{a) Roger Brown. 4260 South Grant Street, President of the Eaglewood Historical Society,
said he wanted to read from the minutes of the Historical Society and the City Council. On August 2, 2001,
he said, we discussed the Skerritt House and Mike Flaherty and Gary Sean talked about the estimated cost
of stabilization and rehabilitation of the Skerritt House. They talked about grant money that wu there and
the money the City has already received at this point. There wu also talk about what wu actually going to
be done to the Skerritt House with that money. The one quote that wu in here was "once this IIIIIIIC}' has
been spent, the decision has been effectively made not to demolish this house." We were told about the
research into the building, and its history, and the history of Tom Skerritt and discussed the merits of
moving, demolishing or saving the house. Basically, he noted, we had a motion at that point to support the
expenditure of the grant monies to stabilize the building and the motion wu uaaaimoualy approved. 0a
August 6•, our current vice presideal addressed Council u an unscheduled visitor and said, "we, as the
board of the Historical Society, eadone the expenditure of the City and State money to stabilize the Tom
Skerrin property. As custodians ofEngl!'wood history, he said, we view this u a prudent and desirable
action ." The reason I bring this up is be~ause last Tuesday we had our board of directon meeting again.
Instead of passing a new motion. basically restating these same things. we decided to reatTum our
commitment. We support the expenditure of these grant monies for the stabilization of the Skerritt House,
he said, we do not support a decision to demolish. He asked if there were any questions. There were none .
He thanked Council.
Mayor Bradshaw thanked Mr. Brown.
{b) Cliff Young, a teacher in Enatewood for40 yan and now living at 3120 West 3~
Avenue in Denver, noted that in 1999 the Englewood City Council purchued the home of the father of
Englewood ... the Skerritt House . We were elated because we thouabt we had dodged having a rea1tor
developer get a hold of the property and who knows what would happen to it then. I would like to address
some of the points here, he said. You have a letter from Mark Wolfe, Director of the State Historical Fund,
be said, and here are some highlights . The decision wu bal.ld on cost, that we couldn't afford to redo the
Skerritt House. I guess, fr um the historical perspective, we ask what's the cost ofpracrving Englewood's
history? The building is architecturally significant and that is from Mark Wolfe. He said yes it is. The
director has said that bis historical society has put together a million dollan for over 2000 projects and he
said the Skerritt House in Englewood fits exactly what they are looking for. So there are some funds
available above the 80,000 stabilization. We are on the local register and he says that automatically puts us
on the State register . Mr . Young stated we can also gel funds through the Department of Local Affain. So
I think we can exhaust a lot of different ways to keep the burden of restructuring this property off of City
Council and the citizens of Englewood . Mr . Young stated we feel pretty sad about demolishing the tint
primary home in Englewood because of some lead paint and waler breakage. It looks u though, when we
talk with Mark Wolfe, that the water damage is mostly cosmetic . So, he said, I would like you to take this
into consideration and maybe we need to revisit this and see what we can do. I just doo 't know how much
it will be read, if that structure is marked with a plaque . Some things that I would consider, u a teacher, is
that we don't know how that could be used right now, my sight is not that clear. There are virtual tours that
can be done with co1t11uten and things, there are things that can be done, but we doo 't really have the
technology now . Give those people a chance, fifteen or twenty yan from now, to be creative. I am
hoping that we will have the foresiabt to be creative and hold off for" little while. He ubd iftbeff were

