MINUTES OF THE SEPTEMBER 8, 2004 MEETING. The Englewood Water and Sewer Board approved the minutes from the September 8, 2004 meeting. Cassidy, Otis, Burns, Bradshaw, Habenicht, Garrett None Clark, Moore, Higday 2. SOUTHGATE SUPPLEMENT #157. Southgate Sanitation District submitted a request for the owner, Lynn J. Hinkle, for inclusion into the Southgate Sanitation District. Supplement #157 is for Lot 1, Village Hill Subdivision for an area that is 2.5 acres. The lot is presently and will continue to be used for a single-family residence. The property is located on the northeast corner of S . Colorado Blvd. and Garden Ave. in Greenwood Village. The address is 5430 S. Colorado Blvd. Mr. Burns moved; Mr. Cassidy seconded: Ayes: Nays: Members absent: Motion carried. To recommend Council approval of Southgate Supplement #157 for Lynn J. Southgate Sanitation District submitted a request for the owner, Diane D . Writer, for inclusion of Supplement #158 consisting of two parcels (Parcel "A" and "B") totaling 10 .0436 acres into the Southgate Sanitation District. Parcel "A" contains an existing residence at 3720 E . Williamette Lane which comprises of 5.1734 acres . No changes in zoning or use are anticipated. Parcel "B" consists of Lots 1 and 4 which comprises 4.8702 acres of vacant land zoned for a single family residence , with service requirements to be determined. The adjacent properties are located east of University Blvd., south of Williamette Lane and west of Colorado Blvd. in Greenwood Village. Mr. Otis moved; Mr. Habenicht seconded: To recommend Council approval of Southgate Supplement #158 for Diane Writer to include 10.0436 acres on Williamette Lane into the Southgate Sanitation District. LICENSE AGREEMENT & TEMP CONSTRUCTION AGREEMENT FOR 5051 S. WINDERMERE ST.-GAS, WATER & ELECTRIC LINES. Tim Czamek, owner of 5051 S. Windermere, submitted a license agreement and temporary construction easement for an adjacent piece of property to the west for gas , electrical and water line crossings. The three City Ditch crossings are to make utilities available for a warehouse building being constructed to the west of his property at 5051 S. Windermere St. Englewood's City Attorney and the Utilities Engineer have reviewed and approved the license agreement and construction easement. To recommend Council approval of the City Ditch License Agreement and Construction Easement from Mr. Tim Czamek for property west of 5051 S. Windermere St. Cassidy, Otis , Bums, Bradshaw, Habenicht, Garrett, Clark None Moore, Higday Mr. Clark and Mr. Burns entered at 5 :20 p.m. 5. WATER RA TE INCREASE. Stu and the Board reviewed the proposed water rate increase that had been discussed with the Board at two previous Water Board meetings and with City Council at their retreat on September 25, 2004. Current rainfall levels, the resulting treated gallons used and the resulting revenues were evaluated. Black and Veatch analyzed various cash flow models with the Board along with upcoming capitol projects, increasing maintenance costs and decreasing water revenues . It was determined that $3,000,000 in additional bonding is required in the Water Fund to complete needed capital projects and maintain an adequate fund balance. The rate increases are necessary to meet bond coverage requirements for the current and proposed bond issues. It is proposed that the rate increase of 6% passed by Resolution Nol. 71, Series 2003 be amended and be replaced by an increase of 15% effective January 1, 2005, an increase of 8% effective January 1, 2006, an increase of8% effective January 1, 2007 and an increase of 7% effective January 1, 2008. To recommend Council approval of the proposed resolution amending Resolution No 71 from 6% to 15% effective January 1, 2005 , an increase of 8% effective January 1, 2006, an increase of 8% effective January 1, 2007 and an increase of 7% effective January 1, 2008. Englewood City Council 1000 Englewood Parkway Englewood, CO 80110 Dear Council Members: Oct 5, 2004 We would like to share our concern about the Council considering adopting multi-tier water rates Lho.t unfairiy penaiizes i1igher use custon1ers. TI1esc wouid )e above and beyond the very significant proposed rate increases of 15% for '05, another 8% for '06, another 8% for '07, and still another 7% for '08! By themselves, these add up to over a 40% increase in a very short time. If you add on a multi-tier penalty (charge) on top of that, it could easily double the increase for us! We attended the public meetings concerning the water treatment plants and supported the plans because it was the 'right thing to do'. There were many concerns about Englewood Waters taste & clarity that this plan seemed to address. I am positive that when we left those meetings that we had no idea that the increase in water rates was going to be this significant. Our wholesale nursery has been part of the Englewood community since 1956. We employ over 50 in the spring and over 35 of them are year round. In 2003 we paid over $40,000 in Property Taxes. In 2003 we collected over $183,000 in Englewood Sales Taxes and are on track to increase that by 10% in 2004. We believe we are using our water wisely, we are turning it into salary for our staff, & dollars for Sales Taxes as well as providing beautiful perennials, shrubs, & trees for our community. \Ve would ask that you not include adopting a multi-tier water rate because we feel it is 1.!~fair !o !i~'.·e 012e category of ~'01...!! I appreciate your concerns in this matter and will be presenting your letter to the Water and Sewer Board at their next meetng. At this time the Englewood Water Board has requested a water rate study to review how the costs of providing water service are distributed to customers. The study will take place in the first half of next year. A consultant will be retained to do the study. At this time no specific direction has been given by the Board other than to do the study. Some Board members did note, however, that other cities do have multi-tiered rate structures and questioned whether or not they would be appropriate. New meters were installed through the flat rate to meter program . Meters were converted to the Itron Radio Frequency Meter Reading system. Continued to expand the Backflow Prevention Program. Published a community newsletter relating to water quality and conservation in June 2004 . The U tilities Department mailed 43 ,435 quarterly bills water and sewer bills and approximately 31,082 sewer accounts outside the City in the 17 connector sewer districts. The Department processed 155 