bookmobile sbould be sold and tbe proceeds placed into a fund a seed money for building a new library .
Her other suggestions for using tbe money include replacing lost std, or enhancing the current collection .

WHEREAS, crime prevention is everyone's business and depends on active cooperation
among all elements of the community; and
WHEREAS, in the era of escalating fear throughout the nation because of violence,
citizens must be made aware of what they can do to protect themselves, their families, their
neighbors, and their communities; and
WHEREAS, the financial loss, personal injury, and community deterioration resulting
from crime are intolerable and need to be addressed by the whole community; and
WHEREAS, effective crime prevention programs excel because of partnerships among
law enforcement, other government agencies, and individuals as they help to rebuild a
sense of communal responsibility and shared pride; and
WHEREAS, youth-oriented prevention programs promote positive alternatives for
young people and encourage youth to make significant contributions to their communities;
and
WHEREAS, all citizens should become more aware of violence, drug, and other crime
prevention efforts within the community to take action themselves and to nurture a safe,

WHEREAS, the goals of the Decade and the American Red Cross in its community
disaster education program are:

• Increasing education and training activities to raise the level of public
preparedness;
• Targeting special segments of the public, especially those at greatest risk;
• Collaborating with the media to improve community preparedneu and
response; and

ISSUE/ACTION PROPOSED
At the request of the Department of Community Development, the Department of Public Works
has received specifications and drawings to install a new HVAC system in the Englewood
Animal Shelter. To proceed with this work, additional funds must be allocated. Staff requests
authorization, via motion, for a PIF expenditure of $47,500.
PRMOUS COUNCIL ACTION
No previous Council action has been taken.
BACKGROUND
The Colorado Humane Society has operated Englewood's animal shelter by contract with the
City since May, 1991. Prior to 1991, City staff operated the shelter.
For the past year and one half, the City of Englewood has been working with the Colorado
Humane Society to resolve concerns at our animal shelter facility. The primary concerns are
the HVAC system and removal of the old incinerator.
The present HVAC system, installed in 1988, is a closed system. Air is recirculated in the
facility approximately 10-12 times per hour through a three-stage filtering system. As an energy
savings feature, minimal outside air is introduced into the system.

The Colorado Humane Society believes this re-circulation of air allows viruses and diseases
which are detrimental to the health of the animals to remain in the facility and be passed from
animal to animal.
The proposed changes to the HVAC system will provide the minimum recommended air
changes of 10-12 per hour with all exchange air exhausted outside and fresh air brought in.
STAFF ANALYSIS
The Oepanment of Public Works is prepared to go out for bids on this project. The selection of
a contractor is dependent upon Council's authorization of an additional expenditure.
PROS AND CONS OF OPTIONS IEVIEWED
Pros: The Colorado Humane ~iety provides a service to Englewood by operating the animal
shelter, which allows the City's code enforcement staff to operate in the field without
having to provide maintenance and customer service at the shelter.
By contract, the Colorado Humane Society pays for utilities at the shelter, so they will
absorb the increased operating costs of the HV AC system.
Cons: Due to the Colorado Humane Society's policies to provide adoption for as many animals
as possible, the resident population at the shelter significantly exceeds what it would be
if the City were operating the facility, theft!by increasing the incidence of airborne
disease.

PREVIOUS COUNCIL ACTION
Resolution No. 42, Series of 1994, authorized the execution of a Possession and Use
Agreement with the Colorado Department of TransportAtion. This allowed the Sate to proceed
with construction of the Dartmouth and Sana Fe inten:hanae, while continuing to negotiate the
amount of compensation to the City.
BACKGROUND
These properties are required for the construction of the Sana Fe and Datmouth intersection.

