HomeMy WebLinkAbout2025 Resolution No. 021 1 RESOLUTION NO. 21 SERIES OF 2025 A RESOLUTION PROHIBITING THE USE OF GRAYWATER AND THE INSTALLATION OF GRAYWATER TREATMENT WORKS WITHIN THE CITY OF ENGLEWOOD, COLORADO WHEREAS, “graywater” is defined by Regulation 86 of the Colorado Water Quality Control Commission, Colorado Department of Public Health and Environment (5 CCR 1002-86, effective June 30, 2015) as the portion of wastewater collected from bathroom and laundry room sinks, bathtubs, showers, and laundry machines (but excluding wastewater from toilets, urinals, kitchen sinks, dishwashers, or non-laundry utility sinks) in residential, commercial, or industrial buildings or institutional facilities before treatment or combination with other wastewater for beneficial use; and WHEREAS, House Bill 13-1044, enacted in 2013, authorized municipalities to approve the use of graywater systems only by local ordinance; and WHEREAS, House Bill 24-1362, effective January 1, 2026, reverses the statewide prohibition and authorizes graywater collection, treatment, and use unless specifically prohibited by local resolution or ordinance; and WHEREAS, the Arapahoe County Board of County Commissioners adopted Resolution 25-236 on October 14, 2025, prohibiting the installation and use of graywater systems within unincorporated Arapahoe County; and WHEREAS, the City Council of the City of Englewood finds that there is not sufficient justification to permit the use of graywater as there are potential risks to public health, water quality, and the City’s water and wastewater treatment systems, and that prohibiting graywater systems is necessary for the protection of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. Pursuant to the authority granted in C.R.S. §25-8-205.4(2)(a)(I), and the Englewood Home Rule Charter, t he installation and operation of graywater treatment is prohibited within the City of Englewood. Section 2. Grant of Authority to Implement Resolution. The Mayor, Mayor Pro Tem (in the Mayor’s absence), and/or City staff are hereby granted the authority to take all actions necessary to implement the provisions of Section 1 above.
