over in Progress Pule. If you haven't been there, she said, it really is fun to watch the kids. They fish with
cane poles and Uncle Milty's always comes up with fabulous prizes. I also have parking permi1s for you,
so when you pull into the park you can proceed to the special permit parking area . Council is very familiar
with the number of volunteers I have, she noted, and the only way I can actually, appropriately, thank them
is to have a volunteer appreciation dinner every year. This year it is on July Io*. I am inviting all of you to
come and join us. It will be OD July to* from 6:00 p.m. to 8:30 p.m. at Jason Parlt. It will be a barbecue,
so pleue come and join us if you can. I have some invitations for each of you, she said. Then we go right
into National Night Out. We will have a very busy 30 days. We have National N~ Out T-shinl for
Council. I will bring your actual National Night Out acbedule to you OD August S , the night before
National Night Out. I beard you were all going out. National Night Out is OD August 66 and we will bold a
National Night Out kick-off' party right here at the ~ter, on August 3"". It promises to be a peat
time, she said, and I have brought you a blurb OD that too, with the datet and times, so you won't have to
try to remember all of this . Then on Aupst.,. National Night Out and Pules and Recreation are joining
together to present King Lear, for a poll National Nishi Out effort. So, tbia coven August 3"", Aupst 66

bring your party assignments . She uked if there were any questions.
Council Member Grazu1ia said she bad one comment. When I was at CML, she said, I went to the booth
that bad the National Night Out packets. I told him I was ftom Enalewood and asked him ifbe knew
Nancy Peterson. He said I couldn't have anything, because Nancy always gets everything, u she orpnizes
the biggest National Night Out in the State. He said be didn't believe she bas that many pu1ies, but I
assured him you do .
Officer Peterson said that, actually, I have my trailer booked up to the ear and tomorrow afternoon, after I
complete some preparationt at Comentone Park. I am beadina do-to their beadquanen to aet the
packets. So I will be filling up the trailer.
Council Member Grazulia said be was from the State, but I can't mnember his mme . Officer Petenon said
that would be Senator Doug Linkhart . Ms. Gruulis said ya.
Officer Peterson said be bas been out here and toured our City two years in a row, so be lmowa lbat we
have them.
Council Member Grazulis advised that be bad-said there are some cities that have zero parties for N~
Night Out.
Officer Peterson stated that we have more National Night Out pu1ies, in Enalnloocl, than in all of the mt
of the State put together. So we are real proud oftbat fact, she said. Al I told you, in Sepe,,fflber oflut
year , that Englewood was the only city, in the State of Colorado, to be recopizied natioaally for our
Nat ional Night Out effort.

(i) Fire Manbal Greene presented a recommendation from the Department of
Safety Services to adopt a bill for an emergency ordinance amending the Englewood Municipal Code
pertainin& to Fire Codes, banning the use of charcoal, gu-fueled, and other open flame cooking devices in
multi-family residential structures. He aolcd that we talked about this at a Study Sesaion mi Council
asked that this be brought forth u an emergency ordinance. I lave identified two aectiom of the Code that
must be amended. We are talking about banning the use of all barbecue grills in all nmlti-family unill that
are two or more stories in height. Cbarcoal would not be allowed, period. Gu fueled cooking devic:a
would only be allowed on tholC decks that are protected by a lprinkler syatcm. Currently, be stated, we
only have one apartment complex in Englewood that mcell that criteria, which is the Aleua. Beyond that,
all would be binned. One iuue tbst bas been brought up 1111111C10U1 times is that some llpU1lmDt owners
would like to provide a grill. We have encouraged them to provide a natun1 gu grill or, if they are going
to provide an LP (liquid propane) type of unit, it should be in the courtyard at leut ten feet away from
combustible structures. We are abo putting this in the Fire Code in the specific section that talks about
charcoal grills.
Council Member Grazulis uked if this coven electric grills. Mr. Greene said no, electric grills would still
be permitted.
Fire Marshal Greene advised that be doesn't have any documemation that electric grills would cause
specific fires, exce perhaps during maintenance. MaiatelllDCe is also a big issue with tbc LP gu devices.
We don't see a lot of electric grills, be noted.
Council MernMr Grazulis advised that she wu asked if they would be allowed. So, she aoted, that would
be an alternative.
Mayor Bradshaw stated that the iq,etua for this lqislation came from a lune Study Sesaioo, but, abo, we
have bad two fires . She asked Mr. Greene to talk about the fires .
Fire Marshal Greene advised that recently we bad a fire !baa wu directly aaribueecl ID cban:oal briquetta
being left on a combustible balcony. I believe the other fire you may be refmin& to, wu when a
gentleman left food cooking oa a stove. It was, unfOltWlalely, at the umc complex. He poinlecl oua that
that complex baa bad at leaat one other fire, that I am aware of, lbat wu caUled by cbln:oal briqueaea. All
of their losses were considerable.

