WHEREAS, Tim Bullock has served the citu.ens of Englewood, Colorado as a member
of the Englewood City Council from January, 1990 to November, 1993; and
WHEREAS, Tim has served as a City COWICil representative to the Water and Sewer
Board; and
WHEREAS, Tim has helped improve intergovernmental relations and multi-
jurisdictional policy development as a repraentative to the Denver Regional Council of
Governments; and

WATER TOWER LEASE AGREEMENT
THIS WATER TOWER LEASE AGREEMENT (this "Lease") is entered into this_
day of , 1993 ("Execution Date") between the City of Enelewoocl
("Landlord") and Denver Cellular Telephone Company d/b/a/ Cellular One ('Tenant").
1. rrcmfRI · Subject to the term1 and conditions deacribed herein, Landlord le-to
Tenant certain apace on the water tower (the "Tower") and certain apace to con1tnact
an equipment 1helter (the "Equipment Shelter") located on the real property deaeribed
in attached Exhibit A (the "Property"). The location and orientation of Tenant'•
apace on the Tower and within the Equipment Shelter (the "Premin1") i1 deac:ribed
and depicted in the attached Exhibit B.
2. J:a:m. The initial term of thi1 Leaae ahall be five yeara, commencinc upon the
earlier of (a) written notification by Tenant to Landlord of Tenant's receipt of all
Governmental Approval,, or (b) 1ix (6) month1 from Execution Date ofthi1 Laue (the
"Commencement Date"), and terminatinc at midnicht on the laat day of the month
in which the fifth annual anniversary of the Commencement Date 1hall have
occurred .
If Tenant ahall not have obtained all Governmental Approval, on or before the date
1pecified in 2 above, then Tenant ahall, by notice to Landlord, cancel all f'ichta and
obli1ation1 under thi1 Leaae, provided Tenant reimburse, Landlord for actual,
reaaonable, lqal or other preparatory expen1e1 incurred to a maximum ol '60().00.

are the tran1mi11ion and reception of radio communication 1iplal1 and for the
inatallation, maintenance, repair or replacement ol related facilitiH, antannaa,
equipment and related activitiea. Tenant shall obtain, at Tenant·, upenae, all
licenae, and permita or authoriution1 required for Tenant'• UN ol the Premiae1
from all applicable pvemment and/or Nll'l•lorJ mtitie1 (the "Governmental
Approval,"). Tenant may (prior to or after the Com---.nt Date) ob&ain a title

and for the UH in fire prevention. All other UNI includinr thia laua, ahall be
ancillary to the Water T-•r'a main purpoea. Rent in this matter don not
reflect the true value oftha uaa of the Water To-r. 'nla City ia accommodatinr
Cellular One by lettinr it uaa ita facility and by charsinr a nominal aum u
rent. Both partiN understand that rent doea not ref1ect the true value of the uaa.
b. Upon the Commencement Date, Tenant Shall pay Landlord, aa rent, the IWII of
Five Hundred Dollar• (S5()0.00) per month ("Rent"). Rent ahall be payable on
the ftnt day of each month in advance to City of Enpwood at Landlord'•

b. Tenant understands and agrees to the sensitivity of the use of this site u a
private communications facility over and above its current uses. Should a
lepl suit be filed by any individual, corporation, partnership, association,
municipality or quasi-municipality, which directly relates to the installation
of Tenant's Antenna Facilities, this Lease shall terminate. Tenant shall have
90 days from the date that Landlord provides written notification and a copy of
uid action to Tenant to remove its Antenna Facilities from the site.

a. Tenant shall have the ri1ht, at its expenae, to place and maintain on the
Premises improvements, personal property and facilities neceuary to operate
its facilities (the "Antenna Facilities"), includin1, without limitation, the
personal property, equipment and radio transmittin1 and nceivin1 antennu,
and electronic equipment described on attached Exhibit C, so Ion, u it does not
interfere with the current uae or the Water Tower. Landlord's prior consent to
the plans and installation of the Antenna Facilitin shall be required but shall
not be unreasonably withheld or delayed and shall be deemed liven u to thoae
items listed on Exhibit C hereto. The Antenna Facilities shall remain the
exclusive property of Tenant. Tenant shall have the ript to remove the
Antenna Facilities upon termination ol this Leue. In addition, Tenant shall
place a prefabricated Equipment Shelter, at Tenant's coat, on the Pnmi-
which will house Tenant's equipment. Tenant shall also locate a prefabricated
equipment buildin1 on the premi-to provide 144 square f•t or apace (12' X 12')
for Landlord's electronic equipment. Tenant will be responsible for all COits
uaociated with the relocation ol Landlord's equipment to the new equi,-t
buildin1.
b. Tenant shall have the ript to install utili&iea, at Tenant's eapenae, and to

BACKGROUND
For the put three yean, the Englewood Public Library hu eponlOl'ed a "Food for Fines"
program during the November/December holidays. This program allow1 people with
overdue fines on their library cardl to have thole fines "forgiven" in retum b the donation
of non-perishable food items. which are then collected and fwwarded to the Interfaith Task
Force b distribution to finandally disadvantaged families in the Englewood aru. Thia will
be the fourth year that the Library has offered this program, which hu been warmly
received by the public lince Its inception . The 1993 program will run b llx weeb.