water and sewer permit applications and read 30 ,500 meters . Continued training and implementation of the CIS Utility Billing System. WATER PRODUCTION: The Safe Drinking Water Act moni toring indicated that Englewood was meeting all regulations required. The staff is continuing investigations into processes that will enhance the aesthetic quality of the water. The alum sludge that had been processed the last several years was hauled to an approved landfill. New deep wells were completed at the McLellan Reservoir and the Englewood Golf Course. Purchased and installed an emergency generator for the Zone II water system. Completed the Vulnerability Assessment and the Emergency Response Plan for EPA. Completed rehab of 3-million gallon storage tank. Powdered activated carbon feed building was constructed and put online. WATER DISTRIBUTION: Began construction on the City Ditch recirculating system near Bates Park. Completed the deep well tie-in at the Englewood Golf Course and McLellan Reservoir. WASTEWATER COLLECTION Division personnel jet cleaned 535, 730 lineal feet of collection main lines. The Collection Division, per an on-going contract, maintains the mains in South Englewood Sanitation District. During 2004 the staff jet flushed 121,143 lineal feet of main and 411 manholes . STORMWATER: Submitted NP DES permit to the State Department of Health. The West Bates storm sewer line was completed to alleviate flooding in the northwest Scenic View area. Began the GPS (global position system) mapping system for gathering information to be installed in the GIS system. A TT. L} MEMORANDUM To: Stu Fonda, Utilities Director From: John Bock, Utilities Manager of Administration~J Date: October 20. 2004 · Subject: Lorraine Smith, 1080 W . Radcliff Ave. On October 19, 2004, Bob Kunselman and Cathy Burrage had an encounter with Lorraine Smith of 1080 W . Radcliff Ave. Ms. Smith is a customer who is chronically late with her payments. She gets red-tagged almost every quarter (see attached billing history -late charges are highlighted in green). Following are statements from Bob and Cathy. Bob Kunselman: 10-19-04 On October 19th I received a call from Loraine Smith at 1080 W Radcliff. She wanted an extension for a week, but had already screamed at Cathy Burrage about the problem. I offered her an extension for a week if she paid half the bill today. She was not willing to do this at that time and basically told me I was incompetent. I gave her John's name & phone number, then after screaming she hung up on me . After John spoke with her I called her back and offered her the same deal as before . She was fine with that but wanted to give me her Visa information to hold on to a couple of hours before running it through. I told her that was illegal and I would not do that. She needed to call back in a couple of hours with the info herself. She started screaming at me and I hung up on her myself. Cathy Burrage : 10-20-04 . On Tuesday, October 19, 2004 Lorraine Smith called regarding a red-tag she received regarding water that was going to be turned off the next day. Looking at her record and seeing that she has been red-tagged every time since 1997, I tried to tell her that she needed to get a payment in to prevent being shut off and she just started shrieking. I was unable to communicate with her and hung up. She called Bob and asked who she was talking to and Bob told her. She then called right back and asked if this was Cathy. When I responded it was, she hung up. She repeated that 2 more times . I also talked to Lorraine on 10/19/04. She was not emotional with me. I explained to her that when an account gets all the way to the day before tum-off, we have limited options as to how we can help her. I commented that she had been sitting on the bill for three months and that she should have called us long before things got to this point. I referred her back to Bob to work out a payment plan. I made a follow-up call to Lorraine on 10/20/04 (I got an answering machine) to confinn the date we will receive the second and final payment of the pay-plan she agreed to with Bob. The plant is to be built north of Woodinville along Highway 9 and be completed in 2010. In January , new sewer customers in King and Snohomish counties will begin paying higher hookup fees to help pay for Brightwater. The Metropolitan King County Council in June approved a higher hookup fee of roughly $5 ,000 , broken down into $34.05-a-month payments. The current hookup fee is about $3,300, or $18.60 a month. The charges aren't related to the rising construction costs and have been anticipated for months , True said. The existing 164 ,000 Snohomish County customers who will be served by the Brightwater plant won't see any rate changes. They pay $25 .60 a month for service . The higher hookup fee will be in place for 15 years , True said. Dutch researchers sampled bottled mineral water from 16 countries , not including the U.S., and found about 40 % of the samples showed evidence of contamination with either bacteria or fungi . In laboratory cultures , bacteria grew from 21 of the 68 samples. Researchers say the high levels of bacterial contamination in commercially bottled mineral water may pose a health threat to certain people , such as children , the elderly , and those with weakened immune sy stems such as people with cancer , k idne y failure requiring dial y sis, diabetes , or AIDS. The findings were presented this week at the Interscience Conference on Antimicrobial Agents and Chemotherap y in Washington, D . C . Bottled Mineral Water May Not Be Safer to Drink Researchers say people with weakened immune systems who are hospitalized are often given bottled mineral water under the assumption that it is not contaminated and therefore safer to drink than tap water . But the results show that there is still a risk of infection from common illness-causing bacteria, such as legionell a, from bottled mineral water. Infection with legionella bacteria can lead to a serious , pneumonia-like condition called Legionnaires' disease . In their study , researcher Rocus Klont, of the University Medical Center Nijmegen in the Netherlands , and colleagues analyzed bottled water from nine European countries and seven others , including Canada, Australia, and Mexico . They found all of the bottles appeared to have been properly sealed , which eliminated the possibility of contamination after bottling . Laboratory tests showed 37% of the samples had evidence for contamination with bacteria, including legionella, and 4% had evidence of fungal contamination.