sentences for juveniles. He advised that our Court Adminiltrator lllllic:ed that -have a provilioa in our
Code that prohibits the Court from leDding juveailes to jail for tnffic infrac:tiom. That is not allowed by
law. So, be said, our recommeodatioa is that -remove that eec:tion from our Code.

to approve a construction contract for this year's three concrete programs . We are doing something
different this year. Normally, we put these out u sepuate projects. For economy of acale, be Aid, and we
hope we can save money managing tbeae; we have actually placed all three concrete prognm1 in
concrete construction account. They are the Concrete Utility, the Concrete Program, which ia the program
where we build all of our handicapped llllq)S, and the new program that wu initiated in 200 I, which ia
called the Sidewalk Missing Links Program. The plan would be that we could manage tbeae program1
more cost effectively. We are also doing something else with tbis contract that we haven't done in the put.
And, he noted, he worked with City Attorney Brotzman on this. There i, a provision in this conttact that
would allow us, for the next two years, with Council's approval each year, to extend tbeae contr1lctl for
additional years. So if we are satisfied with the price, the quality of work, and the perfommlce of the
contractor, then we would have the oppor1UDity to extend tbis COlllnc:t, which would be a COit saving
ll1eUIIR for future yean. I have given you a brakdown of the tine programs, be said. The Concrete
Utility construction is $509,473 .00, which is funded through the Concrete Utility Program. The Concrete
Program, where we construct handicapped nq,a. bas SI04,47S.OO in it. We llllicipme that that is enough
money to do about 7S ramps this year. I wu talking to staff today, be said, and it ia inlacsting to note, that
we have completed about 1,771 ramps, out of2,S00 in the City, over the 1ut several years. At this rate, we
still have about ten yean to go, but we are probably far ahead of most mmicipalities in Colorado. So, be
opined, we have done really, really well in that area. The third concrete program ia Sidewalk Milling
Links. We are anticipating doing some sidewalk upon Zuni,_ the Alternative High School . We tried to
get that done Jut year, he said, but Xcel wu slow in moving some po-poles. The other thing we have
done, u budget saving matter, is that we have a couple of other programs, TEA 21 programs through
DRCOG, for Belleview sidewalks and for some sidewalks on University and we will have a nall:b with
that. So, he said, what we are recommending is that we will spend about $60,000.00 on the Zuni sidewalks
and the balance of that money will be applied towards our match for thole TEA 21 programs. We will start
the engineering on those this year and thole will be COllllrUcted next year. I will still have to budget a little
bit more for 2003, he said.
Mayor Bradshaw said the Zuni sidewalks will provide a place for kids to stand while they are waiting for
the bus to get there to pick them up. Director Kahin said absolutely, this is a nu:b-needed ~vement up
there . '
Director Kahm noted that we will start designing the TEA 21 programs this year and comtruction will like
place in 2003 .
Director Karun advised that the low bidder on this project wu Fuick Concmc, 1111:. Thia cumpuy bu
been around for several years . We don't have any direct experience with them, be said, but we checked

we put a project out 10 bid, we have to go through th e same process, whether it is a fifty tbouund dollar
project or a million dollar project, in terms of putting together plans and apecs and doing all the advertisin&.

the Utility then you pay a fee along with your water bill and we have always called it an insurance, but it is
an alternate way of financing this wort. Our staff baa aone out, inventoried the City and rated all tbe
concrete on a one to ten scale. When we fust started tbe program, and I think this ia our fifth yar, we did
tbe fives and sixes. Thia wu concrete where we bad diree and four incbet of vertical diaplacenmll or
severe spalling, now we are down in the four c:ateaory. We have bad no trouble idenlifyiaa this much
work. But that is where we are, he uid, and it ia spread lbrou&hout tbe City, bued on the condition of the

put handicapped parking signs out, limited to Sunday from 8:00 a.m to 12 :00 p.m Perhaps, be suggested,
it would be possible for Council to change the Municipal Code to allow for such an exception. So, he said,
if we could consider that I would appreciate it. City Attorney Brotzman said we can bring it to a Study
Session .

use in this location and so they are not able to sell this iD accordancc with what they were wmtin& to do.

have only one recommendation for the August 24• sale , he said, if you could take about ten degrees off the
temperature, as it was pretty hot that Saturday. He thanked Council.

Mayor Bradshaw noted that some of the Council members had attended, but she had been unable to attend
as she was involved in an estate sale at her dad's house .