Mayor Bradshaw apologized to Mr. Brewer for malting him wait. I am going to have Diane Wray speak
and then we will get to you, she said.
(c) Diane Wray, 3058 South Cornell Circle, said that as we all know the centennial of
Englewood is coming up next year . She stated that the centennial should not be celebrated by the
demolition of the home of our founder. It makes a DX>Ckcry of any kind of centennial celebration that could
take place in our city. As a citizen and as a member of the Englewood Historical Society, she said, I would
like to inquire into the process . From everyone I have talked to, we have been somewhat broadsided by
this decision . I would like to know the documents that served as the basis for your demolition decision. I
would like to bear described the public proces1 that supported this decision . I would like to know the status
of your plans for demolition and what the schedule for your plan ii. As part of the documents that serve as
the basis for the demolition, what are the potential sources of funds that we have? I understand that we
already have State Historical Fund monies, grant funds liom Arapahoe County and insurance money. In
other words, she said, we already have quite a body of dollars that are setting there that can he used . And
certainly we can envision a lot of other public soun:ea, u well as consideration of pro bono services liom
the community. So, first I would like to ask all of those questions and I would like to say that the Hiltorical
Society, and the people in the city that are interested in this, would like to understand this whole proceas
before any demolition takes place. Secondly, I would like ID say that I dlink the ccnrennial represents an
occasion for us to take stock of the buildings that comprise our city. The redevelopment projectl, the big
ones ... Cinderella City and the foundry project ... are well in band. They are movina forward. And, she
pointed out, if we are going to look to the future, beyond our centennial, and look at the opportunities that
we have to invest in our community, that investment ii going to take place in our homes and in our small
commercial businesses and retail strips. What I would recommend ii that we uae the occasion of the
centennial to create an historic 1U1Vey of the buiJdina IIIOck in our c:ormnunity. That as part of this
document, we create a ten-year plan. Once we lave identified our iq,orlanl hiltoric buildmp, we can
look at where we need to encourage growth. Where do we wana our ftmda to go to help our business
people and our homeowners? Or, where isn't powth wanled? Where do we wana to mainlain and where
do we have quality of life now? She opined that we need to work on mainlainiu& it, not cbanaina it These
are the kinds of decisions and the kind of forward-looking thinp, sbe, said, tbat we can understand when we
co~lete an historic architectural survey of our collllllllllity. Ms. Wray stated tbat an hiltoric preservation
conserves an important part of the planning that' 1 goina to need to start takina place in EnaJewood. She
noted Mayor Bradshaw bad talked about a buiJdina award proaram. Awards bued on maintenance are
divisive, as we saw : We beard all kinda of differena testimony about bow naJtina the awards oo the basil
of the condition of a building really set off a lot of ftres, on a lol of differenl levels. But, if we would take a
look at that whole program and consider an award based on the historic value of the building to the
community, we could have a program, co~letely voluntary, where the building owners are recognized for
the historic contribution that their properties make . And just this process of recognition, I think, will also
encourage the development of under-maintained properties. A summary of the Enalewood Hiltorica1
Society's previous book could be united into a centennial history of the City ofEnaJewood. Usina the
summary from the previous volume the Historical Society created could prove as the beadina for this
survey and we would be happy to create a subcommittee. I undcntand, she said, that there ii already an
historic preservation person on staff with the City, working 30 hours, that could pouibly be devoeed to
some aspects of it. She advised that the Englewood Historical Society would be happy to take a leadenhip
position in putting this together . I think there are plenty of ways that privale dODon and local blwinena
could be encouraged to contribute funds to the printing of a project like this, u is --1 with tbetc kinda
of ce ntcMial books that celebrate the bislory. So please, she said, I dunk tbal the Skenitt HOUie should be
saved. If the City IS incapable ofhandlin& 1t tllnnlelves. tbn we should look at -allffllllive types of
ownership or use for it. Worst-case scenario. this bousc should be boudt'd up and warebouled. She
maintained that it is invaluable to this commwuty and once it is loat it is aoae forner. This house should

there, she said, we should al least make sure that the landscaping isn't lost. That represents a valuable part
of that resource.

6 . Scheduled Vlllton
(a) Mike Brewer, representing the Englewood Masonic Lodge, 3500 South Sherman Street,
said that for those of you who are not aware of who -are, -are a charitable organization with education
as our main charity. The Englewood Lodge bu been a steady presence in the Englewood cOllllllllllity since
1926 . In the last couple of yean, be said, the Lodge bu loobd at becoming more active in the comnamity,
with direct involvement and help in the En&lewood schools. In contacting the schools a couple of years
ago, we asked them what we could do. Basically, Melanie Dressman of Maddox Elementary said we have
a tremendous need in Englewood to help the UDderprivileged kida who cannot afford to buy their own
school supplies. As a parent, I was utounded that 40% or -of the kids in the En&lewood elementary
schools didn't have pencils and paper. The Lodge put together an internal progrun IO help raise funds for
that and the first year we were able to supply Maddox Elementary underprivileged Irids with all of their
school supplies. Last year we supplied all of the underprivileged kids in the Englewood elementary schools
with their school supplies . We will do that again Ibis year. And then we asked them what can we do now.
It was brought to my attention that the school libraries were built in the 1950'1 and the boob haven't been
replaced since. So, be said, we wondered what -could do IO raise moaey to put-boob in these
libraries . The idea for a golf tournament came out of that. I am here IOllipt to ask for a couple of tbinp.
One, the Englewood Municipal GolfCounc, u far as I know, belonp IO the City ofEqlewoocl. We have
made reservations on August t 7* for 25 four-.s IO play rounds of eolf. a puaiDg eo111e11, a bole in
one ... that type ofsituation. If-could set help from tbe City of&pewood IO cover tbe com of the aolf
course, that would help us tremendously, with the proceeds going to the Englewood elementary school
libraries . Secondly, I would challenge the City Council to put together a team to play in that IOUIDamellt.
We are currently struggling to set -ah players to nme this happen and we could'* any help -can
get . We are donating all of our time and raoun:es to nme Ibis happen. be said, and any help we could set
from the City and the City Council would be deeply appreciated. He asked if bR wen: any questions. In
response to Mayor Bradshaw, Mr. Brewer advised that Aupat 17* is a Saturday.
Mayor Bradshaw asked ifhe wanted Council to defray the C9ltl of the eolfcoune. Mr. Brewer said if that
is in your power, that would be great.
Mr . Brewer said I believe the greens fees are about $50.00 a pmoo and -are cbar&in& $75 .00, $300.00
for a foursome . The profit margin, therefore , is very thin. We are buying imurance policies to cover tbe
hole in one . the idea being to give away a new car in the puttina COlllat ... tbae types oftbinp. He DOied
we are struggling 10 make those quotas. This is the first year we have pu1 Ibis oo and. with any charitable
event , there is a struggle that first year to make it happen. If-could have any reductioa in fees for the
greens fee s. he said, or donations along that line, it would help us . That, buically, would make ii easier for
us to make the money to pay the insurance policies and &ive t1IIIR proceeda to the libnry fund to add t1IIIR
books .
Mayor Bradshaw advised Mr. Brewer that Council would take it under advilement and set beck to him.

