Woodward , Tomasso None t • • - Englewood City Council July 18, 2005 Pagel • • 0 (a) Dane Stephenso n, 3 101 South Logan, said I wi sh to formally bring to your attention, a critical safet y matter inv olving speeding and blatant inattention to stop signs involving Logan Street. The area I am speaking of is on Logan Street from Dartmouth down to Floyd Avenue. We arc respectfully enlisting your immediate ass istance with this crucial matter and we offer solutions that we, as neighbors, propose thereof, for your consideration. The problem that we arc having currently is speeding on Logan . While I obviously understand and accept the fact that Logan is a collector street ... this is why I chose to live here ... and traffic tends to be heavy at times, however, the posted speed limit is 30. However, with the average quantity of 10,000-11,000 vehicles passing through daily there is an ever present danger with vehicles speeding, which has already resulted in numerous crashes involving both individuals and property, many of which have been severe in nature . My own fence bears the reality of how cars can come dangerously close to houses due to impaticncr., speed and inattention to the stoplight. Therefore, many of the neighbors on Logan have proposed four ideas to help curb the s~. thus making Logan a safer street for those who reside there, those who aucnd church services at Englewood Bible Church, and for those who utilize the street daily for commuting or otherwise. One ... replace the two-way stop sign at Logan and Eastman with a traffic light that would remain green on Logan until a vehicle became stopped at the intersection at Eastman. thus changing the Logan light to red; and/or, two ... reducc the speed limit along Logan, from Hampden to Yale down to 25; and/or. thrce ... install "Fines Doubled for Speeding" signs along the same stretch of Logan Street; and/or, four ... install digital speed limit signs along the same stretch similar to the ones located at Inca and those at Dartmouth near University. Through two recent meetings with Mr . Ladd Vostry, Englewood Traffic Engineer, we requested a traffic speed/vehicle quantity test to be administered on both Logan and Dartmouth . The most recent one was completed back in 2000 on Logan alone. This test was implemented last week covering both Logan and Dartmouth , as reque sted . However, it was my understanding from Mr . Vostry. that no traffic police officer would be out during the test time monitoring traffic and unfortunately this was not the case. causing the test to be skewed, in my opinion. We all arc very aware that if a police officer is monitoring the traffic, the speeds decrease quickly. even going below the posted speed limit to avoid receiving a ticket. I am very frustrated that this occurred and respectfully request that another test be administered without the assililancc of the Englewood Police Dcpartmcnt. We had been previously told by Commander Jeff Sanchez of the Englewood City Police that his raoun:es were quite limited in thi s area. which is unfortunate, but someone obviously found the time to monitor exactly when we did not need their services. Any other time, I would be most grateful for their prcscncc. Mr. Vostry. however, has been very diligent with our requests, aside from the speeding situation, to post "No Truck" sians. as we have had numerous gas tanker trucks and the like, driving up and down Danrnouth, Lopn and ocher nearby llrCeU daily and has also honored our request to post alley speed limit signs and this traffic &tudy test news COIIIC5 as both a lwprisc and a disappointment knowing that we really wanted the facts and it was possibly 5kcwcd at this point. It is my hope that you consider our situation. our proposed solutions and the request to re-administer the ~icle quantity te st seriously; as the ffilltter of safety involves everyone who lives. drives and worships in our neighborhood . We also wish to work with you, the City Council, on a mutually positive and beneficial solution to thi s dire situati o n. Thank you vc~y much . Mayor Garren said thank yo u very much for coming. (b) Danielle Gregory, 3 182 South Logan Street, said I am basically here to second what Dane S1ephenson just said . The impctu for us coming here today was a recent accident on South Logan Street involving a motorcycle and SUV . The gentleman, basically, neglected the stop sign and hit the motorcycle ... the kid, a 24 year old man. lo t hi s leg immediately and several of his fingers, as I understand . I am a relatively new resident. There have been several incidents at this inte rsection ... at your intersections ... people have died . I know of at least one. So. basically, we arc propo ing four different solutions and I will reiterate them. The fir&t one is to replace the 2- way stop sig n on Eastman where th is particular accident occurred with a traffic liaJit ; second would be to reduce the peed limi1 along Loga n to 25 MPH ; the third is 10 install "Fines Doubled for Si-clina" si1111 for people who don't abide by the speed hmit and finally it would be to install di&ital speed limi t sians alona the same stretch of Lopn S1reet as we have funher up between Bate and Cornell Avenue . We did get together and had a few neighborhood rMCtings. so it was a neighborhood consensus and we felt we didn't need everyone on the street to come down and tie you up here all night tonight. All three of us have turned in the same list. I have a couple of comments. I have lived on Logan Stn:ct, in this residence, fOt" 11 years and have seen several accidents. Most of them were no injury . There was a very serious pedestrian injury and she did pass away. And here very recently, like Danielle spoke of, a young man on a motOt"Cycle was very seriously injured and he has been maimed for life. I think the residents are concerned about the safety, of not only the Englewood citizens, but everyone traveling Logan . I think it is safe to say there are quite a few people, even outside of Englewood, traveling on Logan ... Denver residents, probably Littleton, some Highlands Ranch and a few other smaller communities like Greenwood Village. It just seems like the traffic accidents are increasing and the volume of traffic seems to have increased in the years that I have lived there. The one thing I would like to talk about here are those digital speed limit signs. We mentioned that on our list and there is one already in place