1. CALL TO ORDER
The Regular Meeting of the Englewood Water and Sewer Boa rd was ca lled to order at
5:00 p.m . on Tuesday , April 12 , 2016 at 1000 Englewood Parkway , Englewood , CO
8011 O by Chair Clyde Wiggins .
2. ROLL CALL

3. MINUTES
The Board received a copy the Minutes of the February 9, 2016 Water and Sewer Board
meeting and the phone vote of Feb ruary 23 , 2016 approving the Minutes.
4. PUBLIC FORUM
CITY DITCH FENCING REQUEST-780 W. OXFORD AVE. -MR. PRADO
Mr. Prado , the owner of 780 W. Oxford Ave ., appeared before the Board to expla in his
concern with trespassers and dogs in his yard that borders the City Ditch right-of-way .
Mr. P rado requested tha t t he C ity f ence t he east side of his property along the di tch.
Tom Brennan explained the existing policy whereas the City Does not pay for fencing for
properties adjacent to City Ditch right-of-ways. The exception is street crossings within
the City lim its. When the City Ditch crosses through a property, property owners are
allowed to utilize the right-of-way for lawn , gardens and parking . The City does not allow
structures or trees within the right-of-way. Where there are adjacent property owners , all
must agree to the use.
The board discussed ways to discourage dogs and trespassers. Councilperson Gillit
recommended allowing Mr . Prado to install his own fence. Mr. Brennan discussed
constructing a berm to discourage trespassers . The Board recommended that "No
Trespassing and No Dogs" signs be posted on the east side of Mr. Prado's property
along the City Ditch.

The Board noted they do not wish to set a precedent for fencing along the
City Ditch right-of-way , but agreed to post "No Trespassing and No Dogs "
signs along Mr . Prado 's east property boundary along the City Ditch right-
of-way.

5. NEW BUSINESS
LEAD CONTAMINATION
The State requires the City of Englewood to test 30 sites in the water system every 3
years. Professional licensed operators at the Allen Water Treatment Plant collect daily
water samples from combined raw water sources, including the plant and the distribution
system. The Allen Water Treatment Plant has never violated the lead standard. The
Board received copies of the results of the last two testing cycles.
Byproducts from certain chemicals used for treating water can react making the water
acidic or basic. Acidic water will react with the pipes and plumbing hardware, causing
corrosion which can release lead into the water. Basic water will deposit a scale that
coats the pipes the pipes and plumbing , sealing water from the lead. Englewood water
plant operators adjust the pH so that the water is building a scale and not corroding
pipes and plumbing .
This is an informational item only. Councilperson Gillit requested a site map of where
lead is tested and levels detected.
6. OLD BUSINESS
ENGLEWOOD WATER AND SEWER BOARD MISSION STATEMENT
The revised Water and Sewer Board Mission Statement was submitted for Board
approval:
"The City of Englewood Water and Sewer Board supports the Utilities Department's
commitment to aggressively protect our existing water rights to provide the citizens of
Englewood with an adequate supply of high quality water and a reliable distribution and
collection systems at the lowest possible costs. The Board is responsible for providing
guidance, approving administrative policies and addressing citizen's concerns and
issues. The nine member board is made up of six volunteer Englewood citizens and
three City Council appointees. Board members may serve three six-year terms ."

7. STAFF'S CHOICE
Councilperson Gillit inquired about radioactivity in sludge . Tom discussed independent
risk assessments that have been conducted, along with the State testing using a Geiger
counter. Sludge was found within acceptable and legal limits .
Gillit inquired about the rain barrel issue. It was noted that an article will appear in the
next issue of The Pipeline .
8. ADJOURNMENT
The meeting adjourned at 5:50 p.m.
The next Water and Sewer Board meeting will be Tuesday, May 10 , 2016 at 5:00 p.m. in
the Community Development Conference Room .

Mr. Prada continues to contact city officials regarding many issues in 30 year period
Recently he requested a sign installed at the end of his property where there's no fence in place to keep
out people I pets that are open to his yard.
My neighbors are weary of his constant manipulation of tax dollars and misuse of community resources
We have contacted code enforcement, police department, city council and utilities
We have lived here since 1983 what we can do to resolve this constant aggravation.

