The Englewood Water and Sewer Board Minutes from the December 10 , 2003 meeting were approved as written. Mr. Cassidy moved; Ms. Bradshaw seconded: Ayes: Nays: Members absent: Motion carried. GUEST: BILL McCORMICK -TRIHALOMETHANES. Bill McCormick, the Operations Superintendent of the Utilities Department, appeared before the board to discuss cancer-causing agents, including trihalomethanes, which are monitored by the Allen Plant routinely. Bill noted that Englewood's readings have been consistently below EPA's standard. Stu noted projects that are being considered to maintain Englewood's water quality and possible rate hikes to fund these projects. 3. GARAGE TAP-3555 S. OGDEN ST. Mr. David Penland of 3555 S. Ogden St. submitted a request to extend his water and sewer service from the main house. Mr. Penland, who is handicapped, is requesting the variance to convert his garage to living quarters for his use. The variance will be recorded against the title and will be rescinded upon Mr. Penland vacating the residence. Mr. Otis moved; Mr. Habenicht seconded: Ayes: Nays: Members absent: Motion carried. Approving Mt. Penland's request for a variance to extend his water and sewer lines from the main house at 3555 S. Ogden St. Wolosyn, Clark, Cassidy, Otis, Kasson, Habenicht, Bradshaw, Moore None Higday 4. WINGATE HOTEL SEWER TAP AGREEMENT. Den Mar has submitted a Hotel Sewer Tap Agreement for their proposed 85-unit hotel to be built at 8000 E. Peakview Ave. in Greenwood Village. The proposed agreement has been reviewed and approved by Englewood's City Attorney. The proposed agreement would set the sewer tap fees at half the standard fee, with no additional tap fees to be collected unless the water usage exceeds the agreed upon limit of 100 gallons per unit, per day. Tap fees in the agreement total $63,762.50. Mr. Cassidy moved; Mr. Otis seconded: Ayes: To recommend Council approval of the Wingate Hotel Sewer Tap Agreement. ENGLEWOOD/CENTENNIAL WATER SUPPLY AND FACILITIES AGREEMENT. David Hill, Englewood's Water Attorney, and Joe Tom Wood of Martin and Wood Engineers appeared before the Board to re v iew the proposed Englewood/Centennial Water Supply and Facilities Agreement. Stu reviewed the method outlined for calculating the price of water based on deli v eries and availability. Mr. Hill and Mr. Wood reviewed the history of the agreement and addressed questions from the board. Stu noted the agreement would be retroactive to January 1, 2003. The Board recommended proceeding with a motion approving the agreement to expedite Council receiving the agreement. Mr. Kasson moved ; Mr. Otis seconded: Ayes: To recommend Council approval of the Centennial/Englewood Water Supply and Facilities Agreement. For the past five years, I have been responsible for the issuance of all permits for fire hydrant use within the City of Englewood. During this time, and especially within the last year , I have observed a growing number of applicants who desire to use the City 's hydrants on an ongoing basis. These companies include street sweepers , tree sprayers , the golf course and the Englewood Public Schools . It seems to me that the primary reason for this increase in new applicants is the low cost of using an Englewood fire hydrant. By way of comparison, I have included the Denver Fire Hydrant permit policy as well as our Englewood permit policy for your perusal. In addition , I have included several letters that customers have submitted for your consideration. We use a hydrant simply because it would take a long time to fill such a tank with a garden hose . We access a hydrant near the old mini-golf site at 2101 W . Oxford and at our shop area at 4000 S . Clay . We always obtain a p ermit and we have the proper valve for using the hydrant. We have kept records of our tank watering since 1995 . I would estimate that we use between 20 ,000 and 30 ,000 G. of water during a "typical" Winter season. This year we started tank watering and then decided just to put water back in our system-which we like to avoid if possible. Certainly our greens involve a large investment at the course and we appreciate being able to use the hydrants . We hope to be able to continue to access them in the fu ture . Aa the owner of a mobile wash buaineBS, I am retponding to that letter. 