on Logan. I actually passed anocher one on my way here, over by the new apartments, and I would like to say they are very effective. They catch your eye ... especially when you are a little above the speed limit. they flash at you and it ICCms like it is very effective. When I drive down Logan I see the drivers ahead of me all hitting their brakes and they get down to that 30 MPH, which is the current speed limit. Well with that, I will let you get back to your regular business. Again. thank you for hearing me tonight. Mayor Gam:n said thank you very much . Mayor Garrett said we appreciate the three that have come forward . Council Member Bradshaw said I would like to respond to what mi&ht have happened. I think Ray and I both turned in the request. I received a call from Mrs. Merriman on that stn:ct and I think he did too. Council Member Tomasso said I went over the night of the accident and talked with them. Ms. Bradshaw wd okay, but anyway I think we both turned in a Council Request for police praencc and the police showed up at the same time that they were doing the count. So. I would say that we mi1bt have heen at fault for the police praericc there. We were trying to be responsive to the citizens, but I think we acrewed it up. Council Member Tomasso said it was discussed l.ut week al ET AC. The Tramportation Board was llllicipalin1 all of you showing up to hear from you and to discuu yow options. It was brou&ht up. but I think it will be broupt up again at ET AC. which will be next month on the second Thunday. Council Member Woodward said could we ask Ladd to do the lludy over apin. without the police praencc? City Manager Scars said I know that Rick is working on that. Ladd is, as I understand it, in Czechoslovakia ri&ht now visiting some of his relatives and I don '1 know exactly when he gets back. I met Ladd out there and I know he is doing the analysis, but Rick Kahm would respond on that IMCting night as to when things will happen and if one of those alternatives will be proposed in •.he budget, from a Capital viewpoint, or if there is enou&h operating money 10 proceed with that . Is it Council's desire to talk about it this evening or would you prefer to wait and put it on the Study Session 10 discuss? Council Member Bradshaw said I think the people have more than met the requirements lhat we have asked them to and originally I was opposed to this, but al this point I would request that we have a resolution drafted so that we can send the letter off. Because, I did have a problem with this. In a -y I think we are just finishing someone's financing . I have been dragging my feet and it is not really going to change who is served and l don't Ir.now how it really helps us to have more unoccupied housing. However. how docs us recommending this to the County make it better and the things that have come up ... the fact that they do a certain level of maintcnancc and they have on-site managcmc111 .. .I think those arc my main two. but we might want to add .. .I hope the Community Center can become an usct at least to. that portion. And. I don't think that is something that that area needs. I think it already is addressing that issue in the community . Mayor Garrett asked if there were any other comments. Council Member Bradshaw said I am going to be voting in favor of this ... when originally I was against it, because the on-site management is a good tool . Layton Garden Apartments, from the time I worked at Sinclair in the 70's, was always, always a uoublcsome property and I think with the on-site management it will be a bct1er property. And when we did the check on the Section 8 Housing, the neighborhood didn't come out to the Public Meeting. We asked them to talk to the neighborhood and I didn't sec any opposition to that enterprise going in there. So. because of those reasons, I will be voting for it. Mayor Garrett asked if there was any other discussion or comment Council Member Tomasso said at the Public Hearing I also saw the rcsidenlS come OUI and IIIOllt of their fears were answered . Some of the problcnu; they arc having with the people doing drugs in the current location will soon be answered by this on-site management. That would alleviate that problem. And since it is a piece of property that is up for public sale. we could do worse. Mayor Garrett asked if there were any other comments. Council Member Woodward said as I had mentioned in the Study Session and as Ray has just mentioned. I believe that we could do a whole lot worse . I think, based upon the information that has been submitted and the recommendation of who these people arc and even recommendations from a member of our Housing Authority. I am very supponivc of what I think is going to happen there, so I will be voting yes. Mayor Garrett asked if there was any other discussion. There was none . V oCe results: Motion carried . Woodward, Tomasso Council Member Barrentine {ii) Mayor Garrett said the City has also received a proposal from Miller Wcinpnen Realty dealing with the development that has been proposed ICrol5 the street. They approached us several mondas aao and after some discussion with them wc now believe wc have a proposal that wc would like to take to the community . We will outline the details of that proposal on July 27* at 7 o 'clock in the Community Room. We will have flyers placed in different facilities around the City . I am hoping the Englewood Herald will be having something this week regarding that particular meeting. so we look forward to having public input as we describe what the proposal will be . We are in the process of putting together a fact sheet, which will be the flyer and I would suggest that wc have that by tomorrow afternoon, so that document could be placed in our facilities. (b) Council Members' Choice (i) Council Member Bradshaw said at Study Session wc talked about the resolution supponing Referendum C and D on the November ballot. This is a resolution supporting the Referenda C and D to gether known as the Colorado Economic Recovery Plan. This is a temporary rcpcal of some of the TABOR pro vi sions . She said is that accurate? Wolosyn, Woodward, Tomasso Council Member Barrentine (ii ) Council Member Tomasso said I would like to thank Public Works and Rick Kllhm especially for going above and beyond by looking at our downtown and seeing what needs to be done ... what sprucing up needs to happen for the car show and jumping on those