THE ENGLEWOOD MUNICIPAL CODE RELATIVE TO ACCESSORY STRUCTURES.

which was published in the Englewood Hcnld OD Declembcr 29, 1994. He explained that this public
hearing is the culmination or a loog procas or revising the Comprdlemivc Zooing Ordinance relative to
Accessory Structures. In Fc:brualy, 1993, the Planning and Zooing O!mmill!OO RICCiwd
recommendations from the Board or~ and Appc:als. which bad. in considering variances to the
zoning ordinance provisions, 1CC11 tbal a number or their -repeatedly had the same kinds or problems
and it seemed there was a need to change the onlinw:e to more comillelllly rcOec:t aJIIUDUnity needs. At
the same time, there were opportunities to bc:acr ddinc ud clean up -or the language in the
ordinance. The Planning and 1.oaing O!mmill!OO CIOOducled a Public Hearing OD Oclobcr 19, 1993, and
recolDIIIClldcd to the City Council that the propoaed IWilica be appnMld. The City Council RICCiwd the
recommendation from the Planning O!mmissioo in early 1994 . Sewral study IICllions OD the proposed
revisions were held by Council, and in addition, a public fonam was held in July, 1994 . In response to
some comments made during the coune of the forum, City Council remanded the iaue of Aa:alory
Structures to the Planning Commission for further CXllllidenlioa . The iaue was further consideRICI by the
Planning and Zoning Commission on October 4, 1994; the ddcnninalioo was made that no further
modification or the Accessory Structures proposal was needed. On No\'ember 21 , 1994, Council passed
the proposed ordinance on first reading. and set the dale for public hearing for January 17, 199S . Mr.
Merkel explained that the proposed ordinance offers a number or alternatives that can be pursued in
delermining which structures, in addition to the principal structure, will be allowed . He advised the
proposed ordinance will allow ll!LID!!G ~ or the following : I) an attached gange; 2) a delacbed
garage; 3) a carport; 4) an attached gange and a carport; S) a detached gange and carport; and 6) a
detached garage and an attached gange. Al this lime, a maximum lqll8l'C footage for a gange is 1,000
square feet ; the proposed ordinance will unend this ratrictioo to rcOec:t that the "combined" maximum
lotal floor area of all garages and carports shall not cxcccd 1,000 lqll8l'C feet . Alao, the maximum size or

Development), Environmental Services Administrator Gluier (Community Development) and Eileen
Byrne (Eileen Byrne Aslociates Inc.). Mr. Mulhern briefly dilcusecd the selection process and the criteria
used to evaluate developen . He stated it WU the unanimous c:oocllllion that Miller/Kitchell will provide
the nccessary leadership and a development the City can be proud of. Mr. Mulhern asked that
Miller/Kitchell, as they take Englewood's future into their hands, not do so just with the intent of malting
a deal, but truly with the intent of making a difference. He dwged City Council with the responsibility of
keeping the project on track. Mr. Mulhern ltJollgly urged Council to give staff the authority to proceed
with the development process and aa,ept the cballenges to come.

Bill Coleman, member of the Englewood Downtown Development Authority, owner ofBany's Paint
Center at 3305 South Broadway and member of the Selection Committee, stated he has a lot of confidence
in the development team of Miller and Kitcbell and be feels they have vision. He placed the responsibility
for seeing the process through OD Council and City Manager Clarlt. Mr. Coleman stated that a strong,
active business development in the Cinderella City site will help the Broadway businesses as well as the
City.
Mayor Bums asked if anyone else from the Selection Committee or Community Advisory Group wanted
to speak. 'There wu no response.
Mr. Fullerton introduced Skip Miller, representing Miller Development Inc., and Charlie Byxbee, of
Kitchell Development Company.

complimented the axnmitment of the Selection Committee ud Coaununity Advisory Group OD putting

On January 17, 1994 Council designated the Englewood Herald the legal newspaper for
1994.
RECOMMENDED ACTION
Approve. by motion, the Englewood Herald u the legal newspaper for the City of
Englewood.
BACKGROUND. ANALYSIS, AND ALTERNATIVES IDENTIRED
In 1994 the City Clerk's Office prepared a comparative analysis of publication rates as
requested by Council. The analysis confirmed that the Englewood Herald offers the City
the lowest rates. and those rates have not changed. The Englewood Herald offers a
discount for camera shooting of our larger, more Involved documents, i.e. council bills.
Camera shooting Is advantageous to both the City and the Englewood Herald as the
Herald does not have to typeset lengthy documents and the City does not have to worry
about typesetting errors.
Staff has reviewed the publication rates of the Denver Post, Rocky Mountain News and
Daily Journal and reached the consensus that our needs are best met by the Englewood
Herald.
FINANQAL IMPACT
Publication costs have been budgeted for 1995 In the amount of •10,500.

By Ordinance, City Council is required to designate City Holidays. The number of holidays and
the holidays observed are stated in the contracts for the Englewood Employee Association, the
Englewood Police Benevolent Association, and the Englewood Firefighters Association, but the
actual day of observation can vary. These will also apply to employees not represented by a
union.

WHEREAS, the City of Englewood decided to rcauit a developer for the Cinderella City site;
and \
WHEREAS, the City of Englewood asked a group of community members to serve on a
Selection Committee to evaluate the proposals and provide City Council with a recommendation on
which developer would best suit Englewood's needs; and
WHEREAS, this Selection Committee was comprised of Englewood businesspeople, residents,
and City staff; and
WHEREAS, the Selection Committee spent many hours reviewing and evaluating proposals
and determining which developer would best suit Englewood's interests, keeping in mind that one of
the primuy objectives of the project was that "the ~opmcnt project must contribute something
of lasting value to the community;" and
WHEREAS, Englewood's City Council is very appreciative of the time and effort that the
members of the Selection Committee have given to this project;
NOW, THEREFORE, BE IT RESOLVED BY 1llE CITY COUNOL OF THE CITY OF
ENGLEWOOD, COLORADO, THAT:
The City Council ra:ognizes and thanka the Selection Committee lmolwd in