(a) Approval of Ordinances on First Reading
(i) Director Olson presented a recommendation from the Department of Safety
Services to adopt a bill for an ordinance amending Title 1 S-9-1 of the Englewood Municipal Code
pertaining to Hobby Vehicle Permits. He noted this bas been researched, we have talked to Council about
this and it was taken to the Code Enforcement Advisory Committee. The Conunittee's recommendation
was to eliminate the permitting and cost of permitting sections of this ordinance. He usured Council that
all other aspects of the bobby and derelict vehicle ordinance will remain in place and we will lllill enforce
it. We found it was very difficult to handle the P"flllitting process itself, be said, so this just seems lilte a
matter of convenience . But, he noted, we will still proceed ahead with what we nonmlly do.
Mayor Bradshaw asked if Council bad any questions for Director Olson.
Council Member Wolosyn said she just bad one question. In your minutes and even in your Council
Communication you talked about the language pertaining to the fee, not the permit The reaon I uk about
that is because there is the one permit that didn't ha , ea fee and the other permit that did. So, she said, I
found it to be vague, as to what they were talking about in the Committee meeting.
Director Olson said you are probably talking about the six-month permit Council Member Wolosyn said
that 's right and, also, just the fact that the Council Communication and tbe IIUJlllla of the 1 s• seem to only
strike the language of the licenaina fee, not the permit itself. Director OIIOn advised be would amend that
Council Communication.

Direc.ror Olson said if they are registered and if the vehicles are in good shape, u we found OUI rcceady,

But, Mayor Bradshaw said, it is storing it at their house that is the issue . I drove by a property today and
there were two boats, an SUV, a motor home, a tool truck ... one of those huge, big trucks.
Council Member Wolosyn asked if that wouldn't be more than one hobby vehicle . Council Member
Yurchick advised that those are not considered hobby vehicles.
Director Olson explained that a hobby vehicle is, essentially, a vehicle that is non-running, that is in a state
of repair or something like that and it may not be registered . They may be replacing the engine, it may be
missing tires, wheels and they may have it up on blocks. Mayor Bradshaw said DOW they can't have that at
all. Director Olson stated that everything that is currently in effect, remains in effect.
Council Member Yurchick asked if they could have one. Director Olson said right, that is conect. But, on
the other ones, if they are registered and they have tags and everything else, they can have them.
Mayor Bradshaw said I think we need to have something drafted. She suggested Council Member
Yurchick's group could look at this. Director Olson adviaed that it sounds like the Committee is addressing
that.
Mayor Bradshaw said okay. But what I would like to say is, that they need to be behind the 2S-foot
setback, off the street.
Council Member Yurchick said I see two issues here. One is the derelict/bobby vehicles and the olbcr is
the number oflicensed vehicles allowed at a residence. The Code Enfon:ement Committee, cunently, is
not looking at the number of licensed vehicles allowed at a residence, they are just looking at the derelict
vehicles.
Mayor Bradshaw stated I think we need to look at the number of registered vehicles.
Council Member Yurchick said that is fine, but I juat wanted you to let you know that they are DOC lookina
at that side of it right DOW.
Mayor Bradshaw said that is one of my pet peeves. I think its great when you have all these toys, she said,
I think toys are great, but I think you need to put them somewhere, inatead of parkiq them in front of your
house . We used to have an ordinance that said they could not be visible or they had to at least be 2S feet
back from the street.
Director Olson said I am not familiar with that one. As far as I know, that is not something that is in our
Code right now .
Mayor Bradshaw said I want it to be very strict, that it should be 2S feet back and they can't creep out put
the edge of the house . If they have to, they can fill their backyard with them. I don't cue, but juat get them
off the street.
Director Olson said we do enforce the RV parking restrictions and, of course, if it's a boat and trailer that 's
not hooked to anything, that is another issue entirely. We have ordinancel that address !bat, but if you are
just talking numben, we don 't have anything. He pointed out that that will probably be a relalively
controversial issue . That's fine if the Committee looks at that, he said, and -will enforce wbalever you
come up with. that's our job.
Council Member Yurchick said they did look at the RV thing and the Committee itself decided DOC to
change the existing laws. So, he said, I don't know if they are going to come back and recOIIIIIIClld these
changes or if it is something Council is going to have to take upon itself to do .
Mayor Bradshaw wd I just think we need to take a look at that, because I don't know bow imny vellitlcs •