projects. And thanks to Parks and Rccrcation for assisting in removing weeds and trimming up the bushes, so everything will look really nice for when the public arrives on Saturday. Company is coming ... we've got to look good. I was also curious if wc could have a very small presence of maybe Community Development showing what sites arc available for business. If that could be a discussion the City Manager has with Community Development tomorrow. A really low profile presence, but maybe if they could get a CD, they could give directions to the Web site, maybe wc could bring in some new businesses and make it look like we arc receptive ... wc arc looking for new people. We don't ncccssarily need large corporations; we will deal one on one with individual businesses. City Manager Scars said I will get that to Bob first thing tomorrow morning. I am sure that Darren will be there and there will be some other people there and they should be able to step right in. Is ~ anybody in particular that they should talk to about location to make that happen? Council Member Toniasso said I think Darren will be there. I think he is going to attend the meeting on Tbunday with the merchants. I am s ure that Hawthorn Bocanical will let him set up in the shade right behind their place. The merc hants arc really happy and arc really excited and think the City has been overly supportive. City Manager Scars said we will pass that on to Jcrrcll 's crew and Rick's crew. (iii) Council Member Woodward said the Sounds of Summer this Thursday night will be country music, so all country fans have something to lvok forward to out at the Civic Center at the amphitheater. I want to begin by saying that I've lived at 3401 for nearly 30 years and I care very much about Englewood and what happens to the neighborhood over there . My property is being listed with the property next door, 3411, so maybe that is why there is a mistake and that is because we share one lot between us . have two and a quarter lots and 3411 has one and a quarter lots. but I want to focus on 3401 and let Marianne Farrell, who will follow me, answer any questions you might have about 3411. I would like to give a little history of the property. My father was in construction. He bought that property with the intent of putting an apanment on it with two of his business associates. That was in 1960. And on June 20th of 1961 he applied to the City of Englewood's Board of Adjustments and Special Appeals for a variance of 5 feet that would give him the required square footage to build an apartment. And, I think you have a copy of that variance in that green book and maybe you have a separate copy as well . But as you can sec, the variance was granted unanimously. I met with Bob Simpson and Tricia Langon and was told that the variance is a historical document and it runs with the property . I believe you have a memo that she gave you as well, so that is the way it stands. There was a misunderstanding about the variance . It was originally thought that the requested variance did not address the number of units, the unit size, or parking. but after a closer look, it was found that what seemed to be a plat of the property attached to the variance was, in fact . a plot plan for an 18 unit apartment with 13 parking spaces. So if you look here. this just looks like a plat that you sec all the time, but it wasn't. And then, it is referred to again in the variance and so this has a possibility of four cars on Girard and nine cars on the alley back there . So that was what was granted. Now it may seem peculiar having 13 parking places for an 18 unit apartment. but that was in keeping with the codes in 1961 and you can ask anyone who lives in that neighborhood about the difficulty parldng if you don't have off-street parking, because of the apartments around it . Traci Lynn down the street ... I don't know how many units it has ... but it doesn 't have enough parking. Anyway, that is the history of it. The intent has been and has always been to remove the existing buildings and to put something modern there. Now I am selling the property, because I don't have the resources to build something modern or nice on the corner and. because it is old and unlike modern housing, it needs constant repair and upkeep and I simply cannot do it. I keep up with it the best I can. What I would like to do is to assure my neighbors and the members of the City Council that developing the property won't change the character of the neighborhood or devalue the existing properties. It would do just the opposite ... enhance the ncighborbood. And it is also in keeping with the City of Englewood's version of modernizing this old central section of Englewood and if you think back...those of you who have been here for awhilc ... you will remember Cinderella City and maybe even some of you will remember the gravel pit that was here before Cinderella City, where we arc standing right now. And so you look at what 's replaced it. .. this building, the library, the apanmcnts uound it and you know it is really exquisite. It has turned into a very lovely area. I know that there is some concern about the property and what will happen , because it is listed as land only and I've been asked what that means. And what that means. of course, is that it is 10 put up something modem there. And as I 'said, that had been the intent. I would like to give you a very brief hi story of the property. My father bought it in 1960, as I said, and there is a carriage house in back, which is 3405 . At the time he bought that in 1960. 