I . Call to Order The special meeting of the Englewood Cily Council was called IO order by Mayor Bums al 5: 32 p .m . He Slaled that the special meeting was noticed on June 23n1 by four Council members -Council Members Lauri Clapp, Alex Habenicht, Ann Nabholz and Al Vonnittag and then he. as Mayor, notic:cd it. He staled they have just had an Executive Session rqarding personnel and real CllalC IIIIIICn. and they an: n:a,m,cning on the dais as lhis is a Special Meeting. rather than just a Study Session 4 . Replar Seuioll (1) Orchard Place Mayor Burns note that this is really to get an update. because at the last regular Council meeting they had a lot of people ~ m Orchard Place come and express their concerns about the administration of that building by the Englewood Housing Authority . He advised that Mary Ryan-Ozburn. who has been the Acting Director, is here tonight with tlic new Director of the Englewood Housing Authority Cheryl St. Clair. Mayor Burns stated that today is Ms. St. Clair's first day on Ilic job. He stated there was a Housing Authority meeting Wednesday and Council received a memo as a result of that and it was also given to the tenants. He asked Ms. St . Clair to come up to the microphone and introduce herself to Council. Mayor Burns pointed out that Ms. St. Clair was not at tlic meeting last Wednesday as she was not on the job yet. He stated !hat Ms . St . Clair comes to us with a vast amount of experience from the Denver Housing Authority and tbe Denver Urban Renewal Authority and tliey are very happy to have her. He welcomed Ms. St. Clair. Ms. St. Clair introduced herself and stated she is looking forward to being here and working with the City of Englewood and the Housing Authority . She noted that. as Mayor Burns said. this is her first day so she is really not up to speed on the issues. So, she said, she would like to tum it over to Ms. Ryan-Ozburn and let her give Council Ilic update on Orchard Place. Ms . Ryan-Ozburn Slated that she Im been the Acting Executive Director for the Englewood Housing Authority. She noted that. as Mayor Bums stated. they had a Board Meeting Wednesday night, Jwie 25"'. She advised that at the Board Meeting they convened at the Malley Center to talk with residcnls about their cona:rns and to listen to their concerns. Ms. Ryan-Ozburn staled they have set up a COIUlnillee . Ms . St. Clair, two Commissioners· Debbie Medlock and Matt lmies. and some stalTfrom the Housing Authority are on the committee. So. she noted. they can RICCI with the residents on an individual basis or on a group basis and liear their concerns and address their concerns. She advised they are also discussing the idea of submilling a questionnaire or a survey to the residents of Orchard Place to ask them what their conccms are. so thcy can get more of a feel for what tlic basic issues an: at this point with the different groups . Council Member Habenicht noted slic was 0111 of town at tlic tinic so slic did not have an opponunity to anend that meeting. But, she said. slic lieard then: was some concern on the pan of people who did try to attend, that tliey were sent away because tlic room was too small and then: was an attempt to change to a different room at the Malley Center and that was not allowed. Ms. Habenicht wondered if Ms. Ryan- Ozburn would comment on that and why tlial w-.is. if 1ha1 was or ir she is wrong in what she lieard . Ms. Ryan-Ozburn said she would be liappy lo com1ne111 on that . Slic advised thal the room was posted in their legal public notice as Room I at the Malley Center and tliey had aJso asked tllC residents to let lllCm know if they wen: going lo attend or wanled to speak . She said they knew that about thirty people wanted to attend and they were planning on about that number. But. she stated. when they arrived for the meeting at the Malley Center they discovered how many people had come to attend the mee1ing . She said they were reluctant at thal poinl to change lhe venue. 10 move ii to another room. because of the leg.ii issues surrounding that. She noted they wanled lo make sure it was a legal meeting so lhey 1old lhe residents lhal were there 1ha1 they would meet wilh lhc spokespersons oflhe various groups and listen lo lhem . Ms. Ryan-Ozburn poinled out that 1hey allowed as many people into the room as possible and that she: was not aware !hat anyone was sent away. She said she: was aware thal there were so,ne people out in the hallway and their legal counsel. Lee Applegate, was there and she: also went out in the hallway and talked \l<lth these people . But, she stated. the door was kept open to ensure !hat it was an open meeting and as far u she knows no one was sent away. Ms . Ryan-Ozburn explained !hat