Each year, the C ity holds an an conrc t that is open to all students who live or go to school in Enrlcwood. This year, IS pieces were chosen for the calendar. Mayor Wolosyn introduced the 2006 Calendar artists and Council Member Tomasso presented them with their matted and framed pieces. Sannah Pham is a 4 111 Grader al Clayton Elementary . Sannah's artwork, "The Ant in the Grass," appears on the cover. This is the 2ad year Sannah has had her artwork included in the calendar. Justin Willson is a 3n1 Grader at Clayton Elementary. Justin's piece, ''Pteranadon," appears in January. We have two artists in February: Henry Andrykowski is a 61h Grader at Flood Middle School . His work is a self-portrait entitled "Delightful, Colorful HJ." and Stevie Campbell is also a 6• Grader at Flood. Her work is also a self-portrait. Natasha Fish is a 9'" Grader at Sonfish Academy. Her artwork, entitled "Apart," appears in March. This is the 3n1 time Natasha's artwork has been featured in the Englewood Calendar. We have two artists featured in April: Courtney Schauer is a I" Grader at Bishop Elementary. Her artwork is entitled "Cool Bird Under a Warm Truffela Tree" and Hernan Dominguez is a 1 u Grader at Bishop . His piece is called ''Cool Bird on a Warm Truffela Tree." Amy Truninger-Hanley is a 12• Grader at Colorado's Finest Alternative High School . Amy's artwork, .. Hibiscus," is featured in May . Alexia Vidrio is a lu Grader at Maddox Elementary . There was a round of applause . t • • • Englewood City Council December 5, 2005 Page3 Mayor Wolosy n said there arc calendars available on the table in the back of the room and there will be a group photogra ph in the lobby outside Council Chambers. 7. Recognition of Unscheduled Publk Comment (a) Doug Cohn, 3051 South Marian Street, said at the Study Session last week a question was raised about Englewood being a place that's perceived as being hostile toward business, and I wanted to talk about that just a little bit tonight. You all have a handout here and I think the title kind of says it all . You only have one chance to make a good first impression. I have listed several specific kinds of situations where business guys have had a problem. Fantastic Fun, I think, has come before City Council a number of times . Currently, he is really interested in moving his parking lot around and selling off two little houses facing Acoma Street. There is a fellow who wants to build a duplex there, but somebody somewhere has told him that the Comprehensive Plan docs not allow that. I haven't looked at the whole Comprehensive Plan, I've only gotten through about the first 90 pages or so, but I couldn't find anything in there about that. This is an example of somebody who has been a good business citizen in town and has a difficulty and would like to have something done about that. The MD Liquor guys, on the corner of Bates and Broadway, came before the City Council in either July or August and asked you all to give them a hand with the tree that is completely blocking their sign. The tree is still there. I suggested to the fellow who owns the place that he could probably take care of the problem himself and he didn't want to take my suggestion . The tree is blocking his sign and it is something that the City has done to his business. Mike Smith is a fellow that I just met a few weeks ago who wanted to rent the empty Peerless Tire Store on the corner of Logan and 285. He wanted to put in a business .. .I don't know exactly what kind of automobile related business ... but he was told that "we don 't want your kind in town ." Phil and Jane Watkins ... Phil is a classmate of mine from the class of '65 at Englewood High School, and he and his wife have a stained glass studio. They were in downtown Littleton and they decided to move back home this summer. They moved back home, bought an old rundown place right beside Richard's Motors with a broken down old shack in the back yard and they tore down the shack and wanted to put up a workshop. They went to the building dcpanment and the guy said no. They said, well can you help me out here? He said, well we don't give advice on what you need to do with your work shop, but the plans you brought us arc not any good . Finally , Community Development got involved and there was a whole lot of talking that went on and now he has his workshop. I haven't talked to him for about three weeks , but three weeks ago he was really irritated about the way he was treated by the City. Shirley Friend came to town seven years ago, and I know you guys have worked really hard this summer with Shirley. When she came to town to stan a little business, she wanted to massage folks' feet. She checked with whatever places around City Hall that she needed to check with and ran her business according to the specs that were available at the time she came into business, because there weren't any rules at that point. Then this summer, her whole world caved in . It cost her a whole bunch of money for atto rney fees and she spent lots of time talking with you all. And she is a fighter, so she is going to stay around, but as the word gets around that. .. well , if we don't like what you arc doing, we will just jump on your neck and chase you o ut of town . These arc examples of things that frustrate the guys . Jon Cook has been wanting to upgrade some properties on Broadway and a few weeks ago he was going to make a presentation to you all and I think that was the meeting over at C layton, or somewhere , and the dog guys got into thi s big huff about it and Jon didn't get to make hi s presentation at all . Then last Monday ni ght at the Study Session he was going 10 talk again and once again the dogs bumped him off the schedule. I think, as just a recommendation, I guess, a suggestion, there could be ways that. .. l don 't even know how to say that one .. .I'll just finish up with the last one. Last Friday night we had a way cool lighting of the Christmas tree o ut in the parking lot here and a great firecrack~r show . As a business guy, I was feeling disrespected at the e nd of it . Several business guys w~nt out and bought some bicycles to give away to the kids who live here in Englewood and they put together a contest fo r the kids to be awarded the bikes . And then at the end of the show, they said good night and turned off the lights ... and why don't you all go and have a good time singing Christmas carols. And when the presentation was made , we had 10 scare up a flashlight, so that we could read the names of the folks . We need to do better. I think we can . T hank you . (b) John Andrykowski. 