3401 was a boarding house. It was owned by two sisters and a brocher . The two sisters li ved in two small apartments at opposite ends and both apartments had street access O( doors that went to the stree1. The middle of the house had three bedrooms that were rented and there was an outside entrance o n Girard and you can still sec the remains of that. There was a hallway that came into it. In fact, I have pictures of coveri ng tha1 up because I had people standing in the doorway back there and it didn't really open into anythi ng at that time . But anyway, there was a large kitchen with an outside entrance that was shared and the brother lived in the carriage hou se in the back. which is 3405 South Qrant. so it has the history of having been a dwelling and not jus1 a single family kind of dwelling, plus there are two houses on the property. Currently, around 3401 South Grant Street. as you all know. the neighborhood has been bustling with development and it has been mostly for the elderly and disabled and it is a perfect locati on for ii. Everything is within two or three blocks. There is Swedish Hospital .. .! always thought I could crawl up there if worse came to worse, it i s so close. King Soopcrs ond the Englewood Post Office arc down there and the bus stop and now we have the li1ht rail right here. But, let me give you so me other examples . Grant Street and Sherman share a common alley and there were houses exactly like there are o n my s ide of Grant Streel. The Housing Authority bought those. I don't remember the year, but it was some time in the 90's that they built the c urrent apartments or units that arc back there just north of it and I think there may be 11 or 12 unit s back there , I'm not certai n, but there were five houses. So, anythin1 that would occur or might occ ur at 3401 and 3411 would be in keeping with that. Also. in the neighborhood is the Traci Lynn Apartments and that is on the south side of the street and utty-comer to Grant Street. Immediately across the slrcet fro m Grant. there o n the corner of Girard . is a two story apanmcnt building. Malley Retiremenc Cenier is one and a half bl ocks west and the Assisted Living Apanmcnt Complex as on Sherman. So dcvelopillJ thi comer would be in keeping with the current trends and it certainly would be an improvement over the existing IU\ICturcs . And apin. I think it would enhance the neighborhood and that was the concern that I have had from the neiahbon ... When we look at the area , it can be seen that there have already been several developments and they greatly improved this area , plus they brought revenue to the City. And building modern structures on this property would continue that trend. Basically, that is what I came to explain to you, because there has been some question about it and I had received calls . And interestingly I have received calls asking if I rented to th e people at 341 l and maybe there is a mistake on the books, since I am listed here as well as owning that, but I do not own that property . So if you have any questions for me , I would be happy to answer them and if not, I'll tum it over to Marianne. Thank you very much . (b) Marianne Farrell said I am a broker/appraiser with Metro Brokers representing 3401 and 3411 South Grant. She said my mailing address is 6377 South Revere Parkway, Centennial 80111 . I did distribute the green binders and mostly this is a reference tool for recognizing where the property sits and, in fact, you may have noticed this property has been for sale for coming up on a year. And a lot of it had to do with market values at the time and various other issues, not the least of which was ... what would the variance allow? Upon retrieving a copy of the variance we , in fact, have discovered that the variance has become an historical document and we have been told it docs go with the property. The reason wc are here tonight is just to have the final agreement with the City Council that, in fact , the property can be developed in accordance with the variance that was passed in 1961 . The property is roncd MUR-3-B according to the latest UDC Codes that Englewood had worked on so diligently for three years and came out in 2004 . Again , if you look at these properties, you can sec that in fact they have exceeded their life line . The life line of a neighborhood and properties is that when the neighborhood is first built, the properties accelerate in price and appreciation then they don't accelerate as quiclcly and continue to level off, then the y plateau and decline . When in fact, that is exactly where these properties arc ... they arc in a very declining mode . Since we do want to focus on 3401 South Grant, it needs to be noted that that property docs exist on three lots minus 5 feet and I joined it in a listing with 3411 , because that is one lot plus 5 feet, so that gave me a total of fo ur lots . The variance on 3401 South Grant,joining with 3411, gives us additional parking spaces and that is pretty much the idea we had there. There really is no down side to developing this property. I mean, who would want to continue 10 have the existing properties there in the state that they arc in when , in fact, the sellers are not capable of re storing or repairing those properties and they will continue to decline. So there is no down side to demolishing those propcnics and construeting new properties. CollSU'IICting new properties is consistent with the new construction and new development that is continuing to go on in zip code 80113 . As DOied in the memo in the front of the binder. the Denver Seminary is , in fact, going to be demolished and they are going to build 325 units there, so again , it is an extension of the justification of this particular part of Englewood. We did include pictures of the properties, just to refresh your memory. Crescent Court, which is the Housing Aulhority project just west of this pro perty ... how beautiful that is and well maintained . This would be in accordance with that. I also did an appraisal jus t fo r reference, just so you could sec that there are other properties being developed . It is interesting, in the multi- list. .. thi s docs not refer to all the Arapahoe County records ... but in the multi-list back to 2003, there has not been one new house built from the ground up . There have been houses remodeled, 'there have been houses sold to be tom down. but there ha s not been a new one come from the ground up , that has been referenced in the multi -list. 1liere was a property fo r sale that they were asking $799,000.00 for, in anticipation of demolishing the existing structure and rebuildi ng a new one, but in fa ct ended up just selling the lot and not doing the construetion that was advertised and that went for S 130,000.00. Again, we are here j ust to seek, for a lac k of a better term, dominus vobisc um on thi s variance that we may go forth and develop it. We have potential buyers worki ng with us right now and if in fact an 18 unit building is not what the City Council would agree with , then we would ask you to counsel us as to what you would accept. I guess before wc mo ve on, it appears to me, that the issue is whether the vari ance of 196 1 is appli cable to build an 18 unit apartment complex and whether they can do that using that