Huron Street. He statal the reason be is here is tbat in the past they have used Centennial Park Lake for
their canoe training. They do a higb advenlllre trip every year and they uain their new scouts at the lake .
In return, be advised, they pick up the trash -tbly. They keep it clean and picked up, he said.
Mayor Bums asked, if they are going to continue to be allowed to use the lake, if they need a motion. City
Attorney Brotzman advilell tbal if Council so desires they will bring the agreement back to Council at the

Director Gryglewicz advised that no City funds can be expended without Council approval and what will
happen often times during the year, for one reason or another, somedling out of the ordinary will come up .
Like in the cue of the lltOroey fees for the EURA lawsuit, that was not budgeted. Theo at the end of the
year if the City bas spenl more -will do a suppk:mmlal to clear all those up . Mr. Gryglewicz noted that
we do them periodically tbraugb the year as well . 1bcse aR the funds that were over, for one reason or
another. or there were fimdl budgeted in ooe year and then they were DO( budgeted in the following year,
because they weren't known at the time the budget documeol was put together. This just allows us to
comply with the City Cblncr.
Director Gryglewicz asked if there MR any questions regarding specific items in the resolution.
Mayor Bums commented that the Chartel' requires that we do DO( exceed legally adopted appropriations
without the supplemealal . Direclor Glyglewicz aid that is true and all funds that arc expended arc done by
Council action, they can't be cxpcndcd witboul Council approval. Either by ordinance, or by resolution in
the case of a supplemental.

stiffen if the reason for that was that they do not have express fares on their bus lines and her answer was
yes . So, be said, RID backed tbcmscMs into a corner by having an express route on the bus lines, which
they then bad to duplicate oo the ligbl rail or be subject to charges of discrimination . However, he was
assured that they arc going through a complete review of their rate structure at RID and he suggested that
the public might be willing to accq,t the fact that they may raise the rate a litde bit, but make it uniform so
you don't have this problem. So they are going to ooosider that. But indeed. he said, the reason why they
were son of hoisted on their own petard was because they set up this situalion with their different structure

those rcsuoom needs will have to be aa:ommodalcd. Public Works has asked thaa MOA accommodate
those needs in the core of the building. basically to minimize construction iSIUCS and delays . Mr. Flaherty
said the third thing that came to ligbl that MOA was DOI aware of, apparently , is that the City Attorney has
an access from the Slairs that go from the third floor to the second Ooor to access the courts. For some
reason. and Mr. Flaherty was DOI sure why , MOA does not want the City Attorney in their space . They had
not planned on tbal access in their original design. and that. basically, costs them about 600 square feet of
space that is no longer uable to them. The overall request that MOA has right now , he said. is to increase
their space allocation from approximalcly 7,500 square feet to approximately 9,400 square feet. The
largest portion of that expansion is the additi-1 studio space that they wish to build out. he said. They are
prepared to move forward with a plan that the City wiJI have final approval of, and they are prepared to
fully fund the full space lhll they would be building. They are DOI asking for additional appropriations or
any additional real benefits from the City, bul they believe that they can fully utiliz.e that space and build ir
out at their sole expense:. 1bal would leave a space remaining. he explained, for potential uses or users of
about 4,000 square feet, so it is a nice si7.e space that remains available, but ii is not the 7,500 square feet
David Taylor initially bad planned for his IIIC. Rodney Lootine asked that Mr. Flaherty present this

Mayor Burns said Ms . Leibler bad told him last week tbat they bad planned to share some space with David
Taylor anyway, so they were actually planning on more usable space than 7,500 square feet . Mr . Flaherty
said yes, that is aa:uraie. Tbe combination of factors, the additional space for restrooms. the space tbat
they could DOI USC because of the City Attorney's access. and the space that they bad planned to utilize wilh
David Taylor, really is about 1,900 square feet ditrcreoce from the origioal plan, but tbat did not lake into
consideration what they were going to shin: with David Taylor. Mr. Lontinc also said today tbat they
would be amenable to sharing of certain facilities in their space with other users on tbat floor. he advised .
For example, and clearty we are DOI going to have a dance use. but if there is an opponuniry for aoolher use

amenable to that. as well as potcDtial sharing of a conference room. They want to work wilh us and arc

