In response to these concerns, City staff researched the issue of "adult entertainment and service facilities (adult businesses)," and Ordinance #44, Series of 1981 was adopted, which designated adult businesses as "Conditional Uses" in the 8-2, 1-1, and 1-2 z.one Districts. Part of the regulations contained within the provisions of Ordinance #44, 1981, were "distance factors" requiring a minimum of 500 feet between an adult business and any residential zone district, public park, public library, community center, educational institution, or religious institution, whether within or out of the limits of the City, and a minimum of 1,000 feet between any two adult businesses. The enactment of Ordinance #44, Series of 1981, did "clean up" South Broadway in that massage parlors offering other activities in addition to "legitimate massage service" and the bookstore relocated; the theater changed the type of movies shown during the time it was in operation as a motion picture theater. In early 1993, an application was made for an adult business (Santa Fe Books It Videos) on South Santa Fe Drive . The applicant was given the information required for posting notice for the Public Hearing before the Planning Commission for the Conditional U1e approval, and also obtained the information for proper licensing of the establishment . Prior to the date of the Public Hearing before the Planning Commission, the applicant filed suit against the City alleging that the requirement for Public Hearings infringed on the First Amendment rights of this business. Federal District Judge Richard Matlch ruled, on April 20, 1993, that the Conditional Use regulations as applied to adult entertainment/lel'Vice facilities were unconstitutional. Santa Fe Books tr Videoa opened in early April, 1993, with no zoning approval or license from the City ol Englewood . ln response to the ruling by Judge Matlch, the Community Development staff and the City Attorney 's staff considered ways to addreN this iaue. The determination ruched by staff was to include Adult Entertainment/Service Facilities (Adult Businelles) as "Permitted Principal Uses" in the 8-2 Businete, 1-1 Light Industrial, and 1-2 General Industrial Zone Districts . I fully agree that we do not want a Santa Fe Book Store or a KLtty 's on Broadway. But we are talking about Newsland here. A store that specializes in a wide variety of magazines, books, and newspapers that are otherwise unavailable in Metro Denver. I frequent their store on South Wadsworth.