variance . Clearl y we need to look to our legal counsel to give us a legal opinion on that. Do you need to take time to re view i1? Cny Auomcy Brotzman said the answer is this . The 1961 Board of Adj ustment variance runs with the property. If they want to build exactly what th at variance requires , they can bui ld that. That NIIS wi th the land . If they want to build so mething other than what the 196 1 variance gave them . then they need to go back to the Board of Adjustment and Appeal and get that approved. That decision is also appealable to the Board of Adjustment and Appeals. Mayor Garrett said so if they want to use the variance of 1961 to build 18 units, they just go to the Board of Adjustment and Appeals for a ruling, basically, or declaration on what that variance meanL Mr. Brotzman said correct. Mr. Garrett said if they want to build something different than that, they need to go through the Board of Adjustment and Appeals or Planning and Zoning depending on what they arc doing. Mr. Brotzman said right. Council Member Bradshaw said my concern is the venue is there for them to go to the Board of Adjustment and Appeals ... not come to Council. .. to go to the Board of Adjustment and Appeals. Ms. Farrell said I just need a point of clarification. If I heard the City Attorney correctly, he said the variance goes with the land. Mr. Brotzman said correct. Ms. Farrell said the variance refers to 18 units. Mayor Garrett said that is a subject of debate. The City's Community Development Department has opined that it is 6 units, not 18. So, if you disagree with that interpretation, the Board of Adjustment and Appeals is the proper forum for you to say we think there has been a misinterpretation by the Community Development Department, that it should be 18 units and then you would go from there. Ms. Farrell said ... and I don't mean to persist in an argument ... but it clearly says at the bottom of the variance an 18 unit apartment. Mayor Garrett said we arc not in a position to discuss the merits of the variance. Ms . Farrell said I understand, thank you . Council Member Bradshaw said the Council does not give variances. The Board of Adjustment and Appeals does . Ms . Farrell said I understand. Thank you . (c) Greg Sampicr said I appreciate your consideration of the proposal that I have before you. We arc not asking for specifications of anything, just if City Council can see their way clear to assist in any way, it would be deeply appreciated. The funding that you could potentially provide would go towud the Golf Tournament ... helping to kind of better this tournament and in turn, better things for Brian and his family. They are doin& well, they really arc . The kids arc growing up. In the binder I presented to you there are several photographs that I wanted you to sec. Those photographs were taken almost a month prior to his accident. And I tried to include some things that he has endured through therapy. He has worked hard. There are also some pictures after the fact. The therapy goes o n. He is working hard and his attitude has always been good. And every now and then the old Brian comes cree ping 0 111 and gets you with a good one. We arc real proud of what he is doing. As I said, I won't take a lot of your t ime and belabor the iss ue. (d ) M ary E llen McPherson said I have lived at t6is same place at Fox off of Oxford for almost 40 years and ne ver had any problems until about five years ago. And briefly I can tell you a lot of these problems have 10 do with the s igns . My first problem was in February of 2000 and this had to do with the air bags in my Ultima N issan bl o wing up at the corner of Oxford and Broadway. There was no accident, but I aot a ticket and of course the accid e nt caused me a lot of problems. They called it a closed head injury because of the explosion of those air bags. The N issa n Co mpany, last year. announced that they were faulty . Sometimes, because of salt in the streets or goi ng over a c urb. which I didn't. wo uld cause the air bags to explode. So I have had somewhat of a hearing probl e m from that. and balance and so forth . I did get a ticket because the policeman was confllSCld because with my car JU t barely touc hing the car in fro nt o f me, and usually you should be ba ~k about four feet. but the air bap exploded a nd natura ll y my foot went o ff o f the brake and the car was still in pr and so a car can crawl. Tbal is my first proble m. I thank maybe I go t rid o f that tic ket , because the policeman couldn't quite understand why my car was up again st 1t . O ka y. the next acculcnt I had was on my own street and an immipant ... thal didn't have a h cnsc .. o n Fox S treet and Nassau ran into me , s mashed that car up and I couldn't even Fl out. Of course what I did, I had to crawl out of the other side of the car in order to walk up the block to my house and call, because there was nobody there to sec it. So that was a ticket and that was in 2003. Then the next ticket I got was when I .. .I get kind of forgetful. .. this last one was in July of 2004. This is the worst one ... the insurance company pays because the laws changed. I can't remember what they call it, and so the Federal Express uailer smashed that car to pieces, and I say to pieces, I mean both times they were completely demolished. I was taken to the hospital and then a policeman came to the hospital ... and I was almost out of it. .. because of that accident. .. and gave me a ticket. And it was on the same street of Oxford and Broadway. This is where my problem is . For 40 years I have made the turn at Bill Smith's Plumbing Company and everybody else and the merchants turn right on to Broadway. But evidently, according to the sign, which was wrong, only the middle lane could turn on Broadway and everybody else who had turned on the curb side ... was at fault. Again, I got a ticket and Ken Ross went to the Judge with me and I had to pay S80.00 and the next day they changed the sign so that right now it says "Right Tum Only" on the curb side and the next lane has to go straight ahead . Again, I get a ticket. And that one was a really bad one. I was in the hospital and my bill was $8,000.00 for the emergency room for all the tests. And again, there is all this noise. I have to wear these hearing aids in my ears in order to hear what people arc saying. They called it "closed head injury" because of all of these noises and everything. Now