they were concerned aboul the lire codc:s . Council Member Habenichl said then your legal counsel advised that you could not change the room . Ms. Ryan-Ozburn stated that was right . Council Member Habenicht said there was another comment she heard. thal she would like 10 check out. She stated !hat somebody was told that they would have a certain amount of lime to presenl their concern and they were cut back more lhan half. 1bey fell they were not given a fair hearing. Ms. Ryan-Ozburn said she understands where that confusion may have arisen. She noted thal when she was lalking 10 one of the residents they asked how long they be allowed to speak. At that point, she said, lhc Commissioners had not indicated to her a set time or amount of lime per residenl or per group. She stated whal they indicated was !hat tbere would be about an hour available during lhe Board Meeting 10 listen 10 lhese concerns. She said thal when she talked wilh one residenl she explained thal they were not sure of lhc parameters and lime guidelines. 8111 whal would possible happen would be if !here were ten people there wanting to speak lhey would have aboul live minules a person. If there were live people 1here wan1ing to speak they would have aboul 1en minu1es per person. Bui. she said. as far as she knows 1here was never a set time per person. There were three distinct groups llic:re, she: advised. and since there was an hour allotted they broke ii down into about twenty minutes per group. Eacb group had a spokesperson. except one group had -ra1. but ii was twenty minutes per group. Council Member Vormittag asked how many got to speak. Ms . Ryan-Ozburn said !hat she: was not sure exactly the number. Mr. Vonnittag asked if they had a sign up sheet that they used. Ms . Ryan-Ozburn advised they had a sheet of residents that had called before hand to advise !hat they were interested in attending the meeting and/or speaking al the meeting. She noted she: has that at the office. She identified some residents who spoke. Council Member Vonnittag questioned wlic:1her the minutes have been typed up. Ms . Ryan-0-L.bum advised that they have not. Mr. Vormiltag asked that after they are printed if she: would make sure they get them over at City Hall as soon as possible. He noted he would like to sec a copy to sec what the comments were. Ms. Ryan-Ozburn agreed to provide the minutes. Council Member Wiggins noted that in their memo to tlic: residents on June 21"', in the second paragraph, they indicated the residents could place their wrillen comments in a designated comment box at Orchard Place. Ms. Ryan-Ozburn said that is right . Mr. Wiggins asked who has aa:css to the box and how secure it is. In other words. he asked. if somebody can get inlo ii and get rid of some of those comments or are they all there where they could be accounled for . He said that is what he is wondering about . Because is they have in essence a suggestion box and they can stick it in and you don ·1 like the suggestion and you deep six it. who knows if it was put ii in there . Council Member Wiggins said in his opinion. since they have so much controversy 1ha1 lhcy gel a post office box and register ii some way . So that each comment that comes in is documented. Ryan-Oz.bum said she fell that was an excellent idea . She advised that the box is locked. Council Member Wiggins asked who locks the box . Ms. Ryan-Ozburn advised that she locks the box and she and the police have a key to it. She stressed that at this point they have not been interested in deep sixing anything, that they have been interested in learning what all the concerns arc. Mr. Wiggins said he reali7.es that. but as they listen to the these people they arc claiming that they arc not being heard and their comments arc not getting there. Ms. Ryan-Ozburn said she understands that. she has heard that . Mr. Wiggins stated that he just wants to know if they have something that guarantees if it goes in the box that it is documented and kept over there. Actually, Ms. Ryan-Ozburn advised, they have a procedure in place. She stated that, as she told the residents of Orchard Place. when they fill out a grievance form it will be seen by the manager of the prog,am and bcrsclf. They will both comment on the form and initial off' on it in original hand. That original will be returned to the resident within three days. If it is not, she advised. then our phones numbers arc on that form and they can call and find out what is going on with it. So. Council Member Wiggins said, they do get the original back indicating you have seen it . Ms. Ryan-Ozburn stated that is right . Oby. Mr. Wiggins said. you do have a procedure in place. Council Member Nabholz commented that she was in