BACKGROUND
In the early 1980's, there were several massage parlors, a theater showing X-rated films, and
an adult book store located on South Broadway. Members of the community expressed
concern regarding these types of businesses and the clientele that frequented them. In
response to these concerns, City staff researched the issue of "adult entertainment and
service facilities (adult businesses)," and Ordinance #44, Series of 1981 was adopted, which
designated adult businesses as "Conditional Uses" in the 8-2, 1-1, and 1-2 z.one Districts.
Part of the regulations contained within the provisions of Ordinance #44, 1981, were
"distance factors" requiring a minimum of 500 feet between an adult business and any
residential zone district, public park, public library, community center, educational
institution, or religious institution, whether within or out of the limits of the City, and a
minimum of 1,000 feet between any two adult businesses. The enactment of Ordinance #44,
Series of 1981, did "clean up" South Broadway in that massage parlors offering other
activities in addition to "legitimate massage service" and the bookstore relocated; the theater
changed the type of movies shown during the time it was in operation as a motion picture
theater.
In early 1993, an application was made for an adult business (Santa Fe Books It Videos) on
South Santa Fe Drive . The applicant was given the information required for posting notice
for the Public Hearing before the Planning Commission for the Conditional U1e approval,
and also obtained the information for proper licensing of the establishment . Prior to the
date of the Public Hearing before the Planning Commission, the applicant filed suit against
the City alleging that the requirement for Public Hearings infringed on the First
Amendment rights of this business. Federal District Judge Richard Matlch ruled, on April
20, 1993, that the Conditional Use regulations as applied to adult entertainment/lel'Vice
facilities were unconstitutional. Santa Fe Books tr Videoa opened in early April, 1993, with
no zoning approval or license from the City ol Englewood .
ln response to the ruling by Judge Matlch, the Community Development staff and the City
Attorney 's staff considered ways to addreN this iaue. The determination ruched by staff
was to include Adult Entertainment/Service Facilities (Adult Businelles) as "Permitted
Principal Uses" in the 8-2 Businete, 1-1 Light Industrial, and 1-2 General Industrial Zone
Districts . The distance factors were not included in the c:haUenge to the validity of the
regulations on adult busineAH, and thole dimnce facton will now apply to the adult
bus' as permitted principal Ulel .
The d phase of the propoaed amendmen pertains to the definition ol "adult
bookstore ." The Commission canaidered ways to add this contem and pt'Op(*d
amfflding the "Adult Boobtore" definition by replacing the NStriction ol "10% ol the gr"<*

If regulations are not enacted regarding the location of adult businesaes, they could
proliferate along Broadway, or doee-in industrial areas, thus impacting existing businesaes
as well as the residential neighborhoods. The propoaed regulations are written to comply
with the Constitution, but still provide protection to established neighborhoods from the
aecondary effects sometimes engendered by adult busine9I eltablilhments.

The Federal District Court dec:ilion ol April 20, 1993 declared the provisions ol the Compre-
hensive 2.oning Ordinance requiring Conditional Uee consideration ol adult bwdnellel to be
uncoostitutional. However, there ii ltill a need to provide ·NgUJatton" on where this type
of businela can be located in order to limit the NCondary effects upon the various
neighborhoods of the City that fall in the relbicted uw. By making adult bum, 111 ea a
"Permitted Principal Use" in the B-2. 1-1, and 1-2 Zone Diltricts, and retaining the distance
factors, there will be regulation on the location ol the adult bum'lmea.
Likewise, the amendment of the Adult Booblme definition to eliminate any nmptiona will
simplify enforcement. in that the dellrmination of whether it is or is not an "adult" bookstore
is made by the pretence of ·adult material• and not by IIIIMUring the 1C1111ft footage devoled
to the adult materials, or an audit ol the buainea'a boob to determine the permntage of
revenue from adult materials.

When the kettle failed, the heating oil system was contaminated with cradt sealing
materials. Although repairs are estimated at $8,700, futuft reliability is unknown.
Replacement with a used unit is not recommended since it is very difficult to evaluatr the
lel'Yice condition of a used unit that is coated with tar. A nrw unit should provide a
lel'Yice life of 7 years and provide the reliability desired .

IV. INSTALLATION OF NUTRI-PODS™ AND ABSORPTION PIANTS
A. Contractor shall insull 10 Nutri-Pods™ throughout the reservoir, which
shall be anchored to the bottom and will float approximately 1 to 3 feet
below the waters surface. Nutri-Pods™ will contain aquatic vegetation . In
addition approximately 2 acres of the reservoir bottom will be planted whh
aquatic vegetation. The exact area to be coordinated with Client pcnonncl.
8 . Nutri-Pods™ arc the sole property of LI.MNION Corporation of Bayview Idaho .
'.'lutri-Pods™ arc not being sold to client, but arc provided as a pan of this

at client expense.

X. INSURANCE
XI.
The Contractor shall at all times be covered by adequate public liability and property
damage insurance. All required compensation insurance for maintenance personnel
to be provided by Contractor.
PAYMENT SCHEDULE
The Contract Price is S20.000.00 for the initial installation for the 10 Nutri-Pods™
and plant material for both the Nutri-Pods™ and up to 2 acres of re~rvoir bottom .
Billing for the installation will be upon completion and due within thirty (30 ) days of
receipt. The Annual Maintenance Price is S 15 ,000.00 per year, with a spcci&l
S5 .000.00 discount for the fint calendar year ending December 31, 1994. Billings
"ill be submitted the first ( I st) of each monthly for services to be rendered the current
month . Billi ngs for Annual Maintenance will be for SI , 111 . l l per month April
through December 1994. Paymenu shall be made to RBI Aquatics , Inc. btras will
be billed at a time and materials rate at S1S .OO per hour for technician and t ruck and

As both a resident and a busLness owner in Englewood, I am
concerned with tne cnanges 1n the rules governing the sale of
adult books and videos.
I can understand the need to revise the criterion of 10% of
gross sales s1nce that criterion is difficult to enforce;
however, the 8% of floor space seems to be within your realm of
enforcement.
I fully agree that we do not want a Santa Fe Book Store or a
KLtty 's on Broadway. But we are talking about Newsland here. A
store that specializes in a wide variety of magazines, books,
and newspapers that are otherwise unavailable in Metro Denver.
I frequent their store on South Wadsworth. The adult section 1•
dLscreetly separated and located where the manage111ent has
control over who may enter.
Althougn I am not 1nterested 1n even going 1nto this portion of
the1r store, to eliminate any businesses wh1ch may sell a
\1m1ted amount of adult books and v1deos appears to be an
anti -business measure that returns to the Victorian era of
censorship from fear and 19norance.
Downtown Englewood needs all the help 1t can get to attract and
reta l n bus1nesses wh1ch will 1n turn attract new customers and
111ore bus1nesses.
I w1ah to see the council return to the f1rst proposal for
change 1n the ord1nance where 8' of floor space 1s the
cr1ter1on .
