MINUTES OF THE SEPTEMBER 10, 2002 MEETING. The Englewood Water and Sewer Board approved the minutes from the September 10, 2002 meeting. Mr. Higday moved: Ms. Wolosyn seconded: Ayes: Nays: Members absent: Motion carried. To approve the minutes from the September 10, 2002 Englewood Water and Sewer Board Meeting. Higday, Bradshaw, Wolosyn, Clark, Cassidy, Kasson None Moore, Otis, Habenicht 2. YOUTH MEMBERS ON THE WATER BOARD . The Board received e-mail from Julie Grazulis suggesting adding youth members of various City boards. The Board concluded that because of the nature of water law and the issues dealt with on this Board, it would not be practical to have youth members. The Board supported the idea of having youth members on applicable boards. 3. PUBLIC NOTICE OF SEWER RA TE INCREASE. The Board received a copy of the Public Notice published in the Englewood Herald of the sewer rate increase going before City Council. The Bi-City Wastewater Treatment Plant will require a major expansion of the existing facilities and construction of additional treatment processes. The proposed rate increase will pay for increased costs resulting from these requirements. New construction is necessary to accommodate recent denitrification requirements imposed by the State Health Department. Additionally, the South Platte River has recently been reclassified as a Recreational Class I river which requires increased pathogen destruction. The plant expansion portion of the project is the result of rapid growth in the area served by the plant. Growth has been nearly double the projections used in planning the last expansion. The project is currently being designed by Brown & Cauldwell Consulting Engineers. It is estimated that the total cost of the project will be $110 million, of which Englewood will be responsible for 55 %. Design should be completed by the first quarter of 2004, and at that time bids should be received for construction. Construction is expected to take about three years to complete. In order to finance this construction, the firm of Black & Veatch was retained to analyze financing alternatives. It was determined that a bond issue in the range of $55 to 60 million dollars would need to be issued. It is proposed that this issue be concurrent with the receipt of the bid. Sewer rates will need to be increased to pay the principal and interest on the new bonds. Black & Veatch is currently projecting that a rate increase of 20% is currently needed to show adequate coverage on our existing debt pri or to the issuance of the new bonds. Upon issuance of the new bonds, they are projecting rate increases of about 13% to 15% for the next four years to meet coverage req irements of the bond issue. Stu noted that there was a scheduled public hearing on October 7, 2002 to discuss the upcoming sewer rate increase. The rate increase will go for second reading on October 23, 2002 and become effective January 1, 2003. 4. REQUEST FOR CITY DITCH ENCROACHMENT FOR 2890 S. CLARKSON ST. Mr. and Mrs. Bray submitted a request for an encroachment into the City Ditch easement to allow for a remodeling addition to their home. The issue was tabled temporarily and will be presented at a future meeting. Stu reviewed the request and noted that he has no objection to what has been submitted so far. 5. CORRESPONDANCE FROM EUGENE NORMAN. The board receiv ed a four-page letter from Eugene Norman. Stu noted that the purpose of the letter was unclear and there appeared to be no practical application for his suggestions , but noted that citizens are always encouraged to submit correspondence or ideas to the board. The meeting adjourned at 5 :1 5 p .m. The next Water and Sewer Board meeting will be Tuesday, November 12, 2002 in the Community Development Conference Room. ATT. 2 Connection to fire hydrants in the City of Englewood shall be prohibited except by an employee of the City for municipal purposes or by an official of any fire department or district for fire suppression or emergency purposes. The City Manager or designee may authorize , by a permit , exceptions when necessary to meet emergencies or when a company or private individual, who is able to demonstrate the possession of proper equipment and knowledge of hydrant operation, requires the temporary use of large amounts of water. Water shall be taken from the hydrant through a meter with a backflow assembly and flow adjusting valve to be supplied by the applicant. Water may be taken only from those hydrant(s) which the City shall approve or designate. The applicant shall pay a damage deposit established by the City , a permit fee for use of the hydrant, the minimum charge for ten thousand (10,000) gallons of water, and the current per thousand gallon charge for any amount of water taken over ten thousand (10,000) gallons. (Code 1985, § 12-18-10; Ord. 99-38 ; Ord. 00-7) At this time we have a number of users who are utilizing the fire hydrants on a continual or permanent basis . Uses include mobile car washing, watering golf greens and landscape maintenance . These permit holders use the hydrant connections for business or other uses that continue from year to year. We are also holding a few new applications for hydrant permits because they are for more or less permanent uses . Do we want to start holding strictly to the Code or continue to issue fire hydrant permits for permanent or perpetual sorts of uses ? WITNESSETH: The City without any warranty of its title or interest whatsoever, hereby authorizes Licensee, its successor, assigns, to install a water line over the City's rights-of-way for the City Ditch, described as a parcel of land situated in the Northeast Quarter of Section 9, Township 5 South, Range 68 West of the Sixth P.M., County of Arapahoe, State of Colorado depicted upon the Exhibit attached hereto and made a part hereof. 