BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
This purchase facilitates replacement of the existing lo-pressure scba equipment (purchased
1983) and lo-pressure compressor(purchased 1971).
Fire division staff conducted field evaluations on several different scba units and researched
several different hi-pressure compressors.
Considering user compatibility and scba pe,formanc:e , SCOlT is the scba of choice.
Prices furnished by the various vendors facilitated cost camparilons as well. The SCOTT
unit as presented by Fisher Safety America remains the best value for the dollars spent.
Similarly, different vendors representing different c:ompreaor manufacturers presented their
respective products. The EAGLE brand compressor/ fill station as presented by Compressor
Industries was determined to be the best value.
Of further consideration, the fire division currently uses SCOlT brand ICba's and EAGLE
brand compressor. The compatibility of our existing test/ maintenance equipment with the new
SCOTT equipment precludes having to purchase new test equipment and represents a
significant financial savings to the city.

An appropriation of $90 ,000 was made during the 1995 budget process for
replacement of the fire division 's existing SCBA units and compressor. The
following is a breakdown of the expenditures necessary to facilitate the SCBA
upgrade.

Beginning in December 1994 field evaluations were conducted by the
firefighters on several different brands of SCBA units. The SCBA units were
used in simulated fire and confined space rescue operations. The performance
of the SCOTT brand distinguished it as the firefighters' choice. Bids were
solicited for the SCOTT unit and the second choice unit, SURVIVIAR. The
prices were comparable .
The fire division currently uses the SCOTT brand SCBA and is equipped to do
the required maintenance and testing . This represents a significant savings of
time and money. The compatibility of our existing test equipment with the new
SCOTT equipment precludes us from having to spend additional money on
maintenance and test equipment. I would recommend the purchase of the
SCOTT air pac as bid by Fisher Safety America .

The total amount requested for this purchase is $68,730.10. This price includes
the trade in of our existing equipment.
The upgrade of the air pacs necessitates the replacement of our existing
compressor/cascade system . The three compressors considered were Mako,
Bauer, and Eagle. Division Chief Lockwood meet with representatives of each of
these manufactures to discuss performance, seNice and cost.
As a result of this process, I recommend the purchase of the Eagle unit as bid
by Compressor Industries, Inc. The total amount requested for this purchase is
$17,100.00. This includes the trade in of our existing unit.
Additional costs will include: the purchase of mounting hardware ($490.00),
upgrade of existing pneumatic-powered rescue equipment with hi-pressure
regulators ($1234.00), relocation of existing electrical seNice to accommodate
new compressor ($250 .00), and manufacture of metal frame for mounting fill
station and compressor ($600.00).
Discussions with procurement personnel suggest that putting these items
through the formal bid process would be a duplication of effort, given the
amount of research and evaluation conducted. Therefore, I am asking your
approval to purchase the items listed from the vendors I am recommending.
Upon your approval, I will initiate the purchase of the items and bring this project
to completion .

WHEREAS, the City Council of the City of Englewood, Colorado, desires to make certain
changes to the 1994 Annual Budget; and
WHEREAS, the General Fund incurred additional expenditures related to the City
Manager search and certain special projects; and
WHEREAS, the Donors' Fund received contributions for the Summer Safety Program
and from bookmobile donations; and
WHEREAS, Paving District No. 30 incurred additional expenditures for principal and
interest on bonds; and
WHEREAS, Paving District No. 31 incurred additional expenditures for principal and
interest on bonds; and
WHEREAS, Paving District No. 32 incurred additional expenditures for principal and
interest on bonds; and
WHEREAS, Paving District No. 33 incurred additional expenditures for principal and
interest on bonds; and
WHEREAS, Paving District No. 34 incurred additional expenditures for principal on
bonds; and
WHEREAS, Paving District No. 37 was created with the passage of Ordinance 21, Series
of 1993 and the funding of the District was entirely financed through the General Fund;
and
WHEREAS, Paving District No. 37 received assessments from property owners in 1994
and will transfer those funds to the General Fund; and
WHEREAS, Paving District No. 37 incurred additional expenditures for discounts
allowed for early payment of assessments; and
WHEREAS, the ServiceCenter Fund incurred additional expenditures resulting from
eliminating obsolete inventory; and
WHEREAS, the Risk Management Self-Insurance Fund received funds from other City
funds for the payment of workers' compensation insurance and claims; and
WHEREAS, the Nonemergency Pension Trust Fund incurred additional expenditures

