The purpose of th.ls letter is to set forth, in principle, the terms and conditions under which the
t.:nderwnters of the 199 Northfield-Lloyds All Lines Aggregate Policy have agreed to make
payment to the Cities for the above-referenced loss .
CIRSA has had extensive discussions on this matter with the Underwriters since AugusL 1998. when
I met with you . As a result of those discussions, the Under,vriters have agreed that, in accordance
with the 199 7 ALA polic., payment will be made for the smallest of: (1) the cost to repair; (:) the
cost to rebuild or replace, all as of the date.ofloss, on the same site, with new materials of like size.
kind and quality ; or (3) the actual expenditure incurred in rebuilding, repairing or replacing on the
same or another site .
On January 7, 1999 , we received from the Cities' counsel a summary sheet of costs incurred through
November, 1998 . On February 2 , 1999, we transmitted to the Cities' counsel the Underwriters ·
request for additional back-up documentation on those costs ; howev~. to date, we have received
some back-up materials concerning the services of Brown & Caldwell. but not pertaining to the
expenses for legal and expert wimess fees . Based on the documentation received, the Underwriters
advise as follows :
1) The amount of S490,000 will be paid for the replacement media filter materials purchased
from Brentwood Industries, Inc., in accordance with Englewood Purchase Order No . 700644 .

PREVIOUS PLANNING COMMISSION ACTION
The Planning Commission considered the proposed West Floyd Avenue vacation on April 6, 1999 with
a recommendation for Council approval.
RECOMMENDED ACTION
That a portion of West Floyd Avenue between South Elati Street and South Huron Street be vacated ,
provided that a general utility easement shall be retained which reflects the original right-of-way.
BACKGROUND, ANALYSIS, AND ALTERNAT1VES IDENTIFIED
This vacation request involves the south 66 feet of the West Floyd Avenue right-of-way between South
Elati Street and South Huron Street. This section of West Floyd Avenue has a total right-of-way width
of 96 feet. The request will place this portion of the vacated right-of-way under the control of the
Englewood Environmental Foundation . The vacation is necessary for the implementation of the
Englewood Town Center Planned Unit Development (now known as CityCenter Englewood.)
A portion of the vacated right-of-way will be developed as the CityCenter roadway system and will be
under the maintenance control of the Foundation . The roadway will still be known as West Floyd
Avenue.
The remaining northern portion of the right-of-way will be rebuilt as the access street for the residential
neighborhood to the north . Vacation of this portion of West Floyd Avenue will not impact the
transportation grid of Englewood .
FINANCIAL IMPACT
There is no direct cost associated with the vacation of this right-of-way. The right-of-way is necessary
to implement the Englewood Town Center (CityCenter) Planned Unit Development.

The south 66 feet of the 500-800 blocks of West Floyd Avenue right-of-way.
RECOMMENDATION:
The Department of Neighborhood and Business Development recommends that the
requested right-of-way vacation be approved with the following conditions:
1. A general utility easement shall be retained for the entire vacated portion of
right-of-way.
BACKGROUND AND ANALYSIS :
This vacation request involves the south 66 feet of the West Floyd Avenue right-of-way between
South Elati Street and South Huron Street. This section of West Floyd Avenue has a total right-
of-way width of96 feet. The request will place this portion of the vacated right-of-way under the

indicates that West Aoyd Avenue is a minor collector strcct..
PROCEDURE: The City Planning and Zoning Commission's recommendation will be referred to the City
Council for final action on the requested vacation.
DEPARTMENT AND AGENCY REVIEW:
Public Works Department -Engineering Division -An casement over the vacated portion of
ROW must be retained for any existing and future utilities.
Utilities Department -A general utility casement shall be retained which covers the vacated
portion of right-of-way .

Avenue Right-Of-Way between the South Elati Street and South Huron Street; and;
and

WHEREAS, the request will place this portion of the vacated Right-Of-Way under

reviewed the requested Right-Of-Way vacation and recommends it be approved with
the following condition:

1 . A general utility easement shall be retained for the entire vacated portion of
Right-Of-Way .
Sectjon 2 . Should the vacation of the Right-Of-Way not be ratified and approved aa
an emergency the City of Enclewood would be penalized as a reeult of loaa of eales tax
revenue, accruing to it. AccordinclY, the City Council 6nda and determines that an
emergency exists and that puaap of the within Bill for Ordinance is neceaaary for the
immediate preservation of public property, health, peace and safety, and said Bill for
Ordinance shall be effective upon publication following final paaaage .
Introduced, read in full , and paased on first reading as an emergency ordinance on
the 12th day of April , 1999.
Published as a Emergency Bill for an Ordinance on the 16th day of April, 1999.

