Scheduled Vlliton (a) Tom Ashburn, Convnunity Service Manager for Xcel Energy, said be was here this evening to inttoduce himself and share IOIIIC of his respomibilities with Council, and to let them know how Xcel baa changed in the last couple of yean. He advised that his major respomibilities include building and maintaining good working relationships with all the local govemmenls' elected officiala and staffs in the service territory that Xcel serves . He stated that his service territory includes, rouahJy, all the municipalities in Arapahoe, Douglas and Elbert Counties, and a lllp territory !bat ii baically from DIA to Parker, and from east of Aurora to the Jeffenoa Coualy line . It is a very large territory and sometimes I do not get around IS often IS I should, be said. That ia why I am here tonight, to uy hello and to inlroduce myself. Mr. Alhbum said be noticed on the aaeada that be was to talk about Xcel'• comnunity service policy. We like to be very active and involved in all the communities we serve . Prinmily, we do that by being involved With local economic: development organizations, local chlmben of c:omnerce, and programs that can help nunicipalities arow . We work on the iuuea that affect you, and !bat you are interelled in, a they relate to energy. There are community progr.-that we are involved with once in a while, also. Mr. Alhbum said be was on one of the original taalt fon:es for the Brownfields project for several years, for ~le. Many of you have been invited, and a couple of you have shown up, al the Arapahoe Power Plant in the laal few years, just to get an idea of what ii aoina on a a local community. Mayor Bradshaw asked if there were any questiom for Mr. Alllbum. Council Member Nabholz commented that the tour Mr. Ashburn did for Council two yan aao was very informative and helpful. City Manager Sean stated that Mr. Ashburn ha been excellent to work 'wilh. Ia some of the~ regarding Centennial Park, in puticular, he -available to aaiat 111. She found the sessions worthwhile and she cncounged all Council mcmbcn to attend at 1caat one NLC meetin&, if they haven 't already. She said they bad received her one-pqe report. Council Member Wolosyn asked if it would come back to a Study Scuion. Council Member Grazulis asked if~ were any couanitltel that we would lib IO l'ellBTeCt. Englewood City Council March 18, 2002 Page6 Mayor Bradshaw said there are some out there that we do not even use anymore, such u the small business conunittee that was part of EDDA and the City. Council Member Grazulis said she would just like to look at them closer and discuss them before they are dissolved . Mayor Bndshaw asked Mr. Brotzman ifbe could do that by June. Mr . Brotzman responded affmnatively. (vii) Mayor Bradshaw uked Utilities Director Fonda why the water quality was so horrible. Mr. Fonda said be bad not bad any reports of this . Mayor Bradshaw said they were calling her. Mr . Fonda said be would look into it. (viii) Mayor Bradshaw said the Jason Park Social Club, a group of people who get together and let their clop run around at Jason Park on Monday momings, is doill& a park cleanup this Sunday at I 0:00 a.m. We clean up the park, she comnented, but 10111e people think that, since it is a dog park, they CUI just let their clop loose and it CUI poop all over and they do not have to do anything about it. One man said, if the City would pick up the grass when they mow the parks, they would also pick up the dog poop. Mayor Bradshaw did 11111 feel that was true because we don't mow this time ofyar, and when we do mow, we do not pick up the grass because it is mulched. She said she j111t banded him a bag. (ix) Mayor Bradshaw advised that around July 4* we will be putting the bridge in across the Platte. She uked Council to keep that time open so there CUI be a bi& dedication there. (x) Mayor Bradshaw uked Business and Redevelopment Coordinator Jobnson for the name of a contact peraon at Guts. Ms. Johnson uked if there was anyone in particular .. City Manager Sears suggested the CEO, with whom they bad met, would probably be appropriate. (b) Council Members' Choice ( i) Council Member Nabbolz ( I. She advised that it is that time of year to, again, ult for Council's support to sponsor two foursomes for the Keep Englewood Beautiful Golf Tournament. The cost would be $640.00, she advised. It will be held Monday, June 10•, and will be a shotgun start. 2. She said she had a call from a couple of neighbors who were in dispute, but they resolved the matter themselves . It was a code enforcement issue . The lady bu a four-foot fence between her boUlc and the other house . The other house belongs 10 a City ~loyec and she thought there was a problem with Code Enforcement telling the City e1111loyec one thing, and she was told she should call the police inltcad, when the City CIJ1)1oyec 's German Sbcpberd comes over her fence. la the end, they taled it over and worked it out. She asked if fire inspections are conducted on motels here in Englewood. Director of Safety Services Olson replied that they are done once a year . The problem, be said, is that they can not inspect individual rooms, normally only common areas . Mayor Bradshaw asked if Council Member Nabbolz planned to continue going to the Old Town Englewood meetings. Ms. Nabbolz said yea, abe felt it wu really excitina. (ii) Council Member Moore 1. He said he read in the Englewood Henld that Dennis Schum hid railed aome COIICfflll about the General Iron Works property. He uked Public Works Director Rou iftbere were sips that Rm wu not following the requirements for the cleanup. He said be wu just trying to undenland the reasons for this negative press. He asked iftbere were problems involving~ with the permit, or does Mr. Schum not like what the permit allows. Director Ross felt Mr. Scbmn disagrees with what the permit allows and with Rm's plan. They are required to follow the plan that wu filed with the State and they believe they are in c:oq,liance with that, while Mr. Schum believes there is nastier l1llff than what their soils report indicates and that they lhould take extra steps. Mr. Moore asked if the trucks are supposed to be covered. Mr. Ross said yea, Ibey are llllppOICd to be covered. Mayor Bradshaw said they are DOI covered. Mr. Ross said that is State law, and it does DOI matter whether you are wortiDg with bazardoul maleriala or not. If you are hauling din, you need to have the trucks covered. Council Member Nabbolz said abe saw two aoing down Galapaao today that wa-e not covcnd. Mr. Ross asked if they were bauliDg metal debris or dirt. Director Ross said, to our knowledac, they are doinl what the State bu required them to do. Mr . Ross said everything that they indicated wu pat in writing and that is what we expect of them Council Member Yurchick felt that a lot of Mr. Schum's comments were based on a study done a couple of years ago that showed the bore boles exceeded the arsenic levels. RID's report varied substantially from that initial report. Mr. Yurcbick ukcd which report wu correct. Director ROIi responded that the sublequent RID report lllppOICClly indicated that there were low levels of arsenic, but when we examined that report. it did DOt say where the bores were taken or the depth of the bores. The original report indicated the anenic: level wu in the top two feel, 10 you could get around that by just taking your bore down farther . We really questioned the second report, be streued, and believe the lint report is correct with respect to the arsenic levels. Mr. Yurcbick asked if their State pennitting wu based on a report that wu possibly invalid. Mr. ROIi said no, their permits were based upon that tint report . 