The regular meeting of the Englewood Water and Sewer Board was called to order at
5:00 p.m. on Tuesday, July 12, 2016 at 1000 Englewood Parkway, Englewood, CO 80110

4. WELL AGREEMENT.
The Board received a well agreement from L. K. Blessinger, owner of 2190 W. Harvard
Ave. This is for an on-site well that has been on the property for many years and will be
used for irrigation purposes only.

Harvard Ave. between L.K. Blessinger and the City of Englewood .

MEMO FROM ALLEN FILTER PLANT.
The Board received a memo, "Report regarding the Community Surrounding the Allen
Water Filter Plant," prepared by Herman Gibb, Ph .D., M .P.H. This is an information only
item . Councilperson Joe Jefferson noted that the full version of the Channel 4 newscast
regarding the Allen Filter Plant sludge issue is available on Englewood's website.

7. PUBLIC FORUM
DAVE PRADO-780 W. OXFORD AVE.
Dave Prado of S. Huron Street appeared to discuss his objections to a proposed garden
site in the City Ditch easement behind his property. Joe Jefferson noted that the past
policy has been that all adjacent property owners must agree on the use of the
easement for it to be utilized . Mr. Prado discussed his concern about the garden
attracting raccoons . Mr. Wiggins recommended Mr. Prado fence the 30' along his
property line next to the City Ditch to restrict access to his property. It was noted that
any proposed use cannot interfere with City Ditch operations.
Mr. Prado is concerned about a dying elm tree that he believes is located in the City
Ditch easement. Mr. Brennan noted that he will send out a ditch rider to determine if it
is the City's responsibility for removal.

8. ANNUAL BOARD & COMMISSION APPRECIATION NIGHT.
The Board received a memorandum dated July 7, 2016 inviting the Water Board to the
Annual Board & Commission Appreciation Night on Monday August 8, 2016 at 6:00 at
Pirates Cove, 1225 W . Belleview Ave.
9. WATER BOARD MEMBER JO LAY'S RESIGNATION
Jo Lay announced, with deep regret, that she must resign from the Water and Sewer
Board. Jo and Dick Lay are moving out of Englewood.

The next Water and Sewer Board meeting will be Tuesday, August 9, 2016 at 5:00 p.m.

The Flowing Waters Partnership is an innovative program for water users and providers to give back to
their local rivers. Here in Colorado, water flows down from the Rocky Mountains in hundreds of rivers
and streams . These rivers and streams allow us to call this state beautiful and are a source to growing
food, running a business, or public consumption. The partnership works to find solutions that create
balance, ensuring a sustainable water future for Colorado. They develop solutions to our water
challenges by working with willing water rights holders to keep enough water in our rivers so they
remain healthy .
By joining the Flowing Waters Partnership, the City will support the Colorado Water Trust financially
with a four-year commitment. As water provides staff believes we should be part of the solution for
healthy, flowing rivers. Therefore, staff is recommending participating at a Silver Sponsor level by
pledging $4,000.00 annually for a four-year commitment .

How did you set the $25 0,000 annual goal for this partnership?
In our most recent strategic plan, we charged oursekes with securing 50 °'0
of our operating funds through multi-year commitments. The \\'ater
Trust's annual operating budget is approximately ~900,000, with salaries
for nine staff people included. This Partnership ,,·ill help us get a quarter
of the way there in each of the four years we\·e asked for your
commitment; the rest will be secured through a se ries of grants and other
fundrai sing acti,·ities. That means that with im-es tment from Colorado's
water users, you can O\\·n 25% of the em·ironmental outcomes we prO\-ide!
Why ask for a fo ur-yea r commitment?
At the Colorado \\'ater Trust, we take planning ,-ery seriously. It help s u s
stay focused and clear about the tools we'll u se and the direction \Ye'l! take.
This fund will help us support our operations so that we can accomplish
the work we'Ye se t out to do under our strategic plan. \\'e intend to
increa se the number of projects accomplished each year to fiye a year by
2016, and to imprO\-e and mah1rc project processes, while maintaining our