FINANCIAL IMPACT
The Library averages $1,200 to $1,500 per month in collected "late fines" (i.e. charges on
books and other items returned past their due date) which go back into the City's General
Fund . During the month of December for the past three years, that amount dropped to an
average $800 to $1,000, no doubt due to the "Food for Fines" program. This means that the
City will probably lose about $tOO to $600 in collected overdue charges during this year's
"Food for Fines" six week program.

while the Authority would retain the eastern portion of the site for future housing
development.
The proposed location of the Depot, Lots 18 -30, Block 2, Taylor's Addition, were
purchased in 1992, by the Englewood Housing Authority. This property is in the 600 block
of West Darhnouth Avenue, on the north side of Darhnouth. The Housing Authority, prior
to this has not taken steps to develop the site.
Upon acceptance of the proposal, the Authority made application to the Planning and
Zoning Commission to rezone the site to R-4, Residential/Professional District, from R-2
Medium Density Residence District.
STAFF ANALYSIS
The proposed rezoning request encompasses approximately one acre of land situated in the
600 block of West Darhnouth Avenue. The purpose for the proposed rezoning is to
accommodate the relocation of the old Englewood Depot to the western portion of the site,
and still allow for the eastern portion to be developed for housing . The Englewood Depot,
will be remodeled and used as an office/public facility; a museum and offices for the
Greater Englewood Chamber of Commerce.
The rezoning of the subject site from R-2 to R-4 will allow for the adaptive re-Ule of the
Depot. The Comprehensive Plan identifies this area u medium density residential and both
the R-2 and R-4 zone districts are duaified u medium denlity. The R-4, allows, in addition
to the uses permitted in the R-2, profesaional offices. TherefoN, this prop<*d rezoning ii
consistent with the Comprehensive Plan . Furthermore, the Engnood Housing Authority
has indicated their intention to develop the eutem portion ol the lite u hauling . Thus the
rezoning only effects the u,e of the western portion ol the lite and aunimizes the potential
for impact on the neighborhood .
FINANCIAL IMPACT
The only identifiable financial impact of the propc,Nd rezoning would be the ao. ol
property tax if the H istorical Society retains its tax exempt ltatus. U this is the c.we, this

PROJECT IIARRATIVB
This rezoning request consists of the proposed rezoning of
approximately one acre of land located in the 600 block of West
Dartmouth Avenue in Englewood, Colorado. The purpose of the request
is to allow for the relocation of the Englewood Train Depot to a
portion of this site and to allow for the subsequent use of this
depot as an office and public facility. Th• balance of th• site will
be used for housing.
The parcel is owned by the Englewood Housing Authority (applicant)
and borders Dartmouth Avenue on the south, Fox Street on the east, an
alley and a private parcel on the north, and Galapago Street on the
west. It is currently zoned R-2, which allows for the developaent of
approximately 12 housing units but no office use. The propo•ed
rezoning change i• to R-4 which allow• for the .... r••idential
density but also profes•ional office u•e.
The Englewood Train Depot is an hi•toric •tructure located near Santa
Fe Drive and U.S. Highway 215 (Hampden Avenue). The landowner where
it currently resides has expressed hi• intent to demolish the
building because of its alleged attractiveness a• a nuisance (it is
currently vacant), according to his insurance coapany. A coaaittee
of concerned citizens negotiated with the City of Inglewood to
relocate the depot to a parcel owned by the City but that location is
no longer viable. The Inglewood Housing Authority then entered into
d1scu••1ons about a parcel of land the Authority owne that i• vacant

6 . It is mutually 8"'eed that Lessee shall at all times UM the premises in
accordance with the laws of the United States and the State of Colorado, u well
as the Ordinances of the City of Enclewood. Further, the 1-aee shall at not
time permit nor suffer any disorderly conduct, unreasonable noise or nuisance
whatsoever about the premises having a tendency to annoy or disturb any
persons occupyinc acijacent premises. From time to time the City may establish
rules and regulations for park use. Leuee shall comply with all rules
applicable to City parks.
7 . It i1 mutually 8"'eeci that if the Leuee shall default in the performance al any
of the covenants and agreements herein contained to be kept and performed by
aaid Lessee, and should said default continue for a period al thirty (30) dayt
after written notice thereofhu been liven by the Leasor to correct and cure the
aame, then aaid Lessor shall have the richt to terminate this Lease and
possession of said premises shall be forthwith returned to the said Les10r.

premise• shall at all times remain the personal property of the Leuee which

Colorado, Inc. on the cities liability at Lowry, the cost will be approximately $1,929,322.00
together with an agreement to pay certain expenses of cleaning up Lowry after $319,000,000
in the event of a failed remedy.
The Cities are agreeable to paying such amount and desire to allocate the costs and final
remedy expenses on the basis of flows from each city to the Plant from September 1977
through June 1980 (the "Relevant Period").
That the City of Littleton's share of the cash payment to be made to the City and County of
Denver and to Waste Management of Colorado, Inc. shall be $704,781.33 and its share of the
Reopener which it may potentially have to expend in the future shall be 36.53%.
That the City of Englewood's share of the cash payment to be made to the City and County
of Denver and Waste Management of Colorado, Inc. shall be $1,224,540.67 and the
Reopener shall be 6.1.47%.
Both the City Manager and the Director of Utilities prefer this resolution to the il&ue of
Llttleton/Englewood liability.
FINANCIAL IMPACT
That the City of Littleton's share ol the c:uh payment to be made to the Oty and County ol
Denver and to Waste Management of Colorado, Inc . shall be $704,781.33 and its lhare ol the
Reopener which it may potentially have to expend in the future shall be 36.53%.
That the City of Englewood's lhare ol the c:uh payment to be made to the Oty and County