2. Mr . Moore advised that, in Hampden Hills, which is in bis district, roughly at the comm of Dartmouth, Univenity, Floyd and Race, there is a lot going on in the nei&hborbood. Someone is trying to pop the top on their house, which is permitted under City code, but DOt under the covenms of the neighborhood. These covenants are fairly old, be allowed, and be did not feel there bad been ouch activity in tem11 of having to enforce them. He said be wanlCd to raise the issue to see what the opciom were . He said be wu under the general m.,ression that the neigbbor'-d could collectively enforce the covenanll and there wu not nuch the City could do, since it wu not a code issue. He said be at least wanted to raise the issue and see if there was something that could be done ifwe care to. Mayor Bradshaw said Judy Pienon bad called her and, since ii wu Mr. Mooce's dislrict, Ille spoke to him about it. Ms. Pierson wu chair of the Pllnnin& and Zoning Coanitaioa for eipt or nine years, Mayor Bradshaw advised, and, when Ille wu on tbat board, Ille did DOI know -bad aay mpmamma that would help people pop a top tastcfwly. It is c:omin& to Englewood whether -W1111 it or 110C, and -need ID NC if we are ready for people who want to pop the top oa their bollle, and -need to be aure they will be tasteful additions. Ms. Bradshaw said her concern wu the same• Ma. Pienm'a, and that is whether we have design standards in our comnmnity. City Attorney Brotzman said we do have certain staDdarda, but we can not enfon:e privm coveaanll. It is the role of the bomcownen' association to do that. One of the issues that is comin& forward is that Planning and Zoning is going to be reviewina all of the standards, such • set back, pop tops and design staodards. That is one of the things Cmmunity Development and PJannin& and Zoning have been charged with, so that is going to be moving forward , be said . Mayor Bradshaw said, if someone wants to do that now, they can . Mr. Brotzman said they can, within our regulations . Cowacil Member Moore said the thing he would like to make sure of u we enter that phase, is wbetber we wa nt to cons ider re stricting pop tops in general, not at all or maybe for R-1-A only. I guess that is going to occur through this other process anyway, be added . City Attorney Brotzman said that is supposed to be movin& forward. Mr. Moore asked City Manager Sean ifit wu possible to eq,basiu that question to that c:oamittee. City Manager Sean said that is probably pan of the Coq,rebensive Plan update, and is an iaue that ha been out there for quite a while. The covenants still have to be overcome within that neighborhood . Mayor Bradshaw said they ran into this in Anipahoe Acres wben they became an historical district. The covenants, because they had not been acted upon, lapsed, she advised, and she feh that wu the case here . They lapsed because there never was a meeting after 1955, she said, so that was the legal opinion we got. Co1U1Cil Member Moore asked what the best advice would be that be could give the people who were asking him how to deal with it. He recognized that the City could not do anything, but n.t oftbem can see the covenant and there is an architectural conttol conunittee that has not been around for twenty or thirty years, be said. City Attorney Brotzman said the group should find a private attorney to advile them. Mayor Bradshaw commented that Judith Beggs Pienoo ii an attorney. (iii) Council Member Garrett said right oulSide Civic Center u you So to Haq,den. there are DO Jines on the street anymoR. This creates an interesting dynamic, be said, wh..-n people are deciding whether it is a double tum left. He thought the City might want to clean that up just a bit. Mayor Bradshaw added that everyone makes that W10fficial right tum Jane. Mr. Garrett apeed, and uid, also, when you are coming acrou nonh, you think you sbould go stniight, but you actually have to move over a little bit, and it ii interesting to watch that dynamic, too . (iv) Council Member Wolosyn I . She adviaed that abe and Council Member Nabbolz would be mectiD& tomom>w morning with Nancy Reid to discuss the parade. She said the wanted to brina up ID _. tbat WU floaliDg around before abe went to Wllhington. She did not have a dance to~ it then, but Ille wanted to nm it by Council. There was some talk about having the parade every other year, making it a biennial parade, in which case it would be the odd year, and the next one would be in the year oftbe Centeanial. Ms. Wololyn aid she could see some benefit to that, having a bigger parade and billing ii a a biauaial event In Older to streamline the process, she said she wanted to find out before the meeting wbetber there was any support from the other C01U1Cil members . She felt, if there was support, we should start it DOW so it could be in the next Citizen. Council Member Nabholz said her personal opinion, and those of her constituency who attend and participate in the parade, is that every year there are tbinp built around the parade. The Malley Center has a craft show, and there is a Shrinen pancake breakfast. The one year that it wu cancelled due to mow, when Amy Van Dykcn was Grand Marshal , I don't think we ever heard the end of that, she recalled . Council Member Moore said be did not have a slrong feeling either way, but would tend to say annual . He sa id be is , at the same time, respectful of the concerns that have been railed. Council Member Ganett said be would say annual and did not undentmd the need for every other year. We like bands to come in year after year. and if any of them ever got into a parade in the oft'yearthat wu 11U1ual, we would Jose . Mayor Bradshaw preferred an annual parade. Cowicil Member Yurchick agreed . If we are going to do it, let's do it every year,~ it eliminates the confusion. Englewood City COUDCil March 18 , 2002 Page 10 Council Member Grazulis voted for an annual parade also , because of the needs of the citizens. Council Member Wolosyn said she appreciated the input, because she felt she was just facilitating this . Council Member Moore asked if the audience at the open forum next week would be a good place to get feedback on how they value the parade. Council Member Wolosyn felt this was Council's gift, and one ofComnmnication Specialist Hoflhincs' concerns was that, if thia is going to remain annual, she would like to get a call for voluntecn out in the next issue of the Citizen. 2. Council Member Wololyn stated that Friday, March 2i-in the Atrium, the Englewood Cultural Arla Center Association and the City of Englewood will host a concert. Council Member Garren said that came up briefly at the farb and Recreation Comnission meeting, but there really ii not enough data yet to ICC bow that ii working. She said one of her constituents wanted to know why there were cameras at stoplights, especially al Downing and Hampden, and at Inca and Floyd. The camera at Inca and Floyd appears to be pointed at the building instead of the intersection, and she was wondering about privacy issues. Director Ross said. regarding the camera at Inca and Floyd, they are tryin& to determine whether it can take the place of the loop detectors that are in the road . When you act 1111>w and ice conditions, people often do not park over the loop detectors and they do not actuate the li&ht. We are tryin& out the cameras at that intersection, and they do not have the capability to be moved around . He said if it has moved, it ii probably due to wind, but they will check it. Director Olson said the question is whether you want to go ahead and set up this mechanism that never really got put into place, which can be relatively complicated, especially if you are doing it every year. It states every six months on some of them. But we are defmitcly enforcing it. Mayor Bradshaw asked what Council's pleasure was . If we do not have a pennit, then maybe we should remove it, she said. Council Member Grazulis asked if it would address some of the can on blocks. Director Olson said they enforce that. We do not have can OD blocks out there. Council Member Grazulis asked about can in backyards with tarps over them and flat tires. Director Olson said the problem in a Jot of cases is trying to get into the backyards. and sometimes a court order is required. We make sure the ones on blocks have the coven OD them, but it is just the aspect of whether we should go out and try to force people to get Ibis pennit. That is what we would like to know, whether you want us to pursue the permit part of it, not the enforcement aide. Council Member Yurchick said his concern on the enforcement side is that he can think of two locations be drives by every day, that are highly visible, that have abandoned can and backyarda full of jWlk. The guy has knocked his fence down so he can back his truck in there at night on the comer of Oxford and Inca. His backyard is full of boats and trailers. That is my concern. !fit is bein& enforucl, fine, he said, but ifit is not, do we want to push this, or do we want to take it oft' the books? Mayor Bradshaw asked ifhe meant the permit. Mr. Yurchick rapooded affirmatively. Council Member Moore asked if having the pennit gives us the ability to do something that this other enforcement provision does not. Council Member Yurchick said it just makes them pay money to have that car parted there. Director Olson agreed. He said they