Orchard Place today to drop off' some Dowers for an individual and there were alarms going off'. She noted there was a gentleman there and he was standing in the lobby smoking a cigarctle. Ms. Nabholz stated she was concerned lhat all the doors were open and she asked if there was a fire alarm or what . He said ii doesn '1 make any difference. if she needed 10 use the elcvalor or stairs go right ahead and if you see a fire just blow on it . Ms. Nabholz stated she was really concerned about lhis and when she got 10 1he resident she was visiling she said it happened quile frequently lhat there arc really no fire drills. Council Member Nabholz advised 1ha1 she would like 10 find out when was lhe last lime we had a fire inspection of Orchard Place. She said she was very concerned. that she had she son wilh her and yes she got on lhe elevalor. Bui it was a joke. she said. and she was very concerned about lhe safety of lhe residents. Ms. Nabholz asked where the suggcstion box is localed and noted 1hat she has seen a suggestion box . Ms. Ryan-Ozburn advised lhat one is located on the first Ooor by lhe mail boxes. Ms. Nabholz asked if it is the lillle mail bo,c wilh lhe big slot in it . Ms. Ryan-Ozburn said thac is righ1 . Ms. Nabholz questioned whether ii is possible to physically stick your hand in ii . Ms. Ryan-Ozburn said 1ha1 she would guess you a,uld ifthal was your in1ent . Ms. Nabholz asked if ii was locked . Ms. Ryan-Olburn advised it is locked. But, she noted, if someone was intent on getting in that suggcstion box that she was sure thq• could. Just as if they are inlent 0t1 getting inlo any vaull 1hey could also do 1ha1. Council Member Nabholz asked if any of the residents were considered to be on this advisory c:ommiucc to probably help calm down some of 1he other people lhcre. Ms. Ryan-Ozburn advised 1hat thal question was discussed loday and they have ROI come lo any resolulion on 1ha1 She stated diey arc also talking aboul getting an oulside medialor and she has talked 10 a couple of other people about 1ha1 issue . They arc now, she noted , looking for someone 1ha1 lliey would consider a disinterested oulsidc lhird pany, somebody objective. Council Member Habenichl said she was not sure she understood . She noted 11131 Ms. Ryan-Ozburn indicated lhere was a sign-up sheet for everybody who allended 1he meeting. She asked if ii was for everybody who anempled 10 anend lhe mceling or only for lhose who were allowed 10 auend lhe meeting. She noted 11131 is whal lhe list is. So. Council Member Habenichl said. anyone who showed up for 1ha1 meeting. bul hadn ·1 signed up for ii. was ROI pennilled lo attend. Ms. Ryan-0.lburn said absolulely not . In fact , she advised, lhe list was not even taken 10 lhe 1nee1ing. So. Ms. Habcnichl said. you didn '1 have a list of people who attended the 111CC1ing. Ms. Habenichl asked if they have sign-up sheets for people who auend. Ms. Ryan-Ozburn noled thal at that poinl Ibey n:ally hadn ·1 even 1hough1 aboul doing lhal. She said Ibey were just inlerested in hearing what they had to say and 1hey were quilc surprised al the number of people who did show up. She commented that they were all quile laken aback . Council Member Clapp advised lhat she did allend thal meeting and Tom Munds was there and she would guess there were 97 people in attendance. It was a greal crowd tbat nigb1 and a lot concern. She commented that emotions did run higb. She thougbt lhat a lot of people wen: disappointed lhal only an hour had been allotted for them. that they were never going to even begin lo scratch the surface. She advised that one of the concerns she heard about a one on one wilb a commillee or ofthal nature, coming door to door, is that people would feel somewhal inlimidaled. Tiiey really want thal done more in a group type setting. Ms. Clapp said she knows thal we have moved meetings in the past. She asked if lhal was not true and, if you legally can post the notice on the door. c.m you not move a meeting across the hall. al the same address. in 1he same building. Council Member Clapp said she was a liltlc disappoinled 1ha1 people were not allowed in the room and that !here wasn't more of an effort . Ms. Ryan-Ozburn poinled 0011ba11Jiey were also disappoinled, that what they were relying on al 1ha1 point was 1beir legal counsel's advice. She stated they were very concerned about keeping the meeting a legal meeting and not violating any laws. She agreed thal ii was very disappoiniing 1ha1 everyone did not gel lo come in. Ms. Ryan-Ozburn staled she understands the rcsidenls concerns and 1bcir disappointmenl in not being heard. She said Ibey did 1ell the rcsidenlS 1ha1 nigbl thal Ibey arc going 10 have a series of meetings. 