Liquid aluminum sulfate is a coagulant used for sedimentation in the initial phase of water
treatment at the Allen Filter Plant. The water plant uses approximately 440 tons of the liquid
aluminum sulfate per year .
FINANCIAL IMPACT
Requests for Bid were sent to two vendors (the only known vendors in this area who can
supply this chemical) for liquid aluminum sulfate.

Your request for the technical evaluation on the liquid aluminum sulfate bid is as
follows:
1. Both bids meet Atlsi/AWWA Standards.
2 . Both companies will ship from their manufactwing site.
They will not subcontract.
3. The Allen Plant uses approximately 440 tons t:A liquid aunim.m
sulfate per year. We have budgeted $70,000 for this item in 1995.
The $165.00 per ton is what the department e,cpec:ted in the bidding.
The Utilities Department, therefore, recommends that General Chemical
Corporation be awarded the 1995 bid for liquid alumirun sulfate.

BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The current system is barely functioning . Computer technology has outmoded the current
system. With the next generation of computers, the old system may not be compatible. The
current system was designed to run on computers that .. now obsolete . The hand-held field
data entry units are no longer manufactured. Eventually repair parts will be unavailable,
resulting in the inability to obtain meter reading in the field .
Requests for Bid were sent to seven vendors for an Automated Meter Reading System, for
the purpose of providing accurate and timely meter reading data for billing purposes.

BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED

The SCADA System, (Supervisory Control and Data Acquisition System), based on radio
communications, monitors remote facility operations from a central location at the Allen Filter
Plant. The SCADA System provides system monitoring not hampered by bad weather, power
outages or availability of obsolete parts. The Phase I portion completed the installation of the
outside areas. The Phase II portion will cover the remainder of the outside areas; the
Mclellan Pump Station, the S . Platte River pump station and the remainder of the controls
inside the Allen Plant.
FINANCIAL IMPACT
The Utilities Department has received the State bid for the Phase II portion of the SCADA
System. Timberline Electric is the authorized representative for Motorola SCADA Systems.
They installed the first phase equipment and are very familiar with the Allen Plant system and
programming.
The Utilities Department recommends Tli1NII• EJeclria be approved as the sole source to
install and program the second phase of SCADA installation in the amowit of 143,280.90.
$45,000 was budgeted for 1995 for this phase of the SCADA System.

wired to house the below listed equipment alona with the existini
equipment. The Input/Output points will be wired to field
terminal points which will be wired on site to the existina water
plant equipment . The enclosure will be installed in the control
room up aaainst the south wall. Existina 4" conduits in the
basement must be re-alianed by owner to ao from the existina HCP
to the new enclosure to accommodate the new central. Two
existina Taylor PIO controllers vill be installed into this
enclosure.

Through an intergovernmental agreement, the City will participate in Arapahoe
County's Community Work Experience Program (CWEP). The City will provide
entry level CWEP participants with training and work experience. Examples of
training and work experience may include general office, building maintenance,
parks and golf course maintenance.
FINANCIAL IMPACT
Participants will not receive wages for their work. This is a training program.
Participants arc covered by the City's workers' compensation insurance.