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
Council approved on February 19 , 2008 , the proposal for the Allen Water Filtration Plant residuals
removal and disposal to Allied Waste in the amount of $108 ,000.00 for disposal of approximately 2,000
cubic yards of production.
Council approved on April 5 , 2010 , the proposal for the Allen Water filtration Plan residuals removal
and disposal to E .T . Technologies , Inc. in the amount of $97 ,750.00 for disposal of approximately
1,600 cubic yards of production.
Council approved on February 11 , 2014 and September 30 , 2014 the proposal for the Allen Water
Filtration Plant residuals removal and disposal to Secure On-Site Services USA (formerly Next
Generation Solutions , LLC) in the amount of $412,275 .00 for disposal of 1750 cub ic yards of
production.
RECOMMENDED ACTION
The Utilities staff recommended approval, by motion , of the proposal for the Allen Water Filtration Plant
Residuals removal and disposal to Secure On-Site Services USA , LLC in the amount of $230,550 .00 .
The Englewood Water and Sewer Board , at their May 10 , 2016 meeting , recommended Council
approval.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Ci ty of Englewood owns the Allen Wa ter T reatment Plant. Wh il e t he drinking water produced at
the plant meets all drinking water standards, these are low leve ls of naturally occurring radionuclides in
the source water that are removed through treatment and ultimately resides in the residuals generated
at the plant. As such, the residuals generated at the plant are considered technologically-enhanced
naturally occurring radioactive materials and have additional disposal consideration by Colorado
Department of Public Health and Environment Regulatory requirements .
FINANCIAL IMPACT
The bid opening was held on April 26 , 2016 . Five bids were received:

two years production (1,500 yards). The Utilities Department budgeted $250 ,000 .00 in account #40-

Council approval of the Grant of Easement to South Suburban Parks for the Regional Trail
Extension at the Englewood Water Intake Facility at Union Ave .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Mclaughlin Whitewater Design Group submitted easement exhibits and legal descriptions for
the proposed trail at Union Avenue and the South Platte River .
The project is for a one-mile paved regional trail along the east bank of the South Platte River
from Union Ave. to Oxford Ave . The project will include lengthening of the existing intake
structure, added fenci ng and a concrete trail section to allow for improved access for intake
maintenance .
The South Suburban Parks & Recreation District is requesting approval of an easement for the
trail portion that will cross through the property owned by the City of Englewood at the raw
water intake facility north of Union Ave . This portion of the trail will 8-e-B connect-tefl+o the
Mary Carter Greenway trail system to the existin t rail at Broken Tee Golf Course .

previously sent to the City. As you may recall this trail connection was presented and preliminarily
approved by the Englewood Water and Sewer Board meeting in July 2013 . The design drawings in this
submittal are consistent with the design presented to the Board . We are requesting review and approval
of the enclosed final drawings to move forward with final Board and City Council approvals for the
easements.

The Board approved the Minutes of the July 9, 2013 Water Board meeting
Motion: To approved the Minutes of the July 9, 2013 Water Board meeting.

2. GUEST: BEN NIELSEN , McLAUGHLIN WATER-UNION AVENUE BIKE PATH.
Ben Nielsen from the Mclaughlin Water Design Group in River Run Park Project appeared to
discuss the proposed Union Avenue Bike Path next to the Englewood raw water intake facility
north of Union Avenue. Accommodat ions for the Union Ave. pump station intersecting the bike
path wer e di scu ss ed .
The Colorado Water Conservation Board is requesting concept approval and easements for the
proposed trail through the property owned by the City of Englewood at the raw water intake
facility. The trail is 1 O' wide and will cross under Union Ave. South Suburban will operate and
maintain the trail. Gates will be constructed to close for routine and emergency maintenance.
Motion: To approve project concept and a grant of easement to South Suburban Parks
for the regional trail extension at the Englewood water intake facility at Union
Avenue, per City Attorney 's approval.