Activity Bond Cap Allocation to the Colorado Housing and Finance Authority. This item, be explained, is
a follow-up to the February 11 • Council Study Session where repreaentatives of the Colorado Housing and
Finance Authority presented a range of programs, that they were able to offer, with benefits for Englewood
residents and businesses. We also have provided information, in the put, on Metro Mayors' Cauc:ua
programs, which were an alternative use for the bond cap . Both of programs, the Metro Mayors' program
and the CHFA program, have provided housing financing. I think Council's direction, at the time of the
February meeting, was to work with CHFA if an alternative use of the bond cap didn't come forward by the
July meeting. Mr. Graham stated that the bond cap reverts to the State in September, ifno action is taken.
So, be said, this action tonight, of passing this resolution, would reserve the bond cap for use in Englewood
to provide home ownership programs.

revised, in your packet on the RTD ballot measure . She aaked if Mr. Flaherty would speak on that
Acting City Manager Flaherty said what I think the Mayors ' Caucus is requeatina, is for the municipalities
in the RTD district to prepare resolutions to support the RTD ballot measure . However, I believe this
resolution is still in process . Mayor Bradshaw said yes it is . Mr . Flaherty advised that when it is
completed, and meets the approval of the Mayon' Caucus, then we will bnng it back to Council .
Mayor Bradshaw noted it is just a heads up, for Council's information.

think it puts our kids at risk . The other thing is that I think if people have a lot of vehicles, then they should
probably be able to screen them from the front of their property and not with the blue tarp. That, sbe
pointed out, is another pet peeve I have, the blue tarp. They say they will cover it, but why not use a green
tarp? Anyway, that is a whole other issue. But I think, she said, that might be related to IIOffle of our
parking issues too, that it might go back to the family definition that we passed and I would like to have us
revisit that. Mayor Bradshaw asked if there were any questions on that, if that makes sense. I do remember
when we did that and, at the time, I thought it wu a good idea, but now I'm not sure if it wu. We can
always change our mind, she noted.
(iii) Mayor Bradshaw said the other issue sbe would like to bring up is the Skerritt
House. I don't know if Council is comfot1able talking about it at this point or not, she said.
Council Member Grazulis said I would like to put together a tour of the Skerritt House with the Englewood
Historical Society, perhaps with someone from the Colorado Historical Society and our City people. Then
we can walk through it together, discuss it together and take a look at it together. It is just my own pmonal
suggestion, she said, that we ~y put the demolishmmt of the Skerritt House on bold to try to work
out something. Perhaps we could have Ginny Steele try to put together some more ideas of bow to procure
this money that seems to be Ooating around, but is not coming to stick at the Skerritt House. There is all
this talk about all this money, lhe said.
Mayor Bradshaw said there are promises ofa lot of money.
Ms . Grazulis said that is right and if we could get some of it stick to the Skerritt House it would go a lot
further than saying it is here, u it is not really here until we get it in our.... Maybe that would help
convince us to go one way or the other, she said, and explore some oftbe poaibilities. And also, that

Council Member Wolosyn said I would like to say that the iuue is bigger thanjlllt the ratoration of the
building. I mean, it is a bigger responsibility than just a dollars thing. Historic praervation involves
education, she said, I would say.it is almost like a naiseum building. I looked at some of the old
discussions, which addressed the fact that we could never use the second floor because of the nanow
staircases and we would have to make the doors, on the ftrst floor, wider. We could never, feasibly, have a
business there and I also don't think the location lends itself to even a non-profit. There wu a comment
that it might have made a really good living history farm . She noted that that is a really big commitment to
make to a piece of property. That is really why we have been dragging our feet, because we know that it is
bigger than just fixing it and I don't know that our govemrnent bu the resources to be an biatoric
preservationist. It is hard for me to say that, but I have to say that. She opined that the idea of taking a tour
is great, but that we should all talk together about this , because it is a big thing. I heard a thing on public
radio on Saturday, on Colorado Matters, that Lakewood has tbeir 20• Century Living History Museum,
whi ch is a bunch of buildings they have been buying from throughout the State, that they are making a
commitment to restore . I just don't know if that is one of our fimctiom u a full service City . I think that
will ultimately be what we , painfully, must decide, she said.

with their youth and they even have a position to sit on Council every single week and they take it tiom
there and they take it further into their schools. I thought we might want think about taking it beyond some
of the commissions and taking it up to this level of government, abe said, because they only get to a c:er1ain
point and then we stop .
Mayor Bra~w said Susan Thornton shared with me that Littleton bas a youth commiaaion that deals with
all issues involving youth and they are advisory to Council. Maybe that ia the direction we should go,
rather than all of these liaisons. Mayor Bradshaw uked Acting City Manager Flaherty to get a hold of that
information from Susan Thornton . Mr . Flaherty said be would.