Grant Programs for Federal Fiscal Years 1995 through 1997 ; and
WHEREAS, the project by the City of Englewood known as the Housing Rehabilitation
Loan Program has been categorized as a rehabilitation project activity and the City of
Englewood will maintain documentation with the National Objective of Housing activities ;
and
WHEREAS, the project by the City of Englewood known as the Englewood Family Self
Sufficiency Program has been categorized aa a public service activity and the City of
Englewood will maintain documentation with the National Objective of Limited Clientele
activities; and
WHEREAS, the City of Englewood may proceed to incur coats for these projects until
acceptance by the Arapahoe County Commissioners unless such acceptance is made

COMMUNITY DEVELOPMENT BLOCK GRANf PROGRAM
This Agreement is made and executed this day of

Arapahoe County Housing Authority (hereinafter referred to as the
County) and the CITY OF DGLffOOD, a municipality in Arapahoe

SubGrantee or as the Unit of General Local Government) for the
conduct of a Community Development Block Grant (CDBG) Project for
Program Year 1995.
I. Purpose
The primary objective of Title I of the Housing and Community
Development Act of 1974, as amended, and of the Community
Development Block Grant {CDBG) Program under this Title is the
development of viable urban communities, by providing decent
housing and a suitable living environment and expanding economic
opportunities, principally for persons of low and moderate income.

A. Englewood family self sufficiency Description -The
SubGrantee will undertake to partially fund a Family Self
Sufficiency Administrator, administrative expenses and
fees to other referral agencies for the Family Self
Sufficiency program.
B. Housing Rehabilitation Loan Program Project Description -
This project involves rehabilitation of substandard
owner-occupied housing units. The funding will be used
primarily to finance home repairs to ensure the health
and safety of residents by assisting in funding for
repairs necessary for the houses to meet the City codes
and the requirements of the Section 8 Federal Existing
Housing Quality Standards. Secondarily, this project
will help residents/owners maintain the attractive
appearances of their homes and will prevent neighborhoods
from deteriorating.
B. Payment
It is expressly agreed and understood that the total amount to
be paid by the Grantee under this contract shall not exceed
$10,000 for Englewood Family Self Sufficiency and $226,577 for
the Housing Rehabilitation Loan Program. Drawdowns for the
payment of eligible expenses shall be made against the line
it-budgets specified in attached Exhibit B herein and
accordance with performance. Expenses for general
adainistration shall also be paid against the line i~
budgets specified in Exhibit B and in accordance with
performance.
c. Timeline
The projects will be completed within one (l) year from date
of this Agreement unless modified by mutual agreement.
Estimated Completion Date: Aprill, 1996.
D. Performance criteria
Project funding will accomplish the following:
Englewood Family self Suffici1ncy -Provide housing
assistance and support services to 25 families whom

III. Responsibilities of the But.Grantee
A. Federal coapliance -The SubGrantee shall take all
actions that are appropriate and required of it to coaply with
the applicable provisions of the grant agre .. ents received
from the U. s. Department of Housing and Orban Developaent
(HUD) by the County. Th••• include but are not liaited to

compliance with the provisions of the Housing and Community
Development Act of 1974 (ACT) and all Rules and Regulations,
guidelines and circulars promulgated by the various federal
departments, agencies, administrations and commissions
relating to the CDBG Program. More specifically, the
SubGrantee and the County shall each take all required actions
to comply with the provisions of 24 CFR Part 570, Title VI of
the Civil Rights Act of 1964, Title VIII of the Civil Rights
Act of 1968, Section 104 (b) and 109 of the Housing and
Community Development Act of 1974, 24 CFR Part 85, Subpart K
of HUD's Uniform Administrative Requirement for Grants and
Cooperative Agreements, the regulations applying to minority
business enterprise, 24 CFR 570.904, the lead based paint
regulations 24 CFR 570.608 and 24 CFR 35, and with 0MB
Circular A-87, Cost Principles for State and Local
Governments. Attached hereto as Exhibit A and incorporate
herein by this reference is a summary of provisions associated
with the Community Development Block Grant Program which shall
be followed by the SubGrantee unless it is determined to be
inapplicable. Additionally, in accordance with 24 CFR Part
570, no employee, official, agent or consultant of the
SubGrantee shall exercise any function or responsibility in
which a conflict of interest, real or apparent, would arise.
The Subgrantee cannot engage in a federally funded contract
with any entity registered in the Lists of Parties Excluded
From Federal Procurement or Nonprocurement Programs. This
publication is available in Arapahoe county through the
Housing and Community Development Services Division.
B. Supervisioll &ll4 Adaillistrativ• Colltrol -As to any
projects conducted during Program Year 1995, the SubGrantee
agrees, in accordance with Section III, paragraph A above that
the County shall have the ultimate supervisory and
administrative responsibility, but the SubGrantee shall be
responsible for the expenditure of the funds allocated for its
projects or activities and for the construction or performance
of its projects or activities in compliance with all
applicable Federal laws and requirements relating to the CDBG
Program.
c. •oll-Appropriatiolls Clause -The SubGrantee agrees that it
will include in every contract it enters, which relies upon
CDBG monies for funding, a non-appropriation clause that will
protect itself and the County from any liability or
responsibility or any suit which might result from the
discontinuance of CDBG funding for any reason. Because this
subgrantee agreement involves funds from a federal grant, the
funding provisions of this subgrantee agreement, the federal
grant and the federal statutes control rather than the
provisions of Section 24-91-103.6, C.R.S. with regard to any
public work projects.