2332 East Dartmouth Avenue. sai d there was a program where they were repairing and installing new sidewalks throughout the Englewood area in 2003 and we spoke with the fellow named Larry . I don't quite know hi s last name . but I guess he was in charge of that propam. I called him about it and he said that there were enough funds available and they did not intend to ... or I'm not quite sure what was going on ... if they hadn 't planned on pulling a sidewa lk in along Dartmouth there, between Dow ning and Universi ty ... there is a strip of properties there that don't have a sidewa lk . All of us have young children and it would be ideal if they could ride their bikes to school and not be m the street . I know they put a bike path there now. which is nice, but back 10 the story. ln 2003 he said yes. funds were available 1f we wou ld go door to door and get a petition signed by all the residents along that strcet ... either yea or nay or if they agreed or disagreed or didn't want a sidewalk put in . I don't know quite the numbers, but we went all up and down the ' • • • Englewood City Council December 5, 2005 Page4 sidewalk. my wife and I. and we had everybody sign the paper and say if they were opposed to it or for it, and only one person was not even opposed. they were just indifferent to it. Everybody else agreed that it was a good idea and we took that back to Larry. He said he received it, but we have never heard anything since regarding where that money went, or if it is still in the kitty waiting for nice weather. If we could just have some kind of a response. he said . Mayor Wolosyn said I think we can get some kind of resolution for you, but I don't sec anybody from Public Works, so I am going to ask you to talk lo Mike Flaherty who is our Deputy City Manager. He can at least make sure that someone contacts you in a couple of days to give you a status on that. Mr . Andrykowski said I would appreciate just some kind of heads-up as to how things are going. Again, we arc not opposed to bringing in another copy of that paperwork or doing what we need to, but I think it would be a nice addition to that area. OnliDanca, Resolution and Motioas (a) Approval of Ordinances on First Reading There were no ilems submitted for approval on first reading. (b) Approval of Ordinances on Second Reading There were no items submitted for approval on second reading. (c) Resolutions and Motions (i) Director Gryglewicz presented a recommendation from the Finance and Administrative Services Department for Council to adopt a Resolution authorizing a supplemental appropriation to the 2006 Library Services Department Budget in the amount of $28,000.00. He said, as you know, the Library had a bookmobile for a number of years and as demographics changed and needs changed, eventually it was not really used anymore . It was leased to Douglas County Libraries and they made a proposal to purchase the bookmobile and Council ag,eed to do that in August 2005 for $28,000.00. The $28,000.00 was put into miscellaneous revenues at that time and not appropriated . This is the supplemental appropriation to the 2006 Budget for Library Services. Mayor Wolosyn asked if there were any questions for Mr. Gryglewicz. Council Member Woodwud said my only question is ... we have closed on that and received the fwlds from Douglas C~nty, is that correct? Mr. Gryglewicz said yes . Mr. Woodwud said okay . Our Golf ('.:,ursc: 1 localed w11lun heridan and w1th1n the propelled developmeM -The Sltcndan • • • Englewood City Council December 5, 2005 Page6 (J Redevelopment Agency requires an agreement with the City of Englewood to lease a portion of the Golf Course (over 50 acres) for the planned retaiVentertainment complex. We had a public meeting in July of 2005 to d iscuss the initial proposal and we have continued to discuss terms of the agreement The closing of the lease is contingent upon the negotiation of a final lease with the Sheridan Redevelopment Agency and Miller Weingarten and the successful purchase by Miller Weingarten of the various parcels of land . She said I think I am just going to go over the main points which are : Weingarten proposes to lease over 50 acres, for 20 years, with three additional 20-year options. The lease payment for the primary term is $4.19 million, with payments for the three remaining option periods being $200,000, $300,000 and $400,000 respectively . She said Tom you will have all the particulars . Thank you. (ii) Mayor Wolosyn said next week we are going to be doing Aid to Other Agencies. Another company, I think, Arapahoe Cares, a non-profit, came in after the deadline and I just went ahead and okayed them to submit an application for us to look at next year. It just seemed to be a formality . I hope everyone is okay with that. (iii) did a wonderful job. Mayor Wolosyn said I think the lights look great outside. I'm sorry I had to miss it . I hear Jim (b) Council Members' Choice (i) Council Member Barrentine: I . She said I agree that the lights look really nice and the ceremony was fantastic . It was cold, and yet we had a really nice crowd. One suggestion, a couple of the businesses seemed to have been caught off-guard, but it was nic, to go around and sec them pretty jam packed over at Tokyo Joe's. And the Pub did wcll ... the places that I could sec, there were a lot of people disbursing and kind of giving us some revenue as well . It was a very nice event 2 . She said Positively Englewood did do a presentation at the end of that ev~nt. l wanted to thank Campus Cycles and the businesses that have contributed. While this particular section of this program that we did for Positively Englewood is called Bike a Month for Christmas, we went ahead and did three. This time we did an essay where people wrote and said why they felt a child was deserving of this, so it was somebody else nominating these children. And l cannot tell you how impressive some ofthese young people are in our community. The three people who received the bikes ... it was a hard choice ... but the three people who did, we were very impressed with their commitment to their family and the community. Zach is a 14 year old who took care of his grandmother, who is under hospice care, when his family took her in and all of the amazing things he did as a young man . Fernando is an 8 year old young man who actually gave up hi s youth bicycle to his grandfather when he came to town and he would tell him, grandpa go and sec all of Englewood . He used that to come to the Library and do things and the grandfather was very impressed with this young man . And then Tyler. We also recognized the teacher who helped him through a very difficult time ... Mrs . Westfall, a teacher at Cherrclyn . We did let Tyler present a gift to her as well . One of the reasons that he was asked to help present it was because he had entered every si ngle one of our contests . One of them was a drawing, where they wrote an essay about why education was important to them and he had brought up this teacher, so we remembered that. And then his aunt also sent in a s ubmi ssion for him . He had recently lost his mother and that is how his teacher became so involved with him, helping to get him through academically . as well as personally . I think that she went far, far above and beyond the call !lnd we were glad to have the opportunity to recognize her as well . 