MINUTES OF THE FEBRUARY 13 , 2002 MEETING. The Englewood Water and Sewer Board approved the minutes from the February 13, 2002 meeting. Mr. Kasson moved: Mr. Otis seconded: Ayes: Nays: Members absent: Motion carried. To approve the Minutes from the February 13, 2002 Englewood Water and Sewer Board Meeting. Clark, Higday, Cassidy, Otis, Kasson, Habenicht None Moore, Wolosyn, Bradshaw 2. CITY DITCH LICENSE AGREEMENT -3055 S. UNIVERSITY BL VD . Pete Pappas, owner of the vacant land at 3055 S. University Blvd., appeared before to Board to request approval to allow his property to be connected to the existing 15" Denver Metro sewer line located at the east side of University and the Denver Water Department water main, also located in University. The proposed project is for the development of four single-family residences on the vacant parcel of land north of the existing Korean church at the northwest comer of University and E. Dartmouth Ave. Mr. Fonda agreed with the requested connections since connecting to Englewood's mains would be impractical because of the length of mains that would be necessary. Mr. Fonda noted that manholes and a maintenance agreement with Englewood or would be required for the sewer connection. The Board directed Mr. Fonda to send the Denver Water Department a letter stating Englewood's approval for Mr. Pappas to connect to their lines. Mr. Otis moved; Mr. Cassidy seconded: Ayes: Nays: Members absent: Motion carried. 3. WATER METER PURCHASE. To approve Mr. Pappas' request to connect water and sewer mains for four residential properties at 3055 S. University to the Denver Metro Sanitation District and the Denver Water Department. Clark, Higday, Cassidy, Otis, Kasson, Habenicht None Moore, Wolosyn, Bradshaw The Utilities Department purchases water meters needed for an entire year by requesting one large bid proposal for additional cost savings. The metering system is being converted to the ITRON Automatic Meter Reading System. All meters and registers will be compatible with the ITRON System. About $15,000 worth of these meters and yokes will be resold to Englewood customers for new installations as part of the flat-rate-to- meter conversion process. The remaining stock will be used to replace inactive or poorly functioning meters. Bids were received from two vendors -Mountain States Pipe & Supply was the low bidder for the ERT meters at $61,981 .36 and Dana Kepner was the lower bidder for the yokes, valves and fittings at $6 ,374.66. To recommend Council approval of the purchase of water meters from Mountain States Pipe for $61,981.36 and yokes from Dana Kepner in the amount of $6,374.66. Clark, Higday, Cassidy, Otis, Kasson, Habenicht None Moore, Wolosyn, Bradshaw 4 . EVALUATION OF THE ALLEN FILTER PLANT. The Board received a letter from the State of Colorado dated January 30, 2002 regarding a voluntary evaluation of the Allen Water Treatment Plant. The purpose of the Comprehensive Performance Evaluation is to identify factors that may be adversely impacting a plant's ability to achieve permit compliance without major capital improvements. This is part of a statewide project to document the performance of drinking water treatment plants using a consistent methodology. The evaluation for the Allen Plant is scheduled for April 19, 2002 . 5. DENVER POST ARTICLE-T-REX WORK SEVERS HISTORIC CITY DITCH. The Board received an article dated March 4, 2002 from the Denver Post discussing the agreement between the Denver Water Board and the Transportation Expansion Project to sever the City ditch under I-25 near the University of Denver. Denver has agreed to run between one-third and one-half of its normal flow of water in the ditch over the next two years while Englewood looks for a permanent source of replacement water. Stu noted there will be a "Save the City Ditch" meeting held by Englewood citizens on March 13, 2002 at 5:00 in the Library Conference Room. >, •. 6. WATER & SEWER RATE INCREASE. Stu discussed the economics and factors for a proposed water and sewer rate increase. Increased population and additional nitrate standards have contributed to the necessity of updating the water and wastewater treatment plants. It was noted that the last sewer rate increase was in 1982. The Board discussed spreading out the rate increases as not to create a hardship on the residents. Rate amounts will be reviewed at future meetings. An article notifying customers of the potential rate increase will appear in the next "Citizen." The meeting adjourned at 5.: 50 p.m. The next Water and Sewer Board meeting will be Tuesday, April 9, 2002 in the Community Development Conference Room. Fonda , Director of Utilities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION Ordinance No . 