and see us . I also brought a separate flyer about the Fishing Derby, that Uncle Milty's always sponsors,
over in Progress Parle . If you haven 't been there , she said, it really is fun to watch the kids . They fish with
cane poles and Uncle Milty's always comes up with fabulous prizes. I also have parking permits for you,
so when you pull into the park you can proceed to the special permit parking area . Council is very familiar
with the number of volunteers I have, she noted, and the only way I can actually, appropriately, thank them
is to have a volunteer appreciation dinner every year . This year it is on July 10111• I am inviting all of you to
come and join us. It will be on July I 0111 from 6:00 p.m. to 8:30 p .m. at Jason Park. It will be a barbecue,
so please come and join us if you can. I have some invitations for each of you; she said. Then we go right
into National Night Out. We will have a very busy 30 days. We have National N:P.t Out T-shirts for
Council. I will bring your actual National Night Out schedule to you on August 5 , the night before
National Night Out. I heard you were all going out. National Night Out is on August 6*' and we will hold a
National Night Out kick-off party right here at the ~hitheater, on August 3N . It promises to be a great
time, she said, and I have brought you a blurb on that too, with the dates and times, so you won't have to
try to .remember all of this . Tben on August 7*' National Night Out and Parts and Recreation are joining
together to present King Lear, for a post National Night Out effort So, this covers August 3N, August 6*'
and August 1• and on August s•, when I come to you with the proclamation for National Night Out, I will
bring your party assignments. She asked if there were any questions.
Council Member Grazulis said she had one comment. When I was at CML, she said, I went to the booth
that had the National Night Out packets. I told him I was from Englewood and asked him ifhe knew
Nancy Peterson. He said I couldn't have anything, because Nancy always gets everything, as she organizes
the biggest National Night Out in the State. He said he didn't believe she has that many parties, but I
assured him you do.
Officer Peterson said that, actually, I have my trailer hooked up to the car and tomorrow afternoon, after I
complete some preparations at Cornerstone Park, I am heading down to their headquarters to pt the
packets. So I will be filling up the trailer.
Cowicil Member Grazulis said he was from the State, but I can't remember bis name. Officer Peterson said
that would be Senator Doug Linkhart. Ms. Grazulis said yes .
Officer Peterson said he has been out here and toured our City two years in a row, so he knows that we
have them.
Council Member Grazulis advised that he had said there are some cities that have zero parties for National
Night Out.
Officer Peterson stated that we have more National Night Out parties, in En&lewood, than in all of the rest
of the State put together. So we are real proud of that fict, she said. As I told you. in September of lut
year, that Englewood was the only city, in the State of Colorado, to be recoprized nationally for our
National Night Out effort.
Mayor Bradshaw said that is thanks to your efforts 100. Officer Petenon said thank you.
Council Member Grazulis said that is excellent. She thanked Officer Peterson.
Officer Peterson said she would leave all the items and she thanked Council for their time .

(i) Fire Marshal Greene presented a rec:o111111Cndation from the Department of
Safety Services to adopt a bill for an emergency ordinance amending the Englewood Municipal Code
pertaining to Fire Codes, banning the use of charcoal, gas-fueled, and other open flame cooking devices in
multi-family residential structures . He noted that we talked about this at a Study Session and Council
asked that this be brought forth as an emergency ordinance . I have identified two sections of the Code that
must be amended. We are talking about banning the use of all grills in all multi-family units that
are two or more stories in height. Charcoal would not be allowed, period. Gas fueled cookin& devices
would only be allowed on those decks that are protected by a sprinkler system. Currently, be stated, we
only have one apartment complex in Englewood that meets that critma, which is the Alexan. Beyond that,
all would be banned. One issue that has been brought up numerous times is that some apartment owners
would like to provide a grill. We have encouraged them to provide a natural gas grill or, if they are going
to provide an LP (liquid propane) type of unit, it should be in the courtyard at least ten feet away from
combustible structures. We are also putting this in the Fire Code in the specific section that talks about
charcoal grills.
Council Member Grazulis asked if this covers electric grills. Mr. Greene said no, electric grills would still
be pennitted.
Fire Marshal Greene advised that be doesn't have any documentation that electric grills would cauae
specific fires, except, perhaps during maintenance . Maintenance is also a big issue with the LP gu devices .
We don't see a lot of electric grills, be noted.
Council Member Grazulia advised that she was asked if they would be allowed. So, she noted, that would
be an alternative.
Mayor Bradshaw stated that the impetus for this legislation came from a June Study Session, but, also, we
have had two fires . She asked Mr . Greene to talk about the fires.
Fire Manbal Greene advised that recently we bad a fire that wu directly attributed to charcoal briqueaa
being left on a combustible balcony. I believe the other fire you may be referring to, wu when a
gentleman left food cooking on a stove . It wu, unfortunately, at the same complex. He pointed out that
that complex has had at least one other fire, that I am aware of, that was cauacd by charcoal briquetllll. All
of their losses were considerable.
Mayor Bradshaw thanked him for all bis work. You ha'lle been very respoasive, she said, and l appreciate
it.