High demand means prices a r e already high. C BT shares have sold for
between $25;000 and $28,000 each, according to the ~?.~~!~~.1.7.~ S:?.1.?.r..~1~?.
\Vater Conservancy District, the agency that manages the C-BT system ...................
-·which conveys water from the heachvaters of the Colorado River to
the Front Range and plains.
This means the C-BT water alone could bring in $6.9 million to $7. 7
million, compared with the auction house's estimate for the land of
SS;OOO to $15,000 per acre, or $2 million to $6.2 million.
"On a per-share basis: (C-BT) would certainly bring more than the per-
acre price for land,'' Shuman said. "W11atwe're selling is kind of one of
a kind. It's not every day this kind of an opportunity comes up."
While 80 to 90 percent of Colorado's population is east of the
Continental Divide, 70 to 80 percent of Colorado's water cornes from
the Westem Slope: according to Colorado's Water Plan . Urban areas .. , ................................................................. .
are desperate to get their hands on that water.
The state expects Colorado's population to nearly double by 2050,
meaning more demand on the Colorado River's already limited water
supply that serves seven states in the U.S. and two in Mexico.

These particular water ri ghts are especially attractive because they can
be used for multiple purposes -agriculture, development and
industrial processes, including fracking -a nd can be easily traded as
long as they stay within ('.-BT boundaries_, said Rea.gan Waskom,

Northern Wa ter boundaries encompass L6 million acres that
cover portions of Boulder_, Br oomfield> Larimer ; Logan, :!vfo r gan,
Sedg,vkk, Washington and Weld counties .
The Reynolds farmland, which is northeast of the intersection of
Interstate 25 and Colorado 66, is bounded by Weld County roads 9 1/2,
32 and 13, and another property .
It is not annexed into a to:wi:1> although it is in Mead's growth area .
Tovm manager Mike Segrest said he assumes it wiJl be annexed in the
future.
"I think it is a very valuable p r operty because it does have a lot of water
\vith it," Segrest said, adding that a lot of farmland has been stripped of
its water rights.
The process of stripping water from land is e:oHoquia11y referr ed to as
''buy-andd.ry." Urban areas, including municipalities and developers,
buy the water rights from sometimes cash-str apped farme r s to quench
their gro\ving population . Although farmers can lease back the water,
the p r ocess can lead to dried agriculture land .

The state doesn't necessarily track buy and-dry. But the Colorado
Department of Natural Resources said the South Platte Basin lost
150;000 irrigated acres benveen 1976 and 2010. The Colorado Basin saw
a 70)000·acre reduction of irrigated land from 1993 to 2010 . There has
been a "measurable amount" of reductions in the Arkansas Basin, but
the state doesn't have complete data.
A spokesman from the Department of Natural Resources said ifs safe
to assume that the losses were due to urbanization and industry.
Waskom said it's possible a farmer may purchase the Reynolds Farm -
novi' planted in irrigated crops_, including corn -but it's not
economically foasH:>le.
"The price of \Vater is out of reach and the price ofland is out of reach.'·'
'Waskom said. "Those are development prices."
He said a farmer would need to have deep pockets and be \Villing to
wor.k the land \Yithout making much profit. He added that a
young farmer could buy the land and the ditch rights and not the C-BT
shares, shifting to dryland farming of crops such as -..vheat. But that's a
difficult transition and profits vrnuld be minimal, especially compared
with mi irrigated fann.
''Bankers are not going to go there with him.," Waskom sa.id.
It's more likely that a developer will buy the land) Waskom said . A
developer could build on the land or transfer the vvater rights to a water
provider that supplies an area where it has a project.
"I feel like it is inevitable/' \i\'askom said about the possibility that the
water will be separated from the land. "I wish we could plan it better so
that our best agricultural lands could stay in \Vorking lands. To me,, it's
all being driven by the market, which I'm not saying is had, hut it may
not end up with the kind of Front Range Colorado we want in 10 to 20
years."
Jennifer Pitt, director of the National Audubon Society's Colorado River .....................................................
Project_, said she was not familiar with this particular auction, but said
it seemed different from other sales that have removed \vater from
Front Range farn1land.
This land is in the path of urban development, which means it is more
likely for the land to be converted into another economic purpose
instead of drying up.

farm is bought out and then the water is severed from it in a place
\Yhere that land is unlikely to be developed for urban use," Pitt said.
The land and water rights will be auctioned off starting at 10 a.m. July
28 at the First National Bank Exhibition Hall at the Larimer County
Fairgrounds, 5280 Arena Circle, in Lovelaud.

