Instead of representing "cutting edge", fiber optic is now commonplace, and telecommunications companies are moving rapidly to place fiber optic throughout the nation. Fiber optic technology has gamed such prominence that national policies are being discuaeed that will encourage the development of a nation-wide fiber optics infrastructure. It is believed that this infrastructure will be an essential element in the building of a future "information superhighway". Englewood's current fiber optics ordinance is perceived by telecommunications companies u being "anti-fiber optic". The annual lineal foot fee may result in telecommunication companies delaying their plans, if not abandoning them altogether, to lay fiber optic in Englewood . The results ol this may c:a1111e long mm and unnec r:ry damage to Englewood's future economic health. As fiber optic is placed in surrounding communities, Englewood could find itself without the technological infrastructure neceaury to meet the demands of a global economy, and ilolaled from the rest ol the world in terms of telecommunications technology. However, the regulation ol fiber optic cable placement should not be altogether disbanded, only the fee structure should be changed. All other provisions ol the current ordinance should remain in forc:e . (viz. constnaction ltandarda, the City's right to remove, future uae, repairs made by city forces, c:ooperation between all parties, requiring approval to place, licensee uawnes all liability • risb, indemnity, legal rec..-ow.) Section 12+3 revues license fees from $1 or S2 per lineal foot to a flat $100 per yur. Section 12........_A adopts a nationally recognized standard with modifications. Modifications include requiring a tracer to be buried with the cable. The tracer allows conventional cable/pipe detector equipment to be used to accurately locate fiber optic cables in the field. All other upects of this ordinance dealing with fiber optic cable installations would remain in full force and effect. SfAFF ANALYSIS 11 - The ISTEA program provides an opportunity for Englewood to receive Federal participation in needed major capital improvement pro;ects. Staff recommends Council approval of the change in matching funds from 17% to the required 20%. The fee structure is perceived by telecommunications companies as being anti-fiber optic and may result in delay of their plans to lay fiber optic cable, or possibly abandoning them all together.
