MINUTES OF THE DECEMBER 9, 2003 MEETING. The Englewood Water and Sewer Board approved the minutes from the December 9, 2003 meeting. Mr. Habenicht moved; Mr. Moore seconded: Ayes: Nays : Members absent: Motion carried. To approve the minutes from the December 9, 2003 Englewood Water and Sewer Board Meeting. Bradshaw, Habenicht, Moore, Garrett, Cassidy, Otis None Kasson, Higday, Wolosyn, Clark 2. FRONT-END LOADER PURCHASE. A loader is used on a daily basis for handling materials such as rock, road base, asphalt and bedding materials. This piece of equipment is also used for removal and recycling asphalt and concrete on projects and handling bundles of pipe and pallets. The front loader provides a finish grade on trenching and excavations. This purchase will replace the existing 10-year old front loader under the CERF replacement schedule. Englewood received a bid in conjunction with a City of Aurora bid and the CDOT State award. The winning bid was received from Power Equipment Company in the amount of $75,986.00. Mr. Otis moved; Mr. Habenicht seconded: Ayes: Nays: Members absent: Motion carried. 3. UTILITY TRUCK PURCHASE. To recommend Council approval of the purchase of a Volvo Front Loader with an optional Yard and ~ bucket from Power Equipment Company in the amount of $75,986.00. Bradshaw, Habenicht, Moore, Garrett, Cassidy, Otis None Kasson, Higday, Wolosyn , Clark A truck with a utility body and tow package is being used by the Utilities Department 's Distribution crew for their valve maintenance program. A hydraulic valve-exercising machine will be reinstalled for turning valves to isolate mains for repairs and operating the larger diameter valves for maintenance reasons. Englewood received a bid in conjunction with the State of Colorado Price Agreement. The winning bid was received from Champion Chevrolet in the amount of $25,100 . To recommend Council approval of the purchase of a Chevy Silverado 3500 utility truck from Champion Chevrolet in the amount of $25,110.00. Bradshaw, Habenicht, Higday, Moore, Clark, Garrett, Cassidy None Kasson, Otis 4. LETTER FROM JAMES SCHELLMAN RE: USING McLELLAN RESERVOIR FOR BOATING. James Schellman submitted a letter to the Board requesting that McLellan Reservoir be opened for boating, with limitations imposed by fees and restrictive permits. Mr. Fonda and the Board discussed Mr. Schellman's letter and the reasons for denying this request, including security and water quality concerns. Ms. Bradshaw moved; Mr. Otis seconded: Ayes: Nays: Members absent: Motion carried. To deny Mr. Schellman's request to open McLellan Reservoir to boating. Bradshaw, Habenicht, Moore, Garrett, Cassidy, Otis None Kasson, Higday, Wolosyn, Clark 5. ARTICLE FROM THE DENVER POST DATED DECEMBER 12, 2003 - "SOUTH METRO WATER PROVIDERS TOUT PLAN." The Board received a copy of a Denver Post article dated December 12, 2003 discussing a plan to inject river water underground in wet years to stretch aquifer supplies. Stu discussed the history and possible ramifications of the plan. 6. LETTER FROM SOUTH SUBURBAN DATED JANUARY 8, 2004 RE: ENGLEWOOD GOLF COURSE WELL. Mr. Fonda discussed a letter received from South Suburban Parks and Recreation dated January 8, 2004. South Suburban decided not to exercise its option for the 20 acre-feet of water from the Englewood Municipal Golf Course well, instead opting to accept Englewood's offer to provide tap water by extending the water line that the City is installing for the Pirate 's Cove development. The next Water and Sewer Board meeting will be Tuesday, February 10, 2004 at 5:00 p .m. in the Community Development Conference Room. Fonda, Director of Utilities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION None. RECOMMENDED ACTION The Water and Sewer Board, at their February 10, 2004 meeting, recommended approval by motion of the purchase of water meters from Mountain States Pipe and Supply in the amount of $92,323.18 BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Utilities Department purchases water meters needed for an entire year by requesting one large bid proposal for additional cost savings. The Utilities Department is converting the metering system to the ITRON Automatic Meter Reading System . All meters and registers purchased will be compatible with the ITRON System . A portion of these meters will be resold to Englewood customers for new installations as part of the flat-rate-to-meter conversion process. Some of the meter stock will be used to replace inactive or poorly functioning meters and to convert existing meters to the ITRON system . Because Mountain States Pipe does not sell meter yokes, the yokes (saddles for the meters) are being bid separately and will be forthcoming. FINANCIAL IMPACT Sixteen meters, ranging from 1-1/2" to 3", will be going to the Englewood Parks Department for their personnel to change existing irrigation meters, some over 30 years old and inefficient. Mountain States Pipe is honoring 2000 prices for this bid. Englewood's meter order is being placed in conjunction with Denver Water Board's order to ensure the best quantity price . Mountain States Pipe and Supply's bid is $92,323.18. Of this amount, approximately $15,000 will be resold to Englewood customers, $20,000 will be for Englewood Parks meters and $10,000 for meters for the Pirate's Cove Water Park. W Frakes, Vice President Mountain States Pipe & Supply CO ATT . .3 COUNCIL COMMUNICATION Date February 16, 2004 INITIATED BY Utilities Department Agenda Item Subject Agreement for Realignment of Brown Ditch in Columbine Valley Estates STAFF SOURCE Stewart Fonda, Director of Utilities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION Council passed an Ordinance on May 21, 2001 approving a License Agreement and Grant of Construction Easement for crossing the Brown Ditch at Watson Lane. Council passed a License Agreement on July 7, 2003 to maintain a portion of the Brown Ditch right-of-way along Watson Lane . RECOMMENDED ACTION The Englewood Water and Sewer Board, at their February 10, 2004 meeting, recommended Council approval of the Agreement for Realignment of Brown Ditch in Columbine Valley Estates along Watson Lane. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED Hearthstone Homes submitted an Agreement for Realignment of Brown Ditch right-of-way in Columbine Valley Estates for exchanging property to relocate an easement 25' to the south of the existing right-of-way. Prior agreements have enabled the owner to pipe and cross the Brown Ditch and maintain the City's easement for improved appearance and to minimize safety concerns. This agreement will allow the owner to move the Brown Ditch easement to maximize his property for new construction. The property is located at 5600 Watson Lane, one block west of Federal and south of Bowles north of Columbine Country Club in the City of Littleton. Englewood will maintain their 30' easement and the right to install, repair remove or relocate the Brown Ditch at any time deemed necessary. The easement is being maintained for possible future raw water piping from Union Avenue to Mclellan Reservoir. The Licensee expressly assumes full and strict liability for any and all damages of every nature to person or property caused by the point or points where the Licensee performs any work in connection with the crossing provided by the Licensee. The City reserves the right to make full use of the property necessary in the operation of the Brown Ditch. FINANCIAL IMPACT None . LIST OF ATTACHMENTS Agreement for Realignment of Brown Ditch Resolution AGREEMENT FOR REALIGNMENT OF BROWN DITCH IN COLUMBINE VALLEY ESTATES DRAFT This Agreement is entered into on the __ day of , 2004, between Jack R. Lilienthal, owner of Columbine Valley Estates, whose address is 701 Watson Lane, Littleton, CO 80123, and the City of Englewood, a municipal corporation of the State of Colorado, at l 000 Englewood Parkway, Englewood, CO 80110, for the exchange of real properties relating to the Brown Ditch. WITNESS ETH WHEREAS, there has been a previous exchange of properties between the City of Englewood and Jack R. Lilienthal, owner of Columbine Valley Estates where certain real property was exchanged for a portion of Brown Ditch dated May 6, 2002 and recorded in the records of the Arapahoe County Clerk and Recorder on June 30, 2002; and WHEREAS, Jack R. Lilienthal now desires to develop another portion of Columbine Valley Estates and requests another transfer of properties to again realign Brown Ditch; and WHEREAS, this realignment will benefit the City by straightening a curve in the right of way which should facilitate . WHEREAS, the Englewood Water and Sewer Board approved this exchange of properties at its February l 0, 2004 meeting. NOW, THEREFORE, it is agreed by and between the parties as follows: 1. The legal description of that portion of Brown Ditch right of way, owned by the City of Englewood, to be exchanged by quit claim deed to Lilienthal is shown on Attached Exhibit A. 2. The legal description of the real property owned by Jack R. Lilienthal to be exchanged by quit claim deed for the above portion of Brown Ditch is shown on attached Exhibit B. DRAFT NOW, THEREFORE, the parties hereto agree to the exchange of real properties described above for the realignment of Brown Ditch in Columbine Valley Estates. February 4, 2004 Amendment to Agreement for Drainage & Flood Control Attached is a Council Communication with proposed engineer's estimates of the construction costs for repairs of the Marcy Gulch siphon structure on the City Ditch. In the next two weeks Urban Drainage will be obtaining quotes from their short list of construction contractors. Costs reflected in the attached council communication are based on engineer's estimates and may not reflect the actual bid price received from Urban Drainage. It is imperative that the project be completed by April 1 for the City Ditch to flow and fulfill our contractual agreements with various City Ditch users including Centennial, Cherry Hills Golf Course and the Littleton Cemetery. Time is of the essence because if construction is not completed by April 1, 2004 the project will be delayed until the City Ditch is shut off in November. RECOMMENDED ACTION The Englewood Water and Sewer Board, at their February 10, 2004 meeting, recommended Council approval of the Amendment to the Agreement Regarding Design and Construction of Drainage and Flood Control Improvements for City Ditch at Marcy Gulch. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED A Master Plan of Drainage for Marcy Gulch was originally prepared in 1985 for the Marcy Gulch drainage basin in Highlands Ranch. Urban Drainage, Centennial Water and Sanitation District and the City of Englewood now wish to proceed with design and construction of the drainage and flood control improvements for this area. Erosion has exposed the City Ditch siphon pipe and the coming spring runoff could cause Englewood's existing siphon structure to fail. This would create an emergency situation because water could not be delivered to either Highlands Ranch or the Allen Filter Plant. Englewood owns the spillway that to protects the pipe from Marcy Gulch runoff. Urban Drainage and Flood Control is proposing to construct a new spillway, to replace the existing City Ditch pipe with 66" reinforced concrete pipe, and to construct a new inlet and outlet structure . Enlarging this pipe to 66" will allow the City Ditch to carry up to 75 cfs of raw water. Urban Drainage is overseeing the project and ensuring flood control compliance . FINANCIAL IMPACT Council previously approved the engineering phase of the project for Muller Engineering to design the spillway structure. Centennial is paying for the design of the inlet and outlet structures and enlargement of the City Ditch pipe to 66" ($9,930), with Englewood contributing for the drainage improvement design ($12,550). The engineer's estimate of probable cost is $297,678.60. Urban Drainage has agreed to pay 50% of the drainage construction costs, which is $115,000. Centennial and Englewood will each pay 25% of the drainage construction costs, ($57 ,500 each). Centennial will pay for the siphon enlargementt costs of $64,000. Englewood will pay $2 ,000 for the new 12" gate valve, replacing the old gate valve. By almost ail accounts , the program in 2002-03 was quite successful. We had an independent evaluation done on the program , as well as an analysis of success done by the program contractor. Both reported 14% increased snowfall as a result of the cloud seeding effort. However, as perhaps you know, one can never conclusively prove the success of a weather modification program. Given the apparent success in 2002-03 , we plan another program for the winter of 2003-04. The program we will propose for 2003-04 will be on a smaller scale than last year. I estimate that the total cost will be $400 ,000 or 57% of last year's cost. I am writing you now with the expectation that you will wish to continue your participation in the project, and so you can plan accordingly for the expenses of the project in your 2004 budget. Utilizing the same participation percentages as last year, we calculate your contribution to the program for 2003-04 to be $3,200. Bills will be mailed out next week for the fees, which ar-e expected to raise $1.8 million a year for the state. Agricultural water rights holders will pay $10to $25 per right, whi:le cit- ies and others will pay $100 to $250. For some of the largest utilities, that will translate to thousands of dollars a year. Some farmers, too, will pay more because they have mul- tiple rights. More than 10 ,000 invoices, cover-. ing about 35,000 water rights that qualify for the fees, will likely come as a shock to some, in part because water rights are considered sacro- sanct in Colorado. Holders enjoy nu- merous protections under the law, and have never haq to pay simply to possess such a right. "Under current conditions, with drought, lack of available water, peo- ple getting their wells shut off, any fee right now is tough to take," said Alan Foutz, president of the Colo- rado Farm Bureau. The Division of Water Resources is bracing for a backlash. Division of- ficials held 15 public meetings last fall to inform people about the fees , but are still setti.Qg up a toll-free hot line to deal with thousands of rights holders likely to be angry when they get the unprecedented bill "Folks are justifiably concerned about this," said Ken Knox, chief deputy state engineer at the divi- sion. "It's their water right, their live- lihood. We need to b"e able to re- spond timely and professionally." The state legislature approved the fees last year to avoid laying off water commissioners. Those are the workers who do the criticaljob of po- licing and tracking water rights in the state, ensuring people get the water to which they're entitled -a job once conducted at the business end of a rifle. The water rights fees were among dozens of new fees and fee increases totaling $72 million approved last year by the legislatµre. Lawmakers also raided cash accounts -ac- counts funded by fees -to the tune of about $1 billion. Among the many fee increases: a 50 percent hike in court fees, a 400 percent increase in the fee charged by the state Department of Agricul- ture to check calibration of grocery store scales, and a $40 rise in real es- tate license fees. · Many critics call the new fees back-door tax increases that allow politicians to boast about cutting, or not raising, taxes while quietly making up the revenues through fee increases with less public scrutiny. State Treasurer Mike Coffman said the legislature was in a tough position because the sinking econo- my battered the state budget. Even so, he said, falling back on new and higher fees is bad public policy. "This whole surge of increasing fees is really the equivalent of a back-door tax increase," Coffman said. "It certainly has the same net effect, and it's occurring across the board, in a large number of depart- ments in state government." Not everyone was critical of the fees. Brian Werner, spokesman for the Northern Colorado Water Con- servancy District, which serves sev- eral cities, towns and farms in the state's northeast region, said it will have to pay $5 ,000 to $6 ,000 a year un- der the new program.
