institution, or religious institution, whether within or without the limits of the City, and a
minimum of 1,000 feet between any two adult businesses. The enactment of Ordinance #44,
Series of 1981, did "clean up·· South Broadway in that massage parlors offering other
activities in addition to "legitimate massage service" and the bookstore relocated; the theater
changed the type of movies shown during the time it was in operation as a motion picture
theater.
In early 1993, an application was made for an adult business (Santa Fe Books&: Videos) on
South Santa Fe Drive. The applicant was given the information required for posting for the
Public Hearing before Planning Commission for the Conditional Use approval, and also ob-
tained the information for licensing of the establishment. Prior to the date of the Public
Hearing before the Planning Commission, the applicant filed suit against the City alleging
that the requirement for Public Hearings infringed on the First Amendment rights of this
business. Federal District Judge Richard Matsch ruled, on April 20, 1993, that the
Conditional Use regulations as applied to adult entatainment/servic:z facilities were
W\constitutional . Santa Fe Books&: Videos opened in early April, 1993, with no zoning
approval or liC"enSe from the City of Englewood .
In response to the ruling by Judge Matsch, the Conununity Development staff and the City
Attorney 's staff considered ways to address this issue. The determination reached by staff
was to include Adult Entatainment/Servic:z Facilities (Adult Businesaes) as "Permitted
Principal Uses" in the 8-2 Business, 1-1 Light lndustrial, and 1-2 General lndustrial Zone
Districts . The dist.ance factors were not included in the c:hallenge to the validity ol the
regulations on adult busi.nales, and thoae distance factors will now apply to the adult
businesaes as permitted principal uaes .
The second phue of the propoaed amendments, pertaining to §16-8-1 Definitions, ol the
Comprehensive z.oning Ordinance, area u a result ol an inquiry received by the Economic
Development Division approximately 18 months ago &om a buainwman inllerea•d in

The amended definitions will enable the establishment of new businesaes that are not "adult
businesses", but that do not comply with the existing restrictions in that more than 10% of
the gross sales are from adult materials.
STAFF ANALYSIS
The Federal District Court decision of April 20, 1993 declared the pl'OYisions of the Compre-
hensive Lining Ordinance requiring Conditional Use C'OnlideratiCJI\ ol adult businesaes to be
unconstitutional. There is a need to provide "regulatiCJI\" on where this type ol business can
be localied, to limit the leCOndary effects upon the various neighborhoods ol the Qty. By
making adult businaees a "Pennitlied Principal Use" in the ~2. 1-1, and 1-2 Zone Districts,
and retaining the diatance factors. there will be regulation an the locatian ol the adult
businaees.

Specifications for Road and Bridge Construction. The
State will afford the Local Aqency aaple opportunity
to review and approve the construction plans, special
provisions, and estimates. The State will provide
final assembly of construction plans, special
provisions, esti.llates and construction contract
doc:uaents. The State will establish appropriate
DisadT&ntaged Business Snterprise (DBS) goals for the
construction contract(s). The State, in conjunction
with the Local Aqency, will ad99rtise the call for
bicu and award the construction contract(s) to the low
responsible bidder(s).
3. The State will provide coastruction e119ineering during
the construction of the work. Said coastruction

ISSUE/ ACTION PROPOSED
Staff seeks support for a resolution appropriating fwlds from the General Fund to fund the
Englewood Small Business Dewlopment Corpontian (ESBOC). The total amount originally
requested by the organization was Sl25,<XX>. The City appropriated and made payment ol
562,500 to the ESBOC in 1992. This resolution, if approved, would appropriate the
remaining contribution of $62,500 for 1994.
PREVIOUS COUNCIL ACTION
The proposal to fund the ESBOC was originally praented to Council at the July 6, 1992
study ·on. On October 5, 1992, Council adopled and approve Resolution Number
Eighty-One, Seri of 1992 . The resolution appropriated $62.500 for the ESBOC for the
purpoee of making loans to Englewood bulinelllel in accordance with their by-laws. The

1992 and half after the ESBOC had established a track record . At the January 3, 1994
Council meeting. Loren Shepherd presented a report to COW\cil on the ESBOC's first year.
He also requested the remaining commitment of $62,500 be paid.
PROS AND CONS OF OPTIONS REVIEWED
.
Proa: Adoption of a resolution appropriating funds for the ESBOC shows the commitment
of Council to economic and business development. The funds are important to help small
businestes get established in Englewood. The ESBOC may often be the only means of
borrowing for some small businesses.
Cona: In a period of reduced revenues and personnel cuts, this action may incur the anger
of the public as well as thoee employees affected by budget cuts or layoffs . It mo may be
considered an improper uae of public fwtds-that the City is improperly using funds for
traditionally priva~ sector activities (taking bank business away by providing an altiemative
source of funds).

ISSUE/ ACDON PROPOSED
Staff seeks Council support for a resolution appropriating funds from the Golf COW'9e Fund
to purchase real property. The Oty has entiered into an agreement to purchue real
property from the Motor Crane Company. The property will be uaed in the golf c:oune
expansion project.
PREVIOUS COUNaL ACDON
On December 6, 1993, Council approved a resolution authorizing the purchue oi 19.6.37
acres of land from the Motor Crane Service Company. Also, Council paled on first
reading. an ordinance designating the Golf COW'9e as an enterpme to clarify the City's
intent in light of Amendment 1 restrictions on the issuance oi debt. Council approved a
resolution appropriating $725,000 on December 20, 1993. The acquisition oi this property
was not completed until January 7, 1994. The 1993 appropriation lapaed at year end,
requiring staff to request an appropriation for 1994 .
BACKGROUND
The City is in the process of panding its exiMing Golf COW'9e facility . The expansion will
inch.ad : a new nine-hol , par-three coune. dubhouae improvements, and year-round
training facility . Debt ,ervice payments will be made IOlely from golf course.._,. fees . The

completing the plumed Golf Coune expansion. The expansion. acxxrding to projections,
will inaeue future revenues, allow mare player-rounds of golf, provide year-round training
for players, make the clubhouae mere uaeful and pleasant, and generally enhance the image
of the Englewood Golf Coune.
Cons: The future revenues and the ability to service the debt could be adversely affected by
the following: cmt OftlTWIS, less than prqected player-rounds, increa9ed exposure to
environmental clean-up costs, prolonged inclement weather, adverse econamic conditions,
and unforeseen oompetition. U the expansion is not sua:iessful, the possibility ol future net
losses does exist.