'lbe mobile wash business ls dependent upon fire hydrant uee. There are several reasons for hydrant use. The location af the water source in respect to the compa.ny we service is the main real!IOn. Many companies have water available for use, but to tap into their water would require hundreds of feet of hose to have the water available at the actual waah location. Not only does that create a safety hazard to the employees of the company, but it is quit.e impractical as the proceea is ao much elower due to leH water pressure. During the winter months, many companies turn t.heir outside water faucets oft', therefore they would not even be an option for wash use. My company uses limited Englewood water to wuh two am.all car dealerships and Meadow Gold Dairy. We would like to continue uaing the hydrant at Windermere and Lehigh because it is right in front of the shop and moat convenient. I have been a good customer and report my meter readings monthly as required. I am cert.ainly aware afthe water crisis. AB a company, we are trying to conserve water where possible. Without the use of water, particularly flre hydrant water, I would no longer be able to operate as a bu1iness, and would have t.o cloae down, leaving several employee• and myself without income. If there is suitable snowfall and rain fall amounts the well keeps up with the plant and we have no reason to use the hydrant. But as we all know we can not predict the future of the weather, so it would be greatly appreciated if the City of Englewood would consider renewing our permit for temporary use of the hydrant in 2003. (Code 1985 , § 12 -lB-9; Ord. 00-7 ) 12-IB-10: Connections to Fire Hydrants. Connection to fire hydrants in the City of Englewood shall be prohibited except by an em- ployee of the City for municipal purposes or by an official of any fire department or district for fire suppression or emergency purposes. The City Manager or designee may authorize, by a permit, exceptions when necessary to meet emergencies or when a company or private individual , who is able to demonstrate the possession of proper equipment and knowledge of hydrant operation, requires the temporary use of large amounts of water. Water shall be taken from the hydrant through a meter with a backflow assembly and flow adjusting valve to be supplied by the appli- cant. Water may be taken only from those hy- drant(s ) which the City shall approve or desig- nate. The applicant shall pay a damage deposit established by the City, a permit fee for use of the hydrant, the minimum charge for ten thousand (10,000 ) gallons of water, and the current per thousand gallon charge for any amount of water taken over ten thousand (10 ,000 ) gallons. Customer will need to select a hydrant location from the approved list or wait for Jim Veryser to check out the hydrant they wish to use. 2. Customers will not be allowed to use a hydrant already in use by another customer. Always ch~ck the Hydrant Permit Status sheet to determine which hydrants are in use. 3 . The Fire Hydrant Permit expires after one year and it is the responsibility of the customer to keep it current. 4. The hydrant must be inspected prior to use. The inspection can usually be done the day the permit is issued. 5. Complete the Fire Hydrant Permit form . 6. A $600.00 check is re quired for deposit. This check will not be cashed/deposited unless there is damage to the hydrant or meter. 7. A $20 .00 check per hydrant , is required . Th is is for the permit fee ($10.00) and the minimum water charge ($10 .00). 8. The customer must su pply a meter with a backflow assembly or adequate air gap, a flow-adjusting valve and a fire hydrant wrench. 9. Prepare a Fire Hydran t Permit Sign (found in Jim's office). The customer can only use the hydrant listed on the sign. 10. VERY IMPORTANT -Explain to the customer that the sign must be displayed on the fire hydrant. Also, that the sign must be returned to the Utilities Department or a $50 .00 fine will be assessed. RECOMMENDED ACTION The Englewood Water and Sewer Board recommended Council approval by ordinance at their February 11, 2003 meeting of the two City Ditch License Agreements with RTD . BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Regional Transportation District (RTD) submitted two License Agreements for two locations where fencing improvements span the City Ditch. The fences will be constructed in conjunction with the Southwest Corridor highway improvements along the City Ditch on Santa Fe from County Line Road to Prince Street in Littleton. Santa Fe is being widened to allow construction of separating medians and additional lanes to improve traffic safety. The License Agreements will allow fences to be constructed in Englewood 's City Ditch right-of- way . 