would do it either way. If Council wants them to put some mechanism in place, they will. We are still enfo~ing. and, obviously, if there are some areas where we are not, then we will do it, but it is the pennit that never got arried through. Mr . Moore asked if the incident that Mr. Yurchick described was Jepl. In tcnm of storing things in your backyard, when does it become illegal , he asked . Director Olson said it becomes illegal when you have derelict, abandoned vehicles . If you have a derelict vehicle it essentially means it is unlicensed and unmovable, but if someone has a car that looks, to us, like junk and has a valid license , then they can have it there. A lot of people will claim they are working on it, and we have to work with them on that aspect of it also . Mr . Moore said the permit, then, just adds a layer where they have to pay a bundred dollara. Mr. Obon said absolutely . Mr . Yurchick said six months is free, and after that you have to pay one bundncl dol1ara a yar. Mr. 01- said it is renewable yearly , which is the bi& problem. Council Member Yun:hick felt that a lot of Mr. Scbum's comments were bued on a study doac a couple of yean ago that showed the bore boles exceeded the arsenic levels . RTD's repon varied substantially from that initial report. Mr. Yun:hick asked which report was correct Director Ross responded that the subsequent RTD report supposedly indicaled that then: were low levels of arsenic, but when we examined that report, it did not say where the bores were taken or tbc dcplb of the bores. The original report indicated the arsenic level was in the top two feet, so you could aer lrOUlld Iba! by just taking your bore down farther. We really questioned the second report, be stressed, and believe the lint report is corm:t with respect to the arsenic levels. Council Member Moore asked if the audience at the open forum next week would be a good place to get feedback on how they value the parade . Council Member Wolosyn felt this was Council's gift, and one ofColJIIDlllication Specialist Hoffhines' concerns was that, if this is going to remain annual, she would like to get a call for volunteen out in the next issue of the Citizen. 2. Council Member Wolosyn stated that Friday, March 22 .. in the Atrium, the Englewood Cultural Ans Center Association and the City of Englewood will host a concert. Some of the money that City Council gave to Up Close and Musical will go to help produce this performance, she said, and Mayor Bradshaw has graciously accepted an invitation to inlroduce the concert on Friday night M1. Wolosyn said she had tickets for Council rnemben who can attend. She asked that they be sure to use the tickets if they accept them, because there are only 1 SO seats . We have a great apecmmt with the Fire Manba1 and Assistant City Manager Flaherty to make this a performance space, she said. 3. She said she appreciated the opportunity to go to NLC. The best put for her this year was the eight-hour leadenhip seminan. It is something she felt she should have done two years aao. We all need to be with other people who are in public life, and just getting tips on tricks of the trade. She said she would have her repon within thiny days. (v) Council Member Yurchick I. He advised that the Code Enforcement Advisory Committee meets this Wednesday and two of the agenda items will be staff's role with the committee and the ordinance formina the committee. He said he asked City Attorney Brotzman and City Manaaer Sean to corne and address !bole two issues . 2. He said there was a lener in the Englewood Herald about abulc of the do& pub. He llked if there was any follow up being done . The Parks and Recreation Commission qreed to do this on a test basis with sorne follow up to see if it was creating nuisances or not, he recalled. Council Member Garren said that came up briefly at the Parks and Recreation Commission meetin&, but there really is not enough data yet to see how that is working. Mayor Bradshaw said she had put in a request to have two more of the bag holders at Jason Park on the west and south sides . (vi) Council Member Gruulis I . She said one of her constituents wanted to know why there WffC cameras at stoplights, especially at Downing and Hampden, and at Inca and Floyd . The camera at Inca and Floyd appears to be pointed at the building instead of the intersection. and she was wonderio& about privacy issues . Director Ross said, regarding the camera at Inca and Floyd, they are ttyina to determine whether it can llkc the place of the loop detectors that are in the road . When you act snow and ice conditio111, people often do not park over the loop detectors and they do not actuate the light. Mr. Ross said City Attorney Brotzman would not allow them to do any tapin& with those cameras. We do have a few cameras that we use to observe conditions and situations, be allowed. The one at Hampden and Inca is like that, where it will move around and they can do sweeps and that son of thing. But we do not do any tapes at all, bes~. Ms. Grazulis asked about the one at Downing and H~ Mr. Ross felt that came about II a result of working with the T -REX people . There is going to be a variable message sign that will be im1alled just as you are leaving the City of Englewood, be said, on the south side at about Lafayette Street, in that little triangle-shaped parcel that used to belong to COOT . The variable messaae sign will give advance notice to incidents occurring on Hampden to the east, and 1-25 . Mr. Ross said the cameras are goin& to be used by T -REX as pan of their incident management, and they have them at Broadway and Hampden and at Downing and Hampden, just to monitor what is happening on Hampden. If we have an incident on 1-25, they won't direct them to Hampden if it is blocked as well . 2. Council Member Grazulis asked if the memo she had received, dated March -,., regarding the Englewood School Safety Committee, had anything to do with the School/City Conoittee. Council Member Moore said it was just the School Safety Committee . Ms. Grazulis said she just wanted to make sure she did not miss the School/City Committee, because she bad asked for notification. 3. She said she noticed, in the alley between Lincoln and Broadway, on the eut side, durioa one of the last storms , that there was a paperboy or someone who did not want to llllkc their rounds and dwnped about two dozen papen in their blue wrappers all along the alley. 13 . City Maoa1er'1 Report (a) City Manager Sears announced that the Tri-Cities meeting would be this Thursday morning at the Englewood GolfCoune. We have a range of issues that have come up, be said, that we have notified everyone about. (b) City Manager Sears expressed appreciation for being able to attend NLC . A couple of issues came up ~re, he said. One was homeland security, which is one issue that we are looking at very closely . There has, in fact, been an elevated alert the last couple of days for national awareness of a terrorist anaclc. He felt the issues with FEMA would increase over the next several months . Director Olson has taken a pretty strong leadership role with that, be added . Secondly, at the meetio& they talked about how important Brownfields Grants were . We are hopin& 10 proceed with a national award that is going to be out this next year in terms of the types of things we have done with Browofields. We have let all of our congressional delegation know that we are interested in doing that. (c) City Manager Scars said he was planning to take the next week off. Moore asked if the incident that Mr. Yurchick described was lepl. In terms of storing things in your baclcyard, when does it become illegal, be asked. Director Olson said it becomes illegal when you have derelict, abandoned vehicles. If you have a derelict vehicle it essentially means it is unlicensed and unmovable, but if someone has a cu that looks, to 111, like junk and has a valid license, then they can have it there . A lot of people will claim they are wortin& on it, and we have to work with them on that aspect of it also . Mr. Moore said the permit, then, just adds a layer where they have ID pay I hundred dollars. Mr. 01- said absolutely . The Finance Committee bas decided to recommend to the board that we allow a nine-passenger airliner out of the airport, maybe to Colorado Springs, once a day and back . We are also recommending, as an alternate suggestion, that we go to the voters with a request for a one third to a half mill levy for the airport. lfwe get the money from the FAA we won 't need the mill levy, he said, but we figure we have to have an alternate plan. I hope you folks will understand how important the airport is to Arapahoe County . I serve on that committee with four mayors, he said, the mayors of Aurora, Greenwood Village, Centennial and Lone Tree. We feel it is very important, economically, to Arapahoe County. The airport has 900 employees and they are responsible for another 3500 jobs in the area . l'mjustsaying we would appreciate any of the help you can give us in any of the areas we are involved in . He asked if anyone had any questions. Mayor Bradshaw asked what he was specifically looking at as far as assistance . Mr. Anderson noted they thought about getting a $400,000.00 to $500,000.00 contribution from each of the cities to help in the interim . But, he said, we decided that wasn't the thing to do. We got Arapahoe County to put up a million and a half dollars to take care of that. I would say that what we are concerned about is that if we have to go to a vote for the mill levy we would like to have all the encouragement we can get from the City of Englewood . Mayor Bradshaw said okay, Council will take it un<ler advisement. She thanked Mr. Anderson. 