ISSUE/ACTION PROPOSED
Staff seeks Council support for a bill for an ordinance approving the law Enfo,cement
Assistance Fund (LEAF) contract L-31-95, enabling the City of Englewood to enter into a contract
with the Colorado State Department of Transportation which grants the city money to be used
by the Department of Safety Services for DUI detection and enforcement.
PREVIOUS COUNCIL ACTION
Council has approved the city's participation in previous years (1991, 1992, and 1993).
BACKCROUND
The proposed ordinance would allow the Department of Safety Services to accept LEAF grant
money for use in the detection and apprehension of DUI driwrs within the City of Englewood.
The Englewood Police, in accordance with ~ motor vehicle laws, and with the preservation
of life and property in mind, actively investigates DUI violations with the intent of removing
drunken drivers from the City's streets. Aaeptance of LEAF pant money enables the
department to enhance its DUI enforcement efforts by allowins the department to pay for and
dedicate more officers and equipment to this apprehension effort.
At the present time, apprehension efforts are dependant on officers anemptlns to detect the DUI
driver between assignments. LEAF grant money would allow the department to hire officers, on
an overtime basis, specifically to detect and appiehend DUI driwrs.

pertaining to driving under the influence of alcohol and drugs within its jurisdiction; and

the purpose of setoff until such time as the exact amount of damages due the State from the
Contractor is determined, if the Contractor is a breaching party.

approves this Contract, obligates the nec:essary local monies to pay for a sha9 of costs or iHmd
services and authorizes a signatory to execute this Contract. A copy of such resolution shall be
attached to and made a part of this Contract.

employee. Neither the Contrador nor any agent or employee of the Coillladol lhall be deemed to
be an agent or employee of the State. The Contrador shall pay, wtW'I due, all required employment

Contrador, its employees and agents.

ISSUE/ACTION PROPOSED
Staff seeks Council support for a bill ·for an ordinance amending the Comprehensive Zoning
Ordinance relative to Home Occupations and setting a date for a Public Hearing to consider
this amendment.
PREVIOUS PLANNING COMMISSION ACTION
The Planning and Zoning Commission held a Public Hearing on the proposed amendments to
the Comprehensive Zoning Ordinance on October 19, 1993, which hearing was continued to
November 2, 1993, and further continued to November 16, 1993. The proposed amendments
on Home Occupations include provisions for Home Occupations in the R-1-A Zone District,
addresses changes in State regulations p,veming some specific businesses, and also addresses
the changes in lifestyle of today's populKe. At the meeting on November 16, 1993, the
Planning Commission voted to recommend the amendments to the City Council for approval.
PREVIOUS COUNCIL ACTION
On July 18, 1994, City Council held a Public Forum on these proposed amendments to the
Comprehensive Zoning Ordinance. The majority of the comments that were received were in
support of the proposed amendments.

BACKCROUND
The staff of the Department of Community Development receives numerous inquiries regarding
Home Occupations, many of these inquiries from residents of the R-1-A Zone District . Under
the current Comprehensive Zoning Ordinance restrictions, no R-1-A Zone District resident may
have a Home Occupation in their place of residence -even occupations such as "word
processing", or preparation of arts and crafts items for sale elsewhere is prohibited. Appeals to
the Board of Adjustments and Appeals were an option, but the Board determinations were that
these appeals were a "change of use", and not within their purview to grant.
Other restrictions, such as the prohibition against beauticians and cosmetologists operating from
a private residence, are no longer regulated by the State, and Englewood's regulations should
be brought in line. Modifications have also been proposed to bring daycare center restrictions
into accordance with State restrictions.
The proposed amendments have been discussed in depth on several occasions by the City
Planning and Zoning Commission and City Council, with modifications occurring to the initial
staff proposal during the course of these discussions.
STAFF ANALYSIS
The proposed amendments to the Comprehensive Zoning Ordinance on Horne Occupations re-
flects the increasing acceptance of "cottage industries" by allowing residents of all Zone Dis-
tricts in Englewood the option to have a Horne Occupation. The proposed amendments also
reflect the intent of staff and the Commission to bring the restrictions governing Horne Occu-
pations in Englewood in line with current State provisions.
The basic premise of the Home Occupation restrictions -that being that the business is secon-
dary and incidental to the primary use of the structure as a residence -is still applicable. No
outside staff may be employed, advertising signage is restricted, the business may not have a
separate entrance, etc.; these restrictions will still apply. A restriction on the size of electric
motors used in a Home Occupation is recommended to be eliminated, as no justification for
the restriction could be determined.
Staff is of the opinion that the proposed amendments on Horne Occupations will provide clari-
fication for enforcement personnel, and provide the citizens of Englewood with options for
limited business opportunities for those who may be home-bound. The proposed amendments
could also eliminate a number of appeals to the Board of Adjustments and Appeals. Therefore,
staff recommends that City Council proceed with option 1.