1ha1 they will have a couple of lhe commissioners on 1ha1 comminee and ihcy consider their concerns very imponant . She advised 1ha1 if lhey didn 'I speak lhal nighl. or gel a chance 10 speak. lhat Ibey were given 5x7 index cards and pens for them lo wrile down lheir concerns. She staled lliey have all of lhose and lliey are being copied and pul into packets for each individual member of the commitlee 1ha1 is being pul logether. Ms. Ryan-Ozburn said lhal she could cenainly understand 1ha1 they were disappoinlcd 1ha1 Ibey didn ·1 get lheir chance to speak before the Board. She stated I hat the Board and staff have absolutely no intcolion at all of ignoriog them or not addressing their concerns. She said what she is trying to express here is lhat she conlinues to receive commenls and she feels ii is not a Council issue. Ms. Clapp noted ii would be a real blessing if this thing could be addressed sooner rather lhan lalCr for everyone's sake. She opined that thi11gs continue 10 escalalC. Ms. Ryan- Ozburn agreed. All oflhe issues thal were laken before lhe Cily Manager were addressed and Ibey have worked very hard . Unfonunaicly, she noted. not all of the concerns have been solved or resolved lo everyone's satisfaction. She stated Ibey arc aware of many threals on both sides. She said she has not wilnesscd any of 1hem in person. Council Member Vormittag wanted lo know approximately how long it will take for Ms. St . Clair 10 get up to speed on this panicular issue. Ms. Ryan-OLbum advised thal Ms . St . Clair is gemng up 10 speed quite quickly. lllis bas been her nwnbcr one priority and. she DOied. she met quite a bit today with her on this isaac. Ms. Ryaa-07.bum 51.aled that she has very complete files oo the isaac and Ms . St. Clair is a pal lis1cner and a \'UY discerning questioner and she is getting up k> speed rapidly. Council Member Vorminag asked if she bas an open door policy . Ms . Ryaa-07.bum said she did not know, that she c:atainly -to, and she defened the question 10 Ms. St. Clair. Ms . St. Clair indicated from the audienoe 1h11 she docs. Council Member Habenicht stated that she certainly appreciates due process. that it is always extremely impoltanl. She asked. since there have been so many concerns expressed about feelings of threats or safety or wbal have you. if there is any additional security measures laking place in the building 10 make sure that something just doesn't erupt inappropriately. Ms. Ryan-Ozbum said yes. that they have had members of the impact team at SC\'C:ral meetings. She staled they have emphasized that any resident 1nay dial 911 at any time. They have installed a satellite office on lhc: sevcntb floor. ii is in a vacant room at this point, it was a room that was not developed and is a small little cubby hole. She advised they put a phone: in there with voice mail for the impact team to use, with a locked suggestion box outside: of that door and yes if someone was bound a11d dctennined to get into that suggestion box they could. Ms . Ryan- Olbum Slated they did what they 1hougl11 was appropriate al the time:. If stronger measures IICed to be taken, she said. they will most certainly lake lhc:m if they see that tliat is appropriate. Bui. she noted, she and members of the impact team stop by the building ull3DIIOUIICCd at various times just 10 see how tilings arc going. She added lhal she. along with the impact team. the building manager. the Housing team member and two maintenance workers, go through the hallways. Council Member Habenicht asked how access is gained to the building. Ms. Ryan-07..bum said it is by key. If you arc resident of that building and you have a visitor or a guest. you may buzz them in lbrough the intercom system. Ms. Habenicht asked if she showed up at the building how would she get in. Ms . Ryan-07.bum advised she would have to buu the manager. announce hcrtclf and state her purpose:. Ms . Habenicht asked what would happen ifslic buzzed the lllalllllF· Ms . She asked if the new director would be responding to the people who wrote those letters. Ms. Ryan-0-Lbum advised thal all of those issues will be addressed . Ms . Nabholz said. if al all possible. she would appreciate a copy of those responses . Council Member Habenicht staled she would also appreciate ii if CouHCil could be copied a list of all meetings concerning this iSSIIC. a schedule of meetings. Mayor Bums asked how much the Council wanted 10 gel involved in this. CouHCil Member Wiggins staled that he does 1101 want to gel involved in it. Council Member Nabholz said she lhinks it is a Housing Authority issue. Mr. Wiggim agreed. Ms Nabholz said tliat unless some: resolution stans laking place Council will continue to be involved . Mayor Burns noted we already kind of