8. General Discussion (a) Mayor's Choice (i) Mayor Bradshaw thanked Council Member Garren for inviting Diana DeGene to the meeting this morning . It is great to have someone who will represent Englewood, undentands Englewood, is a native of this area and genuinely cares about our conununity. It WIS so refreshing , she said, to meet a United States Representative who really, ~ally genuinely likes our conmwnity. That WIS such a breath of fresh air. (ii) Mayor Bradshaw advised that on March 2s• we will have an open forum for citizens to speak to Council and Council Member Yurchick will chair that nx.-eting. I have asked that we hold the forum at Sinclair in order to get it out of this building and out into the community, she said, and I hope that is not a problem for people . I have also requested that the one in April be held at Bishop, she said, just to get us out in the community. Council Member Yurchick asked if Sinclair is definite. Mayor Bradshaw said slaffia setting that up . City Manager Scars said he did not know if that had been confirmed. But I know that we have talked to them, he said, so we will verify that. Mayor Bradshaw advised that she was thinking that between 6:00 p.m. and 7:00 p.m. Council might just do some general discussion about housing and business issues south of Hampden, OD the Broadway corridor. That was at Council Member Grazulis's request, she said, and I think that is imponant If people don't come to the forum then we end up with a study session like we bad that one night that waa jlllt packed. For these forums, she said, I was just wondering if we could have study acuion items ~ 6:00 p.m. and 7:00 p.m. so we don't end up with one night that is just packed. I don't know bow you feel about that, she said, but it is just a suggestion. Council indicated they agreed with ber sugestion. (iii) Mayor Bradshaw advised that last Monday's School Board meeting went very well. I think we covered many, many issues and we bad a good disc:usaion. (iv) Mayor Bradshaw advised that the meeting with Dim:tor Simpson and Cberyl St. Clair went well and we will continue to work cooperatively. (v) Ma yor Bradshaw noted the Wesley issue ia that AVS will be buiJdina boules over time , but we still need the facts from staff before we can make a decision about that. She asked iftbat was Council 's direction from the Study Session . Do we need the money or do we develop it siqle family? (vi ) Ma yor Bradshaw said she would like to have staff set up a meeting with RTD , on General Iron Works , for around the first of April. Englewood City Council March 4, 2002 Page 5 (b) Council Member's Choice (i) , Council Member Nabholz noted, in January, a young lady came before Council requesting some funding for a trip to Washington, D.C. and Council authorized $50.00 . She had to tum her money in two weeks ago and she was afraid to call because she thought we had changed our mind. My question is , she said, what is the process and how long does ii take when we are going to cut a check or make a donation . I think we should still stand by our promise, she said. In response to City Manager Sears, Ms. Nabholz confmned that the young lady is still planning to go to Washington, D.C. City Manager Sears asked who is sponsoring the trip , Council Member Nabholz said she was not sure, that it is through Englewood High School. Mr. Sears said we can give her a call. Mayor Bradshaw said she thought it was through a private company, not through the schoola. City Manager Sears said ifwe could find out the name of the company we could give them a call. We could then send them the check and they could reimburse her the SS0.00 . If that is okay, he said. Council Member Nabholz said that is okay, but she was just sorry it has to be so much work. Mayor Bradshaw thought she had left a lener with City Clerk Ellis that night. She asked Ms. Ellis if she bad left anything with her. Ms . Ellis indicated she had not. Council Member Wolosyn said I know we told her that we had to be sure that she actually had received the entire amount, because we weren't going to give her SS0.00 without knowing that So, she said, maybe that is where the glitch occurred, that she didn't come back and let us know she bad the entire amount City Manager Sears asked Council Member Nabholz to have the young lady contact him. Ma. Nabholz said she would. Council Member Yurchick asked if she had raised the money. Council Member Nahholz said she sure did. Mayor Bradshaw said good for he,, (ii) Council Member Moore said he would like a copy of the larger document that Bryan DesMarteau referred to tonight in terms of the licensing discussion. Mayor Bradshaw asked what that was all about, after that Counc il Member Yurchick said he did not know , but that he was being accused of shortening the document, bu t I was not the author and I believe the author is here . Mayor Bradshaw asked what that was all about. I don 't understand the citizen's coocerll. Ass istant Ci ty Ma nager Flaherty said he was not sure either and he was not involved in the discussion. I don't know what the guess is, he said, but at the same tiine, looking at the dollars that way doesn't tell me anything. Assistant City Manager Flaherty stated we can provide some percentages ... 50%, 33% ... to give you some numbers that way, as well . Council Member Moore said he knows it is a wild guess, but whatever that guess might be, it is still at least a little more to go on. City Manager Sears asked who else wanted a copy of the 28 page document. CoUDCil Members Yun:hick and Grazulis indicated that they already have it. Council Member Nabbolz said she probably should have it, as they will be discussing it at a Study Session. Council Member Wolosyn said she didn't need a copy, but that she would like to come by and look at one. 1 once mentioned to Council Member Yun:biclt, she said that it might be nice to have a place in Council's little room where we could have these larger documents and we could go and look at them. Mayor Bradshaw agreed. I am really against us running off everything. Mayor Bradshaw opined that this was such a disconnected discussion tonight. I don't know ifit was just me, she said, but it dido 't make sense, it dido 't feel that those were bis words comin& out of bis mouth. Council Member Yurchick advised Council that Mr. DesMarteau doesn't support a lot of this, but he is the spokesman for the Code Enforcement Committee. Council Member Moore noted be was asked point blank and be said he did support it, u well u die committee. Is that not the case? Mayor Bradshaw said that is why I asked the question. Council Member Moore stated that Mayor Bradshaw asked him point blank ifhe personally supported it and be said yes . Council Member Yurcbick said his comments in the committee meeti1Jas have led me to believe otherwise. Unless , he said, he has changed his mind and he may have . Mayor Bradshaw said I know we requested another study session, but, number one, I can't juatify adding a person to keep track of pets . The people who don't get their dogs taaacd, licensed or take them to die vet, are still the ones who won 't register them. So we put this whole governmental thing together, she said, and, from where I sit right now , !just don 't think it is necessary. Coun cil Member Yurchick said it is his understanding that