3. She said the fireworks were fantastic . I thought they were coming from the parking lot . I couldn't believe they were off of the roof. Bu t. everybody just had a great umc. I'm glad that we were able to participate that way too . (ii ) Council Member McCaslin : I . He said I was at the tree lighting ceremony and Jim did a nice Job . Thank you for everyone showing up . 2. He said I would also like to thank Gary Sears and hi staff for agi,in educating the new Council members. On Friday we took a to ur of the water works. the Library. the court house . ' • • Englewood City Council December 5, 2005 Page7 • ·• • • (iii) Council Member Moore said Mr. Cohn raised a few issues tonight and I was wondering 1f maybe some of those are appropriate to wrap in with what we have asked ACE to look into, in terms of the economic development strategics where we have tried to engage Mr . Cook and Mr . Cairns . So some of these items might be appropriate to bring in the scope of that request. .. I'm not sure if every one of them will be, but I just wanted to put that out there . Mayor Wolosyn said I agree, as I think some of them arc already being addressed by ACE ... Jon Cook and others. I was just going to ask for an update on the tree. I think we should look at this more closely and the ones that are appropriate ... add to that . She said we have an ACE meeting next week. Council Member Moore said thank you. (iv) Council Member Oakley said Mr. Cohn had also sent some e-mails and had addressed some other things that he didn't talk about here tonight, so perhaps we can take a look at some of those too . (v) Council Member Woodward : I . He said I just wanted to mention the Englewood Si1ines and how successful it was. I think we really did have a larger crowd than expected, even though it was a very cold night. The fireworks were great. It was a real added benefit. 2 . He said I wanted to mention that coming up Saturday is Breakfast with Santa at the Malley Center at 8 o'clock. That is always a fun time, with a lot of people showing up . So if you arc able to attend, it will be at 8 o 'clock at the Malley Center. They will have a pancake breakfast. 3. He said I wanted to ask the question about MD Liquors. I know those folks had come in and we had addressed that. .. or I thought we had addressed it. So, if we could get feedback from Public Works or whoever on that, I would appreciate it. ••••• Mayor Wolosyn said before I move to City Manager's and City Attorney 's reports, I am going to back up and add something to the information about the Press Release. Council did decide that we would have a Public Hearing on the Golf Course Agreement. because it is a really big iss ue . We think we need all the input and discussion on it that we can have . ••••• Ma yor Wolo ·yn said thi s leads to another point about big issues . I have been discussing, with Gary, the idea of having a Counci l retreat. A Council retreat based on the ones that Littleton has. This won't be a budget retreat, in that we won 't hear reports from the differe nt depanrnents regarding what they want to spend for the next year. And it won't be a goal setting retreat , in that we ha ve set goals. And, I believe, o ur goals should form the discussion at the n;treat . We have a lot of big issues coming up . not the least of which is if thi s agreement docs go through and that development happens over in Sherida n, just the fact that thi s development is on the edge of our communfty and it will have an impact on us . And then as we discussed tonight, th e Mclellan Rese rvoir, chances of the Bates station development and I think it would be helpful to all of us to sit down . look at these issues, have an o pponunity to son of just free form ... discuss them , so that we al! feel stro nge r whenever the y do really come before us for decisio ns . Also . I would ask anybody to let us know if you have iss ues like th at, that I am not mentioning. to give us, in the next few wee-ks , so that we can incorporate them. if possible. int o this discuss ion or into a Study Session di sc uss ion in the future . The two dates that we arc looking at are either February 11 "' or February 25'". After discu sion, February 25'" was the chosen date . Mayor Wolosyn said we arc looking at something that tans at 9 a.m. It could be 4 to 6 hours, but we will try to make it 4 . If it looks like people are putting a lot of thin gs o n the agenda ... ! think the goal 1s 10 have a full bodied di scussion o n these ·, ues . We \'·'ill keep you posted o n that. 13 . C ity Manager's Report ' • • • Englewood City Council December 5, 2005 Page 8 (a) City Manager Sears said I just wanted 10 tell Council that we ... staff ... did have a very good meeting with RTD this morning and we arc working through a number of issues that, again, need Council direction related to the Bates Station and McLcllan. (b) City Manager Sears said, regarding the information presented by Mr. Cohn tonight. .. staff has had both reports and we have met with Nathan, etc. Would the Council like the staff ... on some of these issues ... the tree issue ... to respond to the Council as to the status of these issues? Council Member Barrentine said I had thought that when we talked to Bob ... and the results of that Study Session was that he was going to try to pull some of those people together and find out what all of the complaints were and come back to us . So. I thought that was already happening. Mr. Scars said he has met with Jon Cook. I know, and talked to Jon, but like on the tree issue, I know that Jerrell Black has been involved with trimming that tree and so Bob hasn't been involved with that issue. Ms. Barrentine said oh, I'm sorry, I thought you meant the comment that he had made about finding out. in general, what the business people had a concern about. Mr . Sears said