MINUTES OF THE JUNE 9, 2015 MEHLING & PHONE VOTE OF JULY 6, 2015 . The Board received the Minutes of the June 9, 2015 Water & Sewer Board Meeting and the results of the phone vote of July 6, 2015 . &@ 2 . SEWER BACK-UP AT 1311 E. BATES AVE. LEITER FROM ASHLEIGH & DAN FREDRICKSON John Bock, Manager of Administration , presented a letter dated June 29 , 2015 from Ashleigh and Dan Fredrickson regarding a June 4, 2015 City sewer main backup that caused damages to their basement at 1311 E. Bates Ave . The owners called All-Phase Restoration for the initial clean up . All Phase Restoration submitted an e stimate for the restoration , whereas John noted the costs that the City of Englewood will cover. The owners are requesting an additional $1,000 to $2 ,000 to cover pa i nting the basement. The Board had added drywall restoration to their policy last year . The current restoration policy, in the event of a City main-caused backup , was reviewed with the I -I r Board . The Board discussed the issue of determining if the homeowner's policy would cover damages . Motion : Moved : To amend the standard restoration policy to allow for painting solely the walls affected at an equivalent quality level. Moore Seconded : Penn Motion passed unanimously. Motion: Moved : To inquire if their homeowner's insurance policy covers damages. The City will pay the deductible amount if the homeowner's insurance covers damages. If not covered by the homeowner's policy, a letter denying coverage will be requested. Moore Seconded: Penn Motion passed unanimously. ~ 3. GUEST: CLARE M. ABRAHAM -3820 S. GRANT ST . -BROKEN CURB VALVE. Ms . Clare Abraham submitted a letter discussing her curb stop that was broken when a City technician turned off the water for a repair. Tom Brennan, Director of Utilities, reviewed the City Code addressing curb valve responsibility, and the current policy for assisting homeowners doing repairs. The Board discussed requiring an owner to sign a release before a City technician exercises their curb valve. The Board recommended placing an article in an Englewood publication about the advantages of exercising the curb valves. Mr. Bock sent Ms. Abraham a copy of "City Code 12-lB-6: User to Provide Curb Stop," that outlines the City Code policy. Motion: Moved: To require the homeowner to sign a release before exercising turning the curb valve. Moore Seconded: Penn Motion carried unanimously. I -2 ~ 4 . GUEST : SLATE COMMUNICATIONS -COMMUNITY BRANDING PROJECT. Ryan Burke with Slate Communi cat ions appeared to discuss t he new community branding project to reflect a new image for the City of Englewood . Three options were displayed and discussed . ~ 5 . KELLS WAGGONER RESIGNATION . City Council and the Water Board received Kells Waggoner's resignation from the Water & Sewer Board . Discussion ensued. Briefly, I refuse to pay for services a year in advance of services to be rendered. I have written & complained to numerous individuals with Englewood to no resolution. This is my final request to resolve this v\·ithout legal action. To do so I'm asking: I. All fees, interest, etc. charged over the life of the account be credited back to my account. 2. I'm billed a maximum of 6 months in advance of services to be provided . 3. Provide me a new balance due and I'll pay it within 3 business days of receipt. Regardless of Englewood's decision on above please send me a record of all activity on the account since I purchased the home in May of 2010. It was the Board·s unanimous decision to maintain the City 's practice of billing in advance. The Board confirmed that , while the bill is for the year in advance . the Departmenf s online and telephone systems can be used to make monthly payments. Englewood"s billing and collection practices are set by Municipal Code and Departmental policy . We are obliged to comply with those requirements. A possible solution might be to call in and set up a payment plan. Service has been rendered for July 1 st through this date. That amount can be paid . Then. a payment schedule can be established for the remaining charge to be paid at an interval agreeable to everyone. If all goes according to plan. we will be implementing customer service software next year that will allow an individual to easily set up partial payments that would more closely approximate your views on when payments are appropriate. Information about the new software will be included with the next bill. In the meantime. the charges on your account are correct. The Englewood service area and its connector districts were established long before the creation of the City of Centennial. South Arapahoe Sanitation District provides sewer collection in your area and Englevvood provides sewage treatment. The account history for 660 I S Steele St. is shown on the next page. On 7I 12 12010 an annual bill for $299.99 with service dates 711 /2010 to 6/30/2011 was mailed. It was not paid and on 5/3/2011 late charges were added. On 7/112011 an annual bill for $309.76 and with service dates 7/11201 1 to 6/30/2012 was mailed. On 8/1112011 payment in the amount of$299.99 was received which appears to be for the 7112 /2010 bill. Englewood wastewater treatment bills are due within 30 days of the bill date . after wh ich time they become past due and subject to late fee s and collection actions. The annual bills Englevvood sends to re s idents in your area contain three different charges: Sewer Cycle Billing is for sewage treatment at the Littleton/Englewood Waste Water Treatment Plant; IBA is for the repair and maintenance of the Big Dry Creek Interceptor which carries the sewage to the Plant; South Arapahoe Sanitation District Billing is money co ll ected on behalf of that District for the repair and maintenance of the sanitary