Council Member Grazulis said you would have to determine bow many licensed driven there are. If
somebody has a large family and they arc all licensed driven they should all have a right to have one, she
said. Other than that, you would have to decide how many you want to allow over and beyond that
number.
Director Olson noted that, right now, this is all we are looking at.
Mayor Bradshaw asked if Council had any other questions . She said it sounds like Council probably needs
to look at that. Council Member Grazulis agreed.
Mayor Bradshaw asked if there was any way to find out what other cities are doing. Council Member
Wolosyn said she would like to know about that.
Mayor Bradshaw said she would lilcc to know what the surrounding cities are doing as far as enforcing that
and how they are addressing visibility and sight lines. It kills me, she said, when you can't see uound a
comer because of huge vehicles parlccd there .
Director Olson said Dave Lynn does a good job researching, so we will go ahead and research it. We arc
talking about the number or vehicles in residential areas only, not business or commercial. Is that right. he
asked . Mayor Bradshaw said that is right, residential only. She said she wanted to know about setbacks
and the maximum number of licensed vehicles allowed.
Director Olson pointed out that they will probably have to differentiate that between recreational vehicles
and all the other vehicles people have . Mayor Bradshaw said total ... licemecl recreational vehicles,
everything.
Mayor Bradshaw asked if it is legal for someone who is r.elling their boat to sit it in the front yard. Director
Olson said no , we would get on them for that The expedalioa is that Ibey would either have it in beck or
somewhere off the street where it is not visible. But if it is in front of the bouae 111d it is off the trailer 111d
not booked to anything, we would normally give them a couple of days or tine days or whatever, 111d then
we go in and take care of it.
City Manager Sean advised they will bring this information beck to Council in a Study Session. Mayor
Bradshaw said probably in August or September. Director Olton said if it is oby, Auauat will work, that
will give us time .

Council Member Yurchick said they did think about the issues on both sides of the coin. Do we enforce it
by hav mg a Code Enforcement officer write them ticket for not having a pennit? They just thought it got
too co m Heated no matter how you looked at the issue. He stated the coocept is good, but the enforcement
just seemed unmanageable.
Mayor Bradshaw said I just think it is a potential revenue stream that maybe we are getting rid of too
quickly, so I am voting against it.
Council Member Wolosyn said, for myself, I wouldn't have objections to doing away with the $100.00 . I
have objections to doing away with the pennit. Just the fact that someone has to be responsible to claim it
u a hobby vehicle and that it not just something they are not moving. 'That is my issue with it, she said,
and I am going to vote against it I think.

Mayor Bradshaw explained to Council Member Moore that Council members usually attend different
National Night Out events. Nancy Peterson gives us a schedule, she said She uked if all ofus will be
participating again.

Council Member Yurchick asked if they would be given a schedule. Mayor Bradshaw said yes.

City Manager Sears said that is actually one of the things l wanted to talk to Council about. We bad two
things on the agc1 ia next week . One was negotiations and a summary of negotiations, because we have
until July I" to come an agreement with our EEA and also our firefighters, or we go to impasse. There
were several meetings being held Wednesday . That is one of the reasons, be said, that we do need to meet
next Monday. The other item on the agenda was ACE and the business survey, but, as Council Member
Wolosyn mentioned, at their meeting they asked Council through Ms. Wolosyn. to put that off to AuguSt
5111, so they could consider that report and perhaps come back with some more specific recommendations.
City Manager Sears asked Mr. Yurchick asked ifbe had talked to any of the members about that survey.
Council Member Yurchick advised that he wasn't at the meeting, but he spoke with Jan Johnson afterwards
and she said they wanted to look at it a little more. I am comfortable with that, he said.
Mayor Bradshaw said I just didn't want them to think we were putting them off.
Council Member Y urchick said it was at their request.
City Manager Sears said we really don't have anything other than negotiations next Monday night.
Mayor Bradshaw advised Ms. Wolosyn that they would jlllt schedule her for another night. Council
Membet-Wolosyn said that sounds good. That is fine, she said, but I won't be here July 1•.
City Manager Sears said one of the other things Council bad talked about waa having a community night on
the fourth Monday. We talked about going to the Malley Center, he said, but we haven't advertised that .

Council Member Wolosyn said that would be a District 2 meeting, so I would U1111De that would be Jolm
Moore's meeting .