Code that prohibits the Court from sendina juvenilea to jail ror traffic inhc:tions. That ia not allowed by
law. So, be aaid, our recommendation ia that we remove that section from our Code .

hope we can save money managing these; we have actually placed all three concrete programs in one
concrete construction account. They are the Concrete Utility, the Concrete Program. which is the program
where we build all of our handicapped ramps, and the new program that was initiated in 200 I, which is
called the Sidewalk Missing Links Program. The plan would be that we could manage these programs
more cost effectively. We are also doing something else with this contract that we haven't done in the past.
And, be noted, be worked with City Attorney Brotzman on this. There is a provision in this conttact that
would allow us, for the next two years, with Council's approval each year, to extend these contracts for
additional years. So if we are satisfied with the price, the quality of work, and the performance of the
contractor, then we would have the opportunity to extend this contract, which would be a cost saving
measure for future years . I have given you a breakdown of the three programs, be said. The Concrete
Utility construction is $509,473.00, which is funded through the Concrete Utility Program. The Concrete
Program, where we construct handicapped ramps, has $104,475 .00 in it. We anticipate that that is enough
money to do about 75 ramps this year. I was talking to staff today, he said, and it is interesting to note, that
we have completed about 1,771 ramps, out of2,SOO in the City, over the laat several years. At this rate, we
still have about ten years to go, but we are probably far ahead of most municipalities in Colorado. So, he
opined, we have done really, really well in that area. The third concrete program is Sidewalk Missing
Links. We are anticipating doing some sidewalk up on Zuni, near the Alternative Hip School. We tried to
get that done last year, be said, but Xcel was slow in moving some power poles. The other thing we have
done, as budget saving matter, is that we have a couple of other programs, TEA 21 programs through
DRCOG, for Belleview sidewalks and for some sidewalks on Univenity and we will have a match with
that. So, be said, what we are recommending is that we will spend about $60,000.00 on the Zuni sidewalks
and the balance of that money will be applied towards our match for those TEA 21 programs. We will start
the engineering on those this year and those will be constructed next year. I will still have to budget a little
bit more for 2003 , he said.
Mayor Bradshaw said the Zuni sidewalks will provide a place for kids to stand while they are waiting for
the bus to get there to pick them up. Director Kabm said absolutely, this is a much-needed improvement up
there.
Director Kabm noted that we will start designing the TEA 21 progru111 this year and cODltlUCtion will take
place in 2003 .
Director Kabm advised that the low bidder on this project was Fasick Concrete, Inc. This company has
been around for several years. We don't have any direct experience with them, be said, but -checked
their references and this put year they have done similar projects in Lakewood, Denver and Golden. In
fact, be said, in Denver they worked on projects two year.; in a row. They came well recommended from
all these cities, so we feel they will be able to do a satisfactory job for us . If Council bas any questions, be
said, I will be happy to answer them.
Council Member Grazulis said you did say that by putting all this Wider one umbrella, there would be a
cost savings. Do you know approximately bow much, she uked. Director K.abm explained that uytime
we put a project out to bid, we have to go throua)i the same proceu, whether it is a fifty tbouland dollar
project or a million dollar project, in terms of putting together plllls and specs and doina all the advertisina.
So we have done that in one package instead of three . Again. be said, if ii works out well this year. and we
arc satisfied. we could probably not do that next year and lbe next year. So, be DOllld, the aavinp is in the
thousands of dollan.

Council Member Yurchick said be just bad a quick question. I am not familiar with bow this works, he
noted . For the $531,918.85, have they identified specific segments that are to be done or do they just do up
to $531,918 .85 worth of work? Director Kabrn said that is a good question. He explained that with the
Utility we have gone out and inventoried most of the City. The Concrete Utility Program is a program that,
by ordinance, everybody in the City is responsible for adjacent sidewalk, curb and gutter. If you belong to
the Utility then you pay a fee along with your water bill and we have always called it an insurance, but it is
an alternate way of financing this work. Our staff bas gone out, inventoried the City and rated all the
concrete on a one to ten scale . When we tint started the program, and I thinlt Ibis is our fifth year, we did
the fives and sixes. This was concrete where we bad three and four inches of vertical displacement or
severe spalling. now we are down in the four category. We have bad no trouble identifying Ibis much
work . But that is where we are, he said, and it is spread throughout the City, based on the condition of the
concrete .
So, Council Member Yurcbick said, we are buying a specific amounl Director Kahm said yes.

(i) Council Member Moore advised that a church on Acoma asked to be allowed to
put handicapped parking signs out, limited to Sunday from 8:00 a.m. to 12:00 p.m. Perhaps, he suggested,
it would be possible for Council to change the Municipal Code to allow for such an exception. So, be said,
if we could consider that I would appreciate it. City Attorney Brotzman said we can bring it to a Study
Session.

I. He noted that in Council's packet there was a letter that was received from some citizens inquiring
about a duplex in R-1 A, down by Belleview Park. I wu told that a letter may have already been sent out.
Mayor Bradshaw said she thought the letter wu sent out by Tricia Langon and it wu in Council's packet
last time. She asked who the letter wu sent to.
Council Member Garrett advised Director Simpson that Council had received a letter from Clyde and Ruth
Wiggin, regarding a possible duplex. It is my undcntandiq that a letter wu sent out addreaaina that. I
received the question, he said, but I never received the anawer in my packet
Director Simpson asked Mr. Garrett for a quick update about what the question ia.
Council Member Garrett said this is about the duplex that wu advertised in R-1-A .
Director Simpson said yes, I remember this . A duplex wu advertised in an R-1-A diatrict 111d this petition
came fomard to us. We sent out a zoning notification to them stating that this wu clearly not a permitted
use in this location and so they are not able to sell this in accordance with what they wen: WUlliaa to do.
We appreciate the petition, he said, but it wasn't necessary.
Mayor Bradshaw asked if the neighbors have been informed. Director Simploo uid ya they have.