they don 't enforce the vaccination law, even when the y pick up the animals . Ma yo r Bradshaw commented that they arc asking for more laws to enforce, wbea we don't enforce the law s we have . (iii) Council Member Gamn: I. Englewood City Council March 4, 2002 Page 7 Mayor Bradshaw noted that actually we arc getting 1.25 %, so we would be getting half of what we collect off of that mill le vy. Council Member Garrett said most of the open space they are talking about is to the east. Mayor Bradshaw said yes . So , Mr. Garrett asked, if we were to say to our citizens do you want to do this for yourself at .1 %, would we be generating for Englewood the same amount of money . It seems very rich to me , he said. Mayor Bradshaw said that is a good point. Council Member Wolosyn commented that she thought they said in one place that it is based on vehicle registration, but then in another place it said vehicle registration/revenue . Council Member Garrett said it is vehicle registration, so I want to sec bow that compares to our sales tax numbers . Just to get a sense of where we arc, he said. Council Member Wolosyn said she was also wondering about the actual numbers they were using for vehicle registration. Arc they sure it is us, or is it one of those things that could be zip code based and then there would be a big problem once it was passed? Council Member Garrett said it is just something I would like information on . Mayor Bradshaw said I was not impressed, period . Council Member Garrett said it was extremely rich for my blood. 2. He said, with respect to the propcnies on Wesley, that they are zoned for more density than we arc talking about building. So I think one of the things we are looking at, is if we own those properties lets go ahead and up-zone those places. Because one of the justifications for taking a Iou, be said, would be the cost ifwc decide to up-zone property and create R-1-A there, which is something we are always seeking. So lets go ahead and lock that in, he said, because the last thing we want is for someone to buy a house and ten years from now raze it and put in duplexes, if that is our ultimate goal. That is just something to think about as we go forward . Mayor Bradshaw said I thought it was Council's goal to raise the bar on the quality of houses up there . That every house does not have to have a garage that faces the front street, the design needs to be better and we want to encourage single family ownership. Council Member Garrett said we can do that to our propeny and go ahead and rezone . Mayor Bradshaw said that is a good point. Mr . Garrett said it is just an idea. 3. He noted he appreciated the trailer on Quincy and the information. Correct me if I am reading this wro ng, he said, but it appears the trailer works . It bas slowed down people coming off that bill, by about four miles an hour, he said, which I think is quite a lot. Direc tor Olson said , th en again, we have kids who try to sec bow fast they are going by using the trailer as their benchmark speed device . So, he said, there are other alternatives . Mr. Garrett thanked Mr . Olson. 4. He stated he has a great amount of pride when people tour this building and we show them what we are doing here, as we did this morning . I think people who haven't been here for a while, and then they see what is going on, are impressed at what we have accomplished. So, he said, I take a lot of pride in showing this building off and the facilities . (iv) Council Member Wolosyn: I . She said she was very happy that she attended the meeting this morning and toured the building with Diana DcGette. Like Council Member Garrett, I was impressed with how impressive we looked and I was very proud, she said. She noted that City Manager Sears and Mayor Bradshaw did a great job of showing us off. 2. She advised that she mentioned this last week, at the School/City meeting, that Council Member Garrett had asked that Council Member Nabholz and I take the lead on trying to do something to make sure the parade goes forth. We will be meeting with Nancy Reid, when I get home on March t9•, to take a look. at what really happens. She noted that the staff does an awful lot of work. and the community does a lot of work, but we need to define both of those areas. Maybe we should be looking at a conununity-based group in the form of a board or conunission, she said, but we would want lo be using the existing corporation. So we are going 10 be looking at ways to do that, she said, and we will repon back to Council after we talk lo Ms. Reid . 3. She noted in the packet there is a list of the letters from the Cultural Arts Commission and the list of vacancies. There has been one resignation, Rosemary LaPorta has moved out of the City and closed her business and one member hasn't come to very many meetings . When we discussed terminating these three positions, she said, I think it was the consensus of the Commission to wait until June. We can certainly ask these people to resubmit their applications, but we would like to show a vacancy for Cultural Arts. I just wanted to mention that, she said. City Manager Sears said he wanted to clarify that the Conunission wants us to go ahead and advertise foe vacancy and then Council will select in June, al the regular time. Council Member Wolosyn said yes, in June, we just want to keep it on the regular schedule . 4 . She said she received a call today from Kyle MacMillan from the Denver Post He is doing a story on the number of initiatives for an centers going forward in the metro area and he wanted to ask about ours . I gave him what I thought was an accurate update of where we are, she said. I advised him that the Cul tural Ans Conunission wrote a comprehensive business plan a year and a half ago and we feel we arc ready to revisit it. That things have changed in the metro area, in the City and with our goals. 'That Council included $300,000.00 in the 2002 Budget for the first installment in a land bank. That the next thing we will be working on is earmarking sites that we can work with lo go forward . Ms. Wolosyn said, not nece ssarily that there will be an ans center, but lets earmark a spot and sec how it works in the community. I want to thank the various Council members, she said, who have been so supportive and have helped me lea rn to aniculate this . In the coming weeks, after I get back from Washington. D. C., I would like to get serio us about defining a site . If we are going to be looking at devclopin& other areas of the City, she said, I delimtely want us to be looking at puning in another fine public building that we can show off, just as we did wtth thi s building today . In response to a couple of citizen requests, Mr. Yurchick asked for a summary of the David Taylor deal , what we arc going to give them up front and what they will get annually. Also, when will MOA provide accounting for their $50,000.00 contribution to the City? City Manager Sears asked Assistant City Manager Flaherty to respond . Mr . Flaherty advised that the MOA accounting is at the end of their contract year, which is the end of June. We have a deal sheet with David Taylor, he said, when we can provide. Council Member Grazulis said she would also like to see that. Assistant City Manager Flaherty advised that the deal sheet with David Taylor is subject to a final contract which we do not have . City Manager Scars said there is a deal sheet that Council approved along with David Taylor and we can pull that up for Council. 2. He said ACE asked what the Building Department is doing with their internal survey. Director Olson,advised that they have redeveloped the form and the form can now be easily computerized with the data . So they started on that and the data entry has already begun. They worked with the IT Department and it is all set. Council Member Yurchick said okay, I will let them know. City Manager Scars asked Director Olson to provide Council with a copy of that form and, also, a copy to Jan Johnson and she can put it in the ACE packet. 