HomeMy WebLinkAbout2025 Resolution No. 003 RESOLUTION NO. 3 SERIES OF 2025 A RESOLUTION ACCEPTING THE TRANSFER OF OWNERSHIP TO THE CITY OF ENGLEWOOD, COLORADO OF VARIOUS PARCELS OF LAND FROM THE ENGLEWOOD URBAN RENEWAL AUTHORITY (EURA). WHEREAS, on September 8, 2009, Englewood City Council adopted Resolution No. 69, Series of 2009 that authorized the City to accept title to various parcels from Englewood Urban Renewal Authority (EURA); and WHEREAS, the parcels were remnants of larger parcels acquired for redevelopment, drainage improvements, parking and roadway improvements; and WHEREAS, these parcels adjoined public property, and were maintained by the City; and WHEREAS, City staff identified three additional parcels that appear to have been inadvertently omitted from the 2009 transfer; and WHEREAS, these remnants of parcels also adjoin City property and/or City right-of-way, and are currently maintained by the City; and WHEREAS, City staff and the EURA investigated, and concluded title should be transferred to the City of Englewood to ensure it has full rights of access and ownership; and WHEREAS, on the 8th day of January, 2025, EURA adopted Resolution No. 2, Series of 2025 authorizing EURA to transfer title of these parcel remnants to the City of Englewood; and WHEREAS, pursuant to Englewood Charter 80, City Council may accept gifts and donations of land. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. The City Council of the City of Englewood hereby authorizes and accepts the transfer of ownership from the Englewood Urban Renewal Authority to the City of Englewood, Colorado for the following three parcels: PARCEL 1 That part of the SE ¼ SW ¼ of Section 34, Township 4 South, Range 68 West of the 6th P.M., being a portion of Lots 47 and 48, Block 1, Englewood Addition, being more particularly described as follows: Beginning at the intersection of the West right-of-way (R.O.W.) line of South Broadway, and the South R.O.W. of West Girard Avenue; thence South 00 degrees 07 minutes 53 seconds West along said West R.O.W. line, 37.50 feet; thence North 89 degrees 50 minutes 22 seconds West, 125.00 feet; thence North 00 degrees 07 minutes 53 seconds East, along the West lines of said Lots 47 and 48, 37.5 feet 10 a point on said South R.O.W. line of West Girard Avenue; thence South 89 degrees 50 minutes 22 seconds Docusign Envelope ID: 0C778C71-0A9B-442F-A719-147E14412309 East, along said R.O.W. line 125.00 feet to the point of beginning, County of Arapahoe, State of Colorado. Also known as 3405 South Broadway, Englewood, Arapahoe County, State of Colorado; Assessor Parcel ID Number 032542951 PARCEL 2 That part of the SE ¼ SW ¼ of Section 34, Township 4 South, Range 68 West of the 6th P.M., being a portion of Lots 1 and 2, Block 2, City Gardens Subdivision , being more particularly described as follows: Beginning at the Northwest corner of said Lot 1, thence South 89 degrees 50 minutes 22 seconds East, along the South right-of-way (R.O.W.) line of West Girard Avenue, 125.00 feet to the Northeast corner of said Lot 1; thence South 00 degrees 07 minutes 53 seconds West, along the East line of said Lots 1 and 2, 37.50 feet; thence North 89 degrees 50 minutes 22 seconds west, 125.00 feet to a point on the west line of said Lot 2 and the East R.O.W. line of South Acoma Street; thence North 00 degrees 07 minutes 53 seconds East, along said East line of South Acoma Street 37.50 feet to the point of beginning, County of Arapahoe, State of Colorado. Also known as 50 Englewood Parkway a.k.a. 50 West Girard Avenue, Englewood, Arapahoe County, State of Colorado; Assessor Parcel ID Number 032542918 PARCEL 3 North one foot of Lot 32, Block 1, Birch’s Addition to South Broadway Heights County of Arapahoe State of Colorado (Note: this real property has not been assigned a street address.) Section 2. The Mayor, Mayor Pro Tem, and City staff are authorized to take all actions necessary to effectuate the transfer of title authorized herein.