this would be a response to the specifics. Mayor Wolosyn said I would ask that, because we already have Jon talking to Community Development ... also, I believe Mr . Cairns has talked to them ... let's try to synthesize this into one piece. As I understand. we are already dealing with some of these things ... Fantastic Fun. Mr. Scars said yes. we met with Nathan a week ago and we could provide the status of that discussion. Ms . Wolosyn said one of these that docs stand out. I agree with Jim. is MD Liquors . If we could just know what happened with that . Mr . Scars said. again. Jerrell did meet with them and they did talk about the tree trimming and as I undcrslOod . it was acccpcablc to the property owner. But I will find out for sure . Off hand ... number I is probably just to update us on that s ituation. Number 2 is . again. probably an update . Number 3 seems to get at our interac tion with the business community. as docs number 4. Number 5. maybe I am wrong. but I just thinlr. it is probably a co pletc misunderscanding. I think our massage laws have been in effect for a lot more than 7 years. Council Member W oodward said . as I rccall , Shirley had come in and asked regarding the licensing and acknowledged that in a meeting here . Council Me mber Moore said so number 5 might s imply be clarifying for Mr . Cohn that this isn't exactly the way that one played ou1. Number ·6 i a lready go in g to ACE. Number 7. again. would fall into our business inlcraction, so we could probably ki nd of combine wi th 3 and 4. Number 8 a lso docs reflect on our business involvement. I thinlr. maybe there is some separation . She said I just wanted to bring up the issue about the race track around Jason Park . I 've lived there almost 20 years and it has gotten way out of control. Everyone calls me and they come to my • house .. .! know I'm doing the Block Captain job for free ... it's just that something needs to be done. We need to post some speed limit signs. I'm real good to the City ... I've brought you revenue with the speeders. It is just that I don't need any more restitution or whatever it is called when they come back at me, because they know I'm the one that turned them in . I don't know how you do it and you can do it probably very inellpensively ... maybe some ~peed bumps ... but, we do need the speed limit signs, because a lot of the young kids will say "I didn't know what the speed limit is" and I go "it is 25 miles an hour." When you come down Jason Street, there is Quincy coming down the hill and it will say 25 , but anywhere around where you park, there are no speed limit signs. So, I think they need to have the benefit of the doubt. They don't know how fast they are going, but it has become a real issue. Dogs are getting hit, because it is a dog off-leash park. I am not a dog owner anymore because it just breaks my heart to see people's dogs hurt ... they treat them like their own kids. It is just that I don't want to live by the park anymore ... someone's kid is going to get hit by a speeder. I'm a mother and grandmother and someone needs to help us out and that would be the City Council, please. Ms. DeWitt said Pam is a volunteer with our flowers at Jason Park and she has noticed the speeding where she works on the flowers . Ms . Genova said I go there, to the c6mcr bed on Jason and Quincy, in the early morning and sometimes on Sunday and we plant and they just fly through there ... down the street and down the bill. Down at the bottom of the hill. on Quincy, is the digital speed limit sign and it is like a challenge. Ms. DeWitt said it is like an invite. () Mayor Wolosyn said thank you . There were four examples in the book where they found dog parks near water ... the closest one that would relate to ours was up in Boulder, where the y put the dog park along the edge of the lake. That was downstream from the water supply and that is the closest one they had . I guess I wonder ... didn't it bother you that the engineers expressed serious concerns that Big Dry Creek goes into the Platte River just 200 yards upstream from where the intake is for the water treatment plant? In the report it talks about the increases in the cryptosporidium and the coliform bacteria that will cost us, the taxpayers, a million dollars or more to mitigate, unless the dog park works perfectly. And it may cause huge fines for the water quality guys if they find that we have intentionally polluted the water. I guess what I am thinking here is you all have created an environmental danger, for no good reason. In the report the writers say that if every person picks up all the waste, all the time, there would not be a problem, but then they estimate in their report that in most of the dog parks that only 50% ofit is picked up at all ... almost guaranteeing the threatened results. Consider Jason Park, which the ladies mentioned just a second ago ... have you wondered why there are so few soccer teams that practice there anymore? Or why there are hardly any picnics in the summer time? I wish to offer you one slight modification in the dog park plan. I urge you to move the dog park across the sidewalk ... from the left hand side of the sidewalk to the right hand side of the sidewalk. If you look a the map , I have Windermere on the bottom of the map ... the long black line through the middle of the map is the SO year flood plain line. Where it says proposed park, that is where you all have agreed to have it right now ... the black line is the high water line in the SO year flood plain. If the park was moved into that fuzzy white area ... that I put the red lines around ... it would be Olli of the flood plain and I think that would be a much better idea. You arc probably asking at this point. why should I even cons ider th is s uggestion? By moving it out of the flood plain, we could save $24,000.00, or so, on part two of the water study that will be required if we put it in the flood plain and we would not have to build the SI 9,000.00 plus water retention pond and the water filters . The parlr. could be configured to be almost the same size. There is an old water ditch ... I'm guessing ... that used to go to the Allen Plant ... running parallel to the sidewalk, on the uphill side, that would catch and trap a IOI of the waste and keep it out of the flood plain. There is a n:tention type pond right on the corner of Windermere, where the drive-in goes into the parking lot. I dol;l't know what that is for, but it looks like a great retention pond to me . Why would you want to rnalr.e these changes? It seems to me that it could free up $60,000.00 in