of the issues of stabilization and parltina here at CityCenter we weren't able to get that settled. We hope to
work through most of those contractual issues and have a Farmer's Market here, and operating, by next
summer. He noted that will also add that kind of Saturday morning activity level, that kind of coffee,
culrure dung, 10 CityCenter.
Council Member Yurchick said he thou&ht we had a Farmer's Market here ooe weekend.
Director Simpson said yes we did. We weR aoina to hold it here at CityCemer, but apin. becaUle of_
of the issues that we are still dealing with, we moved it off-site over to Little Dry Creek. However, be said,

Director Kahm advised that when they were open to the public , our agreement was that would end their

4. She asked what the City of Englewood policy is regarding obstructing traffic on Broadway, when
they are getting tracior trailers into businesses . At leut once or twice a week, she said, the driver gets out
of the truck ... there are two drivers ... and they stop traffic and it usually backs up about three blocks while
they tum the tractor trailer around. It is a business in about the 4 700 block. I will get the exact address. If
that is the only way they can get that in there, then I guess that's one way, but it is always between 8:00
a.m and 8:30 a .m , which, to me, is kind of a bad time .
City Manager Sears said the only thing is that we could possibly talk to the people about changing the time.
Council Member Grazulis said change it to just a little later, rather than l'lllh hour. Durina school time it
bas always been bad and I decided to see bow it goes after school time, but it just kaeps going on.
City Manager Sears asked if she could identify the store . Ms . Grazulis said sbe would get the exact
location.
5. Sbe said she just wanted to let Council know that she bad a call yesterday from a lady and sbe just
bas one cat, but she still bu a lot of issues with govemment telling us bow many mimals we can have .
6. She said she was reading in the ACE minutes about coming up with a weeklong activity such aa
the Littleton Western Week. Ms . Grazulis asked if that waa for next year.
Council Member Yurcbick said they were talking about doing something mme in conjunction with like the
Olde Tyme Fair and moving it more into the business district.
Council Member Grazulis said there was also a suggestion to make it a weeklona affair and I thought if we
make it a weeklong then we should mau sure it is different from Littleton's. That is my only sugestion
for that, she said, I just like to put my two cenlB worth in.
7. She said last evening I was with my dauahter at a grocery store at Dry Creek and University and
we were in line and the people behind us were joking about Cinderella City. They were saying that it wu
still up. We were doing a slow burn, sbe said, and I fiDally bad to tum uouad and uy some nice words
about their education and about bow they really should come down and -it. Apparently, she said, 01D'
education bu not gone beyond our boundaries a lot in certain area. They bad no idea about the
redevelopment.
(iv) Council Member Yurcbick advised that be would not be here July is• for Study
Session and he may not make the Council meeting . I will be in Phoenix, he said, and it depends on when
my plane gets in .

l. Inuoduction: P;u:tjes and Purposes.
Centennial Water and Sanitation District (Centennial) owns reusable return flows to the
South Plane River which consist of Centennial' s reusable warer discharged by Centennial' s Marcy
Gulch wastewater treatment plant (the return flows). The City of Englewood (Englewood) has a
means to re-di vett the return flows at Union A venue, and either retain them l'or use by Englewood or
redeliver same to Centennial. The parties intend that Englewood shall anempt to divert the return
flows, under the circumstances set forth below. and pay Centennial for the return flows if same an:
retained by Englewood: and that Centennial will pay Englewood for re-directing the return flows, if
same are redelivered to Centennial. It is anticipated that Englewood will aaempt to divert the return
flows at its L'nion Avenue pump station. and either use same immediately in its Allen Tre:itment

Centennial will advise Englewood. on a daily basis. of the amount of available return flows at
Englewood's t.:mon ,\ venue pump station. Englewood will advise Centennial, on a daily buis, of
available return tlows Englewood will not be diverting.
3. Englewood to .-\nempt to Oi\'ert
Englewood will make re:15onable efforts to lawfully divert the return flows at its Union
Avenue pump st:ition. Englewood shall have no oblig:i.tion to divert: a) if diversion would impair
the necessary quality of water inuoduced into Englewood's w:uer tre:itment plant or inaoduced into
City Ditch for ;:<change. as determined in Englewood's sole discretion; b) except to the extent that
Englewood determines to use the return flows immedi:i.tely in its Allen Treannent Plant, plus the
exchange capacity in City DHch: c) to the e:ttent that the capacity in Englewood's pumping system
after supplying Englewood·s demand is less than :>.II of the available return flows. Englewood shall
have no obligauon to use the return tlows immediately in its Allen Tre:mnent Plant. While
Englewood shall make reason:i.ble efforts to divert the nm1m flows. the parties recognize dw various
factors may make diversion imprai:ticll. and Englewood shall have no liability to Centennial for
failure to divert. Englewood will account for return tlows diverted at its Union Avenue pump
station .

5. Englewood'5 Option to Acquire Return Flows Deljvered to McLcl1an Reservoir.
Englewood will account for the return flows delivered by exchange to Mclellan Reservoir.
Englewood will have the option to acquire the return flows delivered to Mclellan Reservoir (and
Englewood will acquire any return flows used immediately in Englewood's Allen Treatment Plant).
Within four days after the end of each week (ending Saturday at midnight) Englewood will notify
Centennial if it wishes to acquire all of the return flows delivered to Mclellan during that week.
Englewood will pay Centennial S85 per xre foot for 311 of the return flows which it xquires, and
pay the pumping costs associated with those return flows. Return flows so acquired by Englewood
shall be treated 3S Englewood's water for all purposes, and may be used by Englewood or delivered
to CenteMial under any ~ment between Englewood and Centennial.. Return flows delivered to
Mclellan 3S to which Englewood does not give such notice shall belong to Centennial.