Mayor Bums said he Wldersaands that, essentially, this is pan of the right-of-way of Floyd Avenue, but ii isn't pan
of the travel portion that wc have now. Mr. Still said, n:calling the right-of-way for West Floyd Avenue. that the
ninety-six feet includes two westbound lanes, two easlbound lanes, and a median. The vacation will 00\/Cr the
median and the caslbound lanes and a portion of the eastbound lanes will actually be incorporated inlo the Wal-Malt
transact.ion. Actually, undcmcalh the CIISlbound lanes are the Little Dry Creek conduits, so thcrc really won '1 be my
development, per se, on lop of 1h11 portion of the right-of-way, he said. The road that will be developed. 1h11 the
public will recogniu as West Floyd Avenue, will be on a portion ofwhal is now the median, and the westbound
lanes. Mr. Stitt said, aa:ording to the Planned Unit Development. the provision for right-of-way, or Slreds within
that area . included a circulation road thal would conncct Elati, Fox and Galapago with a sixteen foot or twelve foot
right-of-way thal would provide cin:ulalion for the neighborhoods. This would not allow traffic to Dow from, for
instance, Dartmouth south through the neighborhoods inlo the development across Floyd Avenue. The balance of
the right-of-way, he explained, w"-the public would recogniu as the traditional right-of-way for West Floyd
Avenue, would provide access for buses and loading for the Englewood town center development
Mayor Bums asked if there will be enough right-of-way there for the neighborhood circulation . Mr. Still responded
affinnatively.
Council Member Habenicht asked ifthcrc will be an adequate buffer so that, if there are exhaust fumes and all tiu.,
ii won 'I affect the neighborhood or quality of life of the people who live there. Mr. Still responded that, the way the
Planned Development was laid out, thcrc would be a wall and landscaping lo buffer the neighborhood to the north.
In fact, we have been studying thal buffer to detenninc cxactly what is going to be necessary to pro1CCt the
neighborhood from the bus traffic, since the buses are quite large, and they exhaust up through the roof with an
exhaust pipe. A low. four foot wall, be said. would not provide the kind of sound and vision buffer 1h11 is necessary,
so 'NC arc looking into what will be nccaary to provide the sound and visual barrier for those neighborhoods.

5. She advised that she has received eight phone calls against Sam's Club.
6 . At 2820 South Elati Street, she said, there is a leaking fifty gallon drum of what looks like oil in the alley.
7 . She said she rode along with an officer a a,uple of weeks ago and was very impressed with our Englewood
police department One of her concerns was that there were only two employee proa:durc manuals in the whole
Safety Services building. This was a vc,y conscientious young man, she said, and he said he thought it was about a
seventy page manual and he would appeciale if there were more manuals available.

2. At Huron and Belleview, if you are westbound on Belleview turning nonhbound on to Huron, that seems to
be the "I'm going to market my vehicle" comer, he said, aa the vacant lot and right on the curve . With people
bam:ling down Belleview, that is pretty dangerous, Mr. Garrett said, and asked that it be checked to be sure they are
the proper distance from the end.

3. There was a special officer assigned to talk to some of the South Broadway business people thal she had
been concerned about because they were not reporting their incidents. Ms Grazulis said they arc speaking to those
business people al least weekly. She aid that is very nice and she thanked them .
(v) Council Member Waggoner said, when we were talking several months ago about the
DROP Program, thal we were IUppmal to have something brought back to us by March or Apil.
Council Member Bradshaw said that non<mergcncy has a meeting tomonow. City Attorney Brotzman said police
and fire pension arc this week and next week. Ms . Bradshaw said then it is probably closer to May. She said thal is
the focus of the non-emergency meeting tomorrow.
Council Member Waggoner asked iflhll is going to be mm-active to the first of the year. Ms . Bradshaw responded
affirmatively.

I . She said she remcmbcRd what Council Member Bradshaw remembered, that we never discussed Council
Members' Choice at Special Meetings.
Mayor Bums said we have Council Members' Choice at the Study Sessions, and he fdt it was a matter of
convenience.
2. She mentioned that some of the members of the Cultural Arts Commission will be visiting the Library
Board meeting. We have a liaiMJD from the Library Board on the Cultunl Arts Commission, she advised, so there is
some really good communicalioo going on. The Cultural Arts Commission had been approached about space within
the City complex for a group c:alled the Book Arts League thal is looking for space, and they do some wonderful
things. Ms. Habenicht said. The Cuhunll Arts Commission really felt lhlt this was more of a library kind of
program or use and so we have rd'cmd 11111 to the Library, she said, and they arc going to be making a presentation
to the Library Board. It really Dlnds like a wonderful program, she said, and she felt they would be pmty excited
about it. She said she would keep them poaed.

provide them with donuts and drinb. Anyone who can get out there, she said, allowing that it is bud,et time, it
