Over the past year, Mr. Payne has been in frequent contact with Perry Movick, our manager of information systems, and last week called our office and spoke with Leigh Ann. He is anxious to see Englewood broadcasting on Channel 8, and has offered his production services. Mr. Payne freelances in video production work. He's also an employee at TCI of Colorado. Englewood is a member of the Greater Metro Cable Consortium (GMCC), which is currently analyzing and implementing new c.able sundards and preparing a "Model Franchise Agreement," which will be used as wc ·rcnegotiate our franchise agreement with TCI. Our current agreement expires in April of this year. Attached is a memorandum from Perry providing background on public access and FCC regulations and reports on the status of the GMCCs endeavors. WHEREAS, the Englewood City Council enacted the Wastewater Utility Ordinance No . 58, Seriea of 1991 and revilion1 to the Wute-ter Utility Ordinance are neceaury in order to incorporate additional local enforcement authority; and WHEREAS, the EPA requires the City to re-evaluate its discharge limitation requirements for Industrial Users every five years; and WHEREAS, local limits are developed to control the level of pollutants which are discharged from industries and which enter into the unitary sewer system and ultimately enter the Wastewater Treatment Plant; and WHEREAS, the Wastewater Treatment Plant is regulated by the Colorado Department of Health and Environment and the EPA through the NPDES permit; and WHEREAS, the Wastewater Treatment Plant must meet specific standards which are outlined in the NPDES permit; and WHEREAS, improper implementation of the Pretreatment Prorram is a violation of the Littleton/Englewood Wastewater Treatment Plant NPDES permit; and WHEREAS, the consequences of not implementing the regulations could include EPA fining the City up to $25,000 per day; and WHEREAS, setting local limits helps to protect workll' health and safety, wastewater plant processes, sludge and the receiving stream; and WHEREAS, the EPA has reviewed and approved the proposed amendments to the Wastewater Utility Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS : Scs;tjon 1. The Englewood City Council hereby approves the amendment to Title 12, Chapter 2, Section 2, Subsection C, Specific Prohibitions of the Englewood Municipal Code which shall read as follows : 12-2-2. C . Specific Prohibitions. 1 . It is unlawful for any uaer to contribute or cauae to be contributed directly or indirectly, any pollutant or wastewater which will interfere with the operation or performance of the POTW . These pneral prohibitions apply to all such users of a POTW, whether or not the user is subject to National Categorical Pretreatment Standards or any other national, State or local pretreatment standards or ...... .. Any liquids, solids, or gases which by reason of their nature or quantity are, or may be, sufficient either alone or by interaction with other substances to cause fire or explosion or be injurious in any other way to the POTW or to the operation of the POTW. At no time shall two (2) 1ucce11ive readings on any explosion hazard meter, at the point of discharge into the system (or at any point in the system), be more than five percent (5%) nor any single reading over ten percent (10%) of the Lower Explosive Limit (LEL) of the meter. Fire or explosion hazard may also be determined using fluh point concentration, by closed cup method as specified in 40 CFR 261 .21 . Any wastewater having a pH le11 than 5 .0 or more than 10.0 unle11 the POTW is specifically designed to accommodate any such wastewater, or wastewater havinr any other corrosive property capable of causinr damare or hazard to structures, equipment, and/or personnel of the POTW ; EXCEPT THAT WAIVERS MAY BE GRANTED FOR CONTINUOUS FLOW DISCHARGES WHICH ARE MONITORED CONTINUOUSLY BY AUTOMATIC MONITORING EQUIPMENT. SUCH WAIVERS MAY BE APPLIED TO PH EXCURSIONS WHICH ARE ABOVE 10 PH UNITS AS SET FORTH IN THE LITTLETON/ENGLEWOOD WASTEWATER TREATMENT PLANT POLICY FOR PH EFFLUENT LIMITATIONS UNDER CONTINUOUS MONITORING OR GRAB SAMPLE MONITORING FOR CONTINUOUS DISCHARGES.