o. bpenc!iture Restrictions -All CDBG funds that are
approved by HUD for expenditure under the County's grant
agreement, including those that are identified for the
SubGrantee's projects and activities, shall be allocated to
the specific projects and activities described and listed in
the grant agreements. The allocated funds shall be used and
expended only for the projects and .activities to which the
funds are identified.
E. &qre .. eat CbaJlqe• -No projects or activities, nor the
amount allocated therefor, may be changed without concurrence
by the County and acceptance of the revised Final Statement by
HUD, if required. Changes must be requested in writing and
may not begin until a modification to this Agreement is fully
executed.
F. Direct Projects Supervision and &dainistration -The
SubGrantee shall be responsible for the direct supervision and
administration of its respective projects or activities. This
task shall be accomplished through the use of the SubGrantee's
staff, agency and employees. The SubGrantee shall be
responsible for any injury to persons or damage to property
resulting from the negligent acts or errors and omissions of
its staff, agents and employees. Subqrantee, within its legal
ability to do so under the constitution of the State of
Colorado and its home-rule charter (if Contractor is a home-
rule municipality) and without in any way or manner intending
to waive or waiving the defenses or limitations on damages
provided for under and pursuant to the Colorado Governmental
IJ11J11unity Act (Sec. 24-10-101, et seq. C.R.S.), the Colorado
Constitution, its home-rule charter or under the coJ11J11on law or
the laws of the United States or the State of Colorado, shall
indemnify and save harmless the County against any and all
damages which are recovered under the Colorado Governmental
IJ11J11unity Act and reduced to final judgement in a court of
competent jurisdiction by reason of any negligent act or
omission by Subqrantee, its agents, officers, or employees, in
connection with the performance of this contract.
G. Liuility -Because the SubGrantee is responsible for the
direct supervision and administration of its projects or
activities, the County shall not be liable or responsible for
cost overruns by the SubGrantee on any projects or activities.
The County shall have no duty or obligation to provide any
additional funding to the SubGrantee if its projects or
activities cannot be completed with the funds allocated by the
county to the SubGrantee. Any cost overruns shall be the sole
responsibility of the SubGrantee.

an approved projects or activities shall be used solely

for the purposes approved by the County. Said funds
shall not be used for any non-approved purposes.
2. The SubGrantee agrees that the funds allocated for any
approved projects or activities shall be sufficient to
complete said projects or activities without any
additional CDBG funding.
H. Insurance If the SubGrantee's projects involves
construction activities, any contractor it uses for said
activities shall be required to provide and maintain, until
final acceptance by the SubGrantee of all work by such
Contractor, the kinds and minimum amounts of insurance as
follows:

a. Underwriters shall have no rights of recovery
subrogation against Arapahoe County or the
SubGrantee; it being the intent of the parties that
the insurance policies so effected shall protect the
parties and be primary coverage for any and all
losses covered by the described insurance.
b. The clause entitled "Other Insurance Provisions"
contained in any policy including Arapahoe County as
an additional named insured shall not apply to
Arapahoe County or the SubGrantee.
c. The insurance companies issuing the policy or
policies shall have no recourse against Arapahoe
County or the SubGrantee for payment of any premiums
due or for any assessments under any form of any
policy.
d. Any and all deductibles contained in any insurance
policy shall be assumed by and at the sole risk of
the Contractor.
5. Certificate of Xnaurance: The Contractor shall not
commence work under any contract funded pursuant to this
agreement until he has submitted to the SubGrantee,
received approval thereof, certificates of insurance
showing that he has complied with the foregoing insurance
requirements. The SubGrantee shall also submit a copy of
the Contractor's certificates of insurance to the Cou.nty.
6. Notwithstanding the provisions contained in this
paragraph (H) set forth hereinabove, th• county reserves
the right to modify or waive said provisions for projects
or activities for which th••• provisions would prove
prohibitive. Th• SubGrant .. understands, however, that
the decision to waive or •odify those provisions is fully
within the discretion of the County.
I. Records -The SubGrantee shall aaintain a complete set of
books and records documenting its use of CDBG funds and its
supervision and administration of the projects. The
SubGrantee shall provide full access to these books and
records to the County and the Secretary of HUD or his
designee, the Office of Inspector General and the General
Accounting Office so that compliance with Federal laws and
regulations may be confirmed. The SubGrantee further agrees
to provide to the County upon request, a copy of any audit
reports pertaining to the SubGrantee's financial operations
during the term of this agreement.
J. Reporting -The SubGrantee shall file all reports and
other information necessary to comply with applicable Federal

laws and regulations as required by the County and HUD. This
shall include providing to the County the information
necessary to complete the Grantee Performance Reports in a
timely fashion.
K. Tiaeliness -The SubGrantee has submitted to the County,
along with its proposal, a description of the work to be
performed, a budget, and a timetable delineating the length of
time needed for each project phase, if applicable, through the
completion of the projects. The SubGrantee shall comply with
timetable for completion of the projects. The SubGrantee
understands that failure to comply with the timetable may
lead to a cancellation of the projects and a loss of all
unexpended funds, unless the County determines that there are
extenuating circumstances beyond the SubGrantee's control and
that the projects will proceed within a reasonable length of
time. The timetable's implementation shall begin when the
County provides written notification to the SubGrantee to
proceed.
L. Reim!)urs .. ent for Expenses -The SubGrantee agrees that
before the County can distribute any CDBG funds to it, the
SubGrantee must submit to the County's Housing and Community
Development Services Division documentation in the form
required by that Division which properly and fully identifies
the amount which the SubGrantee is requesting at that time.
The County shall have ten (10) working days to review the
request. Upon approval of the request, the County will
distribute the requ .. ted funds to the SubGrantee or directly
to the appropriate subcontractor or vendor as soon as
possible. Such requests shall not be submitted more
frequently than once per month.
M. •roc;r-Iacoae -All program income derived from the
Arapahoe County co-unity Development Block Grant Program
received by the SubGrantee will be retained by the SubGrantee
and will be dispersed for its approved CDBG project activities
before additional CDBG funds are requested from the County.
Following completion of the SubGrantee's Arapahoe County CDBG
Projects, all program income directly generated from the use
of CDBG funds will be remitted to the County.
N. bset 11ana9 .. eat -Any single parcel of real property
under the SubGrantee's control that was acquired or improved
in whole or in part with CDBG funds in excess of $25,000 will
either:
1. Be used for an eligible CDBG activity, as determined by
the County, for a minimum of five (5) years following
completion of the SubGrantee's projects;

2. Be disposed of in a manner that results in the County's
being reimbursed in the amount of the current fair market
value of the property less any portion of the value
attributable to expenditures of non-CDBG funds for
acquisition of, or improvements to, the property.
Reimbursement is not required after five (5) years
following completion of the SubGrantee's projects.
o. State and county Law coapliance -All responsibilities of
the SubGrantee enumerated berein sball be subject to
applicable State statutes and County ordinances, resolutions,
and rules and regulations.
P. bviro1111ental aevi--The SubGrantee agrees that no CDBG
funds will be legally obligated to any project activity before
the county has coapleted the environmental review procedures,
as required by 24 CFR Part 58.
Q. Sw,contracts -If subcontracts are used on the projects,
the SubGrantee agrees that the provisions of this agreement
shall apply to any subcontract.
R. suspension or 'feraillation Tbis agreement may be
suspended or terminated by the County if the SubGrantee
materially fails to comply with any term of this agreement.
Tbis agreement may also be terminated for convenience by
mutual agreement of the County and the SubGrantee.
s. In the event that the Unit of General Local Government
sbould withdraw from the County's •urban County• designation,
this agreement sball terainate as of the termination date of
the County's CDBG grant agre-ent with BOD.
T. The SubGrantee certifies that to the best of its knowledge
and belief:

agreement, it will complete and submit Standard
Form-LLL, "Disclosure Form to Report Lobbying," in
accordance with its instructions.
u. Disallowance -If it is determined by HUD or other federal
agency that the expenditure, in whole or in part, for the
SubGrantee's projects or activity was improper, inappropriate
or ineligible for reimbursement, then the SubGrantee shall
reimburse the County to the full extent of the disallowance.
IV. •••ponsil:liliti•• of th• COUDty
A. Legal Liability and aesponsil:lility The Parties
recognize and understand that the County will be the
governmental entity required to execute all grant agreements
received from HUD pursuant to the County's requests for CDBG
funds and that it will thereby become and will be held by HUD
to be legally liable and responsible for the overall
administration and performance of the CDBG programs, including
the projects or activities to be conducted by the SubGrantee.
Accordingly, the SubGrantee agrees that as to its projects or
activities performed or conducted under any CDBG agreement,
the County shall have the necessary administrative control
required to meet HUD requirements.
B. Perforaance and Coapli&Dce KonitoriDCJ -The county's
supervisory and administrative obligations to the SubGrantee
pursuant to paragraph A above shall be limited to the
performance of the administrative tasks necessary to make CDBG
funds available to the SubGrantee and to provide a Monitoring
Specialist whose job it will be to monitor the various
projects funded with CDBG aonies to ensure that they coaply
with applicable Federal laws and regulations.
C. Reporting to BUD -The County will be responsible for
confirming the coapliance of the SubGrantee's projects with
applicable Federal laws and regulations. The County will
further be responsible for ... ing that all necessary reports
and information, including the Grantee Performance Reports,
are filed with HUD and other applicable Federal agencies in a
timely fashion.

This ADDDDUJI BO. 1 modifies the Arapahoe County Community
Development Block Grant Agreement (•Agreement•) by and between
Arapahoe County (•County•) and the CITY OP BIIGLBlfOOD
c•subgrantee"), dated
WHEREAS, the Agreement (in Section III.ff), requires that if any
Subgrantee project involves construction activities, then the
Contractor selected by the Subgrantee must provide and maintain
insurance in the amounts set forth therein; and
WHEREAS, pursuant to Section III. H.6, the Subgrantee desires that
the County waive a portion of the insurance requirements of Section
III.ff of Agreement; and
WHEREAS, the County agrees to the waiver as noted herein.
NOW, THEREFORE IT IS AGREED by tha County and the Subgrantee as
follows:
1. The Subgrantaa shall require its selected Contractor to
provide and aaintain general liability and property insurance
in an amount not lass than $100,000 by the Contractor and to
provide and aaintain autoaobila liability insurance and
workmen's compensation insurance required by Colorado law.
Proof of such insurance shall ba provided to the Subgrantee.
2. The Subgrantee and the County reaffirm the provisions of
Section III.F., concerning administration and indemnification
concerning performance of the Agreement.
3. All other provisions of the Agreement not inconsistent
with this Addendum No. 1 ara reaffiraad.