1. Any construction contemplated or performed under this License shall comply with and conform to standards formulated by the Director of Utilities of the City and such construction shall be performed and completed according to the plans approved by the City. 2. The Licensee shall notify the City's Director of Utilities at least three (3) days prior to the time of commencement of the construction of, or any repairs made to, Licensee's water line so that the City may , in its discretion. inspect such operations. 3. Within thirty (30) days from the date of the commencement of construction of said water line, the Licensee shall complete such construction, place and maintain permanent, visible markers, of a type and at such locations as designated by the City's Director of Utilities, referring to the centerline of the installation and shall clear the crossing area of all construction debris and restore the area to its previous condition as near as may be reasonable. In the event the placing of the centerline markers and the clearing and restoration of the crossing area is not completed within the time specified, the City may complete the work at the sole expense of the licensee. 4. The City shall have the right to maintain, install, repair, remove or relocate the City Ditch or any other of its facilities or installations within the City's rights-of-way, at any time and in such manner as the City deems necessary or convenient. The City reserves the exclusive right to control all easements and installat10ns. 5. The stipulations and conditions of this License shall be incorporated into contract specifications if the construction herein authorized is to be done on a contract basis. -- 6. The rights and privileges granted in this License shall be subject to prior agreements, licenses and/or grants, recorded or unrecorded, and it shall be the Licensee 's sole responsibility to determine the existence of said documents or conflicting uses or installations. 7. The Licensee shall contact and fully cooperate with the City's personnel and the construction shall be completed without interference with any lawful, usual or ordinary flow of water through the City Ditch. Licensee shall assume all risks incident to the possible presence of such waters, or of storm waters, or of surface waters in the City Ditch. 8. All trenches or holes within the City 's rights-of-way shall be backfilled and tamped to the original ground line in layers not to exceed six ( 6) inches loose measure to a compaction of ninety percent (90%) Standard Proctor Maximum Density. 9. Licensee shall indemnify and save harmless the City, its officers and employees, against any and all claims, damages, actions or causes of action and expenses to which it or they may be subjected by reason of said water line being within and across and under the premises of the City or by reason of any work done or by omission made by Licensee, its agents or employees, in connection with the construction, replacement, maintenance or repair of said installation. Licensee, for a period of one ( 1) year beginning on ______ , 20_, warrants to the City that the water line will be free from defects in materials and will be free from defects in the installation of the water line into the City Ditch right-of-way . 10. It is expressly agreed that in case of Licensee 's breach of any of the within promises, the City may, at its option, have specific performance thereof, or sue for damages resulting from such breach. 11. Upon abandonment of any right or privilege herein granted, the right of Licensee to that extent shall terminate, but its obligation to indemnify and save harmless the City, its officers and employees, shall not terminate in any event. 2 In granting the above authorizatio~ the City reserves the right to make full use of the property involved as may be necessary or convenient in the operation of the water works plant and system under control of the City. COUNTY OF ARAPAHOE, STATE OF COLORADO . --~J -: -~ A IT., L/ GRANT OF CONSTRUCTION EASEMENT TIIIS AGREEMENT is made this day of 20_ by SCHWINN PROPERTIES LLC ("Schwinn"), whose principal place of business is 2597 South Harlan Court, Lakewood, Colorado 80227, and the CITY OF ENGLEWOOD ("Englewood"), a Colorado municipality whose principal place of business is 1000 Englewood Parkway, Englewood, Colorado 80110. WHEREAS, Schwinn desires to install a water service line in an Englewood City Ditch right-of-way in the location depicted upon the exhibit attached hereto and made a part hereof (the "Project"); and TIIE PARTIES covenant and agree as follows: l. Description of Project. Schwinn will install a water service line in the Englewood City Ditch right-of-way and cover same with clean fill dirt beginning in November, 2002. After the pipe is installed and covered, which is to be no later than February of2003 , Schwinn will do what is reasonably necessary to restore the property to the original condition. 