l . He said, just as an FYI, I am working with Gary Sean on s property at 285 and Emerson. I am
finding out that this has a lot of history, even as recently as lut August Kells Waggoner gave me some
history from when he was the Director of Public Works and having to .deal with that property. City
Manager Sears is still working on it, but there are still some decisions to make.
City Manager Sean said, as an update, Director Olson has gone out there and talked to that lady and
Director Ross has been involved in that with the Highway Department. He asked if either of them would
like to update Council right now on where we are with that property or if they just wanted to send an
updated report to City Council.
Director Olson said I went out there the other day, but I did not talk to the lady. I guess my impression was
that she wu possibly a senior citizen, but that is not the case . She's 35 yean old and appean to be in very
good health and the rationale for her not taking care of her property is not really there from a physical
standpoint. He opined that she is just protesting it in general. Our concern, be said, is if we allow her not
to take care of that property, that that will grow like wildfire to the other properties, which are taking care
of their properties right now under similar conditions.
Director Ross said Director Olson is exactly right. Alon& that Highway 285 frontage, throughout the City,
we average about 20 feet of ript-of-way outside the sidewalk area or the curb area. So when you factor
that all together, be said, that is about seven acres of land that would be added to somebody's department to
take care of. We bate to make a special exception, or open up the door, so to speak. and allow a change to
the way the ordinance is written. Director Rou adviJed that in their Jut TIP application, they requested
sidewalk along 285, which would be adjacent to Ibis property. It is very expensive sidewalk. because we
also anticipated that we had to build retainiJI& walls. If we are succcufill, and we will find out in the next
four to six weeks if we are, that mi&hl be a li&hl at the end of the twmel and it will do a lot toward making
it easier for her to care for and maintain that property.
Council Member Moore said I have looked at that area and it -to me that there is, really, only one
block, two boUICI that cu even begin to make a claim that the property is bud 1111 aaiDlain. I'm not sure
how familiar the rest of Council is wilh that area, but it is very 111eep ripl tbere. There are only two
properties, in my mind. that make ii worth discussing. which includes this pu1icular one. Maybe this is not
feasible, be said, but when I wu looking at the propcniel, I could -the pouibility of sayi_na lbete two
cross the line, in ierms of their ability to maintain their properties. It SOUDds like tbe opinion is that they do
not cross that line .
Director Olson said our cooccm is if we make one exccptioa. we've llllde tbe excepcicm. Tbe property,

to open up that gate to take responsibility for that. My opinion, he said, after looking at it, is that this
individual is capable of taking care of it, but she is just saying she is not going to do it.
Council Member Nabholz asked Council Member Moore if that area is just too steep to actually clean up.
ls it a safety hazard?
Council Member Moore advised that her argument is that it is a safety hazard. I've been there, be said, and
it is steep. But, is it too steep? I don't know. I can see her point, be said, and the interim decision of Bob
Moore was that be agreed it is too steep to maintain. So, it is at least questionable, in terms of the safety
issue. And again, be said, it is right there on 28S and from the base of the street to the slope, there is not
much. He pointed out that that would be the argument, the safety concern.

Council Member Yun:hick asked who bu the responsibility to llllin1ain the easement
City Manager Sears advised they have talked to COOT, because they have DOW come back to us regarding
the surplus property on the other side of Santa Fe . We asked them about this puticuiar ~I. They made
it very clear that COOT only maintains the highway and any adjacent property that is easement, is the
responsibility of either the homeowner or they tum it over to the City to mainlain. 'Ibey are very clear, be
said, and I am surprised that, actually, they are willing to help us out with this one endeavor.
Mayor Bradshaw commented that they are consistent on this. City Manager Sean apeed they are
consistent and by State law they have no jurisdiction to maintain !bat euement This, be noted, is a local
jurisdiction issue. The City !ms consistently enforced this • bein& adjacent to .the property and it is the
property owner's responsibility, throughout the City, to maintain it

They can improve the landscape, they can build a shed on it, bul if we need the easement, they have to take

Council Member Moore stated that the downside of these panic:u1ar propenies is there is no value afforded
to the resident because of the condition of the land. It doesn't give them more space to nm their dos, play
with their kid or plant shrubbery.
Mayor Bradshaw agreed that it doesn't. But, she pointed out, we all make adult choices wbm we buy
property. Council Member Moore said that is fair enoua)i.
Council Member Garrett said that value is included in the purcbue price. Council Member Moore said in
this case it might be considered a liability.
Council Member Moore said he just hates the fact that once apin we are takina Council's time to deal with
this. but nonetheless I didn't realize the history . I am comfortable with whatever decision we make, he
said, I just needed to address this.
Mayor Bradshaw said my concern is that I think we need to treat this citizen the way we do every other