Englewood currently injects gr.inular xtivatedcarbon (GAC) into the forebay :idjacent to the
South Plane R1 ver. from which Englewood':; Union Avenue pumping station pumps warer to the
Allen Tre:itment Plant facilities . {The GAC is injected because of the cutTCnt severe quality
problems in the South Pl:ine River.) The water containing the GAC is blackened in color md
therefore cannot be directly introduced into City Ditch for e:\change purposes. Therefore. a
substitute :.upply of cle:ir water to be e:\changed up City Ditch must be pumped into City Ditch from
a forebay reservoir adjacent to the Allen Treatment Plant (not to be confused with the foriebay at the
riverJ . (Pumping of this substitute supply will be unnecessary if the GAC injection at the river
forebay should cease.) Englewood has n~ pump :ind pipe to accomplish the pumping of this
substitute supply from the forebay reservoir. Centennial will provide md install such a pump and
pipe. :ind hook it up to a power source . at Centennial' s sole expense. Englewood and Centennial will
cooperate in determining the location. nature and installation of the pump :ind pipe . At the end of
this :igreement. Centennial will remove the pump. pipe and power hookup at Ccntennial's sole
expense. unless the parties otherwise .1gree . Centennial will restore any excavation or alter:1tion of
the forcbay :md surrounding are:is. at Centennial's sole expense .

EASEMENT AGREEMENT
This easement is granted this __ day of ___ , 2002 between the Regional
Transportation District (GrantorJ whose address is 1600 Blake Street, Denver, CO 80202,
attention, Director, Planning and Development, and the City of Englewood (Grantee),
whose address is 1000 Englewood Parkway, Englewood, CO 80110, attention, City
Manager, CO on the property (the property) described as follows:
Sec Exhibit A, attached.
Grantee, its heirs, successors and assigns shall be entitled to open space and absence of
constructed improvements on the surface of property. Said casement shall run with the
land and is for the use and benefit of Grantee to ensure adequate setback from
improvements on Grantor's property to Grantee's streets and roadways.
Granter retains all subsurface rights of use on said easement, all rights of access and
egress over and across said casement, md the right to place plants or landscaping
materials, signs, markings, and non-permanent structures over on and across said
easement. Grantor retains all rights of use and ownership not inconsistent with Grantee's
right to open space md the absence of permanent constructed improvements.

Water Board policy regarding an equitable method of computing taps for hotels were established at the
August 13, 1996 meeting. The policy was amended by Council on May 7, 2001 to change the maximum
daily consumption from being based on 100 gallons per occupied room to 100 gaffons per day times the
total number of sewer taps purchased under this agreement

Den Mar has submitted for Council approval a Hotel Sewer Tap Agreement for their proposed 278-unit
hotel to be built at 10325 Park Meadows Drive in Utdeton.
The proposed agreement has been reviewed and approved by Englewood's City Attorney.
' FINANCIAL IMPACT
The proposed agreement would set the sewer tap fees at half the standard fee, with no additional tap fees
to be collected unless the water usage exceeds the agreed upon limit of 100 gallons per unit. per day. Tap
fees in the agreement total $208,512.50.

WHEREAS, Oen Mar requested a reduction in Nwer tap feea becauae they believe their

WHEREAS. the standard tap fee ii b&Nd on a normal Oow of two hundred (200) pllons
per day and Oen Mar estimates that their per unit flow ii no more than one hundred (100)
pllona per day.
NOW THEREFORE the Partiee asree u follow,:
1. The City will sell 278 sewer taps for itl Hot.el unitl at one half the ltandard sewer
r harge, based on their estimate of no more than 100 pllona per day per occupied unit
real flow . Thia i8 a minimum charp and in no event will the bBN tap fee be le18 than
one-half (1/2) the standard sewer charp.
2. The initial tap payment to the City by Oen Mar will be $194,600, for Enalewoocl tap
fees; $12.50 for the permit, and a Bis Ory Creek Interceptor Buin Charp of
$13,900.00, for a total of 1208,512.50.
3. Den Mar will iaaue an irrevocable, atand-by letter of credit in the amount of
$208,500.00, which will be used for any additional tap feea. Thia letter of credit will
be held by the City for tap fees aa required punuant to thil A,reement.
4. The City will monitor winter (November 1 throup April 30), bi-monthly water uaap
at the Hotel during a five (5) year period. Durinc that time, Oen Mar will monitor
water consumption on a daily buil. Oen Mar will furniah the City with a report on
daily water consumption and the number of rooma occupied on the correaponding days.
They will submit the report to the City on a monthly buil.
5. If at any time during the five (5) year period, the daily, per unit conaumption aoe• over
one-hundred (100) gallons per day, Oen Mar will pay the additional tap fee owed. If
the fee is not paid within sixty (60) days, the City will make periodic drawa on Oen
Mar letter of credit to pay to the City additional •-r tap feel baaed on the amount of
flow in excess of one hundred (100) callona per day u billed by the City of Englewood.
If Den Mar's daily, per unit usage ii leea than one hundred (100) pllona per day, the
City will not owe Den Mar any refund.