The following are the options available to Council:
1 . Adopt the ordinance as recommended by the Planning Commission;
2 . Amend Section 1 of the proposed Ordinance to limit the types and number of
home occupations permitted in the R-1-A, Zone District;

Applications are approved by the zoning officer once the home occupation
demonstrates compliance with the zoning ordinances. Some recent developments
which Uttleton is working on are the following:
• Gun sales, where all sales are done at gun shows but the office is located in a
home; The Federal Bureau of Alcohol. Firearms and Tobacco has demonstrated
some concern about sales out of homes. It appears AFT does not want the Qty to
permit sales of guns out of hOJDes or 811811 the location cl gun sale offices out
homes. However. those who sell guns at shows r,ay their business is not 1Ullilce
people who make crafts in their homes and then talce the crafts to ahon for aale.

Hearing on these proposed amendments on October 19, 1993, reviewed and recommended the

About $19,000 worth of these meters and yokes will be resold to Englewood customers for new
installations as part of the flat-rate to meter conversion process. The remaining stock will be

PREVIOUS COUNCIL ACTION
Ordinance was written in 1962 and ameuded in 1980.
BACKGROUND
There has been confusion regarding the wonting of Title 11-3-2 -Snow and Ice Removal as it is
currently written. The original 1962 ordinance prohibited removal of snow and ice onto the
City streets with no exceptions. The 1980 amendment attempted to allow snow and ice on
public sidewalks to be placed onto the City streets if spread on the traveled portion, so that
drainage and traffic is not obstructed. This proposed amendment should clarify the language
and allow snow and ice removal from sidewalks abutting City streets, but still prohibit snow
and ice from private sidewalks, driveways, and parking lots from being removed onto City
streets.
STAFF ANALYSIS
Public Works agrees that the wording reflects current policy. The general restriction is needed
to prevent people from plowing parking lots into the City street.

WHEREAS, the accumulation of 1110w and ice on public 1idewalb conltitute1 a hazard to
the traveling public; and
WHEREAS, the removal of 1110w and ice from private property onto the City ltnetl and
alleys creates a hazard for traffic on those streets and alleys; and
WHEREAS, the Ordinance, a, currently written, creates a conflict in that it provides
standards for snow and ice removal and the ltrictly prohibits such removal ; and
WHEREAS, the proposed amendment should clarify the language and allow 1110w and ice
removal from sidewalks abutting City streets, but still prohibit 1now & ice from private
sidewalks, driveways and parking lots from being removed onto City streets;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS :
Ses;tjon 1. The Englewood City Council hereby approves amending Title 11, Chapter 3,
Section 2, of the Englewood Municipal Code in order to clarify the e11i1ting ordinance
regarding the removal of ice and mow. Title 11, Chapter 3, Section 2, shall nad u follows:
11-3-2 : REMOVAL OF ICE AND SNOW:
A . It shall be unlawful for any owner, tenant, leuee or occupant of any lot, block or
parcel of real estate within the City, or for any apnt in charp of such property,
to allow any snow or ice to accumulate or remain upon any sidewalk
contiguous to such property for longer than twelve (12) houn from the time of the