67 , 2001 -Centenn ial Water & Sanitation District. RECOMMENDED ACTION The Water and Sewer Board , at their April 9, 2002 , recommended Council approval of the License Agreement with Centenn ial Water & Sanitation District for crossing the 20' Mclellan line easement. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED Ord inance No. 67 , 200 1 was for two easement agreements , two temporary construction easements , two grant of easements and a quit claim deed for a 48 " raw wa t er line. An area approximately 20' x 30' was inadvertently omitted and would be included upon approval of the attached license agreement, which is for an area in a 30' easement that crosses Englewood 's 20 ' foot easement. This crossing contains Centenn ial 's 48" pipe, which goes beneath Englewood's 31 " Mclellan raw water line . The Licensee expressly assumes full and strict liability for any and all damages of every nature to person or property caused by the po int or points where the Licensee performs any work in connection with the crossing provided by the Licensee. The City reserves the right to make full use of the property necessary in the operation of the C ity . The City retains all rights to operate , maintain , install , repair, . remove or relocated any of its ' fac ili ties located within the City's right-of-way. FINANCIAL IMPACT None . LICENSE AGREEMENT THIS AGREEMENT, made and entered into as of the day of , 2002, by and between the CITY OF ENGLEWOOD , a municipal corporation of Colorado , hereinafter referred to as "City" and the CENTENNIAL WATER AND SANITATION DISTRICT, a Colorado quasi-municipal corporation, hereinafter referred to as "District'', WITNESSETH: The C ity without any warranty of its title or interest whatsoever, hereby authorizes District, its successors and assigns , to install a 48" ductile iron water pipeline in the Southeast 1/.i of Section 31, Township 5 South, Ranch 68 West of the Sixth Principal Meridian in Arapahoe County , State of Colorado , depicted upon Exhibit A attached hereto and made a part of: 1. Any construction contemplated or performed under this License shall comply with and conform to standards formulated by the Director of Utilities of the City and such construction shall be performed and completed according to the plans approved by the City . 2. The District shall noti fy the City 's Director of Utilities at least three (3) days prior to the time of commencement of the construction of, or any repairs made to , the District 's installation of the 48 " ductile iron water pipeline so that the City may , in its discretion, inspect such operations. 3. Within thirty (30 ) days from the date of commencement of construction of said 48 " ductile iron water pipeline, the District shall complete such construction, place and maintain permanent, visible markers , of a ty pe and at such locations as designated by the City 's Director of Utilities, referring to the centerline of the installation and shall clear the crossing area of all construction debris and restore the area to its previous condition as near as may be reasonable . In the event the placing of the centerline markers and the clearing and restoration of the crossing area is not completed within the time specified, the City may complete the work at the sole expense of the District. 4. The City shall have the right to maintain, install, repair, remove or relocate its facilities or installations within the City 's easement, at any time and in such manner as the City deems necessary or convenient. The City reserves the exclusive right to control all easement and installations. 5 . The stipulation and conditions of this License shall be incorporated into contract specifications if the construction herein authorized is to be done on a contract basis. 6. The rights and privileges granted in this License shall be subject to prior agreements, licenses and/or grants , recorded or unrecorded , and it shall be the District's sole responsibility to determine the existence of said documents or conflicting uses or installations. All trenches or holes within the City 's easement shall be backfilled and tamped to the original ground line in layers not to exceed six (6) inches loose measure to a compaction of ninety percent (90%) Standard Proctor Maximum Density. 8. District shall indemnify and save harmless, to the extent of the law, the City, its officers and employees , against any and all claims, damages, actions or causes of action and expenses to which it or they may be subjected by reason of said 48" ductile iron water pipeline being within and across the premises of the City or by reason of any work done or omission made by the District, its agents or employees, in connection with the construction, replacement, maintenance or repair of said 48" ductile iron water pipeline. 