When the City deems it to be in the best in terest of the city and water consumers, the City may require
any sche duled flat rate user Lo take his or her waler through a meter al the ra tes set by the City Council.
Whenever a meter is to be used, it shall be supplied hy the City . All meters for new accounts s hall be
supplied at the cost of the user.
Al l meters installed shall he the same size as the size or th e se rvi ce pipe , except in instances where
premises have been vacated by a user that required a larger service pipe to supply its demands th an
that required by th e new use r. In such cases, the meter size may be reduced appropria te ly.
Al l consumers' water meters shall he serv iced a nd maintained by the City, and the cost thereof sha ll he
paid by the City, except that in the case ur maliciou s damage, the cost ur the repair shall be paid hy the
owner or the meter.
All meters sha ll he se t or reset according to City standards in a proper watertight and frostprnof pit
within the limit s of a puhlic street or a lley or inside a building located on th e property to be served. In

Colorado Water Trust Flowing Wate rs Partnership
The Flowing \V'ater s Partnership is an innontive program for water users and providers to give back to their local
ri,-ers. Most Colorado water users, providers, managers, and employees don't have the infrastructure or capacity to
implement streamflow restoration projects for environmental benefits . The Colorado \\later Trust, however, spends
all day, e,-ery day, working on flow restoration projects, using market-based, voluntary, and win-win strategies.
By \Vorking within Colorado's water law in neutral and collaborative way, in our 15 year history, we have put 25 flow
restoration projects on the ground, returning over 19,400 acre-feet of water to 25 rivers and streams throughout our
state. Combining the collective interest of the water community with the Colorado Water Trust's get-it-done
culture creates a powerful partnership-one that can achieve more than all of us can individually.
By joining the Flowing Waters Partnership, your organization will support the Colorado Water Trust financially with
a four-year commitment,* demonstrating to your constituents that your organization is part of the solution for

How d id you set the $25 0,0 00 annual goal for this partnership ?
In our mos t recent strategic plan, \Ye charged ourselYes with securing 50 %
of our operating funds through multi-year commitments. The Water
Trust's annual operating budget is approximately $900,000, with sa laries
for nine staff people included . This Partnership will help u s get a quarter
of th e way there in each of the four years we've asked for your
commitment; the rest will be se cured through a series of grants and other
fundrai sing activities. That means that with in»estment from Colorado's
water u sers, you can own 25 % of the em-ironmental outcomes we provide!
Why ask fo r a fo u r-yea r c ommitme nt?
At the Colorado \X 'ater Trust, we take planning very seriously. It helps u s
stay focused and clear about the tools we'll u se and the direction we'll take .
This fund ,,-ill help u s support our operations so that we can accomplish
the work we\-e set out to do under our strategic plan . \'\'e intend to
increase the number of projects accomplished each year to five a year by
2016, and to improve and mature project processes, while maintaining our
neutral position in the world of Colorado water . \\'e ,,-ill continue to be
the group you've come to tru st, only we 'll be more productive.
Understanding there are re striction s on long-term financial commitments,
subject to annual appropriations, go,-ernmental entities can partner for
renewable one-year commitments.
How will the funds be u sed?
These funds \vill be u se d to support the Colorado \'\'a ter Trust's highest
priorities. \'\'e \vork hard e\-ery day to create healthy working ri,-ers, rivers
that are healthy for people and healthy for the environn1ent. As \Ve grow,
our area of greatest need is for general support of the organization. As we
mature, we pledge to revisit how these fund s are u se d, with direction from
all of you, our Partners, to ensure that the fund s are used to maximize the
benefits everyone \vants to see. \'\1e also pledge to be tran sparent and
careful stewards of your in\-es tments.