3. OVERPAYMENT FROM CLOSING -3226 S. CORONA ST.
John Bock appeared to discuss the issue where a title company sent a $200 payment for
anticipated water and sewer charges for 3226 S. Corona St. When the final meter reading was
figured , the final bill was zero. The amount paid became a credit balance with no further
communication from buyer or seller for two months.
Staff denied the request from the seller for a refund because refunds can only be granted to
existing owners. This is an informational item for the Board in the event the seller, realtor or title
company appeal staff's decision . The previous owner called on August 12, 2013 and was told
to call and discuss the issue with the title company.

4 . ENGLEWOOD WATER CONSERVATION PLAN COMMENTS AND RESPONSES .
The Board received the 2013 Water Conservation Plan comments and responses approved by
the consultant. The published legal notice and a water rate comparison for Englewood/Denver
water charges were also included. The comments and responses will be forwarded to City
Council with the final draft of the water conservation plan. After Council approval it will be
forwarded to the State for approval.

5. WASTEWATER COLLECTION SYSTEM MAINTENANCE STANDARD AGREEMENT
FOR THE CITY OF SHERIDAN SANITATION DISTRICT.
The Englewood Utilities Department currently performs sewer maintenance services for the City
of Cherry Hills Village , South Englewood Sanitation District and the City of Sheridan . The
purpose of the Wastewater Collection System Maintenance Standard Agreement form is to
standardize these agreements. The maintenance agreements enable Englewood to perform
maintenance of adjacent districts that are too small to fund their own maintenance program.

On March 28th, 2012 (see attached letter) the State of Colorado sends Englewood the attached letter.

Englewood is stuck with the radioactive sludge -their answer -leave it uncovered and find another way.

• On June 27, 2016 1,500 of the over 3,000 cubic yards is hauled off.
Englewood does nothing until Channel 4 does their report.
• Friday July 8th -My Cancer is back .
• Monday July 11th -I request time off to address quality of life issues based on quantity of life
leh and I begin to prepare for the fight of my live. I'm ready!
• Monday July 18th -City council is shown proof via the Arcadis report.

• Tuesday July 19th -Murphy Robinson reaches out to meet me. I respond back with the enclosed email.
• Thursday July 21 -HR suspends me although I am on medical leave. As I'm saying my good-byes
on July 11th aher my 8 am clock out time and with my 13-year-old daughter filming it, I tell Englewood's
water rights coordinator Dave Chapman to "step it up, do your job-protect your men. Stand up for them ."
• He admits on tape that Big Dry is the problem . The sludge is bad.
It is ALL on the tape and Channel 4 News has the tape.
I have been subjected to numberous insulting and demeaning comment by city officials. Mr. Keck declared that I have the wrong cancer.
Mr.Keck had the audacity to defend Englewood's stance on referencing the sludge as just dirt based on an out dated February 28,2012
letter from COM Smith that had already been slammed and criticized by the March 28,2012 State reponse.

For the record, Joe Pershin died of lung cancer. Tom Chester died of bladder cancer, Jim Black died of lung cancer and mine is colon,
liver and lung cancer. Other workers have the precursors and are SCARED.
Tom Brennan became the Director of Utilities on July 1st, 2015 aher 28 years as city engineer and several other things.
He sent out an email that there's a new sheriff in town and he would meet with each employee within the next month or two .
That was 13 months ago. On April 8th, 2016 we had an opportunity to sit down with Tom , but only in groups and ONLY aher we were
threatened to talk to just talk about our job descriptions. I have emails to prove this, but I am not allowed to access my email nor talk
to anyone of my friends because of the suspension.
My voice is being silenced! In a tender moment I told my mother that I don't need to be next to you to be with you.
I say the same to you.
• You need to protect yourself
• You need to protect your property values.
• You need to hold them accountable
• You need to show up to council meeting on MONDAY AUGUST 1ST 7:30pm!