2. Right to Store Materials. Englewood agrees to penn it Schwinn, in conjunction with the construction and installation of pipe , to store pipe, equipment and fill dirt on a site as indicated on the attached map. Schwinn agrees to erect a temporary security fence around the storage site and maintain adequate security for the site at all times . Schwinn further agrees to comply with all state and federal statutes and regulations regarding the handling, storage, and clean up of any hazardous materials used by Schwinn, its employees, agents and assigns in conjunction with the Project The location of the construction easement is depicted upon the attached Exhibit. 3. Length of Agreement. This Agreement shall expire on October 31, 2003. However, the Project must not begin before November l , 2002 . 4. Access. Schwinn shall have the temporary non-exclusive right to enter the property for any reasonable purpose necessary for the construction of the Project subject to the following restrictions: l) normal working hours shall be from 8:00 a.m. until 4:00 p .m.; 2) the operation of equipment and heavy trucks will be permitted on the property only during normal working hours; 3) Schwinn will comply with all City of Englewood requirements regarding emergency access to the property . 5. Restoration. Schwinn will do what is necessary to restore the property to its original condition including but not lim ited to: regrading the property under this agreement and reseeding the property according to City of Englewood requirements . The restoration is to be completed by the expiration date of this Grant. 6. Site Condition. Schwinn will provide security for the site at all times. In addition, Schwinn will endeavor to keep the site in a visually acceptable manner during the term of this agreement, and Schwinn will maintain adequate dust control either by regularly spraying exposed soil with water or by other acceptable methods . 1 I -~ 7. Liability. Schwinn agrees to be liable and to hold harmless Englewood, its employees, tenants, guests and invitees from any and all claims, causes of action, and liability which may occur as a result of the actions of Schwinn including the cost of defending against such claims. 8. Insurance . Schwinn shall maintain in full force and effect a valid policy of insurance for the Project in the amount of$ property coverage and $ liability coverage. Schwinn further agrees that all Schwinn employees, contractors and sub-contractors working on the Project shall be covered by adequate Workers Compensation insurance. 9. Arbitration. The parties agree to submit any dispute to arbitration pursuant to Colorado law. RECOMMENDED ACTION The Englewood Water and Sewer Board , at their November 12 , 2002 meeting , recommended Council approval , by motion of the bid for Sludge Handling System for the Allen Water Treatment Plant Reservoir to SRS Crisafulli, Inc. in the amount of $84,971.00 . BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED Alum sludge is produced by t he settling process and by filter backwashing. The sludge builds up in the washwater reservoir and the settled so lids are pumped ou t by the sludge-handling barge and goes into the belt press process, wh ich dewaters the residuals. This process allows us to stockpile the dried sludge that will eventually be used in golf course berms and other projects. The existing sludge hand ling system was purchased in 1991 and has been used continually . The existing barge requires continuous repairs, resulting in downtime that is detrimental to sludge production. The Allen Water Filter Plant produces sludge year-round , and it is imperative to process that sludge be processed when the weather is amenable. When the schedule for removing sludge is delayed for repairs, it limits the volume in the sludge reservoir and the opportunity for remov ing it. The projected life span for this type of mach ine is 10 years . FINANCIAL IMPACT Requests for Bid were sent to six vendors for the Sludge Handling System. Two contractors picked up bid packages. A bid opening was held on October 8 , 2002. The follow ing responses were received: SRS Crisafulli, Inc. LWT, Inc. $84 ,971.00 $61,020 .00 Crisifilli , Inc. was chosen because their bid included a required pivoting system which allows for quick and easy maneuvering instead of tak ing a half-day's production to tear down and re-position the equipment. A Cris ifill i barge is currently be ing used and is a proven piece of equipment. Crissifulli has incorporated the pivoting system into their barge design for such small lagoon operations as ours . By purchasing another Cr isifilli barge , the plant can use its existing fittings and power cables. LWT does not have a pivoting system as a stock item . They stated that one could be fabricated, but would end up being a high-maintenance item. Bid requirements were for a 12-foot minimum dredging depth . LWT's equipment depth was 10 fee t. Crisfield , Inc is the recommended low , acceptable bidder at $84 ,971 .00 . The Utilities Department budgeted $95 ,000.00 in the 2002 Budget for this project.