undcntood that So. he said. what he was concerned about is how much staff' time ii will lake and what will they need 10 gel into this. City Allomey Brotzman advised that ii is how much they want to take of this. That right now they have a very large administrati\'C ordinance that was going to be staffed and then brought to Council after August, after lhe Director's retreat when they were going 10 go through this. He noted that where we are inconsistent with the Charter is two departments. not being Safety Services is one of the departments, Parks and Recreation and Neighborhood and Business Development we arc currently not consistent. our Code is not up to date as to what our ac:rual pnlClia: is. Which means. he said, that we are in violation . City Allorney Brotzman advised Council they can lake all of this in one large lump sum. which is its current fonn, or they can break them into pieces and lake a small pica: at a time. She said if that is the case. then yes . She stated she would ccnainly ncver want Council to move on anything that Council docs not fully understand or have an opponunity to review. Mayor Bums asked how much stair time this will take right now. He pointed out that he is concerned that we have so many other things that we arc doing. He asked if Council can have this in some son of form. so thal they can get a good look 11 it. without going through the voluminous paperwork. City Manager Clark explained that the ordinance City Attonicy Brotzman is talking about just came out shonly. that it was one of Randie Banhlomc last items that she completed. He noted that 15 he recalled it is 70 some odd pages in text. He said he had indicated to Mr. Brotzman that he would look at it before the end of this week and then they were going to route it out to the directors. He stated it does the comparison they were talking about. As far as the other ordinance. Mr. Clark stated. he is still not clear what she is lalking about. Council Member Habenicht explained that she is talking about the ordinance that changed the way rcorganiz.alion is done in the City. She reiterated that she would like 10 sec Council repeal that ordinance and immediately go back to where we were before lhat ordinance was passed . Which. she maintained. would not n,quirc 70 pages of anything. She said if they wanlcd 10 look at 70 pages. 20 years. 20 days . 20 months. 20 MICks down the pike. when 1hey have more time. thal is fine. But. she said. righl now she thinks they should rectify what was done that was wrong in the past . Council Member Clapp said she mighl be able to help here. She said she lhinks Council Member Habenicht is talking about the ordinance thal overrode lhe Chaner illegally. That is the exact one. She asked Ms. Habenicht if she was right . Ms. Habenichl said she was. Ms. Clapp reiterated it is the one that illegally overrode Chancr. She opined that you can't produce an ordinance lhat is directly opposed to your Charter. Council Member Habenicht opined that this does not need to be a lot of work. that this is very simple. Take whal we did wrong. put it back to what was righl and then go on from there. Mayor Bums advised Council Member Habenicht thal he has no idea what 1ha1 is. Council Member Waggoner said it seems like 10 him 1ha1 the way 10 proceed is to just get the ordinance that supposedly changes the Cily Chaner and highlighl in 1ha1 ordinance lhe places where it is inconsistent with the Chaner. He opined 1ha1 thal should not be too difficult or take 100 long. He stated the other one would be to. in an organi1..ational chan or something like 1ha1 . show the differences between the City Chaner and the organization that we have today . Rather than delay the meeting by rescheduling it [minimum prior notice of meeting times and places is required by Colorado ReviNd Statute Sec:1ion 24-6-402(21Ccl, with provisions for failure to comply Mt forth at Colorado ReviNd Statute Section 24-6-402(81 and (911, the Board wanted to hur your concerna u soon u pouible and appreciated your designation of spokupersons to convey these concems. As reported at the meeting, a working group is currently being formed which will include among its members the new Housing Authority Executive Director, Cheryl St. Clair, who will commence work on Monday, June 30--, u well u Board members Matt Innes and Debra Medlock, together with uaistance from the Authority's legal counsel . This group wiA invntigate all concerns of Orchard Place and make recommendations to the Board to resolve theH concerns. This group will soon be scheduling additional new meetings with resident groups and with individuals to learn about all Orchard Place concerns, and wil review al writt9" comments submitted on these c:onc:ems.