submitted by CDM Smith, ~d February 15, 2012 whicb provides the r¢iological analysis data on the most r~I samples
of the Allen Water Filtration Plant Residuals.
The letter submitted indicates that the radium activities in the miduals are "below tbe levels of concern as defined in the risk
assessment developed for landfill disposal (CDM 2007)." Review oftbe Residual Disposal Risk Assessment, dmed August
31, 2007, indicates th.at the radium-226 and radium-228 values used in the RESRAD dose modeliDg ruos wc:re 0.6 ~d 0.7
pCi/g respectively. ·
The cumnt data fo r the Allen Water Filtration Plant residuals indic&.s that the ·concentrations iD the residuals arc 3 pCi/g for
radium-226 and 7.1 pCi/g for raclium-228 . These values exceed those used for the ris~ assessmcot.
While the Department bas gr.mted approval for disposal ofresiduw containing radium concentrations in excess of the 2007
values tn the recent past, Departmc:nt 11pproval for disposal of these materials from this point forw!rd will requ~
documentetioo dcmonstrmng that the specific concentrations of radium within the ~idc.als will not result in Mymemba of
the public [mc!uding lwdfill employees) receiving a dose which exceeds 25 mrcm in any one year.
Additionally, it has come to the attaition of the Depmiment that the disposal cells which would conntln the :residuals may be
subject to the operation of a mcth11.ne gas collection and control system during post-closure. 'Ibis gas collection and control
system, and the period over which it would be used were not as,sessod in the 2007 risk assessment l!Jld will need to be
addressed for futme approvals of disposal. This is significant io that che largest fraction of the dose to the public is a result of
the radon-222 contribution. Tbe RESRAD model does not acwunt for the active or p!!Ssive gas collection l!lld control system
md subsequent pathway .
Therefore, there will be two potentie.l conditions in. which the materials w:ill exist in the future: the first being a closed cell
without a gas collectiOD system and the second beiDg a closed cell which employs either a passive or active gas collection and
control system. Demonstration of compliance with the 25 mrem coostraint will be required for each of these conditions.
All acceptable demanst'lltion of compli8llce with the 25 mn:m constraint for the first coodition would be in the form of an
updated set of output files from RESRAD in which the radium values are increased to concentrations that arc greater thaD or
equal to the cmre:nt values (to allow for variability in the future). till of !he other parameters that were originally used in the

The timing of your reque st to meet me is puzzling.
In October 2014, in front of 150 fello\v employees, I asked Eric to stop by the plant to see me. I was so excited about his Yision
of transparency. GOD! Was I excited. As ofJuly 22, 2016, he has not followed up .
In October 2015, \Vh en the fourth employee in three years came do\\11 with this dreadful disease , there was no outreach from city
hall to comfort us .
In February 2016, when I contacted members of city co uncil about what is going on/about our concerns. There is no follow up
from your office to contact me .
May 13 , 2016 when Jim passed a\vay, there was no outpouring of support from your office. On Sunday June 5 at Jims life
service, Tom Brennan never said a word about his service, but at least he was there. Jason and Dave chose not to go and pay any
respects for 20 years of service. They had 3 weeks to plan.
On June 6, when Channel 4 runs the story, in stead of reaching out, insults are hurled . Eric sends out bullet points that I have the
wTong cancer. He sites a CDM report that says long term exposure would gi\'e me lung or bladder cancer. Sir . PLEASE. SIR.
Joe died of Jung cancer. Tom died of bladder cancer. Jim died oflung cancer. I have colon, liver and lung cancer. SIR
Eric wants to know why I am still there. "If I leave, nothing gets done. "
Others ask," what is my biggest fear." Sir. my biggest fear is others dealing with this dreadful disease because I did nothing.
On Thursday June 30th, Jason handed me my work evaluation. At the end of May, he told me that there were no significant
changes, therefore, you can understand why I was so surprised \Vhen I received my worst evaluation ever. I was low balled be-
cause I had the nerve to compliment a few of my fell ow workers in front of HR. My tone was unacceptable. Later that same day,
you (Murphy Robinso n) sent out an apology for launching the new compensation plan. I lose pay. Wow. I confront Jason about
my evaluation. He ha s Dave sit in on my evaluation. C OMPLETELY WRONG . Jason asks" if he can re think this and get back
to me ." As of Sunday July 17th, he has not responded \·erbally, via text or email
On July 8, I get devi stating news . I email Jason on Saturday July 09. As of Sunday July 17th, he has not reached out in person,
phone call , email or text.
On Monday July I I , I turned in a signed leave reque st. The way I always have. I go down to HR and am handed the FMLA
fonns for my doctors . No one from HR call s to check on me, but two consecutive days, I have to s ign for certified mail from the
city HR department. WHERE IS THE COMPASSION?
On Tue sda y July 19th, Yo u (Murphy Robin son ) called me and I in tum call my uni o n rep . I am s trongl y cautioned about talking
to you. You see, you have already talked to them before you reached out to me.
At thi s point, my health is paramount and the stres s ca used by you not caring till now concerns me. My family, my clergy, my
gut tells me that thi s is not in my best interest at thi s time .
I'm certain that Jason ha s taken the proper precaution s and the time to falsify perso nal records . He ordered locks and gate codes
changed on Monday July 18th . We only do thi s when someone is fired . He is concerned because I s topped by Sunday to embrace
both Mike Sax and Tom Riotte and tell them that I Joye them .
Eric should have followed his gut and fired Stu the first time he met him. In stead , he allO\\·ed him to retire with honors and 7
weeks later hired him back as a consultant at S 125 an hour. OH well
Murphy, I hope that you have a great day, as I \rnit to hear from my doctors . I will continue to pray for you as I wonder, "why