next year 's budget ... money that we would not have to spend. By getting the dog park Olli of the flood plain, the City would not have to hire the dog poop police to rnalr.e sure that all of the waste was picked up immediately. Again, in the study. they suggested only about half of the waste was ever picked up. The money could be saved because the City would not have to buy the fancy poop bags for the guys to uae. We could avoid huge potcnt.ial fines from the water quality fellows for intentional water conwnination. And we would not have to spend a million dollars to upgrade the Allen Plut to cope with lhc extra conwnination lhal we put in the river. I g uess yo u could ask the question ... well can't we just have the dog park where it is? The answer is yes, you have already decided that. You ha ve already argued about it for two years ... you already weed on it ... you already a ppropriated the money. Oakley and Mr. McCaslin ... and welcome to the City Council. I have been involved in Englewood and Broadway for the past 30 years. I did a small stint in State Senate and I wish you luck, because I figured up that we have 201 man hours in the doggy profiling bill at the State Senate so ... Good Luck! I did not come to speak about dogs though . I wanted to speak a little bit about the idea of what is going on with the businesses and follow up on the meeting that jusr occurred. I was hoping I would have a chance to speak at that meeting on a more informal basis . But thi s is fine . I want to take this venue and hope we can do it in five minutes ... I even have some pi ctures. What happened is .. .I have a piece of property that I work with that bas been in our family . I have done business there . on Broadway, and I had a very good meeting with the City Attorney, City Manager and Harold Still where we had some issues that came up . What came up was I have a listing and we were aslr.cd at this previous meeting ... and I think it is on the record also ... how our businesses arc feeling ... so I have taken the risk to come here and say that. And the reason that I mention taking the risk is that I believe there is a risk in revealing a deal, because if a deal goes bad , other people may question it. And yet. we keep hearing about ... whether it is the issue of parking, the issue of set backs or the issue of going and having the conversation. My conversation was cxccllenL We had o ne question about property schedules and how it affected the overall property and somebody thought it was split up . That has been handled and I appreciate those who helped with that . We will even have one scheduled by the be gi nning of the year. But . that is something the City Council should know, it's that entry level thing that was mentioned in the Study Session. That happened and you need to know that and I want to be positive toward those th at I dealt with in talking about that . The next thing that happened was the set back. Now what happened, I had a deal under contract , a check with a copy, though not on deposit ... although it still would have had to be refunded and I go t the letter that says we arc terminating it. And they terminated based on set back, based on building parking and based on the qucs!ion mark about the property . which I have already alluded to and dealt with . In the parking, they were told that if the y were to try to keep the same building, put another building up, they would run out of parking s paces . And it is one thing to have a redevelopment like the CityCcnter and another thing to be talking about something that is 50. 75 , 100, 125 feet of frontage , because that is what a lot of properties arc on Broadway. It almost see ms like it could be approached two different ways ... perhaps in the other redevelopments in other corridors and longer stretches ... go for more the setback of zero to five feet . I was quite surprised, to even know the Ci1y had already done that , I wasn't aware that it had happened . But I think that something Council now, after the conversalton an hour ago. wants to look at. .. where do we go with the setback? One thing that may bring some mcenuves in , where you work with the TlR's ... Tax Incremental Rcvcnuc ... where you arc able to have a situation where somebody gets a good incentive, an offset on some sales taX he is goi ng to be bringing in, if he docs build closer 10 the propeny. I will. of course, because of losing thal deal , have to bring, to the Board of Adjustment, a variance and try 10 get the setback that matches up with the pictures that I have here. I think it is very important for yo u all to consider th at. And the second thing ... about parking ... redeveloping a smal! piece of ground on Broadway m Englewood ... now I think th e important thing to think about is that Broadway is one of the few anerials in the City tha1 ac tuall y offers parking . Because of that it should give a little more fle xibi lity in how one mipt address it. I mean the guy is sharp . Sometimes you have to say it twice on the phone, but he heard that and that was his opinion, as a highly educated college professor. .. that's really got that property by selling a book at a dollar a time. And that is part of his life, part of his retirement and he was quite concerned that by having that control of five feet, without the City's name being on it, in a market place that has buildings that arc set back 25, 30 and 75 feet. .. that is something that probably should be revisited . Ccnainly, l will go for the variance thing and I really appreciate the suggestion and any consideration that comes from the Board of Adjustment and the Council. But also, the variance would be very important to look at in changing ... rather than have a variance ... changing the law, so that the ordinance reflects something that is more realistic that way. And the same thing, as I mentioned before, being able to use the on-street parking and not restricting where rebuilding might happen. Mayor Wolosyn said we will take this under advisement and I appreciate the input. Mr. Cairns said sure and anything you could do would be great and let the market place go from there. Council Member Barrentine said I do have some questions, but I will bring it up under Council request if you would be so kind as to stay until then, I would appreciate it . Mr. Cairns said okay, thank you . (b) Richard Littler, 4437 South Lincoln Street, said the reason I am here is I am against the pit bull ban. Any dog that has teeth can bite. Anybody knows who has dogs, it is all in how you raise your dog. There shouldn't be a specific breed ban just because of