City Manager Sears said we arc following up on this and as Director Ross said it is a long-term problem.
We really want to try and address it, he said, but unless we can get COOT to go in and do something as a
courtesy, my feeling is that we need 10 enforce it on an equal buis. That means if they fail to maintain it,
we will issue a citation and go through that process . She may be in contact with the Council or whomever,
he said, and that is her right to do that But we need to treat her like anyone else.
Council Member Moore offered bis thanks for the effort that has gone into this.
2. He asked about the status of the apartment that burned a little while back. It is still fenced and all
the burned furniture is sitting out in front of the property. I know, be said, that at least some of the clean up
can be done on that place. He wondered if tbcrc was something restricting them from enterin& the
premises.
Director Olson explained that usually we allow a certain amount of time and mostly it's because the
insurance con.,any, if they have one, has to come in and do their own investigation to make a
determination as to the cause. So we have to leave all that evidence there for them. Usually they have been
pretty good over there, he said. Since I have been here we have probably bad six fires over tbcrc that
destroyed apartments and they have generally been pretty good about getting in there pretty rapidly to
repair or rebuild the inside. But, be said, I will check on that and sec what is going on, but normally that is
the case, that the insurance con.,any bun 't cleared it yet
Council Member Moore noted the burned furniture bas been tossed outside and ii is just sitting there .
3 . He said maybe this is permissible, but there is a caq,cr shell from a pick-up truck, sitting in a
driveway on Floyd Avenue, somewhere between Downing and Lopn. He asked if that is an appropriate
storage place for a ~ shell. It may be permissible, but it is definitely an eyesore. For a wbiie there be
had a free tag stuck on it, but I guess no one took him up OD the offer.
City Manager Scars said be did not know what the Code says about that. He asked if Council Member
Moore had an address. Mr. Moore said be-uld e-mail the address toaipt ·
Director Olson said, if be is remembcrina this right, they can store them out there, but maybe that bas
changed. We will find out, be said.
4 . He said he just wanted to follow-up to the nonhwest Eqlewood question. The fim A VS property
we were talking about is not the bigger one. He uked if-that wu right. Mayor Bradshaw said ill DOI !be
three at the end, it is the one in the middle.
Council Member Moore said he wanted to make sure that Council hasn't puscd, OD the decision to look at
bwlding several houses on that larger property. Mayor Bradshaw said no .
Council Member Moore said I was thinking about it and I do remember the night of our last discuasion. I
talked to Bob S~son afterwards and I said it sounds 10 me like we just limited subdividina and be didn't
realize that we had done that. I should have followed up on that, but I actually remember no1ina that to
Director S~n and he was caught off pud. He certainly wasn't aware that it was inlmtioaal. Right
now, Mr. Moore said. we are just talkina about that kind of inner property we have .
Mayor Bradshaw said if you subdivide you can ·1 build because of the moratorium.

3. She said there is a gentleman, between Delaware and Elation Cornell, bis name is Justin Widgery
and he is a junk collector. The City's Code Enforcement Officers have cited him numerous times. He's
bringing it in by the trailer full now and be bas three homemade trailers. His house is the little white house
that sits on Cornell. right on the alley . He bas hot water beaters, dishwashers and washers. They talked to
him, she said, but I think we need to really crank up the heat and do something, because it looks really bad.
City Manager Sears asked if it was on the comer of Delaware and Elati on Cornell. Council Member
Nabbolz said yes, it is right on the alley on the north side.
13. City Maoqer'1 Report
(a) City Manager Sears asked Director Ross to come up, because there are a couple of issues
he would like to talk about. He referred Council to the handout they bad received from Mr. Ross.
Director Ross explained that at the ET AC meeting last month we were presenled with a petition signed by
the majority of residents on Galapago Street, between Eastman Avenue and Floyd Avenue, requesting
permit parking. As a result, he said, our Traffic Engineering Division will be putting up the permit parking
signs on this street tomorrow . We wanted the signs to be installed before the next Rockies business day
game, and we will have them up prior to the Yankees-Rockies game on Thursday. He pointed out that this
is another example of interdepartmental cooperation. Director Olson's Code Enforcement Group will be
distributing the flyer you see before you and the Finance Department will be administering the permits.
Council Member Moore asked if it is going to be on one or both sides of the S1l'eet Director Rou said
both sides.
Council Member Moore asked if one of these residents fails to get a permit and gets ticketed, if they will be
excused when they can prove that they are a legitimate resident Director Ross said no. We will ba~ •
two-week grace period and that's it. Director Olson's group will give them warning ticltets during that
two-week period, but after that, if they don't come in, they will be lickelEd.
Director Ross said the other issue is that Sunday wu Father's Day and because part ofDanmouth Avenue
is in the industrial part of town, my group went out and paved the busier intcncctiona alona Dartmouth,
trying to minimize the i~ct to the business conununity. He noted that the Community Development
Department bas been terrific as far as helping us work with the business group and finding out what their
needs are and communicating our paving schedule along Dartmouth. We S1arling paving Dartmouth this
week, he said, and when we are done we will be restriping it Referring to his handout, be noted that the
bottom diagram basically shows that Dartmouth is a bike route. So what we want to do, be said, is create
those sixteen foot shared lanes to make it more comfortable for people to ride their bikes on Dartmouth and
getting those people, on the western part of town, to the Platte River Trail. Then that shared tum lane will
be in the middle . He noted that at one of our business meetings we indicated our intentions and it was very
surprising, they were very much in favor of what we were doiua. They viewed it as traffic c:almin&-They
thought people were driving too fast on Dartmouth, be said, and that small aroup, at leut, wu very
supportive, which surprised me a little bit. But I just wanted to give Council a beads up about~. he said.
Council Member Yurcbick asked if they were going do the bike lane all the way from Sanla Fe . Director
Ross said no . We looked at that, he said, but we really need all thole additional lann at Sama Fe, because
that cycle on Santa Fe is so short . We are not goiua to limit the number of lanes on Sama Fe . So, be said,
our 10ten1 1s for the people who are goinil from Cushing Park, to the Platte River Trail, to ride along Little
Dry Creek. W1dcmeath Santa Fe and then come out on Platte River Drive and then go up, crou the bridge
llJld then use the Plane River Trail. So in that slffleb we are not doiua any bike lane improvemeDII on the