6. Additional sewer tap fees will be computed on the buil or two hundred (200) pllom
per day bein( equal to a tap fee of $1 ,500.00. A. an example, if the uup pa over
one hundred (100) pllona per day by five (5) pllom per day, then five (5),pllom per
day iB two and one-half percent (2 1/2") of the two hundred (200) pllom per day, two
and one-half percent (2 1/2%) of one thouaand tive hundred dollan ($1,500) ii thirty.

total tap fees exceed one maximum tap fee per unit.
7. However. should additional units be added to the project at any time, the tap fees
shall be increaaed by the number of additional unite. Uthe unite are added after the
tive (5) year period duc:ribed in paragraph 5 abov9, or after a ba.l bue line for tap
feea baa been reached, the tap fee, for tha new unite will be tha Ame u the tina1 tap
feee for the original unite.
8 . Any accidental diac:harp of metered water of an unuaual and DOD•recurriq nature
where the City ii notified within 24 hours of diacharp and Den Mar provide,
documentation of the nature and extent of the diacharp may be escluded from the
calculation of the tap fees. The tilling of a awimmin( pool will not be considered an
accidental discharge under this paragraph.
9. At the end of tive (5) years or on the date on which Den Mar bu paid the additional
sewer tap fee, UIIOCiated with an iDc:reaN in the bueline for tap feel to 200 p1lom
per day per unit, whichever event ,hall occur &rat, the letter of eredit may be
withdrawn and the City will no lonpr monitor water uaap eia:.pt for mrma1, annual

10. Any additional tap fees paid purauant to thia agreement are tap fea only and ahall
not be conaidered sewer treatment charges. Any money owed the City under thia
Agreement is a fee for the sewer tap.
11 . The City and/or its auditor maintaina the right to enter the property to examine the
water use records, the hotel occupancy records and to check water meter readinp.
12. Den Mar gives the City the right to diBCOnnect the hotel for nonpayment of any tap fee,
or sewer treatment fees due the City .
13 . This Agreement shall not be auigned by any party without the prior written conaent
of the other and this agreement shall be binding on any 1ucce1BOra or auicnee1.
14 . Den Mar confirms it has 278 units in thia Hotel and qreea that it shall not add
additional hotel unita to the City of Englewood's aewer ayatem without written
approval of the City.

City staff believes that Neve's is the only contractor that can provide adequate seivlces and products that
meet City requirements. Past experience with other bidders has not yielded adequate service and products

Neve's has held their past price increases to a low level and should increase their prices for 2003, 2004,
and 2005 based on Government National averages of three to four percent per year.

BACKGROUND, ANALYSIS, AND ALJERNAJMS IDENTIFIED;
Englewood first became an entitlement community for a Private Activity Bond (PAS) Allocation In
2002 with the State's decision to include all cities over $1 million in PAI allocadon. Before this
year, Englewood was eligible to request a PAB allocation from the statewide pool managed by the
Colorado Department of Local Affairs (DOLA).
Council met with Colorado Housing Finance Authority (CHFA) representatives at the February 11
Study Session to discuss PAB options including affordable housing, home ownership and business

FINANCIAL IMPACT;
The Resolution assigns Englewood's entire 2002 PAB Bond Ceiling Allocation, St, 189,763, to
CHAFA for Home Ownership programs . If the Council takes no action, the Bond Cap reverts to
the Colorado Department of Local Affairs by staMe, for assignment to eligible state agencies.

WHEREAS, the City of Englewood, Colorado ill authorized and empowered under the
laws of the Stat.e of Colorado to issue revenue bonds for the plUpON of pruvidinc BiD&:le-
family mortgage loana to low and moderat.e income peraona and families; and
WHEREAS, the Int.ernal Revenue Code of 1986, as amended reatricta the amount of tax•
exempt bonds which may be issued in the Stat.e to provide ew:h mortpp 1oana and for
certain other purpoeee; and
WHEREAS, pureuant to the Code, the Colorado legislature adoptlld the Colorado Privat.e
Activity Bond Ceiling Allocation Act, Part 17 of Article 24, Colorado Reviaed Statut.es (the
"Allocation Actj, providing for the allocation of the State Ceiling among the Colorado
Houeing and Finance Authority ("Authority") and other governmental unite in the State, and
further providing for the a88ignment of such allocations from auch other governmental unite
to the Authority; and
WHEREAS, pureuant to an allocation under Section 24-32-1706 of the Allocation Act, the
City of Englewood, Colorado bas an allocation of the 2002 State Ceiling for the issuance of a
specified principal amount of Private Activity Bonds prior to September 15, 2002; and
WHEREAS, the City of Englewood, Colorado has determined that the 2002 Allocation, or
a portion ther:eof, can be utilized moet efficiently by aNigning it to the Authority to iNue
Private Activity Bonds for the p~ of providing lingle-family mortpp 1oana to low and
moderat.e income penons and families; and
WHEREAS, the City Council of the City of Englewood bas determined to uaip
$1,189,763.00 of its 2002 Allocation to the Authority, which allignment ia to be evidenced
by an Assignment of Allocation between the City of Englewood and the Autbomy;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, THAT:
Section 1. The auignment to the Authority for Sl, 189,763.00 of the City al Englewood,
Colorado's 2002 Allocation ahall be and hereby ill approved.