the fact that a couple of dogs get some bad press . Also, the reason we bought our house in Englewood is we arc hoping that Englewood wouldn't jump on the breed bandwagon just like Aurora, Denver and such, because you know there arc a lot of educated pit bull owners out there and I don't think that you can just hold a whole breed of dogs accountable because of just a couple of bad ones. You know it is a form of racism against dogs . That is pretty much all I have to say. I am against iL (c) Clara Strogonova said I bought this building on Broadway and I thought I would renew it and make a piece of cake of this . So. I came to a roofing place and I asked ... can I put anodler roof on this building? And they said, the supervisor said, no you cannot, because it already has many pancakes on the top, so I had to put on a new roof. So I hired one scumbag. He gave me a reasonable price ... what I could afford. And they removed it all, maybe, I don't know. maybe they removed only part of the roof and maybe all of the roof, but they did the job and I paid them the rest of the money. It was a big chunk after buying this building. So in duce months, Inspector Hamilton ... when I asked how they did, he said they did a good job. Three months later I got a first flood in my building. On my building ... this is a new roof. So I called the roofer, he came and patched it. So many defects ... he approved this inspection of the roof. but he did not notice flashing around the six skylights. He did not sec it ... what was not done . Flashing around the cooler on the roof ... he approved it in every single case. So I got flood after flood ... flood after flood . I came to complain to the Englewood government, but this time it was another man. They came to my roof. .. three or four people on my roof, they came. They looked around and they.left. I don't know Mr . Sears was between them or not. And they did not say anything. They did not say that something was wrong with the roof. Now. the building is a round dome ... a beautiful, historical building ... 85 years old, gorgeous building. So th is idiot sc umbag. he put material on the len s of the door, leaving the scam of the top of the door. What happened? I have more than 100 degrees on the roof when the sun shines, so he finished the roof in June. So for three months, three mo nth s later , I got the first flood . right? ... becausc it was cracked. He said tonight I would like to bring to your attention a contract extension for the Art Shuttle. As you know, the shuttle has been in operation for about a year now, actually a little over a year, and it has been quite successful. Of all the similar services that arc offered through RTD or by their contractors, with the exception of the Boulder Hop and Skip, the Englewood Art Shuttle is by far the most successful with rider-ship, exceeding expectations. In fact, last month we had rider-ship approaching just slightly over 17,000 riders. So each month, with a few exceptions, rider- ship has been increasing and it has become very popular with the students that live in the community as well as the seniors and those people who would like to get around town from the light rail station to businesses on Broadway, as well as the Swedish Medical Center and hospital complex. The purpose for the resolution tonight, is a slight increase in the cost of the contract from Laidlaw Transit Services and had that increase not been proposed, the contract could have just been carried over from last year . Laidlaw asked us if they could increase their proposal by 3% to cover additional costs in fuel and commodities. We looked at our budget and were able to make some reductions, based on suggestions our other vendors made in areas of advertising and marketing and were able to accommodate the increase for the transit services by Laidlaw. And as a result of that change in the total amount, we have to come back to Council for authorization on this contract. Mayor Wolosyn asked if there were any questions for Mr . Stitt. Council Member Woodward said so what we are looking at is a 3% increase from what was originally budgeted when we approved this a year ago. correct? Mr. Stitt said correct. Mr. Woodward said okay. So this resource of the Mile High Housing Fund has been very important for our City. We used it far more than we anticipated, I believe, when we originally invested $50,000.00 with them. They have grown substantially. They have committed over 20 million dollars in loans for affordable housing. They also plan to expand into Senior Services and Child Care Centers and perhaps do some economic development lending. We thoroughly suppon the direction that Mile High Housing Fund is going in community development lending and would recommend to Council that you approve the renewal of their loan. Mayor Wolosyn asked if there were any questions for Mr. Graham. Council Member Woodward said I have one. Under Financial Impact, it says "Englewood has loaned $50,000.00 for the past five years and is requesting that the loan be increased or renewed for another five years ." What is the increase? Mr. Graham said their request was to increase or renew, so we put their request down. Our recommendation is to renew, but it is certainly Council's prerogative to increase if you would like. City Manager Sears said we did mention it to him and I have asked Sue to ask him to check with his Board about the potential of meeting with us. We have had a dinner in the past. .. a School Board and Council dinner, possibly at the Golf Course or the Community Room. Again , if that is an acceptable time with City Council, but that has been proposed to the School Board there too. Ms . Wolosyn asked if anyone had any comments or objections. There were none. (v) Mayor Wolosyn said regarding the City Council Retreat, that is something I can wait to talk about on the fifth . It is not pressing and I would rather do it in a more informal setting. City Council has had a Christmas dinner and I had requesled th at we participate with the program that the City is doing, with the Inter Faith Task Force. Rather than have that dinner, that we donate that money to that effort, because they arc serving several Englewood families for the holidays and I wanted to participate in that. We ran out of time, so I was asked to bring it here so that is what I am ( requesting . Mayor Wolosyn said do we have any discussion on that issue? Counc il Member Woodward said arc we talking about the donation, Lauren, to the three Englewood families from that dinner? I don't have any idea what that dinner typically costs. Ms . Barrentine