In response to Mayor Bradshaw, Director Ross explained that this is west of Platter River Drive, all the
way to the City limits. W c 'vc notified the City of Denver of our intention, be said, and they have given us
permission to trespass into Denver and do a little bit of striping on their side of the intersection to make it
all tie in. Then they are going to look at it and after they look into it they have indicated they might go
ahead and extend it to add Dartmouth to their bike trail system.
Council Member Yurchick said that is his concern, because coming from the west nothing feeds into it. It's
a six-block bike lane with nothing feeding into it.
Director Ross said we basically believe, with the parking constrainll at this site and with the light rail
facility, that anything we can do to encourage people not to use can to get to CityCcnlcr, that we should do
that. So we are looking at it in terms of the people who are on the west side of the Platte River. If they
want to get to either the Platte River Trail or CityCenter then we reaJly want to try to provide that
connection. We have been really hearing a lot of that during our Transportation Study work, he said, so we
are trying to respond to that.
Mayor Bradshaw said we can try it.
Council Member Yurchick asked if there will also be bike lanes across the bridge. Director Ross said no.
The Transportation Action Plan is going to recommend that we put a widened sidewalk on the south side of
Dartmouth to accommodate those needs. But at the present time people are basically using that five-foot
sidewalk along Dartmouth to get to that trail .
Council Member Yurcbick noted that is a pretty narrow strip to ride your bike on. Director Ross said
especially if you meet someone bead on, it is very narrow.
Mayor Bradshaw said it is sort of like turning left on Belleview, where I live . It gets pretty interesting
every once in awhile.
Mayor Bradshaw asked Director Ross to let Council know how thil works out. You've done a good job,
she said.
(b) City Manager Sears advised that be and Assistant City Manaacr F1abcny met with Cal
Marsella and John Clatlin this morning regarding a number of issues including the Bala Station, some of
the budgeting and where thinas are aoina 10 be with the FuTl'ICks proaram We will keep you up-to-date,
he said, with what is happenina with the Bates Station. There wi11 be a meeting coming up, probably in the
middle of July, in terms of the new facility that is being built down there. They want to have a public
meeting 10 talk about the final design and the construction co~y. We anticipate the meeting will be
held about July I 5,., but we will let Council know when that meeting is set up .
(c) City Manager Sears advised Council that we are workin& with the Humane Society.
Ass istant City Manager Flaherty is doing a lot of work with them, be said, and we have an architect 's report
that says a facility can be built on the Union Avenue property ... it would actually be on the Littleton
property. We will need the Xcel property for parking, be said. We will not totaJly move on that property
until Littleton makes a decision and we get some information back from Xcel. We hope to focus in on that
project , at a Tri-Cities meeting, in the next month or so , be said.
(d) City Manaacr Sears said we also met with COOT reprdina the land adjacenl to Santa Fe.
This is a two-acre site and, accordina to State law, they have to &JVe us an appraisal for that property. He
advised that they arc working on an appraisal of the property to brio& back to the City. We talbd to Mr.
Marsella about that as a potential parkina area . Cal Marsella is aoing to tab a look at that from the RTD
v1ewpo1m and we will come back to Council when we have more information on that. Mr. Sean adviNd

BACKGROUND, ANALYSIS, AND ALTERNAllVES 11>1:NTIFIID
The Environmental Protection Agency federal Industrial Pretreatment regulations and the 1./E
WWTP COPS permit issued by the state of Colorado required the local Pretreatment prosram to re-
evaluate the Industrial dlsch&111e local limits by the end of February 2002. The technical evaluation
was required to determine If the existing limits were protective of the plant operations, receiving
stream (Platte River), biosollds and worker health and safety. The project was completed and
submitted to EPA for approval. The attached letter from EPA Indicates the numben are technically
sound. They were offlclally effective May 31, 2002.
All industries that will be affected by the changes were notified In April 2002. They were provided
with the proposed changes and given 60 days to comment No comments were received .
The new limitations must now be amended in the Wastewater Utility Ordinance. Some of the new
limits are less restrictive than the ones currently listed In the ordinance and others are more
restrictve.