sewer collection system in your area . which system is not owned or operated by E nglewood. The increase you see in the billed amount is due to increases to the Sewer Cycle Billing (8%). a small increase in the IBA charge ($2 .82) and the addition of the past due fee. The Ltilitics Department ha s, in the past, lo0ked at the possibility of switching to billing in arrears but the changes to the billing system. business practices and the effect it would haw on the cash flow make it impractical. It is anticipated that significant rate increases would be needed to make up for the lost revenue . When a home or business is connected to Englewood's sewer system. or a sanitation district tributary to Englewood's sewer system, the applicant agrees to Englc....,·uod's rules and regulations. The contin ued use by a residence or business of Englewood's se\vcr system is implied consent of Englewood's rules and regulations as set for in the following State of Colorado Revised statute: C.R .5 . 31-35-706. Continuing annual charges: The rates and charges so established shall be annual cha rges and shall be continuing annual charges from year to year unti l such ordinance is amended or repealed. Derby is currently a year behind on paying the sewage treatment charges because. to pay for the charges in arrears. he is paying last year's hill this year and not paying the new hill . This results in late charges on each year's hill. Both the Colorado State Re\ ised Statutes (C.R.S. 31-35-708) and the tng kwuo<l ,\fonicipal Code ( 12 -2-3G) allmv and require the addition of late foes and the eventual cc:rti fication of past due charges to the County as a ta.x lien. the charges to be added to the property taxes . Past due charges arc ccrtitied to Arapahoe County on October 31 '1 of each year. 2 -9 c T y 0 F ENGLEWOOD MEMORANDUM TO: Water and Sewer Board Members FROM: Tom Brennan, Director of Utilities-;--'..:£, DATE: September 2, 2015 RE: Solar Electric Array on the North Reservoir of the Allen Water Treatment Plant Razor Sharp Solar submitted a proposal for a 25 year lease agreement to install solar panels on the North Reservoir . The City would be compensated for the use of the facility. This installation would be the first of its kind in the Colorado . Recognizing the importance of renewable energy staff is seeking your input on moving forward with this proposal. Staff has evaluated this proposal and has identified the following : Pros : The plant would operate partially or completely on renewable energy, evaporative losses would be reduce, and algae growth would be reduced . Cons: Would be first of its k i nd in Colorado, 25 year lease is very long, Sta t e Dam Engineer would have to approve all facilities located on the dam, company personnel would have unlimited access to the reservoir , this facility is a drinking water source, possibility of light reflection on neighboring homes , neighborhood acceptance . Recogn izing the identified issues staff is recommending to wait unti l such a facility is operating in Colorado. Razor Sharp Solar has 3 pending projects in State . Allow i ng these fac i lities to come online would allow us to complete more exact evaluation. 3-1 MEl\'I O RANDUl\I TO: Tom Brennan , Director of Utilities FR0\1: Dugan Comer, Deputy City Attorney~ DATE: August 28. 2015 REGARDING: Razor Sharp Solar Proposal Razor Sharp is a solar panel company that is proposing to install solar panels for the generation of solar electric power. The panels would be located at the Allen Water Filtration Plant's water impoundment facility, and would be used to generate electricity for use by the Plant in its operations. The panels would float atop the water in the impoundment facility. Since this is only a proposal the following issues need to be addressed. • It is recommended that the proposal be submitted to the Water and Sewer Board for their recommendations and approval. Mr. Sharp should be present to answer any questions or concerns that the Board has. • If the Board recommends that the proposal be forwarded to City Council for their review, again it should be done at either a Study Session or regular meeting, and again Mr. Sharp should be in attendance to answer any questions. • If Council decides that the proposal should move forward, it is recommended that other jurisdictions who have installed these types of solar arrays be contacted for their input as to how well the system works in their applications. • Based on the proposal and answers to Jason Clark's email by Mr. Sharp other issues have been identified. The twenty-five year lease period, the fact that there would be work done on the impoundment dam, continuing access to the water supply by non-employees of the City, neighborhood impacts, cost to the City, if any, and any subsequent TABOR issues, warranties, indemnification, insurance costs, ownership. Therefore, it is recommended that if approval is given to move forward with the proposal , that the parties use the City's standard Contract for Services along with the attached Scope of Work . Every home in Englewood has a valve on the water service line. The valve is located near the front property line or sidewalk vvhere the wa ter service line comes from the Citv's >vater main. That valve, commonly referred to as a "curb stop," ·· is the property of the homemvner, but the City of Englewood 's Utilities crews need to be able to access it in the event of an emergency. The City of Englewood Municipal Code requires the property mvner to make sure the valve is easily accessible and that the valve works properly. To find your curb valve, look for a round metal va l ve cover about four inches in diameter with a lock-down nut in it. That is vour valve box cover. The valve itself is about fi ve feet down.