IN THE CITY, TO BE DESIGNATED AS CONCRETE REPLACEMENT DISTRICT
NO . 1995, AD0Pl'ING DETAILS AND SPECIFICATIONS FOR THE PROPOSED
DISTRICT, AND DIRECTING PUBLICATION AND MAILING OF THE NOTICE
OF HEARING TO THE OWNERS OF THE REAL PROPERTY IN THE DISTRICT .
WHEREAS, the City Council of Englewood, Colorado, has determined that it is
necessary to create a local or special improvement district within the City for the purpose of
providing for the removal and replacement of sub-standard curb, gutter, and sidewalk or
the new construction of curb, gutter and sidewalk improvements, together with necessary
incidentals, within the City and to assess part of the cost of the improvements against the
real property specifically benefited by the improvements and included within the district;
and
WHEREAS, pursuant to the Charter of the City and Title 11 , Chapter 2 of the ;\-lunicip a l
Code of the City, the City Council, upon its own initiative, has determined to proceed with the
removal and replacement or new construction and installation of such improvem e nts ,
provi ded however, that the City Council shall consider all protests and objection s th at m ay
be made in connection therewith prior to the creation of the special improvement distr ict:
and
WHEREAS, prior to the removal and replacement or new construction of the proposed
improvements , affected property owners will be allowed a specified time period in which to
have said improvements removed and replaced or constructed on their own , and a limited
number of owners of properties located outside of the District, as currently described
herein, will be permitted to voluntarily consent to the inclusion of said properties into the
District; and
WHEREAS , pursuant to an order of the City Council, the City Engineer has prepared and
filed preliminary plans, specifications, estimates of cost, maps and schedules for the
proposed i mprovements:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS :
Section l. The City Council of the City of Englewood, Colorado has determined there
ex ists a necessity for the removal and replacement of sub-standard curb, gutter, and
sidewalk and the new construction of curb, gutter, and sidewalk improvements, together
with necessary incidentals, within the City as more particularly described in the notice of
hearing, and to create a special improvement district for such purpose.
Sectjon ?. The Engineer's reports , together with the preliminary details, specification s ,
estimates of cost, maps and schedules prepared and filed with the City Clerk are hereby
a pproved and adopted by the City Council for use in the removal and replacement or new
con s truction and installation of the improvements to be made in said improvement
d i s tric t .
Sgct jon 3 . The materials to be used in the replacement, construction, or installation of
the proposed improvements are set forth in the Enrineer's reports and i:enerally described
in th e notice hereinafter set forth .

Sectjon 4. The costs of the removal and replacement or new construction and
installation of the improvements, less that portion which is paid by the City, shall be
assessed by ordinance upon all the real property within the district based upon the benefit
conferred by the improvements upon each parcel of realty within the district. If the
assessment is not paid in full within the period of time set forth in the assessment
ordinance, the amount and time of payment, and the rate and time of payment of interest
shall be determined by the City Council as set forth in the assessment ordinance.
Sectjon 5. The real property to be assessed for the improvements shall be the real property
specially benefited by the improvements, which property is located within the district as
described in the notice hereinafter set forth.
Sectjon 6. Notice of the public hearing on the creation of the district shall be published
once a week for three (3) weeks in the Englewood Herald, a newspaper of general
circulation in the City . The published notice shall be in substantially the following form :

All owners of real property hereinafter described, and all persons generally, are hereby
notified that the City Council of Englewood, Colorado, pursuant to its own initiative has
adopted preliminary details, plans, and specifications for the removal and replacement of
sub-standard curb, gutter, and sidewalk and the new construction of c:urb, gutter, and
sidewalk improvements, together with necessary incidentals, within a proposed special
improvement district within the corporate limits of Englewood, Colorado, to be known as
"Concrete Replacement District No. 1995". Said persons are further notified as follows :
I. DESCRIPTION OF DISTRICT AND PROPOSED IMPROVEMENTS:
(a l The proposed district shall be located within the corporate limits of the City and
shall include the c:urb, gutter, and sidewalk, adjacent to the real property as
shown on Exhibit A, which does not meet City standards or is not already
installed, which real property may be assessed with the cost of the improvements.
A copy of this notice will be mailed, postage prepaid, lo each known owner of real
property within the proposed district. The proposed district shall also include a
limited number of properties within the City for which property owners have
voluntarily consented to inclusion.
(b) The improvements to be removed and replaced or constructed within the proposed
district include 4 inch and 6 inch concrete curb, gutter, and sidewalk where said
infrastructure does not meet City standards or are not already installed, together
with necessary incidentals.