BACKGROUND, ANAL)'SIS, AND ALJflNAJMS IQfNDOED;
The Regional Transportation District (RTD) assembled land in Englewood and Denver to build a
light rail train maintenance facility and train storage yard. RTD will be buddlna their bulldlng in
Englewood immediately south of the Englewood City limits, the centerline of West Yale Avenue
extended. The City limits at Yale are also the north property line of the General Iron Worb Subdi-
vision The Building Code wiU permit the proposed buHdins in the proposed location only with the
assurances that no other building wiH be constructed within a specified distance. The Easement
provides that assurance.
As a practical matter, the maintenance facility Is surrounded on three sides with trades some that
permit the trains to access the service bays and some for overnight storqe. The location of the
tracks and required parking make it unlikely that any construction could occur In the easement
area. While the subject Easement Agreement between RTD and the City of Englewood grants
Englewood the property right that no permanent structures wiU be buHt on the easement, the
easement permits other uses including tracks, roads, slgnage, and landscaping. The easement wili
be on the Denver side of the property line and recorded in City and County of Denver as well as in
Arapahoe County.

The goal is to amend the current Englewood Municipal Code 2000 to reflect consistency with the rest of
the Englewood Municipal Code 2000.
RECOMMENDED ACTION
Staff recommends Council pass this Ordinance.
BACKGROUND, ANALYSIS, AND ALTERNATI\IES IDENTIFIED
n 1995 the Englewood City Council amended the General Penalty Section of the Municipal Code by
prohibiting a juvenile under the age of 18 years from having a jury trial. The Municipal Court does not have
the jurisdiction under the State Constitution and Statutes to imprison defendants under the age of 18 years
who are convicted of violating the Englewood Municipal Code.
' At the time of the amendment, language was left in under Tide 1, Chapter 4, Section 1 (B) of the Englewood
Municipal Code 2000, that allowed a juvenile defendant to have a jury trial for convictions which would
arise from the operation of a motor vehide. Since the Englewood Municipal Court does not have
jurisdiction to sentence juveniles to imprisonment for violations of other Municipal Code violations, it
therefore, cannot imprison those same juveniles for violations associated with the operation of a motor
vehicle.
There are no other alternatives identified.
FINANCIAL IMPACT
There is no financial impact to the City of Englewood.

Council approved Ordinance No. 36, Series 1997 creating a Concrete Utility and Concrete Utility
Enterprise Fund (EMC Chapter 8, Title 12) on May 5, 1997.
City Council has established a citywide goal to meet ADA standards for all street improvements in the
public way. City Council passed the 2002 Budget to appropriate funding for this annual program,
which was first implemented in 1996.
On March 1, 2001, Council directed staff to begin programming construction for completion of the
Sidewalk Missing Links in the City of Englewood.

• Section 11-3S.1 of the Municipal Code makes it the responsibility of every property owner to
maintain the concrete curbs, gutters, and sidewalks adjacent to their property. An option available to
property owners is to participate in the Conaete Utility. The Concrete Utility provides a funding
mechanism for concrete repair at a reasonable cost ($5 to $7 per quarter for a typical residential
property) and a convenient way to pay (96% of the fees are collected with the water and sewer bills).
The City contributes its share of the fees just like any private owner.
• For the past several years, staff has worked towards developing a Citywide Concrete Propam
addressing existing sub-standard concrete and complying with the Americans with Disabilities Act in
constructing handicap ramps. The proposed program consists of construction of approximately 75
handicap ramps in the City of Englewood each year .

The cost of these improvements are borne by the City through monies budgeted in the Public
Improvement Fund (PIF). Costs include concrete construction, incidental storm drainage construction,
administration, engineering. surveying. testing. and miscellaneous incidentals.
• In 2001, staff identified and prioritized 16 Mlulng Unb of Sidewalb in the City of Englewood.
The total cost of constructing these segments was estimated to be $1,657,000. These links represent
walks that have never been completed in a Paving District or by other means. Council concurred that
these areas do need walk and began appropriating funding in the 2001 Public Improvement Fund (PIF)
towards this goal. The segment to be constructed under this contract will be the completion of Zuni St,
east side, from the Vassar to the Colorado's Finest Alternative High School.
This year, staff has combined all three concrete projects into one bid in order to take advantage of the
economy of scale. The City of Englewood will have the option of extending this contract for up to two
additional one-year periods. With Council approval each year, this could allow the City to take
advantage of quality work and favorable prices in future years' work.
Concrete Utility 2002, Concrete Program 2002, and Sidewalk Missing Links 2002 are scheduled for
construction during the summer and fall of 2002.
FINANCIAL IMPACT
Bids were opened on June 20, 2002. Plans and Specifications were obtained by ten contractors, and
six bids were received per attached Bid Tabulation:
low bid received was $531,918.85 from Fasick Concrete Inc.
Engineer's estimate was 634,336.00