3. He asked why Code Enforcement doesn't have the time to enforce the SI00.00 per derelict vehicle fee . Mayor Bradshaw said she wondered about that too. Council Member Grazulis said that was her question too . Council Member Yurchick said he didn't need an answer tonight Director·Olson said he didn't have one anyway , as this is the first time he has heard that.. Mr. Yurchick said it is not the lint time he has heard it. Mr. Olson said he is really not sure . Assistant City Manager Flaherty said he could add something to that. He offered that it is a registration fee, not a fine . I think a fine was mentioned in the presentation, he said. Apparently, there is a regi11n1tion fee on the books and the registration has never been implemented for reasom unknown. Counc il Member Yurchick stated it is SI00.00 per year, per derelict vehicle . It is a law on the books . Assistant City Manager Flaherty said apparently so. but I haven't seen the citation. Director Ol son said they will really look at that, because that wu confusiq toniaJit. Basically, he said, what you saw, that I redid, was a document with the information regarding the spaded and neutered animals deleted . 5. He advised Council that he would be late next week . 6. He commented, regarding the Code Enforcement Committee, that be bas gotten the impression over the last year that it is kind of the tail wagging the dog. That it is staff driving that committee and it is not the committee setting the agenda. I have read the ordinance on establishing the Code Enforcement Committee, be said, which pretty clearly outlines their duties, but it doesn't really outline staff's role with that Committee. I just have a fundamental issue when somethiJJ& like this dog licensing comes forward and it is directed out of Code Enforcement. So we have the people who have to enforce the law, trying to write the law . Mayor Bradshaw asked Director Olson if he would like to respond to this. Director Olson noted that the Department of Safety Services continually presents various laws that we would like to see put in place , so it is not unusual to have staff make those proposals. So I guess, be said, it is to the extent that you feel it is an advocacy type of position and I think that is what was reviewed in the 28 page document. It appeared, be said, to be too much of an advocacy type of thing. We discussed it 111d I don 't think it was, but it just may have come out that way. Regardless, that is why the document wu cut down to make it look like it was more a neutral position, which it actually should be. But, be noted, there are a variety of reasons that we come forward to Council with different proposed ordinances, so that is not unusual to have staff doing that. Council Member Y urcbick said bis concern, on this particular issue, was thal be felt like the Code Enforcement staff was trying to railroad this thing in, the way they wanted it, not so much the way the Committee wanted it. Director Olson ~aid he. would be real honest. He stated that we don't really care which way this goes. Whatever Council puts in place, he said, that is what we will enforce. But we really don't care ifit doean't go through at all. That's fine with us . If it does, obviously we will work with it in the best way that we can . But, be noted, its not something that we have set around and said we have to have this. Council Member Yurchick said the issue isn't the law, whether the law puses or not is irrelevant to me . The issue is the fact that staff is driving this stuff and the committee isn't. Mayor Bradshaw said then what you arc saying is the Committee is supposed to get neutral information and serve in an advi sory capacity to Council and that is not happening . Co un cil Member Yurchick said it is to the point that Code Enforcement bas a list of items they wanton the ag enda and it is not driven by the Committee itself. Mayor Bradshaw said you mean the Code Enforcement Officers have a list of things Ibey want. Director Olson said 1 think they will be on most of the issues and unless they are constantly brought up to date on what's going on or what staff's issues arc, then they won't be aware of them. It is actually both groups working together, he said, and that is the way it should be . Then they make recoounendations to Council. He advised that there will be times when staff will come to Council with something. regardless of where the Committee is at, because it is something we need to do as a staff. Just as we do with police related matters or fire matters. We don't go through a committee to make sure it is okay. We analyze the issue, come forward to you with our position and see what Cowicil thinks about it. · Council Member Wolosyn said I think that is an important point you arc making. Say, in Cultural Arts, I wouldn't want staff putting things through directly to Council without informing the Commission. On the other hand, she said, the Commission will bring up its own points too. Things come from both ways, to come back to us . Director Olson said that was his understanding as to why the Committee was put in place; at least it was several years ago, when it first started up . Council Member Wolosyn said she agreed with Council M~ Yurchick, staff shouldn't direct. Director Olson said be agreed . I don't want to have our folks just sitting there slamming something down that Committees throat and then they feel that they have to go with it. That is not it, he said. Mayor Bradshaw opined that there is a fine line there. We have staff for the Plannin& and Zoning Commission, the Code Enforcement Advisory Committee and the Pub aad Recreation Commission and I think it is a fine line, a fine professional line that people need to walk. Being advisory versus recommending. And that is your concern, she said, that there are recommmdations coming through and not advice . Council Member Yurchick said his question is how do we address this issue. Mayor Bradshaw asked if Council should tighten up committee rules . Council Member Grazulis suggested that Council review the rules. Director Olson said he dido 't hear that. Council Member Yurchick said his question was bow do we address this issue . Director Olson advised that he would, obviously, address it internally. When the Committee first started out , he said, I was there and then 1 backed out of it, because I dido 't want them to feel like the Director of Safety Services was somehow leading the Committee . Which, he said, I have to tell you that at the first mecung we actually did, because we had a group of people who were really not quite sure why they were there and what they were supposed to be doing . So I gradually backed out and that is why we have also not allowed most of the staff memb.:rs to be there, because that was creating somewhat of a problem too. My understanding is that nght now David Lynn will be there, occasionslly Bob Moore and, of course, Mike Flaherty from the City M1111ager's office. I think we have a number of committees that staff is involved with. Be it ACE, or the Planning and Zoning Commission or the Code Enforcement Advisory Committee. And, be commented, the Code Advisory Committee is always one of the most difficult, because we arc either enforcing it too bard or enforcing it too light. We are going to collectively get hit one way or the other. He opined that we need to develop some proposals and some policies to deal with the different elements of every committee we have. And, as Director Olson said, then we need to leave off and ask if the committee wants us to follow-up with that or ask if this is something that is taking it too far beyond where you want to see it. It is a pendulum. He noted we faced that two or three years ago when it was too lax and we weren't enforcing adequately. I think to a certain extent we have heard that we are over enforcing it or we are enforcing it too strict or stricter than some people would hke or we are taking it to a different level. But we need to stay in touch with that Committee. Mr. Sears pointed out that if we don't make a recommendation about things that can improve things then we are really not doing our job. We are also in a position of knowledge, be said. We are out there and we kind of know what is going on and the committees, as volunteers, kind of rely on the people who have that knowledge. I don't think we framed this issue adequately. As, Assistant City Manager F1abcrty said, we tried to neutralize where we were at, but maybe we need to work on bow we do things. Council Member Yurchick said that is fine . For instance, be said, in my opinion, it should have been neutral before it even got to the City Manager's Office. City Manager Scan said I think you are probably right . That is, quit : frankly, why I have had Mike Flaherty stay on the Code Enforcement Advisory Committee. Because it is a hot issue in this community, it will always be a bot issue in this community and I want to make sure that, at my level, we are in tune with that. I'm not sure we stayed where Council would like for us to