we would participaae with MOA. They would pay for one third of the common aRa finish. Ms . Bradshaw
said Ihm we will be picking up two thirds. Mr. F1ahc:ny said unless there w.is a second tenant Ms .
Bradshaw asked if there was a second uscr out thc:rc. Mr. Flabcny said be had not identified one . and his
guess was that there were those who were interesled, including City departments that may have an interest
in tbal area.
Council Member Garrett recalled tbat Mr. Flaherty said they would take the additional space without any
additional cost to the City. By taking additional space, the ratios change, so by definition they should pick
up mon: than a third of the cost of the bathrooms. He asked if tbat w.is being contemplated. Mr. Flaheny
said we have not discussed that with them. Essentially, at this point in time, their contract states that they
will pay for one third, not to exceed one third, of that cost, but we do need to make a conttact amendment if
we allow them additional use . Thal is something that we could certainly negotiate. Mr. Garrett said we
have to realiz.e tbat our subsidy for the CAM charges will also go up proportionally. Depending on bow
this comes out. and bow it is configured. we nccd to have 4 ,000 square feet that is usable for some other
tenant. be said. Also, Mr. Gamtt said. the ncm<XC!usive right to that SIUdio and tbat conference room
would be very impor1alll to him. so that tbc:y an: 11111 giving away space and. other than those kinds of

agreement. He asked if tbc:y were going to include tbcle build-out costs in that formula. Mr. Flahen y said
they had not rcquesled that • this point, and we have not offered.
Mayor Burns asked if tbc:y just wanted a comensus this evening to proceed with this. City Manager Scars
said be w.is not rcilly iDICl'CSled in a molion. We would like to negotiale some of the points. he said. and
then bring this back to the Council so tbc:y could ac:tually take a look at il The onl y n:aJ bind. he felt. was
the plumbing. which is where we an: at in the project right now . What we would rcilly like. he said. is a
feeling that at least Council is intcrc:sted under certain terms that maybe we could move ahead. and if that is
the best we can give to them and tbat is the consensus, we will take that back and see if we can work
through the terms with them. Mr. Sears said be rcilly appm:iated the feedback from Council and both be

Official Posting Place for all notices of the City of Englewood .

The OPEN MEETINGS LAW , State Statute§ 24-6-402 (2) (c) requires that "a local public body
shall be deemed to have given full and timely notice if the notice of the meeting is posted in a
designated public place within the boundaries of the local public body no less than twenty-four
hours prior to the holding of the meeting . The public place or places for posting such notice
shall be designated annually at the local public body's first regular meeting of each calendar
year ."

WHEREAS , the City Council of the City of Englewood approved the passage of Resolution
No. 40, Series of 1996 -"Establishmg Fee Schedules for Water Service ; and
WHEREAS , Resolution No. 40 , 1996, established a fee sc hedule for flat rate and metered
water; and
WHEREAS , Resolution No. 40 , 1996 incorrectly listed the minimum quarterly ch a rge for
a 3/4" meter ae $4 .78 : and
WHEREAS , the passage of this Resolution will correct the amount to $4.49 for a 3/4'"
meter;
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNC IL OF THE C ITY OF

RECOMMENDED ACTION
Council approval , by Resolution , of the recommended change to Resolution 40, Series 1996.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The original Resolution was passed March 18, 1996, establishing a fee schedule for flat rate
and metered water. The minimum quarterly charge for a 3A " meter was erroneously listed as
$4 .78 . The proposed correction would state the accurate amount of $4 .49 minimum for a 3A"
meter.
Water customers have been billed the correct amount all along; the recommended correction
would reflect what has been used for billing computations. No billing adjustments of any kind
will be required . The only error was in the original resolution .

\\"HEREAS , Resolution No. 66, Series of 1989 was the last water rate increase; and
·wHEREAS , the proposed increase provides revenues to build facilities needed to meet future
federal requirements and provide additional treatment plant improvements for the removal of
certain pathogens; and
WHEREAS, changes in federal regulations and the increasing threat of giardia and
cryptosporidium contamination have made it necessary for the City to add additional treatment
processes to its water treatment plant; and
WHEREAS , the Allen Plant is currently operating at its optimal efficiency, but it may not meet
the new requirements; and
WHEREAS, along with increasing the safety of the treated water, the upgrades may also
improve the taste and odor of the water; and
WHEREAS, the City also would like to start a program to clean and improve the water mains in
the streets of Englewood and to increase it's raw water supply; and
WHEREAS, a rate increase is necessary to fund these improvements ; and
WHEREAS, the proposed increase in water services charges are 9.0% on July l , 1996, 9.0% on
Januar/ 1, 1997 , 8.0% on January 1, 1998 and 8 .0% on January l, 1999; and
WHEREAS , the Englewood Water and Sewer Board recommended, at their March 12 , 1996
meeting, approval of the proposed resolution which increases water rates to fund a major capital
improvement program ;
NOW , THEREFORE. BE IT RESOLVED BY THE CITY CotJNCIL OF THE CITY OF
ENGLEWOOD , COLORADO, THAT :

