HomeMy WebLinkAbout2025 Ordinance No. 037 1 ORDINANCE COUNCIL BILL NO. 37 NO. 37 INTRODUCED BY COUNCIL SERIES OF 2025 MEMBER ANDERSON AN ORDINANCE APPROVING THE 2800 WEST CHENANGO PLANNED UNIT DEVELOPMENT (PUD), LOCATED AT 2724 WEST UNION AVENUE, 2727 WEST UNION AVENUE, AND 2800 WEST CHENANGO AVENUE IN THE CITY OF ENGLEWOOD, COLORADO. WHEREAS, Global Storage Colorado, LLC (“Applicant”) is the owner of the properties located at 2724 West Union Avenue, 2727 West Union Avenue, 2800 West Chenango Avenue, and vacant parcel AIN: 2077-08-4-10-021, as well as the existing storage facility at 2690 West Union Avenue in Englewood, Colorado; and WHEREAS, the subject property consists of four parcels totaling approximately 9.8 acres, located at the northeast corner of S. Decatur Street and W. Chenango Avenue, and is largely undeveloped; and WHEREAS, the property is currently zoned Medium-Density Single and Multi- Dwelling Unit Residential District (R-2-B), which allows for detached houses, up to six- unit attached houses, and up to four-unit multi-unit houses; and WHEREAS, the Applicant seeks to rezone the property to the 2800 West Chenango Planned Unit Development (PUD) to expand its existing Global Storage facility located at 2690 West Union Avenue onto the adjacent parcels at 2724 West Union Avenue, 2727 West Union Avenue, and 2800 West Chenango Avenue; and WHEREAS, the proposed PUD would permit outdoor storage, mini-storage facilities, warehousing, and outdoor storage for vehicles, equipment, and materials, as well as limited outdoor retail and sales to allow for the continued operation of an existing firewood sales business; and WHEREAS, the PUD would also maintain existing single-family residential uses to allow the continued use of existing structures for employee housing and sales offices, but would remove right to subdivide and develop detached, attached, and multi-unit homes and accessory dwelling units as a use by right currently permitted in the R-2-B zone district; and WHEREAS, the surrounding area includes a variety of land uses: • To the west and north, properties are zoned Single-Unit Residential District - Medium Lot Size (R-1-B); • To the east, the existing Global Storage facility is zoned Light Industrial District (I-1); and Docusign Envelope ID: AE1B37D3-982E-4A89-9035-313AFB07D9BA 2 • To the south, the property borders the City of Littleton, which includes an open- space storage area and a three-story walk-up multifamily residential development; and WHEREAS, in accordance with Englewood Municipal Code (“E.M.C.”) 16-2- 1(E)(5), City staff reviewed the proposed PUD for compliance with Title 16 and prepared a report with recommendations for the Planning and Zoning Commission and City Council; and WHEREAS, pursuant to E.M.C. 16-2-1(G)-(H), the Planning and Zoning Commission held a public hearing on March 4, 2025, reviewed the PUD, approved it with conditions, and forwarded the matter to City Council with a recommendation for conditional approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: SECTION 1. The 2800 West Chenango Planned Unit Development (PUD) is hereby approved, rezoning the properties located at 2724 West Union Avenue, 2727 West Union Avenue, and 2800 West Chenango Avenue to a PUD, subject to the terms and conditions outlined in Exhibit A, attached hereto, and as set forth by the Planning and Zoning Commission. SECTION 2. The Applicant, Global Storage Colorado, LLC, shall comply with the following conditions as recommended by the Planning and Zoning Commission: 1. A detention pond shall be constructed as part of the development. An access easement for the detention pond and associated drainage swales shall be dedicated in writing on the district plan and during the subdivision process to allow City access for maintenance. 2. Access off of South Decatur Street shall be restricted to emergency access only and closed to general vehicular traffic. 3. The access point off of West Union Avenue shall be improved to meet all applicable Americans with Disabilities Act (ADA) standards. 4. All ingress/egress permits required for the access improvements off of West Union Avenue be applied for and approved prior to opening the back lots for business. In addition, the PUD site shall be subject to all applicable laws and regulations regarding noise restrictions for residential properties, including but not limited to, EMC § 6-2-8, during the hours of 10 p.m. to 7 a.m. The PUD site shall be subject to all applicable laws and regulations regarding noise restrictions for industrial properties during the hours of 7 a.m. to 10 p.m. SECTION 3. The following general provisions shall apply to the interpretation and application of this Ordinance: A. Severability. If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or Docusign Envelope ID: AE1B37D3-982E-4A89-9035-313AFB07D9BA 3 invalidate the remainder of this Ordinance or its application to other persons or circumstances. B. Inconsistent Ordinances. All other Ordinances or portions thereof inconsistent or conflicting with this Ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. C. Effect of repeal or modification. The repeal or modification of any provision of the Code of the City of Englewood by this Ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purposes of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, proceedings, or prosecutions. D. Safety Clauses. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Englewood, that it is promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be obtained. This Safety Clause is not intended to affect a Citizen's right to challenge this Ordinance through referendum pursuant to City of Englewood Charter 47. E. Publication. Publication of this Ordinance may be in the City’s official newspaper, the City’s official website, or both. Publication shall be effective upon the first publication by either authorized method. F. Actions Authorized to Effectuate this Ordinance. The Mayor is hereby authorized and directed to execute all documents necessary to effectuate the approval authorized by this Ordinance, and the City Clerk is hereby authorized and directed to attest to such execution by the Mayor where necessary. In the absence of the Mayor, the Mayor Pro Tem is hereby authorized to execute the above-referenced documents. The execution of any documents by said officials shall be conclusive evidence of the approval by the City of such documents in accordance with the terms thereof and this Ordinance. City staff is further authorized to take additional actions as may be necessary to implement the provisions of this Ordinance, and has authority to correct formatting and/or typographical errors inconsistent with the approval of this legislation by City Council.