stay, he said, but I think Council's directioo is relatively clear and I think that is what we would like to do. It is a two-way street. If we guide a committee by saying MJook, you dlHl't want to do this type of thing" then I think we could be in the same jeopardy u we are when we say "take a look at it." I think it is how we present that information. Our job, as staff; is to praem ideu and present ways to improve things and then step back and ask the citizens if this is what they would like to see enforced within their community. We probably just need to do a better job, be said, pcrtiaps tbis one shouldn't have reached this level in the way that it did. Mayor Bradshaw said maybe that is why I felt this was inco~lete, that we weren't ready to discuss it and I don't think they were ready to present to us . That is what I was sensing. Council Member Wolosyn said, for me, the gap was that I do support licenses, now give me a way that I can undcrslalld, that it could actually happen. The alternatives I beard tonight didn't sound, to me, as if they were really feasible . That was the gap for me, she said, and if that is the cue then just say that it is not feasible at this time. Ma yor Bradshaw said it didn't seem thought out enough. Director Simpson's presentations were thought out enough, thi s one didn 't seem like it was. How do we set these guidelines so the committees know what the boundaries are? Council Member Wolosyn said I would have to say that those are hard to defme and it would be bard to ·set a group o ( rules. A lot of it is dynamics. If it is a group of people who just want to take direction from staff, then it will go that way, if you have a strong group of people then that's a different issue. It is a dynamic that works itself out, she said, and I think we have an honest structure. I think we do. Mayor Bradshaw stated every time you have to go through storming and norming. I think it soUDds like you have a huge turnover in that group, she said, and you are probably ready to start doing that again and that is a group process. Mayor Bradshaw asked Council Member Yurchick what be would like to see. Council Member Yurchick said I don't know, I don't have any answers, I don't even know what the roles are and I don't think they are clearly defined. City Manager Sears said he wanted to make a suggestion. As we beard tonight, Council is not satisfied with the information or the method that it was presented. We took a look at one s ide that said this bow this can come together and this is how it can work and here are seven different options to make it work. But we really didn't take a look at those that would say that this is really kind of an additional burden, this is an additional problem. I know there is that feeling among Council and the citizenry. I would like to take that back to the Committee, he said, and ask them to take a look at it from that viewpoint Are we going to actually get enough people to participate in this and can the existing staff people actually baodle this or is there another method to do this? Perhaps a voluntary registration would work, for those that want to do that. I think, he said, that there are a whole range of different options that the Code Enforcement Advisory Committee could potentially talk about. If you are not happy with certain issues, be said, then Council could handle it just like they did with ACE. Council remanded certain thinp back to them for further study. So that is one alternative that Council can choose, with maybe some direction, and that is what the Advisory Committee is there to deal with. I think the comment, that perhaps this was a little overly staff driven, is probably an okay thing . Being honest about that and sayina okay Committee, on your own, without influence from staff, what do you think about that? I think that could be articulated to them and I would be happy to make those conunents, with Mike Flaherty's help, if the Council feels that way. Mayor Bradshaw asked if that sounded better. C ity Manager Sears noted that they can run the issue back through the Committee again and if they are still saying that absolutely this is the best thing since sliced bread, then they can come back to Council and then it is up to Council to make that final decision. Counci l Member Yurchit k stated the issue is n 't this ordinance. To me, he said, it is the s ~tom. The problem is that I want the Committee to voice their opinion and their input. Mayor Bradshaw said, to play devil's advocate. we created tlus thing called Code Enforcement. We pushed it reall y hard five years ago . Council Member Moore asked if they could reinforce , with this particular committee, that they are there on behalf of Council . That could come from the City Council representative or the City Manager's Office, just as a reminder. I hear a lot of pros and cons about code enforcement, he said, and I want to look to this conunittcc: to represent the citizens in this process . Mayor Bradshaw said yes and for them to help with that balance . So, Mr . Moore said, lets remind them that they are there for us, to help us with these issues. Mayor Bradshaw asked if that provides a little more direction. I just needed the gestalt finished, she said, there was a piece and that was all wc had . Council Member Garrett said at the same time I look at the Parks and Recreation Commission, where a lot of the things that come before them is staff driven. It is then up lo that committee to act as the filter for that, which I think is the proper role of the conunittec. What I am hearing, be said, is that then: is a feeling that maybe the committee: wasn't the proper filter in this case. I hate to start defining roles and re,ponsibilities too clearly, because that actually bothers me. Mayor Bradshaw agreed. Council Member Garrett said it was the filtering procedure he would like to e~hasizc, as DB1Ch u the responsibility. Council Member Moore said that if you make it as clear as what I just said, then Code Enforcement could take an advocacy role, as long as the committee: knows they don't have to do anything with it if they don't want to, that they can serve as that filter . Mayor Bradshaw said she thought they felt that they had to have an answer, that they had to come up with a licensing program. 1 don't know that that was our dircc,tion, she said. Council Member Wolosyn said wc did ask them to give us a picture of what it would look like ifwe passed licensing , how it would be implemented. Council Member Yurchick said you know this will go to public bearing and we will pack the house on licensing . City Manager Sears said yes, that is bUe . She said I am also on the Code Enforcement Advisory Conunittee and I have been uneasy since I walked into it, because I didn't get into it from the stan. I was trying to figure out which direction they were headed and what it was going to be. I had a problem with the company they chose, she said, and not coming up with enough letters of recommendation. Because of my history with this issue, I didn't say much, so I was kind of silent, and just sat there . They kept asking me what I thoughl and how Co1U1Cil would perceive this and I wasn't going to give them any answers right up front. I was also uneasy with the money aspect of it, that it was just totally untrue and some of the things were based on the money. 2. She noted Council used to get updates from Jim Ulrich regarding things that were happening in Englewood. such as murders and fires and stuff. She pointed out that things have happened, we were told they were sensitive, we never got anything and then we would read about it in the Eaalewood Hcnld. People do ask me about these things, she said, and I was just wondering if we could have some type of Council update when serious things happen within our City·. If I don't listen to the news, then I don't know what is going on. Mayor Bradshaw asked if Council could receive e-mails . If there is a fire or something we al-ys get e- mails, she said, but if there is an unsolved murder we read about it in the paper. Council Member Grazulis said in particular if it is a murder or rape and it is close to home I would kind of like to know . Besides, she said, it is difficult when people stan to call me to ask me about' it and then I have to say l have no idea what you arc talking about. City Manager Sears stated there is a little bit of a disconnect sometimes, but you arc right, you arc on the line because people expect you to know . So, he said, we need to do a better job of making Council aware of those emergency situations . She advised that tickets can be obtained from Amy Doe for Back to Bach, which is a concert scheduled for Friday, March 22nd at 7 :30 p.m in our Civic Center atrium. l think it will be really nice, she said, and there should be posters all around. Council Member Wolosyn noted that Council should be receiving tickets. 