We have recently been made aware of a situation with one of our water plant operators at the
Allen Filtration Plant who currently is suffering through cancer. The employee, Ken Kloewer,
who is a lead operator contracted cancer and filed a workers compensation claim due to his
belief that environmental factors at the plant caused the disease. Mr. Kloewer's claim was
denied by our workers compensation system. He has now gone on a personal crusade to prove
that the Allen Filtration plant and more specifically the grit or residuals that are removed from
the water are the source of his cancer. While it is true that the residuals do contain low level
radiation, the limits have been measured and studied over a longitudinal period and found to
be within acceptable levels.
Mr. Kloewer, however, has taken to communicating with neighboring property owners to the
Allen Filtration Plant and told them that the materials removed from our water are cancerous
and are the cause of his poor health. Please see the attached letter entitled "Englewood
Sludge". While we are sympathetic to Mr. Kloewer's health situation and have worked to try
and obtain resources to assist him, we do not agree with his characterization of the "sludge" as
being a carcinogen or dangerous to people's health within our community.
The study of the residua Is has been a focus of the Colorado Department of Public Health and
Environment as a condition of our treatment permit and we have been required by the State of

.. , Colorado to dispose of the material at a special landfill that manages radioactive materials. This
requirement, however, has been debated by the owners of the landfill who are concerned with
our "dirt'' taking up precious space in their facility when the levels of radioactivity being less
than what many brick homes in Englewood currently emit. Furthermore, third party laboratory
analysis is required of the residuals on an annual basis prior to disposal. As you can see from
the attached lab reports that go back to 2004, the results led a Ph . D. from Camp Dresser
McKee who is an expert at mass spectrometry and radiation to ind i cate that our residuals are
safe and should be disposed of in a municipal landfill. Please see attached file entitled "Residual
Lab Test Results".
At a meeting with C!RSA and their legal counsel this morning, it was determined that the City
will hire a third party expert to analyze the residuals and provide everyone with their expert
findings on the safety of the materials . Further, the studies that have already been performed
on the material by experts in the past have indicated that the types of cancer that would
manifest themselves from prolonged exposure to high levels of radiation that Mr. Kloewer
suggests have caused his disease would be lung and bladder cancer and not the type of cancer
that he is suffering from.
I am passing this information along in the instance that you have been approached by
constituents who are concerned about what they might have heard about the residuals . To
date, all the studies that have been performed by the City and CIRSA have indicated a safe level
of radioacticvity that is no greater than background conditions. We will continue to keep the
Council appraised of this matter as more data from the outside expert is gathered, but at this
point we need to reiterate to our public that the plant, our water, and the residuals are safe.