then, the last ticket that I got was just about a month ago and it was on Windermere coming toward 0Jtford again ... right in my own neighborhood . On Belleview where I picked up this friend, she had been in the emergency room and I picked her up off of Belleview and I came down Windermere because I knew it wouldn't be crowded, and so I guess I was going 40 miles on Belleview and when I turned I was still going 40 miles and two men on motorcycles stopped me and they said I was going 40 miles. I got a ticket and that one cost me ... that was rcccntly ... and that was $120.00. One other ticket that I forgot between there was on Odord Street again and I was on the lane going to the Rec Center, where I had been going for 10 years ... off of Folt ... and there was a car in front and a car in back and I was in the middle lane, but I had to get over to the side lane in order to make the turn, there was a cop right there on Hwon Street waiting. It should be a passing lane there . There shouldn't be just one lane in the middle of Oxford IO try IO make the turn. I got another ticket there for S80.00. So anyway, a friend of mine said she gol a licket on the opposite side, on the curb side, she said that her 1icket was only $15 .00 ... the Judge dropped it to $15.00 ... and the Judge charged me $80.00. Now this last one, I forgot that one was in the middle ... thal one was about in 2004 or still 2003. I have never had a speeding ticket before in my life. I've never had any ticket for doing anything that I know is wrong, but I've got all these funny tickets now against me . I'm not happy. I want IO leave Englewood and especially the address where I live, you know. And if there was a cop car with lights blinking on Windermere, I would have wanted to make sure that I was not going too fast, even though it is 001 a residential area or cars arc not parked on the side, but these two molorcycles were just waiting to pick up people, because they knew that people on that street might be, you know, going a liule bit faster . My pastor who lives in Highlands Ranch ... hc is a very good driver ... he got a ticket that same day coming down there and he lives in Highlands Ranch . I went to the Rec Center that morning after I took care of my friend 1ha1 was ill and a woman there said she had gonen a ticket also coming down Windermere thal day. I said well they sure made a 101 of money. And that ticket was my last ticket and that was a month ago and that was $180.00, all because of my bad situations of unlicensed ... and the one was an unlicensed immigrant. uninsured driver. And my insurance company has now dropped me because of all of these incidents, none of which I was responsible fo r. Then, one last thing, which doesn't have ,lo do with a ticket. I live on the corner of Nassau and Fox and that street has never been r.aved . It is called Nassau Street. It's never been paved and they don't even keep ii up with gravel a nd there are all these weeds in the street. It has caused my drive to be broken up, it has caused weeds to come int o my yard from these weeds in the street. I have complained about that, but they don't do anything about that. And th ey told me to come in and announce thal at the City Council meeting. Nassau Street on FoJt never has been )lav ed s ince we've owned that property and so I have weeds that arc into my yard that shouldn't be ... bccausc weeds are in the street. They don't even gravel it . Dr. Milligan lives right at the bottom of that street. .. he's my neighbor. .. of course they had a fire and they don't live there any more . So anyway, I didn'I even know I was going to be o n here . I was just told that I could come and talk about my problems to the City Council . I almost didn 't come. so I didn't kno w I wa s going to be here. Anyway, those arc my problems with the signs and ti c ket s ... $120.00, because of my tickets and I've never had a ticket for speeding before or for doing anything wrong . General Discussion (a) Mayor's Choice (i) Mayor Garrett said I would like to point out that due to the hard work of some of the Council members here. the City of Englewood was a participant in the Habitat for Humanity project and I want to show the plaque they awarded us at the opening. This should be on display somewhere in City Hall. It was a very nice ceremony and I would like to thank several members of City Council who did a lot of work over there. The house came out very nice. Council Member Bradshaw said I can't believe the difference, it is gorgeous. (ii) Mayor Garren said wc had this discussion during the Board and Commission interviews, but I don't think we ever formally talked about it The provisions on Code Enforcement suggest that we have a second Council liaison. Jim had talked about being a part of that and I just want to make sure that wc arc all on board with that one. We talked about it, but wc didn't address it in formal session. Jim is the second liaison for the Code Enforcement Advisory Committee, because the Charter provides for a second one. Council Member Bradshaw said oh good. Mayor Garrett said he volunteered for that Ms. Bradshaw said because we had two on at the very begiMing. Mayor Garren said yes and one member resigned from Council and had not been replaced . (b) Council Members' Choice (i) Council Member Bam:ntine : I. She said I wanted to let everybody know that Positively Englewood held their third bike giveaway for the 4"' of July . Since we have been doing a lot of this with Parks and Recreation ... displaying the bikes over at the Recreation Center ... Parks and Recreation youth member Rebecca Laughlin. wu nice e-sh to aet an organization that she works with to help us. We went over to Belleview Park for this particular give away. We bad approximately 30 kids picking up trash and if they gave us a bag of trash that they picked up in the park, they got an entry for this bike that we gave away that day. We had about 30 of them. We got a nice picture of them in front of this whole big pile of trash. That park really looked pretty darn clean when wc were leaving so I was pretty impressed, with at least our section of it And what the girls did, which I appreciated, was to make SIR that as many people in that park that were there for the 4• of July festivities knew about what we were doing. So they gave people a trash bag. a flyer and explained what we were doing. We had a five year old. a very nice young man named