WHEREAS, our Founding Fathers, in order to secure the bleuings of liberty for
themselves and their posterity, did ordain and establish a Constitution for the United States
of America; and
WHEREAS, it is of the greatest importance that all citizens fully understand the
provisions and principles contained in the Constitution in order to support, preserve, and
defend it against all enemies; and
WHEREAS, the two hundred and seventh anniversary of the signing of the
Constitution provides an historic opportunity for all Americans to realize the achievements
of the Framers of the Constitution and the rights, privileges, and responsibilities it affords ;
and
WHEREAS, the independence guaranteed to American citizens, whether by birth
or naturalization, should be celebrated by appropriate ceremonies and activities during
Constitution Week, September 17 through 23 , as designated by proclamation ar the

On April 4, 1994, Council approved an intergovernmental agreement with the State of
Colorado Fishing is Fun grant program.
BACKGROUND
The Parks Section applied for a grant from the Division of Wildlife for the purchase and
installation of a floating fishing pier for the south shore of Centennial Lake. The grant was
awarded in the amount of $43,075.00, on a reimbursement basis.
Bids were solicited through contacts with local vendors and through advertisement in the
Daily Journal. Two bids were received and a bid tabulation is attached. The acceptable bid
totalled $52,066.00. One bid totalled $.ll,500.00 but does not meet technical specifications.
The specification stated that flotation must be achieved through a positive means such as
encased foam, not just trapped air. The lower priced pier achieves flotation through a
combination of trapped air and buoyancy of the material.

An alternate bid was submitted by the recommended supplier in the amount of $48,()76.00.
The difference between the alternate and the recommended bid is the substitution of a
standard railing system in the alternate bid for a custom A.D.A. approved railing system
found in the recommended bid. The railing system was recommended by our A.D.A.
consultant, the Easter Seal Society. A copy of their recommendation is attached.
The difference between the grant amount and the purchase price is due to design changes
in overall size of the pier and the railing system.
SI'AFF ANALYSIS
Staff recommends the purchase of the pier from Recreation Plus LTD/Recreation Systems in
the amount of $52,066.00.
PROS AND CONS OF <FJlOilS REVIEWED
Pros -The purchase of this fishing pier will greatly enhance the available fishing ac:cess for
the very young, the elderly and people with disabilities. Installation of the access paths
required in the match portion of this grant will begin the development of the south shore of
Centennial Lake.
Cons -To not approve the purchase of the pier would forfeit the grant monies and delay
the development of the south shore of Centennial Park.
FINANCIAL IMPACT
A total of $40,000.00 was budgeted for this project in the Conservation Trust Fund. The
grant amount is $43,075.00. The project, including paths and fishing pier, has a total budget
of $83,075.00 .

Dear Chris:
This letter is a follow-up to the conversation we had yesterday concerning the
dock railing you designed. During our meeting, you explained the
specifications you prepared for the railing manufacturer. Once again. I
commend you on the design and your close attention to the changes
necessary for persons who use wheelchairs.
During our discussion, you explained that an accessible railing will cost the
City of Englewood an additional $4,000.00. You questioned me concerning the
necessity of providing this railing due to the increased cost.
It is my opinion that the additional $4,000.00 would be well spent by the City.
Since the dock and accompanying railing will be new construction, you will
be held to a higher standard of compliance by the public. U a complaint is
filed with the Department of Justice, the first course of action will be for the
Department to try to reach a "voluntary compliance agreement" between the
individual filing the complaint and the City. This action may entail attorney
time and the inevitable attorney fees. The City of Englewood could easily be
held responsible, not only for their own attorney fees, but also for the fees of
the complaining individual. In the end, the Department of Justice could find
that the "voluntary compliance agreement" may entail renovation of the
railing to allow accessibility. Since renovation is generally more expensive
than creating accessibility during the initial construction phase, the City of
Englewood could easily spend more than the original $4,000.00 .
U a "voluntary compliance agreement'' can not be reached, the case will be
referred back to the Department of Justice. Once again, attorney fees will
incur. In addition, a dvil penalty may be levied against the City. The first
violation penalty can not exceed $50,000. Once again. the inevitable result
with be ·creating accessibility at the railing.

BACKGROUND
The Department of Transportation's plans for the South Santa Fe corridor include a frontage
road, within the City of Sheridan, which extends South Natches Court to the north from
West Oxford Avenue. This roadway will require the acquisition of approximately 600
square feet, 0.01 acres, of property from our GoH Course.

construction of South Natches Court while we negotiate with CDOT to determine the fair

The City of Littleton submitted a License Agreement to cross over the City Ditch with a
concrete pan west of Santa Fe Drive and approximately 1/2 mile north of Mineral. The
City reserves the right to make full use of the property nea!lllal')' in the operation of the
City. The City retains all right to operate, maintain, install, repair, remove, or relocate any
of its facilities located within the City's property.
SfAFF ANALYSIS
The License Agreement is for the City of Littleton to cross the City Ditch with a S' X 1' deep
concrete pan across the 54" City Ditch pipe. The Licensee expressly aasumes full and strict
liability for any and all damages of every nabtre to person or property caused by the point
or points where the Licensee performs any work in connection with the crossing provided
by the License .

Good evening, Rich Chavez, Rocky Mountain News. Mayor and Council Members, my
purpose here tonight is to introduce the idea that we. the Rocky Mountain News, took on
to support, through raoun:es alone, the bookmobile project . I'd jUlt like to say that the
community has responded aomewbat, wl you'll probably have a dynamite report later on.
Right now it would be my honor to introduce IOIDClbody who ii not IOlicited . When
Conoco first learned of our endeavor, they volunteered without any IIOticitation . And so it
is my pleasure to introduce Diane Detuerk from the Conoco Region here in Englewood.
Hi, I'm Diane Detuerk with Conoco. I'd just like to say that Conoco ii honored to
support something as worthwhile u the bookmobile. We've got $250.00 worth of gas
coupons to be used to fuel the bookmobile on its travels. It's a one quarter contn1Jution,
and we'U support that for the rest of the year .

bookmobile committee a chance to go through the end of this year to raise their funds.

the part of any corporate enlity in the COIIIIIUlity to pay attention to what's going on
around them and step up to the plate. It's what we like to aee happen around here . I
think there are a few comments that people would like to make. I think Alex is first .
