2. UPDATE FROM DAVID HILL.
Stu reviewed the most recent bill from David Hill, Englewood's water attorney. As part
of his billing process , Mr. Hill provides updates on on-going cases. In the FRI CO
(Farmers Reservoir Irrigation Company) exchange case, Centennial is negotiating to buy
some of the water that FRICO is selling. Hill noted that FRICO's rights have been
illegally expanded for generations and it is very important that this be terminated because
any expansion impacts Englewood 's rights.
3. PHASE II STORMWATER PERMIT WITH THE ENGLEWOOD SCHOOL
DISTRICT.
The City of Englewood has drafted an application to the Colorado Water Quality Control
Division for approval of a Phase II Stormwater Permit. The Arapahoe County School
District No . 1, Englewood Schools has been classified as a "nonstandard municipality"
for the purposes of obtaining a MS4 Permit. In lieu of developing its own program and
obtaining a separate Phase II Stormwater Permit, the Englewood School District would
like to participate with the City of Englewood to be covered under Englewood's
stormwater application and permit.
The City of Englewood is willing to include the School District's property with the City's
application, upon the condition that the School District sign an intergovernmental
agreement for development, imp lementation and enforcement of Englewood's municipal
stormwater program within Englewood's and the School district's boundaries . The
District shall be responsible for addressing any resulting enforcement measures directed
at the City when the violations occur on their properties.

4. RECIRCULATION SYSTEM ON THE CITY DITCH.
The Board was updated on the progress of the City Ditch recirculation system. An
electrical transformer has been installed, with one person objecting because of a view
obstruction. Approximately 2 cfs of water is expected to run through the City Ditch north
of Hampden.
5. WATERMAINFLUSHING -APRIL 18,2005 .
The City of Englewood Utilities Department will be conducting its annual fire hydrant
flushing program starting the week of April 18, 2005 at 12:01 a.m. During this time, the
water mains throughout the entire City will be flushed to remove sediments from the
ma ms.
6 . REALIGNMENT OF VALLEY SANITATION SEWER EASEMENT AT THE
LITTLETON ENGLEWOOD WASTEWATER TREATMENT PLANT.
In 2004 Englewood purchased land where the Englewood Servicecenter and the
Littleton/Englewood Wastewater Treatment Plant resided that had been under a long-term
lease . In preparing for the closing, a title search was ordered which revealed Valley
Sanitation District 's fee-simple portion (approximately 20' x 300') and an easement
(varying from 20' to 40' x 500'). The Littleton/Englewood Wastewater Treatment Plant
is now consolidating the 30 parcels that comprise this area and trying to obtain and
incorporate Valley's adjacent land and easement, located at the site of the future
denitrification facility and where the digesters have been constructed.
The original Valley Sanitation District line at the Littleton/Englewood Wastewater
Treatment Plant was disconnected and realigned in the 1970's to accommodate plant
construction and realigned again in 1992 to run down Platte River Drive to accommodate
the LIE WWTP when the original Englewood Wastewater Treatment Plant was
decommissioned . The original line was abandoned and removed , but the right-of-way
still belongs to Valley Sanitation District.
Englewood's City Attorney is drafting an agreement between the Valley Sanitation
District and Englewood for an exchange whereby Valley relinquishes all rights and
property of the old abandoned sewer line , via a quit claim deed, in exchange for the
Englewood Littleton Wastewater Treatment Plant taking over and maintaining the 24"
Valley District sewer line adjacent to the Englewood Littleton Wastewater Treatment
Plant from Valley MH 5 to the intake. This was given to the Board as an informational
item .
7. KENT COUNTRY DAY SCHOOL SEWER BILL.
Stu received a reply to the Utilities Department's March 30 letter to Kent Denver School
for unpaid sanitary sewer tap fees and treatment charges. Martin Beier, Kent's attorney,
is claiming that the statute oflimitations applies to their back-charges going back more
than six years. Stu noted that if a settlement is not reached, a lien will be filed on August
1, 2005 . The Board will be kept apprised of developments.
8. TOUR OF THE ALLEN FILTER PLANT.
Don Coatman conducted a tour of the Allen Filter Plant. The Board toured the new
generator pad, the floc-sed gallery and the beltpress building.
The meeting adjourned at 6:20 p.m.
The next Water and Sewer Board meeting will be Tuesday, May 10, 2005 at 5:00 p.m. in
the Community Development Conference Room.

RECOMMENDED ACTION
Council approval, by motion, of the purchase of one, new Sanitary Sewer Flusher
Truck from Williams Equipmen t in the amount of $115,875 .00.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The proposed sewer flusher truck is used for removing accumulated solids and
debris in the wastewater collection mains. All sanitary sewer mains are on a
maintenance schedule to be flushed at least once a yea r. The truck will also be used
on a contract basis for line maintenance for South Englewood Sanitation District and
part of Cherry Hills Village. The purchase is being recommended to replace the
existing 10-year old Unit #1399, a 1994 GMC Sereco Flushing Truck, according to
the CERF replacement schedule, but was held over one y ear for budget constraints.

Options included in the base unit are a cold winter recirculation system for water
pump operations, side panels to cover the pump area, a hand-held spotlight with 15'
of cord and a quick disconnect switch and an engine kill switch at the operators
station.
The two lower bids were not accep ted because they did not meet the chassis
requirements required in the bid specs.
FINANCIAL IMPACT
Williams Equipment is the recommended bidder at $115,875 .00. Entire amount will
be funded by the CERF Fu nd.