8' chain link fences for prohibit pedestrian access into the railroad right-of-way. Some portions of the existing railroad right-of-way and some portions of the City Ditch right-of-way overlap. Englewood 's City Attorney and the Utilities Engineer have reviewed and approved the two City Ditch License Agreements. FINANCIAL IMPACT RTD will fence and maintain approximately 50 feet (25 ' each crossing) along the City Ditch at their expense. (CPI) to be included 011 Colorado's Most Endangered Places List 2003. Established in 1984 , CPI 's mission is to promote and advance historic preservation throughout the state of Colorado. Cl'l's annual Most Endnngered Places List , now in its sixth yenr, serves to identify historically s ignificant sites in Colorado that are most in danger of being lost. Production of this list is a combined effort of many people throughout the state of Colorado. Once CPI list s these sites, they offer assistance to help broaden public awareness, organize support, and search for fimding to preserve these reminders of our state's heritage. On fric.lay, february 7, 2003, CPI will announce this year's list at its annual Saving Places Conference Announcement Luncheon, lo be held in Denver. As has been discussed between our representarives. the water would be stored on a trial basis under the following conditions : 1. Beginning on December 19 , 2002, and so long as Denver bypasses a minimum of 5 .0 cubic feet per second (cfs ) of water at Chatfield Reservoir, Englewood will deliver Denver's water from Chatfield Reservoir, through the City Ditch, and to the pump station that conveys water from the City Ditch to Mclellan Reservoir. Englewood anticipates that 5 cfs of the bypassed water will improve its water quality downstream at its Union Avenue Intake. The 5.0 cfs of bypassed water is also intended to allow Centennial's diversion of up to 2.0 cfs under its water rights divertible at Chatfield by exchange using downstream sources of substitute supply . Englewood will pump and store the water in Mclellan Reservoir to the extent there is capacity in the pump station and reservoir that is surplus to the needs of Englewood and Centennial. Presently it is estimated that there is 16 to 20 cfs and 1100 to 1200 acre-feet of such surplus capacity in the pump station and reservoir, respectively . 2. Centennial will deliver Denver's water from Chatfield Reservoir through its Nevada D itch pump station to Mclellan Reservoir, provided Denver bypasses minimum of 5 .0 cfs of water at Chatfield Reservoir as described above. 3. Denver will pay for its proportional share of operating costs for conveying, pumping, and storing its water in Mclellan Reservoir. 4. The point of delivery and measurement for water pumped to and stored in Mclellan Reservoir shall be at the pump station(s). 5. Should Englewood or Centennial require use of storage space in :Yklellan Reservoir for water occupied by Denver's water, Denver's water will be evacuated o r booked-over to make space available for Englewood and Centennial. provided that , in the case of a book- over. the water to be booked-over has or will take on the same characteristics, such as reusability, as the water that otherwise would be stored. Englewood will provi d e Denver with as much advanced notice as is possible. but not less than 24 hours. when storage space occupied by Denver will no longer be available. Denver will evacuate all water stored by July 31, 2003, unless the parties agree to extend the time Denver's water may be held in Mclellan Reservoir. Absent an agreement for extension , any water still in storage after July 31, 2003 will revert to Englewood and/or Centennial. 7. Evacuation may be accomplished by releasing the water to Dad Clark Gulch for delivery into the South Platte River. Denver's water held in storage may also be credited to Denver's delivery obligations through book-over from Denver's account to Englewood under the terms of the Settlement Agreement dated August 11, 1995 upon mutual agreement of Denver and Englewood, or to Centennial under the terms of the Water Agreement dated December 12, 1994 upon mutual agreement of Denver and Centennial. 8. Any evaporation and seepage from Mclellan Reservoir will be assessed against the amount of water stored on Denver's behalf in proportion to the total amount of water in storage in a manner that is consistent with present accounting practices. 9. Englewood, Denver, and Centennial will explore other options for using and/or evacuating Denver 's water in Mclellan Reservoi r. 10. Should any party elect to terminate this agreement. deliveries into storage will discontinue within ten days of Den ve r 's receipt of written notification of such election. Denver shall have 45 days following the receipt of the notification to evacuate or book-over any water it may have stored in Mcl ellan Reservoir. If the above terms are acceptable , please so indicate by signing below . Again, thank you for your willingness to cooperate with us in this manner. It is this kind of cooperation that will assist water users , big and small, to optimize water resources during this severe drought.