5. She said she had a question regarding the green iron work that has been going up around the businesses. It seems like we have come to a stall, she said, but maybe that is just economics or there is no one willing to do it anymore . She asked if there is a stall in putting that green iron work up. Business and Redevelopment Coordinator Johnson advised that actually we are still moving forward with that and you will sec some more coming up soon. She noted that is pan of the Catalyst Propam that goes along South Broadway and Hampden. We had a business near General Iron Works that put up there own green iron work. she said. They called us, got all the specifics for it 111d knew that they weren't qualified for tbc program, but they still wanted to have the Englewood green iron work. Council Member Grazulis said that is wonderful. Mayor Bradshaw said we need to send them a letter or something. Council Member Grazulis advised that the Teenage Drinking Task Force meetings arc coming along nicely. 7. She asked when the next Centennial meeting would 'be held. Assistant City Manager Flaherty said that actually they haven't had a meeting of the ad hoc committee yet. W c arc looking at the week of March 11• for that first meeting, he said, and we will get Council that information as soon as we can. We are ttying to finalize that this week, internally, he said. Ms. Grazulis thanked Mr. Flaherty and noted that when she called about it they thought that the meeting had actually been held. 8. She said that when she went to that last Code Enforcement Advisory Committee meeting they had a five minute video with Ernie Bjorkman in the role of the code enforcement officer. It was absolutely hilarious and really worth seeing, she said. I would like Council to sec that. Mayor Bradshaw suggested that be scheduled for a Study Session. City Manager Sears said it is only about two minutes long, so they could schedule that for March 18111• Ms. Grazulis commented that one of the things that happens is that he writes out a fine for a derelict vehicle with trash in the back of it and he is kind of giggling under his breath about Englewood. That is why, she said, I have a problem ifwe can't enforce that $100.00 fee. I think ifwe enforced that fee then people wouldn't want to pay it and so that would give them the incentive to have the vehicle hauled away . She felt that might get rid ofa few of those cars like that. 13. City Manacer's Report (a) City Manager Sears advised that they started work on General Iron Works and there was a flyer that went out to the neighborhood. I have a copy of our permit for grading and work on the site if anyone is interested in taking a look at it, he said. It is a pretty thorough document and it puts the responsibility on RTD to enforce drainage requirements and monitor the airborne types of particles and whatever. If you arc interested in the details you can take a look at that. I think it is probably helpful in case you receive a telephone call from a citizen. Rick Kahln, in particular, and Ken Ross an: working very closely with them on this . They arc responsible for the clean-up and extraction of the metals and things like that. It docs appear that they will be going down Galapago and they will not be going through the Winslow property at this point in time . Mayor Bradshaw pointed out that they are removing a lot of the metal by rail , otherwise that would have doubled the trips coming off that site. City Manager Scars said that is right. Mayor Bradshaw said she wished they could have used Winslow. Mr . Sears advised that Ken Ross and Rick Kalun were present if Council bad any questions. She noted that we have worked really hard to try to keep dangerous trucks off of Santa Fe, now, with this amendment they would be saying that we can't do it. Director Olson said this must have just come up, because I just attended a legislative conunittce meeting with the chiefs of police the other day and this was not even discussed. Mayor Bradshaw advised that it just came up . Mr . Olson said it must have been today or Friday. As it was the consensus of Council to send the letter, City Manager Sean advised that they would prcpue the letter tomorrow and send it off to Senator Teck. ( c) City Manager Scars advised that we received a lener today from Kulak Rock, our bond counsel, and they want to know if we ue planning to participate in the Mayor's Caucus Single Family Mortgage Program. As we understand the direction from the Council, be said, it is that we arc not to proceed with them, IS of February 28111, which was their deadline. We have some other alternatives, including CHAF A and some other things, that we can bring back to the Council. But I guess what I would like to know, be said, is if it is the final decision that Council will not be participating with them, so we can tell our bond counsel that those funds won't be transferred over. Mayor Bradshaw said I thought that WIS becau se we have our own allocation this year. BACKGROUND, ANALYSIS, AND ALHRNATI\IES IDENTIRED Bob Schwinn, owner of 4685 S. Mariposa Dr. and an adjacent piece of property to the south, submitted three license agreements. The first is for new construction to install two water lines, two sanitary sewer lines, two gas service lines and a bridge/culvert over the City's right-of.way for the City Ditch. The next one is to allow an existing sewer and gas line to cross the City ditch for the residence at 4685 5. Mariposa Dr. The last license agreement is for an existing bridge/culvert for the residence at 4685 S. Mariposa Dr. The Licensee expressly assumes ful and llrlct liability for any ~ aD damages of every nature to person or property caused by the point or points where lhe Licensee performs any wortc In connection with the crossing provided by the Licensee. Rear discharging trailers are used to operate a beneficial use prow;am where biosollds are transferred to spreading equipment directly. In this prosram, blosolids do not touch the land until applied by staff. The unit being replaced was originally purchased In 1989 and is beyond scheduled replacement date. Due to wear evaluation, the original units were used longer than anticipated and scheduled replacement was postponed to 2002. In 2001, eight competitive bids were solicited and two responses (one was •no bidj were received. A vendor quote is attached based on this bid for a like-product purchase recommendation. One vendor responded with a bid and another vender responded with a "no bid". There was no response from the other six vendors . Submittals were reviewed and a technical evaluation has been completed. Trailers, as bid, are technically acceptable and two units were ordered for delivery December 2001. In the 2002 budget, another unit was budgeted and approved to replace a third aluminum trailer scheduled for replacement. A new quote was obtained from the vendor who provided the 2001 replacement units and is attached to this recommendation. Rationale for obtaining this quote is based on the following ~asons: • A sealed bid was conducted during the summer of 2002 • Equipment uniformity in design and operation is consistent with the recently delivered units . • Price for the unit is $1 ,600.00 higher than paid last year . This increase is due to a specification oversight in the original bid, which did not include an oil reservoir within the trailer body. FINANCIAL IMPACT The Utilities Department is converting the metering system to the ITRON Automatic Meter Reading System. All meters and registers will be compatible with the ITRON System. About $15,000 worth of these meters and yokes will be resold to Englewood customers for new installations as part of the flat-rate to meter conversion process. The remaining stock will be used to replace inactive or poo,ty functioning meters or convert meters to the ITRON system as part of the water meter maintenance program. There is money budgeted for these items in the 2001 Budget Request for Bids were sent to two vendors, with two companies responding with bids. Mountain States Pipe & Supply was the low bidder for the ERT meters and Dana Kepner was the low bidder for the regular 1/• • yokes, valves and fittings.