RECOMMENDED ACTION
The Englewood Water and Sewer Board recommended Council approval by Ordinance at
their May 10, 2005 meeting of the License Agreement and Temporary Construction Easement
with Qwest Corporation for a 2 " PVC conduit for a fiber optic line for internet service.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Qwest Corporation submitted a License Agreement and Temporary Construction Easement to
cross the C ity Ditch right-of-way with an underground bore for one (1) two inch (2") PVC
conduit 50' across the City Ditch right-of-way. This will enable a fiber optic cable providing
high-speed data service to the adjacent residential subdivision. The crossing is located on the
north property line of Wolhurst, south property line of the Large Animal Clinic on S. Santa Fe
Drive.
Englewood 's City Attorney has reviewed and approved the license agreement and Temporary
Construction Easement.

This Temporary Construction Easement (the Temporary Easement) is entered into

construction of the Project subject to the following resrrictions: l) normal

rhrough Friday and 2) the operation of equipment and heavy trucks will be
permitted on the Englewood Clry Ditch ROW only during normal working
hours.

4. Restoration. Upon completion of the Project, Grantee will perform such
restoration and regr1ding as is necessary or prudent to restore the surface lI"e:i
of che City Ditch ROW ~o its original condition.
5. Indemni fic:i.t ion. Grantee, to the extent permitted by the laws and
constiturion of the State of Colorado, hereby 1grees to be liable and hold
harmless the City of Englewood, its employees, tenants, and guests from any
and all claims, causes of action, and liabiliry which may occur as a result of
the negligent or •.vrongful acts of Grantee in the consmJction of the Project,
including the cosr of defending against such claims.
6. Liabi licv. Grantee hereby acknowledges that ir understands that there is water
flow in the City D irch from . .\.pril l to :\ovember l of e:ich year and that it
will assume li ability for any damage to adjoining property c~used by warer
flow re:)ulring from d:lmage to :he City Diti:h c:i.used by the Grante~'s
construction activit ies.
7. Insurance. Grantee shall maintain in full :-orce and effect a valid policy of
insuranc:: for the: Project in the amou;-it of S600,000 .00 propeny coverage and
5600 ,000.00 1iability co verage. Gramee ftmner agrees that all its cn:!Jloyees,
contractors a.1d sub-conr:-actors working on :he Project $hall be covered by
adequate Workers Compensation insurance.
8. Assignme:ir. This Tc:miporary Construction Easement is assignable only with
the written permission of E:nglewood, which pe:mission will not
unreasonably withheld, conditioned or delayed.

The entire Englewood Distribution/Collection crew began flushing fire hydrants on April
18 , 2005 beginning at 12:01 a.m. (midnight) and lasting for two days.

5 hydrant caps were frozen
Cherry Hills Rancho fire hydrants were flushed for the first time in at least 5 years .
Heavy sediments were found and cleared. One fire hydrant was completely replaced in
Cherry Hills Village at 27 Martin Lane.

Denver Water use falls significantly
Lawns go on diet as drought leads to changed habits

Water use is plummeting at Colorado's largest municipal utility as customers cling to their drought-savvy
ways.
This year, Denver Water is forecasting a 24 percent drop in overall water use, more than double its original
projection, which foresaw an 11 percent drop.

Changes i n l awn-wateri ng habits are particularly dramatic, with the utility forecasting outdoor summer use
shrinking by an unprecedented 40 percent this year.
"This is conservative," Denver Water Manager Chips Barry said. "I would be blown away if we really come i n
that l ow . But all the rules we used to t hink were sound and reliable (for projecting water use) are less so
now."
According to its pre-drought analys is, the utility should have sold about 92.8 billion gallons of water this
year.
New projections show the uti li t y's 1.2 m i llion metro-area customers are l i kely to use just 70.5 billion gallons,
largely because of lessons learned from the drought.
The phenomenon, known as a drought shadow , is expected to continue through the next nine years.
By 2014, even w ith a projected 1 percent annual growth in its customer base, Denver Water expects to sell
87 . 7 bi llion gallons of water, less than it normally would have sold in 2005.
The drop in sa les l ike ly means major changes for Denver Water, board members said, as the utility struggles
to adjust to a tighter budget and craft future wate r supply plans.
This year's budget, for i nstance, already has been squeezed, with new water revenues projected at $144
million, down from the $16 7 million orig i nally forecast.
But during a briefing Wednesday the agency sa id it would absorb the $23 million loss by using its cash
reserves rather than i mposing a midyear rate hike, an option discussed last month.
It will also cut $14 m i llion from its capital budget and reduce operating and maintenance expenses by
$700,000, Finance Director David LaFrance said.
It also means that a major in itiative to expand the northern end of its metro-area delivery system -a
project that could mean bri nging more water from the Western Slope -may be delayed, Barry said, though
efforts to secure the federal permits will continue.

This fall the agency l ikely will impose an 8 percent rate hike, as it had announced, but will also look at
changing future rate structures.
Despite concern over low water use, board members said, they weren't prepared to let customers turn their
spigots on full-force this summer, even if it would mean more cash.
Barry suggested that the agency adopt a three-day-per-week summer watering plan, but whether it will be
mandatory -with fines for violations -or voluntary isn't clear yet.
The board is expected to make a decision May 11.
"No one is up for sending out a message that we 're out of this drought," board member Tom Gougeon said.
Saving water
Conservation by Denver Water customers since the drought began in 2002 has reduced consumption by
billions of gallons, and the trend is expected to continue.