Tyler, who had won the bike the month before in a drawing, pick the name so that we wouldn't have any things going on there. He was very cute. He picked the name out and a young teenager. a young man who had just gotten hi s first summer job ... unfortunately, also had just gotten his bike stolen a couple of months befon:. So he was reall y grateful to have that new bike. We just had a great time. It was a great event. I wanted to extend my thanks fo r supporting that and note that the Parks and Recreation Commission has also have been very supportive of the things that we have been doing. We are trying to come up with our next one for August. We will be putting up some advertisement for that. I wanted to say thank you to her and her family and also thanks to Positively Englewood for continuing with this . I talked to him during the course of that week, very early on he went out there, checked, found out that there was going to be a huge parking problem for that community over there. They were able to put up some signs requesting people be considerate of the community. It worked . They were very happy. They didn't have a problem. There is no way of knowing that something like the Women 's Open will get the attention it got, when you 've got a few players that all of a sudden start getting a lot of publicity. So they were very pro active ... the community, and they were very happy. I got several phone calls from people who were just very impressed with the way you handled that. She said the last one was the concrete issue. Again, I just really appreciate that you jumped on it as fast as you did with someone who wanted to buy in on that concrete program. She said as weird as it seems, I just like that I live in a City where people care enough. A woman who had talked to All Souls about their development and just wanted to keep her little piece of the view of the mountains and he was instrumental ... and several people, including Ladd .. .in malcing sure that they kept to their original plan, so that this woman could, as they agreed on in the beginning of that development, keep her little view of the mountains and those kind of things arc important. I wanted to tell you thank you very much, as usual. It is just fantastic being in Englewood, so thanks. (ii) Council Member Moore said I enjoyed the fireworks show. It was a beautiful display. (iii ) Council Member Bradshaw: I. She said I enjoyed it too . Thank you Public Works, or Michael in particular, for getting the sign for our bloc k. I live on South Elati Drive and the first year we didn't have it ... a barricade ... and we had 50 cars just park on our block and the tradition of our neighborhood is to sit in the cul-de-sac and watch the fireworks display as a group and there was no room to do that . She said the other thing I have is the Relay for Life is going to be held II Belleview Park August 20-21 and Gabriel Allen asked me to talk to Council about waiving the fee for the banner. This is a fund raiser for Cancer and the fee is $150.00 to put a banner up. I reside at 3101 S. Logan Street. I have lived in Englewood for 14 years and 3 of these years at my current address . I wish to formally bring to your attention, a critical safety matter involving speeding and blatant inattention to stop signs that involves Logan Street, from Dartmouth Avenue to Floyd Avenue particularly. We are respectfully enlisting your immediate assistance with this crucial matter and we offer solutions that we as neighbors, propose thereof, for your consideration. While I obviously understand and accept the fact that Logan is a collector street (as I chose to live here) and that traffic tends to be heavy at times, the posted speed limit is 30. However, with the average quantity of l 0,000-11,000 vehicles passing through daily, there is an ever present danger with vehicles speeding which already has resulted in numerous crashes involving both individuals and property, many of which have been very severe in nature. My own fence bears the reality of how cars can come dangerously close to houses due to impatience, speed and inattention to the stoplight. Therefore, many of the neighbors on Logan have proposed four ideas to help curb the speeders, thus making Logan a safer street for those who reside there, those who attend church services at Englewood Bible Church, (as the back of their church and parking lot are present at Logan and Eastman) and for those who utilize the street daily for commuting or otherwise . One ... replace the two-way stop sign at Logan and Eastman with a traffic light that would be remain green on Logan until a vehicle became stopped at the Intersection at Eastman, thus changing the Logan light to red; and/or Two ... Reduce the speed limit along Logan, from Hart,pden to Yale to 2S; and/or 1 ' .... ,• • • Three ... lnstall "Fines Doubled for Speeding" signs along the same stretch of Logan Street; and/or Four ... Install digital speed limit signs along the same stretch similar to the ones located at Inca and those at Dartmouth near Unlvenlty. Through two recent meetings with Mr. Ladd Vostry, Englewood Traffic Engineer, we requested a traffic speed/vehicle quantity test be administered on both Logan and Dartmouth. The most recent one was completed in 2000 on Logan alone. This test was implemented last week covering both Logan and Dartmouth as requested. However, it was my understanding from Mr. Vostry, that no traffic police officer would be out during the test time monitoring traffic and unfortunately this was not the case, causing the test to be skewed, in my opinion. We all are very aware that if a police officer is monitoring the traffic, the speeds decrease quickly, even going below the posted speed limit to avoid receiving a ticket. I am very frustrated that this occurred and respectfully request that another test be administered without the assistance of the Englewood Police Department. We had been previously told by Commander Jeff Sanchez of the Englewood City Police that his resources were quite limited in this area, which is unfortunate, but someone obviously found the time to monitor exactly when we did not need their services. Any other time, I would be most grateful for their presence. Mr. Vostry however, has been very diligent with our requests to post ''No Trucks," signs, as we have had numerous gas tanker trucks and the like, driving up and down Dartmouth, Logan and other nearby streets daily and has posted alley speed limit signs upon our request, and this traffic study test news comes both as a surprise and a disappointment. In January and February 2005, Council passed two ordinances approving redemption and sale of two other properties acquired through the foreclosure process. RECOMMENDED ACTION Community Development staff recommends that Council adopt a Bill for an Ordinance approving the redemption and subsequent sale of 3596 South Bannock Street (a single-family home) acquired through the foreclosure process as defined by Colorado State Statutes. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED Th e Housing Rehabilitation Program was created in 1976 by the City of Englewood to preserve the existing housing stock in Englewood, and to also address the problems that homeowners experience with the financing of major household improvements. The City Attorney required that the new Housing Rehab Program not be administered directly by the City to avoid any conflicts with a State Statute that prohibited any municipal government from making loans to its citizens. It was deci ded to use th e Englewood Housing Authority (EHA) as the conduit to manage and operate th e Pro gram . The legal authority to operate and manage the Rehab Program was assigned to the City in 1999 thro ugh an agreement with the EHA. It was determined at that time that the Program and City staff should be under the direct management of the Community Development Director. In order to avo id an y conflict with Colorado State Statutes, an enterprise fund was created under TABOR regulations known as the Housing Rehabilitation Fund (Fund). The Rehab Program retained its own funding sourc es designated as Fund 45 and Fund 46 that are used to support the operations of the Program . ' .. • • A third mortgagee had filed their own Intent to Redeem notice with the Public Trustee's Office. The third mortgagee had until June 15, 2005 to act on their Intent to Redeem and wired funds to the Public Trustee's Office. On June 16, it became known that the third mortgagee did not send funds . A letter was hand delivered that same day requesting that a Public Trustee's deed be Issued in the name of the City of Englewood-Housing Rehabilitation Fund. · The redeemed property will be sold to a private owner-occupied party who has secured their own financing. The funds that were used to redeem the property will be returned to the Housing Rehabilitation Fund 46 when the property is sold If an offer to purchase the property is received from any City of Englewood employee, their family members, or any business in which a City employee has a financial interest, then staff win submit the offer to the City Council for approval. FINANOAL IMPACT Fund 46 will cover all costs of the redemption and the subsequent sale of 3596 South Bannock St There are no other financial impacts to the City. RECOMMENDED ACTION The Water and Sewer Board, at their July 12, 2005 meeting, recommended that Council approve, by motion, the purchase of water meters and yokes from National Meter and Automation in the amount of $151,465 for the three year program ($41,165 will be used in 2005 with the remainder dMded over the next two years), and the bid from National Metering Service in the amount of $35,660 for 2005 valve work and installation of large commercial meters Labor for the large meter installations will be renegotiated yearly. Essentially the installation and valve work contract is a time and materials contract. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Utilities Department is in the process of updating existing meters to incorporate electronic transmitter systems (ERT), which are compatible with our billing system and will make meter reading more efficient and safe . This will reduce needed manpower for meter reading and decrease on-the- job injuries. Many commercial meters in Englewood are over 15 years old and as large meters age, they become inefficient and slow down, causing a loss in revenue . AWWA standards recommend that larger meters be tes ted every three years and replaced every ten years. The recommended large meter replacement program will have the larger 1-1/2" to 6# meters being replaced over the next three years. Badger meters w ill be used to maintain consistency with exis ting meters and a meters are pulled, they will be tested for accuracy and determine loss. By having ati ona l Metering Service provide labor for replacing these larger meters, installation can be completed in a short amount of time and begin more accurate readings on the larger water users . ' • • National Meter and Automation, providing the meters, is located in Centennial and is the largest and only Badger water meter distributor in Colorado. National Metering Services, providing the meter installation portion, is located in Kearney, New Jersey and just completed a job in Broomfield. Upon checking. Broomfield provided excellent references. FINANCIAL IMPACT $300,000 was budgeted under maintenance for three years, averaging out to approximately $100,000 a year, with more being spent the first year. Because of possible valve replacement that may be necessary once the crew is on the job, there are variables in the labor amount For meters, two bids were received: Hughes Supply National Meter & Automation For installation, three bids were received: Quicks Hoe Service Vanguard Utility National Metering Service $158,355 $151,465 $71,682 $69,544 $35,660 For the meter portion, Nationa~ Meter and Automation is the lowest acceptable bidder In the amount of $15 l ,46S. For the installation portion, the lowest acceptable bid was $35,660 from National Metering Service. It does not include the valves necessary during the meter exchange. It is anticipated that 110 valves will need to be exchanged during the Q-1 phase. At a cost of $175 to $375 per valve, they wiU be replaced on a case-by-case basis. It is estimated that an additional $19,000 to $22,000 will be needed for meter valve installations, making the final bid approximately $55,000 to $60,000. This still makes National Metering Service the lowest acceptable bidder. This bid includes Nadonal's testing of each old meter for accuracy as they are pulled. This will be done either in the field or at National's field office. Staff also recommends awarding the valve work and installation contract to the lowest acceptable bidder, National Metering Service, in the amount of $35,660 for 2005.
