the cost of physical connections required to allow water to be supplied by the receiving entity. 3. Recaiving Eniity. After the physical connection is completed, the receiving entity will provide water service to the transferTed tap, and bill the customer accordingly . 4. e.ayment of Tap Fees , It is anticipated that the Board and Englewood will transfer customers between themselves on numerous occasions, and that payment of tap fees for each transaction would be burdensome. Therefore, the parties agree to perform an annual reconciliation to determine if either party owes tap fees to the other. At the end of each CC11endar year in which water service has been transferred under this Agreement, the Board and Englewood will convert the taps each has transferred into%- inch equivalents, according to the table attached as Exhibit A. If one entity has transferred more equivalents than the other , then that entity will pay the then-current tap fee charged by the other for the number of excess %-inch equivalents. 5. Assignment. Neither party shall assign any of its rights and duties under this Agreement without the written consent of the other party . 6. Applicable Laws. This Agreement shall be governed by and shall be construed in accordance with the Constitution and laws of the State of Colorado . 7. Termination. This Agreement shall remain in force until superseded by mutL.1al agreement between the parties. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Utilities Department conducted an inventory study of the City's storm sewer system and found a storm sewer line located in the 1400 through the 2400 blocks of W. Dartmouth Avenue is in need of rehabilitation. This storm sewer line drains stormwaters for the Collegeview Drainage Basin , which serves the Scenic View area in northwest Englewood. Alternatives to rehabilitation were evaluated and a plan was recommended. In January, 2000 approval was granted for professional design services to prepare a complete set of construction drawings for the Dartmouth Avenue Storm Sewer Rehabilitation Project. This storm sewer line has experienced degradation to a level that immediate rehabilitation is necessary since the entire lower portion of the pipe has completely deteriorated and the street could collapse at any time. Rehabilitation will consist of replacing the existing storm sewer line with new rep pipe. FINANCIAL IMPACT Funds are available from the Stormwater Enterprise Fund for the proposed contract amount of $. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Utilities Department conducted an inventory study of the City's storm sewer system and found a storm sewer line in the 1400 through the 2400 blocks of W. Dartmouth Avenue in need of rehabilitation. The existing storm sewer has experienced degradation to a level that immediate rehabilitation is necessary since the lower portion of the line is completely disintegrated. - FINANCIAL IMPACT Since a guaranteed revenue stream is necessary to support the requested bonding issue, a rate increase is being proposed to support this project in the amount of %. Fonda , Director of Utilities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION The original Stormwater Fund was established in February 1993 to provide system maintenance , NPDES permitting , plan reviews and field locates but did not provide for major capital improvements and rehabilitation. Also recommending Council approval of a resolution for Award of Contract for construct ion of the storm sewer project and an ordinance approving the stormwater fee increase to meet the bond obligation at the August 6, 2001 meeting. RECOMMENDED ACTION The Utilities staff recommends Council approval of revenue bonds to finance the construction of the Dartmouth Avenue Storm Sewer Rehabilitation Project in the amount of$ .00. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Utilit ies Department conducted an inventory study of the City's storm sewer system and found a storm sewer line in the 1400 through the 2400 blocks of W. Dartmouth Avenue in need of rehabilitation. The existing storm sewer has experienced degradation to a level that immediate rehabilitation is necessary since the lower portion of the line is completely disintegrated. FINANCIAL IMPACT Since a guaranteed revenue stream is necessary to support the requested bonding issue, a rate increase is being proposed to support this project in the amount of %.