said since we have been having that dinner, do we have any idea? I'm pretty sure they budget so me thing for it and have a general idea what we would be spending. Ci ty Manager Sears said I do n 't know . We have been to different places. We have been to the Dragon in the past a nd the G olf Course. I can't tell you off th e top of m y head, but probably 4 or 5 hundred dollars . That would be an estim ate of the cost of what that wo uld be . but that would just be off the top of my head. Ms. Barrentine said then what I would like to suggest is I would like to donate my portion. since they will know what it costs th e n, to the program that the City is putting together and so I will not be attending the Christmas dinner. I would like to donate my portion of it to go to that event. I think it is a worthwhile cause in a really needy time and with the economy this year. I think it is belier spent that way. Property owner Bruce Cairns had spoke on some concerns, but would there be a problem with connecting with some of those other people? I was under the impression that you just wanted to limit it to Jon , but if there were other people that wanted to come and talk to you ... Mr. Simpson said I can talk to whoever you like. It is just a question of getting those different perspectives. I also can ... I'm not trying to be flip ... but I can throw in that we held a business forum about two years ago wlicre we did have several business concerns that were expressed and I can go into it in more depth in a report, but it was a very useful forum, because it really outlined a whole series of things that led, ultimately, to the creation of our economic development strategy. It really outlined a good road map for a lot of the things we need to be working on. And I would like to throw that in for you, just so you can kind of get a good sense of what was expressed in, kind of, those areas too. I can talk to Mr. Cairns and talk to Mr. Cook. If you all have other people you would like me to talk with, I can do that. I'm always happy to that, because my job and goal and my personal interest is to make sure that business is vibrant in this community and we've got to make sure we do those things. It's always fun and it is always interesting. Ms. Barrentine said I hear repeatedly that you arc very cager to hear from the business community on their perspective and what's going in the market today. I appreciate what you did two years ago and maybe that same kind of vehicle would be worthwhile to get some input now, so I appreciate your willing to work with that. Mr . Cairns, would that be something that would work for you to try? ... and then I would leave it up to the Community Development Director to address other businesses that might have issues, as well as anybody that you and Mr. Cook may have heard that could use this vehicle and speak to him as well . I would appreciate that. And thank you very much Bob. That is very nice to have this working together. 3. She said we used to have a parliamentarian. I am conccmcd about keeping on track. certainly with what is going on, but 1 also want to facilitate the position of Chair to encourage that to facilitate discussion and infomwion and not control it. RECOMMENDED ACTION Approval of a Resolution appointing Alternate Member Mark Craft to fill the vacancy created by the resignation of Regi Maclaren. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Englewood Transportation Advisory Committee was established by City Council as an advisory committee for the purpose of gathering citizen input, reviewing and monitoring transportation issues in the City of Englewood, and making recommendations to City Council. Regi Maclaren recently resigned his position on the Englewood Transportation Advisory Committee. Mark Craft was appointed by City Council in July, 2005 to fill the Alternate Member position. ETAC requests that Mr. Mark Craft be appointed by City Council to fill the remainder of Mr. Maclaren's term, which expires February 1, 2006. ETAC is hopeful that the Alternate position will then be filled du ring the board and commission interviews in January . FINANCIAL IMPACT There is no financia l impact. I WANT TOT ALK ABOUT THE IMAGE ENGLEWOOD HAS OF BEING HOSTILE TOW ARD BUSINESS I. Funtastic Fun is a business that has been around for a while. We want Englewood to be child friendly and it would be good to keep Nathan in town. He needs some relief from regulations that are hurting his ability to stay here. He wants to consolidate his parking lots and sell two lots for development as a duplex across the alley from his funplex . This would give him some flexibility in a tough market place. Someone has told him the Comprehensive Plan will not allow him to do it. This decision is hurting his ability to stay in town. 2. MD Liquors on the corner of Bates and Broadway came to YOU ALL (the city council) a few months ago asking that the tree blocking their sign be trimmed so customers could see the business better. Nothing has been done. What does he have to do to get some relief from a problem the city created for him? I suggested to him that he could take care of the problem himself: but he thought my idea was a bad one. 3. Mike Smith wanted to start a new business in the old Peerless Tire store on 285 and Logan and was told he would not be allowed to have his business there. He wanted to open an auto related business where . one had been. He is telling his friends not to bother trying to do business in Englewood. 4. Phil and Jane Watkins opened their stained glass studio at 3821 S. Bdwy in Jul y. They moved to town from downtown Littleton . Phil is a 196 5 graduate of EHS . He tore down a rattrap in the back yard to build a workshop . He took the plans to the building dept. and they told him no . He asked what the problem was and was told they WOULD NOT GIVE him any guidance. They were not in the business of offering advice , only approving or disapproving plans . After several weeks of increasing aggravation, community development got involved and the problem was eventually solved. Shirley Friend came to town 7 years ago to begin a little business . She did everything right as far as complying with existing rules when she moved in . Then, this summer all the rules changed and she has had to spend lots of money with attorneys and lots of time visiting with you all to figure out how to adjust to the new restrictions you all put on her. It appears her problem bas been solved, but at a high cost to her and us. 6. Jon Cook wants to upgrade some of his properties along Broadway. He has come to a nwnber of study sessions and regular meetings, met with various staff people and is finding it very hard to make Englewood a more attractive and profitable place to do business. Things are moving forward, but the continuous roadblocks and endless meetings are making it hard to improve our city. He attended a study session LAST week and was btunped off the schedule by dogs. This was the second time he came prepared but dogs got in the way then also. Where are our priorities? 