States Pipe in the amount of $204,750.28
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Utilities Department is requesting approval to purchase 5 ,051 feet of 30" PVC pipe and )
fittings for piping the McBroom Ditch from the Bear Creek Filter Plant to the Union Avenue
Pump Station. Piping this section of ditch would enable Englewood to use water rights on
Bear Creek at the Allen Filter Plant. This affords the Allen Filter Plant an alternate source of
water supply to the South Platte River.
FINANCIAL IMPACT
Request for Bids were sent to four vendors , with three companies responding with bids. A bid
opening was held on December 17, 1999 and the following bids were received:

Mountain States Pipe was the recommended low bidder at $204 ,750 .28 . Englewood's
technical engineer has recommended acceptance of the low bidder, Ferguson Enterprises.
The Utilities Department allocated $300,000.00 in the 2000 Budget for this project. This
money was budgeted under #09-03-43111. The remaining $100,000 will be used for
purchasing additional pipe in 2000 for the remainder of the McBroom Ditch project that will
span from Bear Creek to S . Clay Street.

Council approval, by MOllan. of the bid for the rehabilitation of the Sherman elevated water
storage tank .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Sherman tank is a 200,000-gallon tank that was put on-line in the spring of 1982 and
serves the southeast portion of Englewood . Earlier this year, the tank was inspected and
revealed the beginning of corrosion .
As part of the proposed tank rehabilitation project, the tank interior will be sandblasted ,
corrosion spots welded and repaired , the interior painted and a Cathodic protection system
applied . Also, as part of the project, the sonic level probe, photocell and lightbulbs will be
replaced. These preventative measures will extend the life of the tank .
The contractor is allowed a maximum of 35 days to complete the project. Variable frequency
drive pumps from the Allen Filter Plant will supply alternative water pressure in a closed-loop
system .
Requests for Bids were picked up by 14 vendors for the Sherman Elevated Water Storage
Tank Rehabilitation .

BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
In 1988, representatives of Boy Scout Troop No. 92 requested permission to use the
lake at Centennial Park for the purpose of training their Scouts in canoe handling. Since
boating of any kind is not permitted in Englewood lakes and ponds, a nonexclusive
Private License was created by the City Attomey's office to allow use of Centennial Park
Lake by Boy Scout Troop No. 92 for a period of three months. Proper supervision of the
activity and public liability insurance are required terms of the license .
FINANCIAL IMPACT
There is no financial impact to the City of Englewood.

THIS GRANT of a nonexclusive private license to BOY SCOUTS OF AMERICA TROOP
NO . 92 (Grantee) by the CITY OF ENGLEWOOD, COLORADO to occupy and utilize
certain public property known as Centennial Park Lake , withm the limits hereinafter mor e
fully described , for the purpose of Boy Scouts of America Troop No. 92 canoe handling
education; providing for the terms and conditions ofthis License: and prov1ding for the
compensation to be paid to the City of Englewood.
1 . A private License is hereby granted to Boy Scouts of America Troop No. 92 . to occ upy ,
maintain and utilize public property known as Centennial Park Lake.
2 . This license is granted for a term of three months and those additional days n ecessa ry
for lake clean-up purposes unless sooner terminated according t o othe r t e rm s a nd
provisions herem contained.
3 . Boy Scouts of America Troop No . 92 shall pay the City of Englewood the s um of Te n
Dollars ($10.00) for the license herein granted. Such consideration s hall be in add1t1 on
to, and exclusive of. any other taxes or special assessments required b y la w t o be paid
by Boy Scouts of America Troop No . 92. All sums payable to the City of Englewoo d
hereunder shall be paid to the Director of Finance of the City.
4. The above described property shall be used by Boy Scouts of America Troop No . 92 for
the following purposes subject to the direction of Englewood Director of Public Works .
5. The above described area is granted s ubject to the following conditions, term s. a nd
reservations :
A. Qualified adults over the age of 30 shall s upervise the canoe e ducation at a ll
times. The adult s uperv1s or shall be a properly qualified person with s loll a nd
experience m s uch trairung . Care shall always be exercised to insure s afe t y of
all persons participating and viewing the exercises .
B. Gra ntee s hall not use the park other than in conformance with the rules a nd
regulations of the City of Englewood . Vehicles shall be in the parking area
only. Canoes shall be launched from North shore only . Grantee s hall de live r
to the City of Englewood the dates and times of use .
C . No items may be stored at the Lake . At all times, the adult s upervisor shall
have a copy of this License. All Boy Scouts shall be advised that they may not
use the Lake without adult supervision, and they shall be reminded of this on
a regular basis.
D . This License is made subordinate to the right of the City to said area for a
public purpose, and in addition to any other reservations made herein, it is
understood and agreed that should the City deem it in the public interest to
use the above area , or any portion thereof for a public purpose . then written
notice of its intention to cancel this License will be provided to the Grantee .