9. It is expressly agreed that in case of the District's breach of any of the within promises, the City may , at its option, have specific performance thereof, or sue for damages resulting from such breach. 10 . Upon abandonment of any right or privilege herein granted, the right of the District to that extent shall terminate , but its obligation to indemnify and save harmless , to the extent of the law , the City , its officers and employees , shall not terminate in any event , except as to the Centennial Water and Sanitation District pursuant to the provision of paragraph 8 above . In granting the above authorization, the City reserves the right to make full use of the property involved as may be necessary or convenient in the operation of the water works plant and system under the control of the City . BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The City of Englewood provides sewage treatment to a population of about 70,000 people outside the City through contracts with numerous connector districts . The area is defined by the natural drainage and extends south and east from Broadway to the Valley Highway and from Hampden to Lincoln Ave. excluding Highlands Ranch. By contract the City of Englewood must approve any additions of land to be served by the districts. These are usually in-fill situations that are within what the City considers to be the area it has committed to serve. Adequate capacity has been provided in the treatment plant to accommodate all such future inclusions. Annexation of this parcel of land will not increase the tap allocation of the Southgate Sanitation District. A request was made by the Southgate Sanitation District representing the owner, Judy C . Geiger-Jennings and Carlton R. Jennings, Inc., for inclusion into the Southgate Sanitation District. Supplement #153 is for Lot 7, together with the North Yz of vacated portion of East Garden Avenue 124 for an area that is 2.19 ac res. T he lot h as a Residential Zoning and contains a single-family residence. The legal is attached as Exhibit A. Those water rights were sold to the Colorado Central Power Compan y by deed on January 17 , 1957 . That severed any connection between the water rights on the McBroom Ditch and the properties on S. Julian , originally Lots 15 and 16. As for your concerns regarding a provision for taking water, which you claim y·1u are due as owner of the se lots. should the Water Commissioner for the State of Colorado find. in a judicial proceeding, that you are in fact the owner of certain shares of stock in the McBroom Ditch Company or that you are in fact entitled to certain water out of the McBroom Ditch, the McBroom Ditch Company will ..;ertainl y compl y with any such ruling and provide water to the proper owner of said water rights . However. until such a determination by the Colorado Water Commissioner. the McBroom Ditch Company 's position is that the one share of McBroom Ditch stock which evidenced the above water right was in fact transferred to the Colorado Central Power Company which was in tum transferred to the City of Englewood. Beginn i ng mid-April, 2002 , chloramines will be used i nstead of chlorine as the disinfectant in your tap water. Many other drinking water providers in Colorado and the re st of the nation currently use chloramines. Locally, Denver Water, Aurora, Highlands Ranch , and Westminster use chloramines. The primary reason for this change is to lower d isinfection by-products in the water and to continue to meet the increasingly stringent Drinki ng Water Standards regarding disinfection by-products. Chloram i ne treatment has been used effectively for di sinfection purposes for many years by drinking water providers across t he country. As an added benefit, chloramine treatment has been shown to lessen the chlorine taste i n water. The Utilities Department is confident that the new treatment method will improve the taste and odor of Englewood 's water. Chloramines do not pose a health hazard to the general population. However, they can be a serious problem to individuals with kidney dise ase undergoing dialysis treatment on an artificial kidney machine unless the chloramines are reduced to acceptable levels. The Utilities Department has been working with the State and County Health Departments to ensure that everyone involved with the treat- ment of dialysis patients is alerted and that proper precautions are taken. The health care providers are aware of the changes and have the necessary procedures in place to ensure patient safety. If you have concerns, check with your treatment center. Chloramines, like chlorine, are toxic to fish. Lett i ng the water sit for a period of time helps dissipate chlorine, but it is not a reliable way to treat the water for longer lasting chloramines. Therefore, if you have pet fish in an aquar i um, you should assure that the fish are properly protected.