7. Bill Heasty owns several newsstand stores in the Denver area and wanted to open a new store here about 8 years ago and was told his kind of business was not wanted on Broadway. Then in the 2003 S. The City of Englewood was approached by Miller Weingarten Realty on behalf of the Sheridan Redevelopment Agency earlier this year regarding the proposed redevelopment. Because the Englewood Golf Course is located within the city limits of Sheridan, and within the proposed redevelopment area, the Sheridan Redevelopment Agency requires agreement with the City of Englewood to lease a portion of the golf course (over 50 acres) for the planned retail/entertain- ment complex. The City of Englewood held a public meeting in July, 2005 regarding the initial proposal, and has continued to discuss the terms of a possible agreement with MiUer Weingarten since that time. The closing of the lease is contingent on the negotiation of a final lease with the Sheridan Redevelopment Ag e ncy and Miiler Weingarten and the successful purchase by Miller Weingarten of the various parcels of land needed for the development. The substantive elements of the Miller Weingarten proposal include : Th e golf course facility will be maintained in its entirety, including the 18-hole regulation course, the Par 3 course, and the driving range. The proposal involves shifting the Par 3 course, the driving range, and the front 9 holes off the landfill and using part of the west side of the South Platte River for the front 9 holes. ' .... ..• • • Miller Weingarten proposes to lease over 50 acres, for 20 years, with three additional 20-year options. The lease payment for the primary term is $4.19 million, with payments for the three remaining option periods being $200,000, $300,000 and $400,000 respectively. The portion of the golf course included in the proposed property lease will be shifted and rebuilt in its entirety at the sole expense of Miller Weingarten, on property owned by the City of Englewood within the interior of the existing course, along the South Platte River. The estimated cost for shifting and rebuilding this portion of the golf course is $4.5 million. Miller Weingarten is obligated to protect the City of Englewood from any loss of profit from operation of the golf course during any period that the golf course is impacted by the construction and for a period of two years after opening. In addition, Miller Weingarten will cover expenses that exceed revenues in an amount up to $1 .1 million per year for the same period. Miller Weingarten has made a non-refundable deposit of $150,000 to the City of Englewood to cover the cost of any City expenses associated with the negotiation and execution of the proposed transaction. Miller Weingarten is obligated to protect CityCenter Englewood from negative impacts associated with the proposed retail/entertainment complex. Miller Weingarten will provide two road access points from the golf course to the development if the City develops the golf course for commercial use. City Council will hold initial consideration to enter into a formal agreement with Miller Weingarten on January 9, 2006. The City of Englewood was approached by Miller Weingarten Realty on behalf of the Sheridan Ret!evelopment Agency earlier this year regarding the proposed re0-0 elopment. Because the Englewood Golf Course is located within the city limits of Sheri a , and within the proposed redevelopment area, the Sheridan Redevelopr.ent Agency requires agreement with the City of Englewood to lease a portion of the golf course (over 50 acres) for the planned retail/entertainment complex . The City of Englewood held a public meeting in July, 2005 regarding the initial proposal , and has continued to discuss the terms of a possible agreement with Miller Weingarter, since that time . The closing of the lease is contingent on the negotiation of a final lease with the Sheridan Redevelopment Agency and Miller Weingarten and the successful purchase by Miller Weingarten of the various parcels of land needed for the development. The substantive elements of the Miller Weingarten proposal include: • The golf course facility will be maintained in its entirety, including the 18-hole regulation course, the Par 3 course, and the driving range . The proposal involves shifting the Par 3 course, the driving range, and the front 9 holes off the landfill and using part oftlte west side of the South Platte River for the front 9 holes . • The proposal carries no financial risk to the City . • Miller Weingarten proposes lo lease over 50 acres. for 20 years, with three additional 20-year options. The lease payment for the primary term is $4 .19 million, with payments for the three remaining option periods being $200,000, $300,000 and $400,000 respectively. • The portion of the golf course included in the proposed property lease ·will be hilled and rebuilt in its entirety at tht> sole expense of Miller Weingarten. on property owned by the City of Englewood within the interior of the existing course. along the ~outh Platte River . The estimated cost for shilling ahd rebuilding this portion of the golf course is $4 .5 million . • Miller Weingarten is obligated to protect the City of Englewood from any loss of profit from operation of the golf course during any period that the golf course is impacted by the construction and for a period of two years after opening. In addition. Miller Weingarten will cover expenses that exceed revenues in an amount up to $1 .1 million per year for the same period . ' • • • Miller Weingarten has made u non-refundable deposit of$150,000 to the City of Englewood to cover the cost of any City expenses associated with the negotiation and execution of the proposed transaction . • Miller Weingarten is obligated to protect CityCenter Englewood from negative impacts associated with the proposed retail/entertainment complex . • Miller Weingarten will provide two road access points from the golf course to the development if the City develops the golf course for commercial use. ( City Council will hold initial consideration to enter into a formal agreement with Miller Weingarten on January 9, 2006.
